Rule of construction.</toc-entry></toc></subsection></section><section id="id7509FFBC9F3D4D6195F621D90DE3FFAB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="id30c9de3118754a61a0708bab3425379a"><enum>(1)</enum><text>Immigration plays a defining role in the identity of the United States. Families throughout the United States have roots in the immigration experience of earlier generations of immigrants who came to the United States seeking better opportunities, safety from persecution, and ultimately, a chance at the American dream.</text></paragraph><paragraph id="id4a4aca5f8f3e492195603f62755b9678"><enum>(2)</enum><text>While the ancestors of some families arrived in the United States centuries ago, other families are continuing that tradition today. There are 51,900,000 immigrants who live in the United States. The immigrant population of the United States comprises 15 percent of the population, while another 13 percent of the population are second-generation Americans. There are 18,310,000 children in the United States who live with 1 or more immigrant parents, representing 26.5 percent of all children.</text></paragraph><paragraph id="id018BC86E24C04C37863B2040453DA81C"><enum>(3)</enum><text>In the United States—</text><subparagraph id="id36ac588c435740c5baa4aa0d6c25d61d"><enum>(A)</enum><text>26,000,000 individuals live in a household with 1 or more family members who are not authorized to be in the United States; and</text></subparagraph><subparagraph id="id24884a696e9b42338cee5023d80c2834"><enum>(B)</enum><text>4,600,000 United States citizen children live in a household with 1 or more family members who are not authorized to be in the United States.</text></subparagraph></paragraph><paragraph id="id3681f788ca3249bfa222dc005f534a52"><enum>(4)</enum><text>Children of immigrants are the future workers, leaders, voters, parents, and taxpayers of the United States and are critical to the health and well-being of the United States.</text></paragraph><paragraph id="id629dc1c2d7d140daace99156af0175f1"><enum>(5)</enum><text>In their pursuit of the American dream, generations of immigrant families have contributed to their communities in the United States and will continue to do so, including as essential workers who keep the United States running at great risk to themselves and their families.</text></paragraph><paragraph id="ida01b1cbc4110485faf0d93ccddf831a5"><enum>(6)</enum><text>Immigrants play a critical role in the United States economy, and providing a path to citizenship for undocumented immigrants is a necessary part of maintaining the economic strength of the United States.</text></paragraph><paragraph id="id43956915a34f4855956b0701389ce628"><enum>(7)</enum><text>Immigrant entrepreneurs account for more than 30 percent of all new business owners in the United States. In 2025, 231 of the companies listed on the Fortune 500 were founded by immigrants or children of immigrants.</text></paragraph><paragraph id="id409cc4ae6b2a4d26a3544bc0f982988a"><enum>(8)</enum><text>As of 2023, approximately 9,700,000 workers in the United States were undocumented immigrants. Undocumented immigrants contributed more than $37,000,000,000 in State and local taxes in 2022.</text></paragraph><paragraph id="id2d15471b569d4a3b9518f3dea4a2550c"><enum>(9)</enum><text>Removing undocumented residents from mixed-status households cuts the median income of such households by 48 percent.</text></paragraph><paragraph id="idd89f92368589492a8b3effc64972b098"><enum>(10)</enum><text>Removing 8,300,000 undocumented workers from the workforce would reduce gross domestic product by as much as 7.4 percent by 2028.</text></paragraph><paragraph id="id4998f0525c8d4e86ad0687b86b43b6ef"><enum>(11)</enum><text>Approximately 1,500,000 mortgages are held by households with 1 or more undocumented individuals.</text></paragraph><paragraph id="idf1ee278a0e504e31a20e1ee40420e009"><enum>(12)</enum><text>Indiscriminate immigration enforcement and the threat of immigration enforcement negatively impact the health, development, and well-being of children at risk of separation from a loved one due to detention or removal from the United States. Neurobiological research demonstrates the acute and lasting trauma that family separation, and the threat of separation, causes in children, such as changes in the architecture of the brain and increased likelihood to experience emotional and behavioral issues, depression, anxiety, post-traumatic stress disorder, and suicidal ideation.</text></paragraph></section><section id="id4D428CC405274ED682757FC56A13C1CD"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id3F95E4AA49084BC09F97CB86B77794A2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise specifically provided, any term used in this Act that is used in the immigration laws shall have the meaning given the term in the immigration laws.</text></paragraph><paragraph id="id6770231978c146bdaf35e76b2921c9da"><enum>(2)</enum><header>DACA recipient</header><text>The term <term>DACA recipient</term> means an alien who has been granted deferred action pursuant to the Deferred Action for Childhood Arrivals program, as set forth in the final rule issued by the Department of Homeland Security and entitled <quote>Deferred Action for Childhood Arrivals</quote> (87 Fed. Reg. 53152 (August 30, 2022)).</text></paragraph><paragraph commented="no" id="id4D4E387246084603BADD6517F9E085DE"><enum>(3)</enum><header>Immigration laws</header><text>The term <term>immigration laws</term> has the meaning given the term in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>).</text></paragraph></section><title id="id9EAE6B2B14A342EEB57A45F9A5B63F55" style="OLC"><enum>I</enum><header>Protecting immigrant families</header><subtitle id="id0A5050054A2C4EC08816E41EB5E8C8BC" style="OLC"><enum>A</enum><header>Expansion of admissibility</header><section section-type="subsequent-section" id="id335AF749AC404E6A84E9BD7AD9935EBF"><enum>101.</enum><header>Promoting family unity</header><subsection commented="no" id="id45079c2e065449bab7e180de9efc587b"><enum>(a)</enum><header>Elimination of 3-Year and 10-Year bars and modification of permanent bar</header><text>Section 212(a)(9) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)</external-xref>) is amended—</text><paragraph id="idc61a1addb1cc4faba29613552a617a3d"><enum>(1)</enum><text>by striking subparagraph (B);</text></paragraph><paragraph id="idb48858399bc0486c96389a5b6c4eab12"><enum>(2)</enum><text>by redesignating subparagraph (C) as subparagraph (B); and</text></paragraph><paragraph commented="no" id="idF39A3A18FB554FB1B1F7272886318B26"><enum>(3)</enum><text>in subparagraph (B), as so redesignated—</text><subparagraph commented="no" id="id4693A7C876544DE2B583697064FED7C9"><enum>(A)</enum><text>by amending clause (i) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4C922068CB4F45BA9A7F45DE7FE29B7E"><clause commented="no" id="id16A010AA3C3D4742AE48EB5AD5BB3EC7"><enum>(i)</enum><header>In general</header><text>Any alien who knows he or she has received a final order of removal under section 240, and who enters or attempts to reenter the United States without being admitted, is inadmissible.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="idB4B674E0686D409EB31CFB64B3C44D62"><enum>(B)</enum><text>by amending clause (ii) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfff15fb404ae4336aa1d1ec7ebc1fa01"><clause id="ida582544f8051431c93c76dc55f9f3968"><enum>(ii)</enum><header>Exceptions</header><subclause id="ida5826a7795e14c9da6388194f2a3038c"><enum>(I)</enum><header>Consent to reapplication for admission</header><text>Clause (i) shall not apply to an alien seeking admission on a date that is more than 3 years after the date on which the alien last departed the United States if the Secretary of Homeland Security has consented to a reapplication for admission by the alien.</text></subclause><subclause id="id7e88d54f79b247338475964181caac3d"><enum>(II)</enum><header>Minors</header><text>Clause (i) shall not apply to an alien who is under 21 years of age.</text></subclause><subclause id="id3d61b371040347778f3200a8e6c7c03e"><enum>(III)</enum><header>Asylees</header><text>Clause (i) shall not apply to an alien who has a bona fide application for asylum pending under section 208 or a bona fide application for withholding of removal under section 241(b)(3).</text></subclause><subclause id="id2a2d1e2f68ab437eb29b321d6bb554d4"><enum>(IV)</enum><header>Family unity</header><text>Clause (i) shall not apply to an alien who is a beneficiary of family unity protection pursuant to section 301 of the Immigration Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/8/1255a">8 U.S.C. 1255a</external-xref> note).</text></subclause><subclause id="idbf3e7810911047449566218d2ee054fa"><enum>(V)</enum><header>Victims of a severe form of trafficking in persons</header><text>Clause (i) shall not apply to an alien who demonstrates that 1 or more severe forms of trafficking in persons (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>)) was a central reason for the unlawful presence of the alien in the United States.</text></subclause><subclause id="idb69a97510a8f48be959d1805b9211e21"><enum>(VI)</enum><header>Aliens who entered as children</header><text>Clause (i) shall not apply to an alien who—</text><item id="id2f500898797e4ffca33cbb8dc181671e"><enum>(aa)</enum><text>is the beneficiary of an approved petition under section 101(a)(15)(H);</text></item><item id="ideac8c3473f72491c90ce4aac71a311cf"><enum>(bb)</enum><subitem commented="no" display-inline="yes-display-inline" id="idd041de2bfeda4dc6a528d3a223fb257b"><enum>(AA)</enum><text>is in school, has graduated from high school, has obtained a general education development certificate recognized under State law or a high school equivalency diploma; or</text></subitem><subitem id="id28ecb99c801a4fa0a4bc4b05882ede87" indent="up1"> <enum>(BB)</enum> <text>is serving in the Armed Forces (as defined in section 101(a) of title 10, United States Code) or is an honorably discharged veteran of the Armed Forces; and</text>
 </subitem></item><item id="ida3e1347b91a74b81bf7fff9c95c4c7f0"><enum>(cc)</enum><text>had not yet reached the age of 16 years on the date on which the alien initially entered the United States.</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="iddadfedad630e499dabb3f3141917cbb7"><enum>(C)</enum><text>in clause (iii)—</text><clause id="idF9612F635360455890248A6FF4855369"><enum>(i)</enum><text>by redesignating subclauses (I) and (II) as items (aa) and (bb), respectively, and moving such items, as redesignated, 2 ems to the right;</text></clause><clause id="idA445A21B23F64E63BB01DED38F915B74"><enum>(ii)</enum><text>by striking the clause designation and heading and all that follows through <quote>Security</quote> and insert the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id561af299f7474c919fa8e2af7ff797e9"><clause id="idC7B927091D6A4307A4620002D1658363"><enum>(iii)</enum><header>Waivers</header><subclause id="id112B0536B9BD4376831821D37C9144BD"><enum>(I)</enum><header>VAWA self-petitioners</header><text>The Attorney General or the Secretary of Homeland Security, as applicable,</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id8E4FD427FF1F4739905C78C58EFF5EDA"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF8D695A816A14A5093417E7AB5466490"><subclause id="idD17200AA3C0142C1B4BF690028CF8E69"><enum>(II)</enum><header>Extreme hardship</header><text>The Attorney General or the Secretary of Homeland Security may, in the discretion of the Attorney General or the Secretary, waive clause (i) in the case of an alien who is the parent, spouse, or son or daughter of a United States citizen or of an alien lawfully admitted for permanent residence if it is established to the satisfaction of the Attorney General or the Secretary that a denial of admission to the alien would result in extreme hardship to the United States citizen or lawfully admitted permanent resident son or daughter, spouse, or parent of the alien.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection commented="no" id="id32949753CD2443F8ABA8F035C71D492D"><enum>(b)</enum><header>Misrepresentation of citizenship</header><text>The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended—</text><paragraph id="idA7E499F3DF8A475E8012DC0A252DD37F"><enum>(1)</enum><text>in section 212 (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>)—</text><subparagraph id="id9BDD2C1B2FFC4BF395C552A6A65C61D8"><enum>(A)</enum><text>in subsection (a)(6)(C)—</text><clause id="id052F91431BCF4F5BA77FC9027653BF39"><enum>(i)</enum><text>by amending clause (ii) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id962A8FB1BCFB4676BAD3EF6C82704AAA"><clause id="id1664E790210A43ADB4185E52797E4FAC"><enum>(ii)</enum><header>Misrepresentation of citizenship</header><subclause id="id218FD439AEBC44BA93C81C620E452D24"><enum>(I)</enum><header>In general</header><text>Any alien who knowingly and willfully misrepresents, or has knowingly and willfully misrepresented, himself or herself to be a citizen of the United States for any purpose or benefit under this Act (including section 274A) or any Federal or State law is inadmissible. </text></subclause><subclause id="id60902330D1054B7D8C1F35F6A557EF08"><enum>(II)</enum><header>Exceptions</header><item commented="no" display-inline="no-display-inline" id="idda479917df75418f862eb10c3735ee16"><enum>(aa)</enum><header>Children</header><text display-inline="yes-display-inline">In the case of an alien who was under the age of 21 years at the time of making a misrepresentation described in subclause (I), the alien shall not be considered to be inadmissible under any provision of this subsection based on such misrepresentation.