which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prevent the distribution of intimate visual depictions without consent.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Rampant Online Technological Exploitation and Criminal Trafficking Act of 2026</short-title></quote> or the <quote><short-title>PROTECT Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id1d404ee5ce6249cab5e4a1b028faa8c5"><enum>2.</enum><header>Regulating the uploading of pornographic images to online platforms</header><subsection commented="no" display-inline="no-display-inline" id="id7fee8aa4f6f4465b8f8e1ebd63f581ee"><enum>(a)</enum><header display-inline="yes-display-inline">Amendment to title 18, United States Code</header><paragraph commented="no" display-inline="no-display-inline" id="id0365233be2624c4ebf2f20879683eb44"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/2257A">section 2257A</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id013aab170b7544faa2dba3b58180029c"><section id="ida3d5f0b5f8f84bc0ad2082bb8ea1fc50"><enum>2257B.</enum><header>Uploading pornographic images to online platforms</header><subsection id="id0af1915ba10e49928c20ae958313583e"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ida174a39447964b66a6c40d488c2475e5"><enum>(1)</enum><header>Consent</header><text>The term <term>consent</term> has the meaning given the term in section 223(h) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223(h)</external-xref>).</text></paragraph><paragraph id="id64a74cd1b6b24543a7b0a64ad98c963f"><enum>(2)</enum><header>Covered platform</header><subparagraph id="idacd2dab674e24a64a70cb17901c1a95f"><enum>(A)</enum><header>In general</header><text>The term <term>covered platform</term> means a website, online service, online application, or mobile application—</text><clause id="ida61d0e9ec2634a53b528d37f04db3984"><enum>(i)</enum><text>that serves the public; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id163ef23e988b459f9bdcfa31f007918a"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id519193cef626401d965237d89756a1f7"><enum>(I)</enum><text display-inline="yes-display-inline">that primarily provides a forum for user-generated content, including messages, videos, images, games, and audio files; or</text></subclause><subclause id="id29f95ba3d1974a7da39625479732ade8" indent="up1"><enum>(II)</enum><text>for which it is in the regular course of trade or business of the website, online service, online application, or mobile application to publish, curate, host, or make available intimate visual depictions.</text></subclause></clause></subparagraph><subparagraph id="id54b33a09703e4665ad413ef777c5a6a8"><enum>(B)</enum><header>Exclusions</header><text>The term <term>covered platform</term> does not include—</text><clause id="id007c0cc96b6f4228a3aa80739cde64e4"><enum>(i)</enum><text>broadband internet access service, as described in section 8.1(b) of title 47, Code of Federal Regulations, or any successor regulation;</text></clause><clause id="id8a8c4923dde94460b8e7e4852aff41e5"><enum>(ii)</enum><text>electronic mail; or</text></clause><clause id="idf085b1e94c1842519ec3404ad7d94ad9"><enum>(iii)</enum><text>except as provided in subparagraph (A)(ii)(II), a website, online service, or application—</text><subclause commented="no" display-inline="no-display-inline" id="id57e128856e5f478b8712e63e3d99547b"><enum>(I)</enum><text display-inline="yes-display-inline">that consists primarily of content that is not user-generated and is preselected by the provider of the website, online service, or application; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida636b23b15d94c92a0f2f58a91ede508"><enum>(II)</enum><text display-inline="yes-display-inline">for which any chat, comment, or interactive functionality is incidental to, directly related to, or dependent on the provision of the content described in subclause (I).</text></subclause></clause></subparagraph></paragraph><paragraph id="id924d6d7717424dbcacd45dd773b705ad"><enum>(3)</enum><header>Intimate visual depiction</header><text>The term <term>intimate visual depiction</term> means any visual depiction—</text><subparagraph id="id83e5e4ebc7a64ac4ad023d49b4476d19"><enum>(A)</enum><text>of an individual who is reasonably identifiable from the visual depiction itself or information displayed in connection with the visual depiction, including through—</text><clause id="id655485B95DDE438D8D70CE0E36439285"><enum>(i)</enum><text>facial recognition;</text></clause><clause id="idDC857EF23A754C7C804F3175A4DB46A8"><enum>(ii)</enum><text>an identifying marking on the individual, including a birthmark or piercing;</text></clause><clause id="id89CC7023CF984728854904F2054F547F"><enum>(iii)</enum><text>an identifying feature of the background of the visual depiction;</text></clause><clause id="idE9C4E1958FCC4F02A5A07C896DE3C00B"><enum>(iv)</enum><text>voice matching; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idC602C23F3D534EFF830BE5B6F34987A6"><enum>(v)</enum><text>written confirmation from an individual who is responsible, in whole or in part, for the creation or development of the visual depiction; and</text></clause></subparagraph><subparagraph id="idb73510053a454c69a10096c8265262cc"><enum>(B)</enum><text>in which—</text><clause id="idfea3928fc13e489fbaa318109813b93c"><enum>(i)</enum><text>the individual depicted is engaging in sexually explicit conduct; or</text></clause><clause id="id5a21a5da9ad846b4b23bcd33d3589a00"><enum>(ii)</enum><text>the naked genitals, anus, pubic area, or post-pubescent female nipple of the individual depicted are visible.