</text></item><item commented="no" display-inline="no-display-inline" id="id3eb391929a0341e3a07097c604e20ce3"><enum>(bb)</enum><header>VAWA self-petitioners</header><text display-inline="yes-display-inline">An alien who is a VAWA self-petitioner shall not be considered to be inadmissible under any provision of this subsection based on a misrepresentation that is connected to the alien’s abuse.</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idE3802F00498A48A2954155F780297D61"><enum>(ii)</enum><text>in clause (iii), by striking <quote>of clause (i)</quote>; and</text></clause></subparagraph><subparagraph id="idC2856859CAFC4F78BCC1C5004C31D09D"><enum>(B)</enum><text>by amending subsection (i)(1) to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idE91CB90F14DF42DBAD721950CFE44308"> <subsection id="id44816A34BF414371AB7363F1F0C299D7"> <enum>(i)</enum> <paragraph commented="no" display-inline="yes-display-inline" id="idF868E2DFBF1B484BB079A1E4490A173D"> <enum>(1)</enum> <text>The Attorney General or the Secretary of Homeland Security may, in the discretion of the Attorney General or the Secretary, waive the application of subsection (a)(6)(C) in the case of an alien who is the parent, spouse, or son or daughter of a United States citizen or of an alien lawfully admitted for permanent residence and in the case of an alien who is an alien granted classification under clause (iii) or (iv) of section 204(a)(1)(A), if it is established to the satisfaction of the Attorney General or the Secretary that the admission to the United States of such alien would not be contrary to the national welfare, safety, or security of the United States.</text>
                                        </paragraph>
                                    </subsection>
                                    <after-quoted-block>; and </after-quoted-block>
 </quoted-block></subparagraph></paragraph><paragraph id="idBF2EEDE581A2480DA505AE153C248AA9"><enum>(2)</enum><text>by amending section 237(a)(3)(D) (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(3)(D)</external-xref>) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ida36c6096f72e4eaaa2e83f288055c4af"><subparagraph id="id65c94f310bba4703a66ef213b01a6a44"><enum>(D)</enum><header>Misrepresentation of citizenship</header><clause id="idbc5de8c45c7a4e998f1ad2f19fc84dd7"><enum>(i)</enum><header>In general</header><text>Any alien who knowingly and willfully misrepresents, or has knowingly and willfully misrepresented, himself or herself to be a citizen of the United States for any purpose or benefit under this Act (including section 274A) or any Federal or State law is deportable.</text></clause><clause commented="no" display-inline="no-display-inline" id="ide534dd439ca24ada891e62001e9163f5"><enum>(ii)</enum><header>Exceptions</header><subclause commented="no" display-inline="no-display-inline" id="ide1392bdb4b5c4e168916e23256fa987a"><enum>(I)</enum><header>Children</header><text>In the case of an alien who was under the age of 21 years at the time of making a misrepresentation described in clause (i), the alien shall not be considered to be deportable under any provision of this subsection based on such misrepresentation.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9b27354031d04412a564c49d1ccfb5d5"><enum>(II)</enum><header>VAWA self-petitioners</header><text>An alien who is a VAWA self-petitioner shall not be considered to be deportable under any provision of this subsection based on a misrepresentation that is connected to the alien’s abuse.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id2a974e58ed1a4f79ac8cd97d5242350a"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="ide030d402aa9248c0a1a86537b3dfd2af"><enum>(1)</enum><text>Section 214(q) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(q)</external-xref>) is amended—</text><subparagraph id="idd667f5d78ecf4a5c8c1fa6d321ad99ce"><enum>(A)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph id="id8a604ed4c9884ce1838d7884fcfd60af"><enum>(B)</enum><text>in paragraph (3)(C), by striking <quote>paragraphs (6)(A), (7), and (9)(B)</quote> and inserting <quote>paragraphs (6)(A) and (7)</quote>; or</text></subclause><subclause id="id4CB7F2BBE64D421B8A0764B750171418"><enum>(II)</enum><text>the reinstatement of the prior order of removal of whom—</text><item id="id8F90425634804DF78ABEA2D7A02C698B"><enum>(aa)</enum><text>is not in the public interest;</text></item><item id="id2408378688A3482895505299DF270D31"><enum>(bb)</enum><text>would result in hardship to the United States citizen or lawful permanent resident parent, spouse, or child of the alien; or</text></item><item id="idEC2404E0C94E44398BB85FB95F2D3ADD"><enum>(cc)</enum><text>would prevent consideration of an application for asylum that has not been previously adjudicated.</text></item></subclause></clause><clause id="id2012963AA6644C5689016E693D331A1E"><enum>(ii)</enum><header>Rule of construction</header><text>For purposes of this paragraph, family separation shall be considered—</text><subclause id="idB937C49255164AAB881D1107449ADF57"><enum>(I)</enum><text>not in the public interest; and</text></subclause><subclause id="id8FC0CC02C2754D1A986A2F4196888FAA"><enum>(II)</enum><text>a hardship.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id112B5F4644CC409FA140D5BA454EE2B2"><enum>(b)</enum><header>Motions To reopen and reconsider</header><text>Section 240(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9B4F84A0164740149FC10E99C468DE3C"><paragraph id="idE0FAA552D4124BEDA4D4A7FA0819AF3E"><enum>(8)</enum><header>Special rule for relatives of United States citizens</header><subparagraph id="idA2B3761AFAF1485CAE142806E38AFAD3"><enum>(A)</enum><header>In general</header><text>Notwithstanding subparagraphs (A) and (B) of paragraph (6) and subparagraphs (A) and (C) of paragraph (7)—</text><clause commented="no" display-inline="no-display-inline" id="idF6018C4462F6471B9D03208D5A44E333"><enum>(i)</enum><text>an alien described in subparagraph (B) may file a motion to reconsider under paragraph (6) or a motion to reopen under paragraph (7) at any time and without numerical limitation; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3B1CEADB02604A17B368B100CAA31B66"><enum>(ii)</enum><text>the Attorney General shall consider any such motion.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id81411B3582984383AD987985D5AF83D9"><enum>(B)</enum><header>Alien described</header><text>An alien described in this subparagraph is an alien who is—</text><clause commented="no" display-inline="no-display-inline" id="id480A36465FAD4F808A54608A6F41CB26"><enum>(i)</enum><text>outside the United States after having been excluded, deported, or removed from, or ordered to voluntarily depart, the United States on or after January 20, 2025; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idA7702CA9C5F44135B2BAB7E60999E636"><enum>(ii)</enum><text>the spouse, child, or parent of a citizen of the United States or an alien lawfully admitted for permanent residence.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8D06DBA163394021A2E292A0A291E239"><enum>(C)</enum><header>Treatment of physical presence</header><text>For purposes of any physical presence or continuous residence requirement for relief under the immigration laws, with respect to an alien described in subparagraph (B), a period outside the United States after having been excluded, deported, or removed from, or ordered to voluntarily depart the United States on or after January 20, 2025, shall not be considered to toll or break the alien's physical presence or continuous residence in the United States.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section section-type="subsequent-section" id="idD9B1C1D38938459F928358412999AA96"><enum>112.</enum><header>Expansion of cancellation of removal</header><subsection id="id2D10AA2361154D6C8F7F1001EF735449"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 240A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b</external-xref>) is amended—</text><paragraph id="id04E01C21D7BB47A6ACF00AC93EB3C457"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idE724873453564A0FA8BF7AD6DD34D2BE"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="idFE010FC553F64DC6AE656945E5DE863D"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>10</quote> and inserting <quote>7</quote>; and</text></clause><clause id="id065E6BE9D5C34561BAACE097E38F1DC2"><enum>(ii)</enum><text>by amending subparagraph (D) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0E6689E327944E31BB3BCB124D464F22"><subparagraph id="id95DC96F5A5654BA4ABC73834EB834373"><enum>(D)</enum><text>establishes that removal would result in extreme hardship to—</text><clause id="id44428A9BDB9E4224876689B3AE2772E7"><enum>(i)</enum><text>the alien; or</text></clause><clause id="id3B799831C4834A869866641D2F34378B"><enum>(ii)</enum><text>the alien's spouse, parent, or child who is a citizen of the United States or an alien lawfully admitted for permanent residence.</text></clause></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id13DF16822B104130848829736A250893"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id776E6D582A12456EAC9A4E46ADEA1DE1"><paragraph id="idCA14CE6CC5BA42CCA5459F3F2D8B3F7B"><enum>(7)</enum><header>Waiver of extreme hardship</header><text>The Attorney General or the Secretary of Homeland Security may, in the discretion of the Attorney General or the Secretary, waive the application of subsection (b)(1)(D) in the case of an alien who is the parent, spouse, or son or daughter of a United States citizen or of an alien lawfully admitted for permanent residence and in the case of an alien who is an alien granted classification under clause (iii) or (iv) of section 204(a)(1)(A), if it is established to the satisfaction of the Attorney General or the Secretary that the admission to the United States of such alien would not be contrary to the national welfare, safety, or security of the United States. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7a938fcc9b5e4c14b4f0e8ebbcbce553"><enum>(8)</enum><header display-inline="yes-display-inline">Affirmative application process</header><subparagraph id="idEB05004AD6584DE1BDCD311CBE2AF087"><enum>(A)</enum><header>In general</header><text>The Secretary of Homeland Security may cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence, an alien described in paragraph (1) or (2), who—</text><clause id="idEDDAAB79E7F44E0B9198192493DB8695"><enum>(i)</enum><text>demonstrates that the alien is the spouse, parent, son or daughter, or legal guardian of a citizen of the United States; and</text></clause><clause id="id1E4695FEAC304C038E52784FFDF91E6B"><enum>(ii)</enum><text>submits to the Secretary of Homeland Security an application at such time, in such manner, and containing such information as the Secretary may reasonably require.</text></clause></subparagraph><subparagraph id="idA29CC7DA56844B158CDF36CC95632BE2"><enum>(B)</enum><header>Numerical limitations</header><text>Notwithstanding any other provision of law, an alien admitted to the United States under this section shall not be subject to any numerical limitation.</text></subparagraph></paragraph> <after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idBB90103F664A4A5DA9E1C7898B4DBCBC"><enum>(2)</enum><text>by striking subsection (e).</text></paragraph></subsection><subsection id="id99133512C46049ADB0F43EBD5A36654A"><enum>(b)</enum><header>Regulations</header><text>Not later than 9 months after the date of the enactment of this Act, the Secretary of Homeland Security shall promulgate final regulations setting forth procedures and requirements with respect to the processing and adjudication of affirmative applications for cancellation of removal under paragraph (7) of section 240A(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)</external-xref>), as added by subsection (a)(1)(B).</text></subsection></section><section id="HBCFF793CB478440491618D486EDE1268"><enum>113.</enum><header>Prohibition on removal of certain aliens</header><subsection id="id0BDB90DC331F4C699455FDCBF230F14B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 235 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225</external-xref>) is amended—</text><paragraph id="id15EEF53005AD480DADF923E7028652E7"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by inserting <quote><header-in-text level="section" style="OLC">; prohibition on removal</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">hearing</header-in-text></quote>; and</text></paragraph><paragraph id="id5E535FCF3AA34C16B2644AEC1723E335"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC28BDAB7886345ECB31526FF38399C28"><subsection id="H5AA1F31310AB40839F7D3E75A9A5A950"><enum>(e)</enum><header>Prohibition on removal of aliens with certain pending petitions and applications</header><paragraph id="idB8ACAE26F58242DAB1097E37A5D63FC3"><enum>(1)</enum><header>Beneficiaries of petitions for immigrant visas</header><text display-inline="yes-display-inline">An alien who is the beneficiary (including a spouse or child of the principal alien, if eligible to receive a visa under section 203(d)) of a petition for classification under section 204 or for classification as a VAWA self-petitioner that was filed with the Secretary of Homeland Security and who is prima facie eligible for approval may not be removed while such petition or application is pending or a decision on such petition or application is on appeal.</text></paragraph><paragraph id="idC8854FC9DCF74AEEB36DDEB0DF18F25D"><enum>(2)</enum><header>Applicants for certain nonimmigrant and special immigrant classifications and cancellation of removal</header><text>An applicant for classification as a nonimmigrant described in subparagraph (T), (U), or (V) of section 101(a)(15), an applicant for classification as a special immigrant under section 101(a)(27)(J), or an applicant for cancellation of removal under section 240A may not be removed while such application is pending or a decision on such application is on appeal.</text></paragraph><paragraph id="id77a6c19271f54ce3a878d65ede99040e"><enum>(3)</enum><header>Stay of removal</header><text>An individual who is prima facie eligible to receive a visa under section 203(d) of a petition for classification under section 204 due to the changes enacted by the <short-title>Fairness for Immigrant Families Act of 2026</short-title>, or who is prima facie eligible to apply for cancellation of removal under the changes enacted by such Act may not be removed during the period beginning on the date of the enactment of such Act and ending on the date that is 6 months after the date on which the rules for the implementation of such provisions are finalized.</text></paragraph></subsection><subsection id="id4bf9ce7e45cd434f821b28f57102d448"><enum>(f)</enum><header>Prohibition on removal of DACA recipients</header><text>An alien who has an active grant of deferred action pursuant to the Deferred Action for Childhood Arrivals program, as set forth in the final rule issued by the Department of Homeland Security and entitled <quote>Deferred Action for Childhood Arrivals</quote> (87 Fed. Reg. 53152 (August 30, 2022)), or whose application for renewal of such deferred action is pending adjudication by U.S. Citizenship and Immigration Services, may not be removed.</text></subsection><subsection id="id0f2bfb8e678d4a2e94b61f3082577460"> <enum>(g)</enum> <header>Presumption of non-Detention</header> <text>There shall be a presumption of nondetention for individuals described in subsections (e) and (f). This presumption shall not apply if the Secretary of Homeland Security, the Commissioner of U.S. Customs and Border Protection, the Director of U.S. Immigration and Customs Enforcement, or an immigration judge specifically determines that the alien is a threat to himself or herself, the public, or national security.</text>
 </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idC180A7AF47E240A5B1982717C8800866"><enum>(b)</enum><header>Conforming amendment</header><text>The table of contents at the beginning of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by striking the item relating to section 235 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7D64287015974A08AD8E0E4D2E9A5298"><toc><toc-entry bold="off" level="section">Sec. 235. Inspection by immigration officers; expedited removal of inadmissible arriving aliens; referral for hearing; prohibition on removal.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="ida4790cddacac419f8cec77a61f04d48b"><enum>114.</enum><header>Motions to reopen in cases involving fraud, negligence, misrepresentation, extortion, and unauthorized practice of law</header><text display-inline="no-display-inline">Section 240(c)(7)(C) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a(c)(7)(C)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id33b1f4bf4041454bb94121ca68455bc2"><clause id="id8bfb1e6b609247bab34a2357ba8427be"><enum>(v)</enum><header>Fraud, negligence, misrepresentation, or extortion by, or attempted, promised, or actual practice of law without authorization on the part of a representative</header><text>Notwithstanding subparagraph (A) and clause (i), an alien may file a motion to reopen at any time to apply for relief due to fraud, negligence, misrepresentation, or extortion by, or attempted, promised, or actual practice of law without authorization on the part of, a representative described in subsection (a) or (b) of section 1292.1 of title 8, Code of Federal Regulations, or a person who claimed to be such a representative if the alien establishes by a preponderance of the evidence such fraud, negligence, misrepresentation, or extortion by, or attempted, promised, or actual practice of law without authorization on the part of, such a representative or person.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id573a5817b48843a48dfac589a8d9d99d"><enum>115.</enum><header>Withdrawal without penalty in cases involving fraud, negligence, misrepresentation, extortion, and unauthorized practice of law</header><text display-inline="no-display-inline">Section 239 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229">8 U.S.C. 1229</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd5c8843af35a40d1b1f271f5a650fd18"><subsection id="idaa1f343c22b6424c929c6eb4e8ca050f"><enum>(f)</enum><header>Fraud, negligence, misrepresentation, or extortion by, or attempted, promised, or actual practice of law without authorization on the part of, a representative</header><paragraph commented="no" display-inline="no-display-inline" id="iddce64cc4dfa4443193815a2e35775f08"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An alien may withdraw an application or petition submitted by the alien without penalty due to fraud, negligence, misrepresentation, or extortion by, or attempted, promised, or actual practice of law without authorization on the part of, a representative described in subsection (a) or (b) of section 1292.1 of title 8, Code of Federal Regulations, or an individual who claimed to be such a representative, if the alien establishes such fraud, negligence, misrepresentation, or extortion by, or attempted, promised, or actual practice of law without authorization on the part of, such a representative or individual, by a preponderance of the evidence.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11eef39e055f4ebbaabb6dbaf7ba8580"><enum>(2)</enum><header>Prohibition on issuance of Notice to Appear</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall not issue a Notice to Appear based on information provided in an application, petition, or withdrawal request submitted by an alien described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle><subtitle id="id191CC3813E834DC1A69D92E991202D18" style="OLC"><enum>C</enum><header>Provisions relating to removal of parents of United States citizens</header><section id="id9601F138C5944067A35829359FC99A0D"><enum>121.</enum><header>Review of and reporting on removal of parents of United States citizens</header><subsection id="idD83F399DFD114C20877BCB1A92D97765"><enum>(a)</enum><header>In general</header><text>Before the removal from the United States of an alien parent or legal guardian of a child under the age of 21 years who is a citizen of the United States or an alien lawfully admitted for permanent residence, the Director of U.S. Immigration and Customs Enforcement (referred to in this section as the <quote>Director</quote>) shall review and approve the removal of such alien.</text></subsection><subsection id="idF10C694A99594C188B218308CB560EB6"><enum>(b)</enum><header>Quarterly report</header><text>Not less frequently than quarterly, the Director shall submit to Congress a report on each review conducted under subsection (a) during the preceding quarter that—</text><paragraph commented="no" display-inline="no-display-inline" id="idc9c7ae92b1d849e39e5429b401831437"><enum>(1)</enum><text display-inline="yes-display-inline">describes the result of the review; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id628dbf66bd7b4e009866abc7c5f67e42"><enum>(2)</enum><text display-inline="yes-display-inline">includes the rational for removal in each case.</text></paragraph></subsection><subsection commented="no" id="id27FF355E7C89421780A7E180F779532D"><enum>(c)</enum><header>Nondelegation</header><text>The Director may not delegate the responsibilities under this section.</text></subsection></section><section commented="no" id="id468BA08CB68447038EBC9E9B5463FD6B"><enum>122.</enum><header>Report on enforcement actions against certain immigrants</header><subsection commented="no" display-inline="no-display-inline" id="id72c75042f31842a9b8a9813810d54e44"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">With respect to covered aliens—</text><paragraph commented="no" id="id903E7AE87F554F459AB8A98ADBDDF8F2"><enum>(1)</enum><text>not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to Congress a report on the number of such aliens removed from the United States during the period beginning on January 20, 2025, and ending on the date of the enactment of this Act; and</text></paragraph><paragraph commented="no" id="idACA74D9A6AA2481EA6922CE3796CE72D"><enum>(2)</enum><text display-inline="yes-display-inline">not less frequently than quarterly, the Secretary of Homeland Security shall submit to Congress, for the preceding quarter, a report on—</text><subparagraph commented="no" id="idCAC80F9F656045589999BA2BFE27B8B5"><enum>(A)</enum><text>the number of such aliens arrested by U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection;</text></subparagraph><subparagraph commented="no" id="id01367E58EBB945F2B8588EF814E09364"><enum>(B)</enum><text>the number of such aliens detained by U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection;</text></subparagraph><subparagraph commented="no" id="idE9908B3465D14503A29925BC9793AC45"><enum>(C)</enum><text>the number of such aliens for whom U.S. Immigration and Customs Enforcement has obtained a final order of removal;</text></subparagraph><subparagraph commented="no" id="id4E275C33F014405AB042C15D3E77196E"><enum>(D)</enum><text>the number of such aliens removed from the United States and the countries to which such aliens were removed; and</text></subparagraph><subparagraph commented="no" id="idE76456F3A7304D39BD6F0CA52CC99E48"><enum>(E)</enum><text>the number of such aliens processed through partnership programs with local law enforcement, including—</text><clause commented="no" id="idC5F0A61AC4F644FAACA883C661C1AC52"><enum>(i)</enum><text>a written agreement under section 287(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357(g)</external-xref>); and</text></clause><clause commented="no" id="id91AC536B4735463AACB21518458400CC"><enum>(ii)</enum><text>detainers placed by U.S. Immigration and Customs Enforcement.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2ba0c65c713b4ad98b9fd53a629f9e30"><enum>(b)</enum><header>Covered aliens defined</header><text>In this section, the term <term>covered aliens</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id3e15c43b8b744572911e58842fe4252b"><enum>(1)</enum><text display-inline="yes-display-inline">alien parents of children who—</text><subparagraph commented="no" display-inline="no-display-inline" id="id260993172c864e0f8327224f97ef83e5"><enum>(A)</enum><text display-inline="yes-display-inline">are citizens of the United States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcfc1e13873bb4048b3ccddd5f5ef1fab"><enum>(B)</enum><text display-inline="yes-display-inline">are lawfully admitted for permanent residence (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idadf2d44d2683485bb97a2d42a755ad79"><enum>(C)</enum><text display-inline="yes-display-inline">have been granted deferred action pursuant to the Deferred Action for Childhood Arrivals program set forth in the final rule issued by the Department of Homeland Security entitled <quote>Deferred Action for Childhood Arrivals</quote> (87 Fed. Reg. 53152 (August 30, 2022));</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62ce3b99059f4a0796da47ec06fd6633"> <enum>(2)</enum> <text display-inline="yes-display-inline">aliens who have been granted deferred action pursuant to the Deferred Action for Childhood Arrivals program set forth in the final rule issued by the Department of Homeland Security entitled <quote>Deferred Action for Childhood Arrivals</quote> (87 Fed. Reg. 53152 (August 30, 2022));</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9cd46d44dd6a4ccbbc8480c1a2c3ed53"><enum>(3)</enum><text display-inline="yes-display-inline">aliens with pending applications for classification as VAWA self-petitioners (as defined in section 101(a)(51) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(51)</external-xref>));</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id367aedba28544737b2713b28fb513e79"><enum>(4)</enum><text display-inline="yes-display-inline">aliens who are applicants for status as nonimmigrants described in subparagraph (T) or (U) of section 101(a)(15) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id758b983a809c4d80942c90867d16933d"><enum>(5)</enum><text display-inline="yes-display-inline">aliens who are applicants for status as special immigrants described in section 101(a)(27)(J) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43f76c2023634e05ab513af87978f778"><enum>(6)</enum><text display-inline="yes-display-inline">aliens granted status as special immigrants under that section.</text></paragraph></subsection></section><section id="id9295a765a3a24567aeafd252f4bc187a"><enum>123.</enum><header>Report on United States citizens detained or deported</header><subsection id="id3d1b667cb4814650bb39b79865d3436e"><enum>(a)</enum><header>Initial report</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to Congress a report on the number of United States citizens detained or removed from the United States during the period beginning on January 20, 2025, and ending on the date of the enactment of this Act.</text></subsection><subsection id="id6597820651b3428ca11cd0674955a8d3"><enum>(b)</enum><header>Immediate report</header><text>Not later than 24 hours after the detention or removal of a United States citizen, the Secretary of Homeland Security shall submit to Congress a report regarding the incident, including a description of the actions being taken in response to such incident.</text></subsection><subsection id="id9c6601f621bb4a0cba3dd561f544a974"><enum>(c)</enum><header>Quarterly report</header><text>Not less frequently than quarterly, the Secretary of Homeland Security shall submit to Congress a report on any United States citizen detained or removed from the United States during the preceding quarter, including a description of the actions taken by the Secretary in response to each such detention or removal.</text></subsection></section><section commented="no" id="id08406F890E584D0CAFCDFA6396A04682"><enum>124.</enum><header>Protections for United States citizen children abroad</header><subsection commented="no" id="idAFAAD595D5CB498A8E6A22195C8468BF"><enum>(a)</enum><header>Report on United States citizen children accompanying removed parents</header><paragraph commented="no" id="idC8942814B32D48BDA765C4C9C37FDFC0"><enum>(1)</enum><header>In general</header><text>Not less frequently than semiannually, the Secretary of State, with the cooperation of the Secretary of Homeland Security, shall submit to Congress a report on known citizens of the United States under 18 years of age who leave the United States to accompany an alien parent or legal guardian who has been removed from the United States.</text></paragraph><paragraph commented="no" id="id3F74F3F301544DBCB25D8615C852DC78"><enum>(2)</enum><header>Elements</header><text>Each report required under paragraph (1) shall include, for the preceding reporting period—</text><subparagraph commented="no" id="id4D9B21C0AA3043E2A41F92E724B87D81"><enum>(A)</enum><text>the number of such citizens of the United States; and</text></subparagraph><subparagraph commented="no" id="id471F47498F5049C891191E726F3CF90D"><enum>(B)</enum><text>for each such citizen of the United States—</text><clause commented="no" id="idD5BBDA57C20E4D128DA6930F70354D36"><enum>(i)</enum><text>his or her current age;</text></clause><clause commented="no" id="id996CAC6A274D41289367520C76D9E408"><enum>(ii)</enum><text>the age at which he or she departed the United States;</text></clause><clause commented="no" id="idAEF72A97263740C8B03A2B7415E9BD29"><enum>(iii)</enum><text>his or her country of residence;</text></clause><clause commented="no" id="idDE277531C2614FF3AA52F6F3D89324FE"><enum>(iv)</enum><text>an assessment whether—</text><subclause commented="no" id="id6D0508960B754ACBA42A8954EFC86309"><enum>(I)</enum><text>either parent was deported or removed from the United States;</text></subclause><subclause commented="no" id="idC622613162574CA59036400EDCFD8640"><enum>(II)</enum><text>either parent remains in the United States; and</text></subclause><subclause commented="no" id="idA2DECA0A34B14A499F8CDA33A4C3E9C5"><enum>(III)</enum><text>he or she was in foster care in the United States at any time; and</text></subclause></clause><clause commented="no" id="id21FE0540155E4B69B53C86B5424067D0"><enum>(v)</enum><text>an identification of any pending custody case in the United States with respect to such citizen, as applicable.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id624BB6CEA510437185447F85F813BC77"><enum>(3)</enum><header>Cooperation of Secretary of Homeland Security</header><text>The Secretary of Homeland Security shall provide to the Secretary of State any data of the Department of Homeland Security that the Secretary of State may require to prepare the report under this subsection.</text></paragraph></subsection><subsection commented="no" id="idDD1B8FF0FF6A49F0AB20EADC5D8BAAA5"><enum>(b)</enum><header>Directorate of Community Outreach</header><text>There is established within the Department of State a directorate for the purpose of conducting outreach to citizens of the United States under the age of 18 years who have left the United States to accompany an alien family member who has been removed from the United States.</text></subsection><subsection id="id693d6d9744c7489c8a4b1082f8a14066"><enum>(c)</enum><header>Duties</header><text>The duties of the directorate established under subsection (b) shall include—</text><paragraph id="id45cc8e236de347eca29f9011010a1812"><enum>(1)</enum><text>facilitating access to passports, birth certificates, education records, health records, and any other documents necessary for United States citizen children’s integration into destination country and travel to the United States;</text></paragraph><paragraph id="id91beb8a1908d478d96277a4187fb1233"><enum>(2)</enum><text>working with destination countries to ensure United States citizen children’s integration into new communities;</text></paragraph><paragraph id="id073d5e82353e47ce9e64409cbcf17e1a"><enum>(3)</enum><text>assisting United States citizen children with information regarding eligibility for any benefits and responsibilities, such as education, voting, and selective service;</text></paragraph><paragraph id="id1e315634c849410193c98246d52d7cd1"><enum>(4)</enum><text>to the extent feasible, conducting voluntary pre-departure consultations with families to establish the needs of the United States citizen children for successful integration in the destination country; and</text></paragraph><paragraph id="id9dc3881a845f4bcabc038e0cd4fefb7e"><enum>(5)</enum><text>other duties to fulfill the purpose described in subsection (b).</text></paragraph></subsection></section></subtitle></title><title id="id85CBB46604E1472CBCAA170BB425E5F0" style="OLC"><enum>II</enum><header>Combating fraud and promoting citizenship</header><section id="id86377F67FC884C138E12206F35556734"><enum>201.</enum><header>Combating immigration services fraud</header><subsection id="idbc6ec1858b7741c2945eec460cd28e23"><enum>(a)</enum><header>Schemes To provide fraudulent immigration services</header><paragraph id="id74ec07ff66d7448786573e4b58db140d"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idea2a6b9d51ec4b728ac4ab20003c3b9d"><section id="id8c1ecb0fcbab49d6b7a9dc5b763c5682"><enum>1041.</enum><header>Schemes to provide fraudulent immigration services</header><subsection id="id11c1e575ffae4d6497f1d74707acaa64"><enum>(a)</enum><header>In general</header><paragraph id="id2E3A9364E6B24A4FA72D4B2C763EA144"><enum>(1)</enum><header>Offense</header><text>It shall be unlawful to knowingly or recklessly execute a scheme or artifice, in connection with any matter that is authorized by or arises under any Federal immigration law or any matter the offender claims or represents is authorized by or arises under any Federal immigration law, to—</text><subparagraph id="id788d54ca1a5e4326abe07eeaf3062269"><enum>(A)</enum><text>defraud any person; or</text></subparagraph><subparagraph id="id2153af912ebe41c593bf72506c5e8d0e"><enum>(B)</enum><text>obtain or receive money or anything else of value from any person by means of false or fraudulent pretenses, representations, or promises.</text></subparagraph></paragraph><paragraph id="id98A4744D921F4FE4B49BEFEA9D2681E3"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined under this title, imprisoned for not more than 10 years, or both.</text></paragraph></subsection><subsection id="id82c9102335764b0da862432b68ed45c6"><enum>(b)</enum><header>Misrepresentation</header><paragraph id="id9EA2721E2506488CA9DB834FDC536828"><enum>(1)</enum><header>Offense</header><text>It shall be unlawful for a person to knowingly and falsely represent that such person is an attorney or an accredited representative (as that term is defined in section 1292.1 of title 8, Code of Federal Regulations (or any successor regulation)) in any matter arising under any Federal immigration law.</text></paragraph><paragraph id="id63AF2E3D3D3B44A6BF9D1D645CEDE792"><enum>(2)</enum><header>Penalty</header><text>Any person who violates paragraph (1) shall be fined under this title, imprisoned for not more than 15 years, or both.</text></paragraph></subsection><subsection id="id39a1d8cff8134c638fff085b9c4392d2"><enum>(c)</enum><header>Reimbursement</header><text>Any person convicted of an offense under this section shall fully reimburse the client for any services that person fraudulently provided.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="ida07121e089894fd5b8f27ba3df54972d"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">chapter 47</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/1040">section 1040</external-xref> the following:</text><quoted-block style="USC" id="id7aaeb9f2-8189-4621-94a2-3bb388fff31f"><toc><toc-entry level="section" idref="id8c1ecb0fcbab49d6b7a9dc5b763c5682">1041. Schemes to provide fraudulent immigration services.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id23492326a71a465b99ba216d26889ee1"><enum>(b)</enum><header>Local immigration consumer fraud information hotlines and assistance websites</header><text display-inline="yes-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idcd9c6eeff30146adb8ae0a4c179f7bf3"><part id="idc8f3561819a447c4b4c471db05d37ce7"><enum>PP<?LEXA-Enum OO?></enum><header>Immigration consumer fraud hotlines and digital tools</header><section id="idb3d68347fe2c4a46bfdee0ce2be45377"><enum>3061.</enum><header>Immigration consumer fraud hotlines and digital tools</header><subsection id="ided213859ccd3491298abdc3ed8bf8559"><enum>(a)</enum><header>Grant authorization</header><text>The Attorney General shall make grants to States, units of local government, or any combination thereof, in partnership with stakeholders, service providers, and nonprofit organizations.</text></subsection><subsection id="id57779dd72a894b55bb8a6ce3da1a30c1"><enum>(b)</enum><header>Mandatory grant uses</header><text>Grant funds awarded under this section shall be expended for each of the following purposes:</text><paragraph id="idca806d3e45434dc7a9808bc7c03d8697"><enum>(1)</enum><header>Immigration consumer fraud information digital tools</header><text>To provide for the establishment and operation of an immigration consumer fraud information and assistance digital tools, including websites or applications, which shall be a highly secure internet resource that provides information and assistance to victims of immigration consumer fraud. In establishing and operating the immigration consumer fraud and assistance digital tool, the grantee shall—</text><subparagraph id="id963953ccd0b94a368739727bf441137e"><enum>(A)</enum><text>use grant funds for startup and operation costs associated with establishing and operating the tool;</text></subparagraph><subparagraph id="id3e025c3f29074dfc85dfe1df3f5ce77d"><enum>(B)</enum><text>use a name or acronym as part of its website that identifies the tool with the geographic locality receiving the grant under subsection (a);</text></subparagraph><subparagraph id="id0e53c402aedf40b0a8f1f0207a64b6e3"><enum>(C)</enum><text>provide accurate information that describes the services available to immigration consumer fraud victims, including free or low-cost legal assistance;</text></subparagraph><subparagraph id="id2761cc7608104405940228ba1f7c881f"><enum>(D)</enum><text>clearly include, in all pages of the tool, that the information presented is for reference purposes only and does not constitute as legal advice; and</text></subparagraph><subparagraph id="id206c9e829e854fc5872a991ea4cb23a6"><enum>(E)</enum><text>provide translation of resource content, in languages that are consistent with the criteria outlined in subsection (d)(2)(E)(i), either with a web page interface, or mirrored pages.</text></subparagraph></paragraph><paragraph id="id96a4891250f743a19ec3958dbfb5768c"><enum>(2)</enum><header>Immigration consumer fraud hotlines</header><text>To establish or expand an immigration consumer fraud hotline to provide information and assistance to victims of immigration consumer fraud. In addition, grantees may, in operating with the hotline, work in conjunction with other local programs and activities that serve victims of immigration consumer fraud. In establishing and operating the hotline, the entity shall—</text><subparagraph id="idbb9a40e301a94ae8a4f7434b5d71a279"><enum>(A)</enum><text>contract with a carrier for the use of a toll-free telephone line;</text></subparagraph><subparagraph id="id76412dffb1f244caad3bf59b6c3a6ff3"><enum>(B)</enum><text>employ, train and supervise personnel to answer incoming calls and provide assistance and referral services to callers on a 24-hour-a-day basis;</text></subparagraph><subparagraph id="idbf484a1a5d504fe0b36ce9a05ab322b1"><enum>(C)</enum><text>assemble and maintain a current database of information relating to services for victims of immigration consumer fraud to which callers throughout the United States may be referred; and</text></subparagraph><subparagraph id="idb8b469d6d2c649558b2a239f9c300d4b"><enum>(D)</enum><text>be prohibited from asking hotline callers about their citizenship status.</text></subparagraph></paragraph></subsection><subsection id="id2d9f670dfcc143ba9c374970bcde3131"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this Act shall require a grantee receiving funds under this Act to comply with a request lawfully made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act (8 U.S.C. 1226 and 1357) to comply with a detainer for, or notify about the use of services provided under this Act by an individual.</text></subsection><subsection id="idbc1c0fd084c34e92b25f99e84b8f20db"><enum>(d)</enum><header>Application</header><text>The Attorney General may approve an application for a grant under this section only if such application—</text><paragraph id="id57ec14d278a44767a58200050f433e9f"><enum>(1)</enum><text>contains such agreements, assurances, and information, is in such form, and is submitted in such manner, as the Attorney General shall by rule require;</text></paragraph><paragraph id="ida2b6058c3b7f44ca97c87d60ae9c81fd"><enum>(2)</enum><text>in the case of an application for a grant to carry out activities described in subsection (b)(2), includes a complete description of the applicant’s plan for the operation of an immigration consumer fraud hotline, including descriptions of—</text><subparagraph id="id18c54e730e464389a0dbfd1e3c50c477"><enum>(A)</enum><text>the training program for hotline personnel, including technology training to ensure that all persons affiliated with the hotline are able to effectively operate any technological systems used by the hotline;</text></subparagraph><subparagraph id="id437ce2d0fb024f28bba2eb51a2af6a47"><enum>(B)</enum><text>the hiring criteria for hotline personnel;</text></subparagraph><subparagraph id="ide76c4a87f5cb4e65a91e3610ecaa56d7"><enum>(C)</enum><text>the methods for the creation, maintenance, and updating of a resource database;</text></subparagraph><subparagraph id="id6b1bb90194c044f2a26dcd13f2612764"><enum>(D)</enum><text>a plan for publicizing the availability of the hotline;</text></subparagraph><subparagraph id="id3611a4068d134185b14e4ca681fb8316"><enum>(E)</enum><text>a plan for providing service to non-English speaking callers that—</text><clause id="id204126b5629546f2b526b6095c84dfe3"><enum>(i)</enum><text>is based on data from the Bureau of the Census and be consistent with the local area demographics where the immigration consumer fraud hotline will operate such plan and outline which languages are most prevalent and commonly requested for translation services; or</text></clause><clause id="id2a4079c7187847cf89b4e2b0b4229fed"><enum>(ii)</enum><text>is based on qualitative and quantitative observation from community service providers offering immigration-related services; and</text></clause></subparagraph><subparagraph id="idd86480e5080a4eebaef36af8dc012c1f"><enum>(F)</enum><text>a plan for facilitating access to the hotline by persons with hearing impairments; and</text></subparagraph></paragraph><paragraph id="id3bbf5e30271a4c99ae3aac8de2607031"><enum>(3)</enum><text>in the case of an application for a grant to carry out activities described in subsection (b)(1)—</text><subparagraph id="id02f4ef963b054198a61146a669fcb9ac"><enum>(A)</enum><text>include a complete description of the applicant’s plan for the development, operation, maintenance, and updating of information and resources of the immigration consumer fraud information and assistance website;</text></subparagraph><subparagraph id="id1cf5cce9f89443c9a04093e8fefe66a6"><enum>(B)</enum><text>include a certification that the applicant will implement a high level security system to ensure the confidentiality of the website, taking into consideration the safety of immigration consumer fraud victims;</text></subparagraph><subparagraph id="id29f63f10758040d1b4367863222a072f"><enum>(C)</enum><text>include an assurance that, after the third year of the website project, the recipient of the grant will develop a plan to secure other public or private funding resources to ensure the continued operation and maintenance of the website; and</text></subparagraph><subparagraph id="idface0f48d7dd445c8d25c30fb7b7a5dc"><enum>(D)</enum><text>demonstrate that the applicant has recognized expertise in the area of immigration consumer fraud and a record of high quality service to victims of immigration consumer fraud, including a demonstration of support from advocacy groups.</text></subparagraph></paragraph></subsection><subsection id="id5c37d602763d4e22b3a59300a3563f4b"><enum>(e)</enum><header>Renewal of grants</header><text>A grant made under this section may be renewed, without limitations on the duration of such renewal, to provide additional funds, if the Attorney General determines that the funds made available to the recipient were used in a manner required under an approved application and if the recipient can demonstrate significant progress in achieving the objectives of the initial application.</text></subsection><subsection id="id3752d96144114c62b98293c091e968ea"><enum>(f)</enum><header>No cost extensions</header><text>Notwithstanding subsection (e), the Attorney General may extend a grant period, without limitations as to the duration of such extension, to provide additional time to complete the objectives of the initial grant award.</text></subsection><subsection id="id0c32be98bcc441f8811f9a584f6b37fe"><enum>(g)</enum><header>Authorization of appropriations</header><paragraph id="id6056d29b26af4febb8cc4c9965a11dff"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $15,000,000 for fiscal year 2027, and for each succeeding fiscal year.</text></paragraph><paragraph id="idbc2b892eda9041b0a941484794508765"><enum>(2)</enum><header>Websites</header><text>Of the amounts appropriated to carry out this section, not less than 20 percent shall be used for purposes of carrying out activities under subsection (b)(1).</text></paragraph><paragraph id="idf3c7f91dc0d345f498364985dcbd2935"><enum>(3)</enum><header>Availability</header><text>Funds authorized to be appropriated under this section may remain available until expended.</text></paragraph></subsection><subsection id="id62025a30e47648a0bf387b2298731b1b"><enum>(h)</enum><header>Prohibition of data sharing for immigration enforcement purposes</header><paragraph id="id69e9cdb9b67e455e83c266735f1a35fa"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 642 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373</external-xref>), an entity receiving a grant under this section may not disclose or use personally identifiable information provided by individuals using a website or a hotline under subsection (b), for the purposes of enforcing the immigration laws.</text></paragraph><paragraph id="id7492ea1b4ebc407ab2310eb6adad3304"><enum>(2)</enum><header>Referrals prohibited</header><text>An entity receiving a grant under this section may not refer any individual participating in any program funded under this section to U.S. Immigration and Customs Enforcement or to U.S. Customs and Border Protection.</text></paragraph><paragraph id="id9bb174cb4bf845faa890b270c14d2f69"><enum>(3)</enum><header>Defined term</header><text>In this section, the term <term>personally identifiable information</term> means any information about an individual elicited, collected, stored, or maintained by an entity receiving a grant under this section, including—</text><subparagraph id="id6376eb9c311e431e820db66205bdc3eb"> <enum>(A)</enum> <text>any information that can be used to distinguish or trace the identity of an individual, such as a name, residential address, a social security number, an alien registration number, a date and place of birth, or a parent's maiden name; and</text>
 </subparagraph><subparagraph id="idcfb0c26bf0e0438db662b517c7e3d47e"><enum>(B)</enum><text>any other information that is linked or linkable to an individual, such as medical, educational, financial, and employment information.</text></subparagraph></paragraph></subsection></section><section id="idd7b9b214f17349428acb02b0b99ec98c"><enum>3062.</enum><header>Report</header><text display-inline="no-display-inline">A State or unit of local government that receives funds under this part during a fiscal year shall submit to the Attorney General a description and an evaluation report on a date specified by the Attorney General regarding the effectiveness of the programs carried out with a grant under this part.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id21e7641151c24c558de398492fa35abb"><enum>(c)</enum><header>Grants to states and local jurisdictions To promote outreach campaigns against immigration consumer fraud</header><text display-inline="yes-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101 et seq.</external-xref>), as amended by subsection (b), is amended by inserting after part PP the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb1941ae969754945aea893523b26c1c8"><part id="idea436a47af784ac39dcaed31d234748b"><enum>QQ<?LEXA-Enum PP?></enum><header>Grants to States and local jurisdictions to promote outreach campaigns against immigration consumer fraud</header><section id="id80fe2db55d0749658210db90e0866f66"><enum>3071.</enum><header>Grants to States and local jurisdictions to promote outreach campaigns against immigration consumer fraud</header><subsection id="id339e4acfd0684f6a85f1c1ae2e583027"><enum>(a)</enum><header>Grant authorization</header><paragraph id="idaf32f5e1fc2f4d958775e822e9843f2f"><enum>(1)</enum><header>In general</header><text>The Attorney General shall make grants to States, units of local government, or any combination thereof, in partnership with stakeholders, service providers, and nonprofit organizations.</text></paragraph><paragraph id="id225fcb7faaf24dd7a8dbed85302d1e67"><enum>(2)</enum><header>Purpose</header><text>The purpose of grants distributed under this subsection is to enable States and localities to work with parties in paragraph (1) to carry out outreach campaigns in any of the following:</text><subparagraph id="id1a6ab74270794e2ebbef5a44d1032163"><enum>(A)</enum><text>Access to legal resources, including free or low-cost legal resources for persons of low-income.</text></subparagraph><subparagraph id="idfa50f2dc80ca4a8cbd25d5272340088b"><enum>(B)</enum><text>Workshops educating the general public on immigration consumer fraud, including methods to identify such fraud and best practices on prevention.</text></subparagraph><subparagraph id="id1b833db94389421bb986986d6de006ea"><enum>(C)</enum><text>Hiring of casework staff, attorneys, translators, accredited representatives and other similar staff to provide support for outreach objectives.</text></subparagraph><subparagraph id="iddecc7089b1f44d55a6a2c1ac2ce7c1a7"><enum>(D)</enum><text>Printed materials or digital media designed with the intent to educate the public on where to obtain trusted legal resources, and how to prevent becoming a victim of immigration consumer fraud.</text></subparagraph><subparagraph id="id2887892a185b4807a11095aea9b49c7e"><enum>(E)</enum><text>Public service announcements in television or radio, providing information on resources and assistance on preventing immigration consumer fraud.</text></subparagraph><subparagraph id="id04fe0c624c5745b19adba99429b7aa70"><enum>(F)</enum><text>Translation services, including translated equivalents of subparagraphs (A), (B), (C) or (D), consistent with the grantee’s immediate translation needs based on—</text><clause id="idb4f58eb15d8d456a889e40d95c0d791a"><enum>(i)</enum><text>data from the Bureau of the Census that is consistent with the local area demographics where the outreach campaign will operate, along with a description of the languages are most prevalent or commonly requested for translation services; or</text></clause><clause id="id72150dfe525b438d806315d41f27233b"><enum>(ii)</enum><text>quantitative or qualitative observation from community service providers offering immigration-related services.</text></clause></subparagraph></paragraph></subsection><subsection id="id130e67ca882342ff9edc3a7c8a764265"><enum>(b)</enum><header>Contents</header><text>In accordance with such requirements as the Attorney General may by rule establish, each application for a grant under this section shall—</text><paragraph id="idd729940b24a742e48908ab9d3abf46e0"><enum>(1)</enum><text>include a long-term strategy and detailed implementation plan that reflects consultation with community groups and appropriate stakeholders;</text></paragraph><paragraph id="id73087d05faa742a0b3c6bb2e4e31e3af"><enum>(2)</enum><text>explain the applicant’s inability to address the need without Federal assistance;</text></paragraph><paragraph id="id39a33646d1a04a55b50899152cbff9b5"><enum>(3)</enum><text>identify related governmental and community initiatives which compliment or will be coordinated with the proposal; and</text></paragraph><paragraph id="ide0e8f92d1f1c4578b2502e1fdcc3b089"><enum>(4)</enum><text>identify local service providers and nonprofit organizations that have substantial or significant experience dealing with immigration-related matters.</text></paragraph></subsection><subsection id="id9a8786cdcf324cc4bf04a90883e48dca"><enum>(c)</enum><header>Renewal of grants</header><text>A grant made under this section may be renewed, without limitations on the duration of such renewal, to provide additional funds, if the Attorney General determines that the funds made available to the recipient were used in a manner required under an approved application and if the recipient can demonstrate significant progress in achieving the objectives of the initial application.</text></subsection><subsection id="idabe32c98e16a4f9c99870bd3dbaa11b5"><enum>(d)</enum><header>No cost extensions</header><text>Notwithstanding subsection (c), the Attorney General may extend a grant period, without limitations as to the duration of such extension, to provide additional time to complete the objectives of the initial grant award.</text></subsection><subsection id="id3cb78b51bf6a48819dc1ae60f6d03414"><enum>(e)</enum><header>Suspension of funds</header><text>If the Attorney General determines that a grant recipient under this section is not in substantial compliance with the terms and requirements of an approved grant application, the Attorney General may revoke or suspend funding of that grant, in whole, or in part.</text></subsection><subsection id="id70467ad64d9342c6871f3ac8a3cfdf8d"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph id="id7278e7ff6c124b4da6d1a148e5bc8a35"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $10,000,000 for fiscal year 2027, and for each succeeding fiscal year.</text></paragraph><paragraph id="id72a273c68d06480db908f914fcf9f440"><enum>(2)</enum><header>Availability</header><text>Funds authorized to be appropriated under this section may remain available until expended.</text></paragraph></subsection><subsection id="id6d0e572d6ca3409e921527416088bc5a"><enum>(g)</enum><header>Prohibition on data sharing for immigration enforcement purposes</header><paragraph id="idd2e998250aca459a94b198038a022c1d"> <enum>(1)</enum> <header>In general</header> <text>Notwithstanding section 642 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1373">8 U.S.C. 1373</external-xref>), an entity receiving a grant under this section may not disclose or use personally identifiable information provided by individuals participating in outreach campaigns specified in subsection (a) for the purposes of enforcing the immigration laws.</text>

and</text></subparagraph><subparagraph id="id145A9386A3E54591BBBEB5BA7C929B7D"><enum>(B)</enum><text>section 1041 of title 18, United States Code.</text></subparagraph></paragraph><paragraph id="idad919f0fac6e43d39d9a4cda47ee1a38"><enum>(3)</enum><header>Permitted use of funds</header><text>A State or unit of local government that receives a grant under this section may use funds from the grant for activities, including—</text><subparagraph id="idb228e64335b247118c6a149913e72a79"><enum>(A)</enum><text>hiring staff, such as compliance officers that are charged with investigating and enforcing Federal, State, and local laws against immigration consumer fraud;</text></subparagraph><subparagraph id="id136d283ef8af45f0b5d5fbceccdf6b8a"><enum>(B)</enum><text>training staff, such as the compliance officers described in subparagraph (A);</text></subparagraph><subparagraph id="id315d884e108c432191260d5e5d5d82c7"><enum>(C)</enum><text>investigating complaints of immigration consumer fraud; and</text></subparagraph><subparagraph id="idf1749d19d6d14106a50e5d51028cb289"><enum>(D)</enum><text>taking action against violations of Federal, State, and local laws relating to immigration consumer fraud, which may include the prosecution of violators.</text></subparagraph></paragraph></subsection><subsection id="idbd6b63b5dbe7436c80cbdf8dc28b8820"><enum>(b)</enum><header>Contents</header><text>In accordance with such requirements as the Attorney General may by rule establish, each application for a grant under this section shall—</text><paragraph id="idbe243d7c320c4aa0820455c2c4b5e23c"><enum>(1)</enum><text>include a detailed implementation plan that reflects consultation with community groups and appropriate stakeholders;  </subparagraph><subparagraph id="id899C37D7112F446E8774B40B04D54B3B"><enum>(B)</enum><header>Exception</header><text>An entity receiving a grant under this section may disclose or use personally identifiable information provided by an individual involved with the work funded under this section if—</text><clause id="idF6229F90896F4D81BE630F3DD18101D9"><enum>(i)</enum><text>the disclosure or use required in order to prosecute a case; and</text></clause><clause id="idE5153FADD6BE4AFA94557C38D1BD4CC0"><enum>(ii)</enum><text>the individual explicitly permits the use or disclosure.</text></clause></subparagraph></paragraph><paragraph id="idfec56a5bb8ac48c793c625bbc6da9135"><enum>(2)</enum><header>Referrals prohibited</header><text>An entity receiving a grant under id="id397b5a9c76c64c65bad540a24b1f429a" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3082.</enum><header>Report</header><text display-inline="no-display-inline">A State or unit of local government that receives funds under this part during a fiscal year shall submit to the Attorney General a description and an evaluation report on a date specified by the Attorney General regarding the effectiveness of the programs carried out with a grant under this part.</text></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H66A1268D587B46DEA67E913A82A2DF34"><enum>202.</enum><header>Requirements for immigration consultants</header><subsection id="id082540BC5FF5430CBECBBBA19E41AAB1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Commission, in consultation with the Director of the Executive Office for Immigration Review and the Secretary of Homeland Security, shall promulgate regulations, in accordance with section 553 of title 5, United States Code, that require an immigration consultant—</text><paragraph id="HFF05197DFF9F4291965D1572FBA6DD23"><enum>(1)</enum><text display-inline="yes-display-inline">to disclose in all advertising or promotional material and by displaying a notice at the regular place of business (if any) of the consultant that the consultant is not an immigration attorney, cannot provide legal advice or legal services on immigration matters, and is not authorized to represent aliens before an immigration court or the Board of Immigration Appeals or authorized to represent others before the Department of Homeland Security in connection with an application for an immigration benefit or an immigration proceeding;</text></paragraph><paragraph id="H9C371696C1C34B988B11718E380768C9"><enum>(2)</enum><text>if the consultant enters into a written contract for the provision of immigration consulting services—</text><subparagraph id="HC56FD4ED9D624B02851F1D06E4E16CD5"><enum>(A)</enum><text display-inline="yes-display-inline">to ensure that the contract states that—</text><clause id="H2DA86D016FA8482A855D29734D6FB411"><enum>(i)</enum><text display-inline="yes-display-inline">the consultant is not an immigration attorney, cannot provide legal advice or legal services on immigration matters, and is not authorized to represent aliens before an immigration court or the Board of Immigration Appeals or authorized to represent others before the Department of Homeland Security in connection with an application for an immigration benefit or an immigration proceeding; and</text></clause><clause id="H620D2CC9A3A8490F91FEC239A9AA9B6E"><enum>(ii)</enum><text>the client has the right to have the contract reviewed by an attorney;</text></clause></subparagraph><subparagraph id="H9034F25723AF4B8BBC68487698FA7D18"><enum>(B)</enum><text display-inline="yes-display-inline">to provide the client with a copy of the contract in English and, if requested by the client, in one or more other languages;</text></subparagraph><subparagraph id="H469872EADAC34A078BD0958153535FBF"><enum>(C)</enum><text>to inform the client of the right to request a copy of the contract in languages other than English, as required by subparagraph (B); and</text></subparagraph><subparagraph id="H513CB67A57A54F72889784EC86FDA962"><enum>(D)</enum><text>to ensure that the contract provides the client with the right to rescind the contract at any time during the 72-hour period after entering into the contract;</text></subparagraph></paragraph><paragraph id="H8C67379401A24CEEAE25199D8BB4B944"><enum>(3)</enum><text>not to collect fees for immigration consulting services before having rendered the services for which the fees are charged;</text></paragraph><paragraph id="H8F3482F460BC4FA09B603D23FCFA099A"><enum>(4)</enum><text display-inline="yes-display-inline">to return to the client any original document obtained from the client (unless the original document must be provided to a Federal or State agency or another person and has been so provided) and to furnish to the client for no additional charge a copy of any document prepared or obtained by the consultant for the client or otherwise used in connection with immigration consulting services for the client (other than notes or other documents prepared by the consultant for internal use in order to provide such services); and</text></paragraph><paragraph id="H31914722852B45938803EE4872EF006D"><enum>(5)</enum><text>to retain for not less than 3 years after ceasing to provide immigration consulting services for a client a copy of any document required by paragraph (4) to be returned or furnished to the client.</text></paragraph></subsection><subsection id="H64ED571EADD14EF6BF711373C4580841"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HB8FE4F809A3042B58CD4C857C3E52879"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="H14067D92511147D1BD78A57CB549DCD9"><enum>(2)</enum><header>Immigration consultant</header><text>The term <term>immigration consultant</term> means a person engaged in the provision of immigration consulting services, except that such term does not include a person who is—</text><subparagraph id="H3AC86D99FAC64601923D67B6D22E5F99"><enum>(A)</enum><text>authorized to represent aliens before an immigration court or the Board of Immigration Appeals; or</text></subparagraph><subparagraph id="HBB8E38BFA51B4BCABBD7EAC53034FE21"><enum>(B)</enum><text display-inline="yes-display-inline">authorized to represent others in connection with an application or proceeding described in paragraph (3)(A) before the Department of Homeland Security in accordance with regulations promulgated by the Secretary of Homeland Security.</text></subparagraph></paragraph><paragraph commented="no" id="H13742CD62E7448B7931130B797FBEEBA"><enum>(3)</enum><header>Immigration consulting services</header><subparagraph commented="no" id="HB931B07DC4D94BCB9ED16FA4A6421E7A"><enum>(A)</enum><header>In general</header><text>The term <term>immigration consulting services</term> means assistance, advice, or services provided to an individual in connection with—</text><clause id="H9054B643ADFB4CA29F31E0CCB44AD23C"><enum>(i)</enum><text>application (or consideration of application) by such individual for an immigration benefit; or</text></clause><clause id="HEFF729148D4344778301D26E6AB8AD00"><enum>(ii)</enum><text display-inline="yes-display-inline">an immigration proceeding involving such individual before or with the Department of Homeland Security or the Executive Office for Immigration Review.</text></clause></subparagraph><subparagraph commented="no" id="H549C41430ADC4973BB56595347E335F8"><enum>(B)</enum><header>Inclusions</header><text>Such term includes the following:</text><clause commented="no" id="H30C2DBBDC94C4035BE3C691C9C19B916"><enum>(i)</enum><text>Assistance with procuring supporting documentation requested by such an agency, such as a birth certificate or marriage license.</text></clause><clause commented="no" id="H15B03EB2C42E43F5B2624A1B0DD075BB"><enum>(ii)</enum><text>Referring a client to an attorney for legal representation.</text></clause><clause commented="no" id="HA0B7D5716746488A99135621DE95FB3A"><enum>(iii)</enum><text>Assistance with complying with requirements relating to biometric services.</text></clause></subparagraph><subparagraph id="H502CC71766F54788948D887036D24220"><enum>(C)</enum><header>Exclusions</header><text>Such term does not include the following:</text><clause commented="no" id="HA1E2AFEC645146ACB565644A0D7B4C78"><enum>(i)</enum><text>Completing a form of a Federal or State agency or submitting such form to such agency.</text></clause><clause commented="no" id="HA967F469B4A44058B34721CB8DD47B75"><enum>(ii)</enum><text>Translating the responses of a client to the information requested on such a form or in other communications with such an agency.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE97D4A4CADA14C8BB63A242395816284"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian tribe.</text></paragraph></subsection><subsection id="H615B212D325846CD9C2DB57627522755"><enum>(c)</enum><header>Applicability and enforcement of regulations</header><paragraph id="H7EE12634FFE6428BB7084700DA3400E9"><enum>(1)</enum><header>General application</header><text display-inline="yes-display-inline">The requirements of the regulations promulgated under subsection (a) apply, according to their terms, to those persons, partnerships, and corporations over which the Commission has authority pursuant to section 5(a)(2) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(2)</external-xref>).</text></paragraph><paragraph display-inline="no-display-inline" id="H94AF58E717E647F9B9AD63029378BB58"><enum>(2)</enum><header>Enforcement by Federal Trade Commission</header><subparagraph id="H9397C764E9AF4D6C9E103817CAB1562D"><enum>(A)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of a regulation promulgated under subsection (a) shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices.</text></subparagraph><subparagraph id="H5988D9FF60744951863C09B22826233D"><enum>(B)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Commission shall enforce the regulations promulgated under subsection (a) in the same manner, by the same means, and with the same jurisdiction, powers, and duties provided in the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>), and any person who violates such a regulation shall be subject to the penalties and entitled to the privileges and immunities provided in such Act.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1628BAB51E4D499D992F4FBC48C81127"><enum>(3)</enum><header>Actions by States</header><subparagraph commented="no" id="H0071EA4B46364CAC9DD1CE72DBBD3EE3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which the attorney general of a State, or an official or agency of a State, has reason to believe that an interest of the residents of such State has been or is threatened or adversely affected by an act or practice in violation of a regulation promulgated under subsection (a), the State, as parens patriae, may bring a civil action on behalf of the residents of the State in an appropriate State court or an appropriate district court of the United States—</text><clause commented="no" id="H98E2353BBAF444B7BE04C722649C6839"><enum>(i)</enum><text>to enjoin such act or practice;</text></clause><clause commented="no" id="H803C14F1A78D4F199709851BF7F19EE9"><enum>(ii)</enum><text>to enforce compliance with such regulation;</text></clause><clause commented="no" id="H9B65260168F646359956CA027D48DAA1"><enum>(iii)</enum><text display-inline="yes-display-inline">to obtain on behalf of residents of the State—</text><subclause id="H42C7480408BB4EBCA13D4776FAE5265B"><enum>(I)</enum><text display-inline="yes-display-inline">damages for actual monetary loss from the violation, or up to $10,000 in damages for each such violation, whichever is greater;</text></subclause><subclause id="HB4FF2E59018447D68B4D8D0286848BA5"><enum>(II)</enum><text>restitution; or</text></subclause><subclause id="H47B32755C91042B6A778837D783FAB93"><enum>(III)</enum><text>other compensation; or</text></subclause></clause><clause commented="no" id="H1A57C620C4024FD2BFBB8736928EB35B"><enum>(iv)</enum><text>to obtain such other legal and equitable relief as the court may consider to be appropriate.</text></clause></subparagraph><subparagraph commented="no" id="HC84CF0AC4E34469FB20989ABED06F57A"><enum>(B)</enum><header>Notice</header><text>Before filing an action under this subsection, the attorney general, official, or agency of the State involved shall provide to the Commission a written notice of such action and a copy of the complaint for such action. If the attorney general, official, or agency determines that it is not feasible to provide the notice described in this paragraph before the filing of the action, the attorney general, official, or agency shall provide written notice of the action and a copy of the complaint to the Commission immediately upon the filing of the action.</text></subparagraph><subparagraph commented="no" id="H06BBEEB9FC77482481D1EEFDD583AB90"><enum>(C)</enum><header>Authority of Federal Trade Commission</header><clause id="HDDCFF2E3DC80464398DD0D5A2392A0AE"><enum>(i)</enum><header>In general</header><text>On receiving notice under subparagraph (B) of an action under this subsection, the Commission shall have the right—</text><subclause commented="no" id="H5C68527F10E54DB18B7FF2C367F2E58A"><enum>(I)</enum><text>to intervene in the action;</text></subclause><subclause id="HA734D24C88AC4294877230C38B306D3F"><enum>(II)</enum><text>upon so intervening, to be heard on all matters arising therein; and</text></subclause><subclause commented="no" id="H9A14C661CD9B49E2970104F8933415CA"><enum>(III)</enum><text>to file petitions for appeal.</text></subclause></clause><clause commented="no" id="H7AD04F427682474690FB5DAC45FD7F65"><enum>(ii)</enum><header>Limitation on State action while Federal action is pending</header><text display-inline="yes-display-inline">If the Commission or the Attorney General of the United States has instituted a civil action for violation of a regulation promulgated under subsection (a) (referred to in this subparagraph as the <quote>Federal action</quote>), no State attorney general, official, or agency may bring an action under this subsection during the pendency of the Federal action against any defendant named in the complaint in the Federal action for any violation of such regulation alleged in such complaint.</text></clause></subparagraph><subparagraph commented="no" id="HC399D86FC2084793AA39D9472E903A44"><enum>(D)</enum><header>Rule of construction</header><text>For purposes of bringing a civil action under this paragraph, nothing in this Act shall be construed to prevent an attorney general, official, or agency of a State from exercising the powers conferred on the attorney general, official, or agency by the laws of such State to conduct investigations, administer oaths and affirmations, or compel the attendance of witnesses or the production of documentary and other evidence.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H2326064D89A345ABB89F3CD33810A6CE"><enum>(4)</enum><header>Private right of action</header><subparagraph id="H0236878AD2C44C808BA547E333A396A3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A person injured by an act or practice in violation of a regulation promulgated under subsection (a) may bring in an appropriate State court or an appropriate district court of the United States—</text><clause id="HB441822884A846129017ECF9D2546311"><enum>(i)</enum><text>an action to enjoin the violation;</text></clause><clause id="HE208460D895D4BBAB4C7BA02AFA8D93B"><enum>(ii)</enum><text>an action to recover damages for actual monetary loss from the violation, or to receive up to $10,000 in damages for each such violation, whichever is greater; or</text></clause><clause id="HC6C06E4F82A045439E3458181FE5581F"><enum>(iii)</enum><text>both such actions.</text></clause></subparagraph><subparagraph commented="no" id="HAD486ABBEE5A40E7BCA80A3FDA6EB0D7"><enum>(B)</enum><header>Willful or knowing violations</header><text display-inline="yes-display-inline">If the court finds that the defendant acted willfully or knowingly in committing a violation described in subparagraph (A), the court may, in its discretion, increase the amount of the award to an amount equal to not more than 3 times the amount available under subparagraph (A)(ii).</text></subparagraph><subparagraph id="H168F50BA07504337852F1519633FCAC0"><enum>(C)</enum><header>Costs and attorney’s fees</header><text display-inline="yes-display-inline">The court shall award to a prevailing plaintiff in an action under this subsection the costs of such action and reasonable attorney’s fees, as determined by the court.</text></subparagraph><subparagraph id="H6FA6ABD2034D4553B037F548A3FC4F6E"><enum>(D)</enum><header>Nonexclusive remedy</header><text>The remedy provided by this subsection shall be in addition to any other remedies available to the person.</text></subparagraph></paragraph></subsection></section><section id="id1D1AC7B279484D2DB7D7C31AF548E8AD"><enum>203.</enum><header>Fee and backlog transparency</header><text display-inline="no-display-inline">Section 286(m) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(m)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf67542ee33f7471895505a2a401d8bfc"><subsection id="H46F281F311174024943E1682D7CA2FFC"><enum>(m)</enum><header>Immigration service fees</header><paragraph id="H1F3AB1F558154BC3B8816E0F03435AE2"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), all fees designated by the Secretary of Homeland Security in regulations as <quote>immigration adjudication fees</quote> shall be deposited as offsetting receipts into the <quote>Immigration Examinations Fee Account</quote> in the Treasury of the United States, whether such fees are collected directly by the Secretary or through clerks of courts.</text></paragraph><paragraph id="HAC5DF4C087014FA7B7A3E2D49FDCAD10"><enum>(2)</enum><header>Virgin Islands and Guam</header><subparagraph id="id1BBA51CA4C4B48E28B18839FC9213A3A"><enum>(A)</enum><header>Guam</header><text>All fees described in paragraph (1) that are received by the Secretary of Homeland Security from applicants residing in Guam shall be remitted to the Department of Revenue and Taxation of Guam.</text></subparagraph><subparagraph id="id1724AF0A7452434A9F2883CB0C38715B"><enum>(B)</enum><header>Virgin islands</header><text>All fees described in paragraph (1) that are received by the Secretary of Homeland Security from applicants residing in the United States Virgin Islands shall be remitted to the Treasury Division of the United States Virgin Islands.</text></subparagraph></paragraph><paragraph id="id965e4ddfc76b4a499086a21499ae087c"><enum>(3)</enum><header>Annual report on immigration fees</header><text>Not less frequently than annually, the Secretary of Homeland Security shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report on the collection and use of immigration fees that—</text><subparagraph id="id1841597e7bc946ec9c249d5b351474d7"><enum>(A)</enum><text>identifies—</text><clause commented="no" display-inline="no-display-inline" id="id87e0b6e75e754b1994f44a55bda0d42b"><enum>(i)</enum><text display-inline="yes-display-inline">total fee revenue collected, disaggregated by the type of immigration benefit for which fees were collected;</text></clause><clause id="id5227147e811d4c35b36ec072e6b75ded"><enum>(ii)</enum><text>the expenditures of such revenue, disaggregated by major function, including adjudications, customer service, fraud detection or vetting, and information technology modernization; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id60c1956e9a6047089c69eeb5db974d3f"><enum>(iii)</enum><text display-inline="yes-display-inline">any transfer of funds from the Immigration Examinations Fee Account and any funds appropriated to U.S. Citizenship and Immigration Services to other divisions within the Department of Homeland Security or to other Federal departments or agencies; and</text></clause></subparagraph><subparagraph id="id6695f29c67854229ba341b921fbf1b5b"><enum>(B)</enum><text>describes the use of carryover balances and reserves related to the Immigration Examinations Fee Account.</text></subparagraph></paragraph><paragraph id="HB0308043AEEF446398A1430B3CB14F92"> <enum>(4)</enum> <header>Accountability relating to fee increases</header> <text>The Secretary of Homeland Security may not increase any immigration service fee above the level of such fee as of January 1, 2026, before the date that is 60 days after the date on which the Secretary submits to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name> and the <committee-name committee-id="HJU00">Committee on the Judiciary of the House of Representatives</committee-name> a report that—</text>
                            <subparagraph id="HA1819ADE395D48A3958E34792B16CD4B">
                                <enum>(A)</enum>
 <text>identifies the direct and indirect costs associated with providing adjudication and naturalization services;</text>
                            </subparagraph>
                            <subparagraph id="id8260D5C9E3B94508B6FDAA21D2152E75">
                                <enum>(B)</enum>
 <text>distinguishes the costs referred to in subparagraph (A) from immigration enforcement and national security costs;</text>
                            </subparagraph>
                            <subparagraph id="HA12FF76263884F1196DE8B81289DF815">
                                <enum>(C)</enum>
 <text display-inline="yes-display-inline">identifies the costs allocated for premium processing services to business customers, as prescribed under subsection (u);</text>
                            </subparagraph>
                            <subparagraph id="idC6730B3F4D234AD893D58BB391D6B205">
                                <enum>(D)</enum>
 <text display-inline="yes-display-inline">describes the extent to which the fee prescribed in subsection (u) is set at a level that ensures full recovery of the costs referred to in subparagraph (C);</text>
                            </subparagraph>
                            <subparagraph id="id0BA9A911F15F4461B281AFFFE4696F1C">
                                <enum>(E)</enum>
 <text display-inline="yes-display-inline">identifies the amount of funding that is being allocated for the infrastructure improvements in the adjudication and customer-service processes prescribed under subsection (u);</text>
                            </subparagraph>
                            <subparagraph id="H996B538B68CE4352B658613E24BEF89A">
                                <enum>(F)</enum>
 <text>contains information regarding the amount by which such fee will be increased;</text>
                            </subparagraph>
                            <subparagraph id="ide6e04f43a1d24667ba4a42df45840e72">
                                <enum>(G)</enum>
 <text>itemizes the total amount an applicant may be required to pay; and</text>
                            </subparagraph>
                            <subparagraph id="id5a2162c34d6a465b965553fbcda1c82d">
                                <enum>(H)</enum>
 <text>identifies which parts of the fee are waivable.</text> </subparagraph> </paragraph><paragraph id="H9BC2AD5EE76D4F58BC70DA12B5284F07"><enum>(5)</enum><header>Adjudications delay and backlog report</header><text>Not less frequently than quarterly, the Secretary of Homeland Security shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report that identifies for the preceding quarter—</text><subparagraph id="idf774bb9a7d57463194bfd149594b8afe"><enum>(A)</enum><text>median processing times, disaggregated by form number;</text></subparagraph><subparagraph id="idef7fb1d2ba974bba9099e6df9faa5a0e"><enum>(B)</enum><text>total pending caseloads, disaggregated by form number;</text></subparagraph><subparagraph id="id811ddf6ed03c412bbd4b4152488bb591"><enum>(C)</enum><text>the number of applications received, completed, approved, denied, and pending;</text></subparagraph><subparagraph id="ida15fd27bff0d4a92b7b087a9136e2ec2"><enum>(D)</enum><text>staffing levels for adjudications;</text></subparagraph><subparagraph id="id4a60f7aba2cf48ec8bfe64e6f00dbf88"><enum>(E)</enum><text>the percentage of applications processed in conformity with U.S. Citizenship and Immigration Services processing goals;</text></subparagraph><subparagraph id="id683a0c6c07cb49218ad1f278178c1898"><enum>(F)</enum><text>each instance in which the processing time of more than 10 percent of adjudications in any single category of immigration benefits surpasses the agency’s stated processing goal as of January 1, 2026;</text></subparagraph><subparagraph id="id41d62768dd77442983cc5ae6cfd6b9cd"><enum>(G)</enum><text>each instance in which the processing time of more than 5 percent of applications for lawful permanent residence surpasses 150 days; and</text></subparagraph><subparagraph id="idfeeb9fd458514e4a984882dd234202d7"><enum>(H)</enum><text>each instance in which the processing time of more than 5 percent of applications for naturalization surpasses 150 days.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title style="OLC" id="id511BADB0804F49588A0D62F7CA5A0F67"><enum>III</enum><header>Building community trust</header><section id="id60b731714c3041d9953c66c7f6d72a3c"><enum>301.</enum><header>Protecting aliens who are victims of or witnesses to crimes or are defending civil rights</header><subsection id="id79f7915dedd54bfbb8d884c6ebf4a42b"><enum>(a)</enum><header>In general</header><text>The Director of U.S. Immigration and Customs Enforcement shall ensure, except as provided in subsection (b), that removal is not effectuated, removal proceedings are not initiated, and expedited removal is not invoked against any alien who is known to be—</text><paragraph id="id32926220e58044609655a958bdb4f8c0"><enum>(1)</enum><text>a victim of domestic violence, human trafficking, or any other serious crime;</text></paragraph><paragraph id="id49bcc70e21664d938ed0b9ce8324a8cd"><enum>(2)</enum><text>a witness involved in a pending criminal investigation or prosecution at the Federal, State, local, or Tribal level;</text></paragraph><paragraph id="idc29ac3359f344fb5a03eaa8688ac25e9"><enum>(3)</enum><text>a plaintiff in a nonfrivolous lawsuit regarding violations of his or her civil rights, including with respect to union organizing and employment discrimination, as described in the memorandum of the U.S. Immigration and Customs Enforcement entitled <quote>Prosecutorial Discretion: Certain Victims and Witnesses of Exploitative Labor Practices</quote> issued on January 23, 2023;</text></paragraph><paragraph id="id5ecbdbd3a6f44117a33a9a6e20b5100f"><enum>(4)</enum><text>a recipient of deferred action related to worksite enforcement, as described in the memorandum of the Department of Homeland Security entitled <quote>Worksite Enforcement: The Strategy to Protect the American Labor Market, the Conditions of the American Worksite, and the Dignity of the Individual</quote> issued on October 12, 2021; or</text></paragraph><paragraph id="id9283c5c93d8949dd993e5ace84cbff5c"><enum>(5)</enum><text>actively engaged in an activity related to the preservation of his or her employment, housing, or other legally protected rights.</text></paragraph></subsection><subsection id="id6A2C3DAAB60346F1B4813852EB145678"><enum>(b)</enum><header>Exceptions</header><paragraph id="idFA9B1BB2F6C64A28B6015462948CAC82"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), an alien described in such subsection may be subject to removal proceedings if the Secretary of Homeland Security determines, on a case-by-case basis, that there is sufficient evidence to conclude that the alien—</text><subparagraph id="id5A8B139647324905AF7D04024B4ED3E0"><enum>(A)</enum><text display-inline="yes-display-inline">has been convicted of a serious crime;</text></subparagraph><subparagraph id="id47D0FA7A3A224E53811CD8F8C08BB680"><enum>(B)</enum><text display-inline="yes-display-inline">poses an individualized threat to any person or public safety;</text></subparagraph><subparagraph id="id7C616FB3AD084549B97E7307E95F6000"><enum>(C)</enum><text display-inline="yes-display-inline">has engaged in serious violations of human rights;</text></subparagraph><subparagraph id="id11EDEB9A48ED4E559BB6A2F9ECAA2889"><enum>(D)</enum><text display-inline="yes-display-inline">is complicit in significant immigration fraud; or</text></subparagraph><subparagraph id="idFE2A21B6F1E34A928607D01A0FE3A160"><enum>(E)</enum><text>has filed a claim in bad faith with intent to delay or avoid the removal of an alien.</text></subparagraph></paragraph><paragraph id="idFCD4466CF9184957963E41E46C3A085A"><enum>(2)</enum><header>Savings provision</header><text>Nothing in this subsection may be construed to deny any alien who has been a victim of domestic violence, human trafficking, or certain other crimes from receiving the immigration benefits to which he or she is entitled under the Violence Against Women Act of 1994 (title IV of <external-xref legal-doc="public-law" parsable-cite="pl/103/322">Public Law 103–322</external-xref>), the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7101">22 U.S.C. 7101 et seq.</external-xref>), or any other applicable law.</text></paragraph></subsection><subsection id="id67e5576993ab4e99819e68fa9caee829"><enum>(c)</enum><header>Effect of violation</header><text>With respect to a removal proceeding commenced as a result of an enforcement action carried out in violation of subsection (a)—</text><paragraph id="id3008106a12a84568953c05d5b6aa035c"><enum>(1)</enum><text>information resulting from such enforcement action may not be entered into the record of proceeding or received into evidence;</text></paragraph><paragraph id="id79d6248d750c47d5bff5401255d2677a"><enum>(2)</enum><text>the alien who is the subject of the removal proceeding may file a motion for the immediate termination of the removal proceeding; and</text></paragraph><paragraph id="id8751be004fe04683b313145eeb3cc5e5"><enum>(3)</enum><text>in considering whether to administratively close the removal proceeding, the immigration judge shall give appropriate weight to the circumstances of such enforcement action.</text></paragraph></subsection><subsection id="id4fd5b7b44978475a884dc320f8ebce93"> <enum>(d)</enum> <header>Presumption of non-Detention</header> <text>There shall be a presumption of nondetention for individuals described in subsection (a). Such presumption shall not apply if the Secretary of Homeland Security, the Commissioner of U.S. Customs and Border Protection, the Director of U.S. Immigration and Customs Enforcement, or an immigration judge specifically determines that the alien is a threat to himself or herself, the public, or national security.</text>

                    <enum>(e)</enum>
                    <header>Report</header>
 <text>The Secretary of Homeland Security shall submit a semiannual report to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="SSAP00">Committee on Appropriations of the Senate</committee-name> the <committee-name committee-id="HJU00">Committee on the Judiciary of the House of Representatives</committee-name>, and the <committee-name committee-id="HAP00">Committee on Appropriations of the House of Representatives</committee-name> that identifies, for the most recent 180-day period for which such data is available, the number of arrests, detentions, and removals of aliens described in subsection (a).</text>
 </subsection></section><section id="idCD77632610BA4EADB277D032EA72D765"><enum>302.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or in the amendments made by this Act, may be construed to modify—</text><paragraph id="id598C2003BA4742D88E3688FD2BAAB2A6"><enum>(1)</enum><text display-inline="yes-display-inline">the applicability of any ground of inadmissibility or deportability relating to criminal convictions; or</text></paragraph><paragraph id="id5FCE243A6A814C819C6FB54FCE1A595D"><enum>(2)</enum><text display-inline="yes-display-inline">the eligibility criteria relating to criminal convictions for any application or form of relief under the immigration laws.</text></paragraph></section></title></legis-body></bill>