</text></clause></subparagraph></paragraph><paragraph id="idda8c9190608e458b92f95093a71d58db"><enum>(4)</enum><header>Pornographic image</header><text>The term <term>pornographic image</term> means—</text><subparagraph id="id373cd449122a42ccb16a341cdeead918"><enum>(A)</enum><text>any visual depiction of actual or feigned sexually explicit conduct; or</text></subparagraph><subparagraph id="idd52060733205497299ca8099a0bcf149"><enum>(B)</enum><text>any intimate visual depiction.</text></subparagraph></paragraph><paragraph id="ida9501cfe6a5a4eb1aaed69d978073ad1"><enum>(5)</enum><header>User</header><subparagraph commented="no" display-inline="no-display-inline" id="id0794e9d55e124e16b6782f155f749189"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The term <term>user</term> means an individual who is an information content provider, as defined in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>).</text></subparagraph><subparagraph id="iddf8dcd4ee3f34d70a267954e57ec2dc5" commented="no"><enum>(B)</enum><header>Clarification</header><text>For purposes of subparagraph (A), the term <term>information</term> within the definition of the term <term>information content provider</term> in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>) shall be construed to include pornographic images.</text></subparagraph></paragraph></subsection><subsection id="id03ca6f221eb44f78a3698b3ce21033d0"><enum>(b)</enum><header>Verification obligations of covered platform providers</header><paragraph id="ide6ea36d13d554b93b51f4b3263540cf0"><enum>(1)</enum><header>Verification of users</header><subparagraph id="id586e709f77a0433fb8afe502783a643a"><enum>(A)</enum><header>In general</header><text>A provider of a covered platform may not upload or allow a user to upload a pornographic image to the covered platform unless the provider has verified, in accordance with subparagraph (B)—</text><clause id="id1e9af7fca9b64a3b99d27635ff426cf7"><enum>(i)</enum><text>the identity of the user; and</text></clause><clause id="ide7afc680f20c4c6c9760ddf9d61a2819"><enum>(ii)</enum><text>that the user is not less than 18 years old.</text></clause></subparagraph><subparagraph id="ida646571c179c4d539502fe239d63cea6"><enum>(B)</enum><header>Means of compliance</header><text>In carrying out subparagraph (A), a provider of a covered platform shall verify the identity and age of a user by—</text><clause id="id41f81d451d274a0e9f81fe49b40c7a9f"><enum>(i)</enum><text>requiring use of an adult access code or adult personal identification number;</text></clause><clause id="idd14260bf437e4e8eb8ff44582fda1d11"><enum>(ii)</enum><text>accepting a digital certificate that verifies age; or</text></clause><clause id="iddf78cd10e5b14ea39ceb99ca36c77981"><enum>(iii)</enum><text>using any other reasonable measure of age verification that the Attorney General has determined to be feasible with available technology.</text></clause></subparagraph><subparagraph id="id76c6b957e8194ec5ae7a464ec3bf76af"><enum>(C)</enum><header>Insufficient user confirmation</header><text>Merely requiring a user to confirm that the user is not less than 18 years of age, without independent means of verification, shall not satisfy the requirement under subparagraph (A).</text></subparagraph></paragraph><paragraph id="id9605f55115c24c82b2ea0d1447c698a0"><enum>(2)</enum><header>Verification of participants</header><subparagraph id="id785c83f1fc8440339c6a449ea70fda0d"><enum>(A)</enum><header>In general</header><text>A provider of a covered platform may not upload or allow a user to upload a pornographic image to the covered platform unless the provider has verified, in accordance with subparagraph (B), that each individual appearing in the pornographic image—</text><clause id="id254471761910417e86b792179651986a"><enum>(i)</enum><text>was not less than 18 years of age when the pornographic image was created;</text></clause><clause id="id6dcfe46a6dc149608c98cce41aa623a4"><enum>(ii)</enum><text>has provided explicit written evidence of consent for each sex act in which the individual engaged during the creation of the pornographic image; and</text></clause><clause id="id8a09aedd0c8c44ec96103075ef18fa12"><enum>(iii)</enum><text>has provided explicit written consent for the distribution of the specific pornographic image.</text></clause></subparagraph><subparagraph id="id215dfca8cfe84b9aa79cde963ff1e46d"><enum>(B)</enum><header>Separate consent for sex act and for distribution of image</header><clause id="id5124861B242445F39F6584C68913899A"><enum>(i)</enum><header>Consent for sex act</header><text>Consent described in clause (ii) of subparagraph (A) does not imply or constitute evidence of consent described in clause (iii) of that subparagraph.</text></clause><clause id="idE3EDD2FC1D824CB090D934F4B5EB6A23"><enum>(ii)</enum><header>Consent for distribution of image</header><text>Consent described in clause (iii) of subparagraph (A) does not imply or constitute evidence of consent described in clause (ii) of that subparagraph.</text></clause></subparagraph><subparagraph id="id8bcef34cee1b420b92122f319431c02a"><enum>(C)</enum><header>Means of compliance</header><text>In carrying out subparagraph (A), a provider of a covered platform shall obtain, either from the user seeking to upload the pornographic image or through other means—</text><clause id="id7a15168eb6b6408595a770738a90db1f"><enum>(i)</enum><text>a consent form created or approved by the Attorney General under subparagraph (D) from each individual appearing in the pornographic image that includes—</text><subclause id="id22c2ed51a7f74915a19a00a72596de92"><enum>(I)</enum><text>the name, date of birth, and signature of the individual;</text></subclause><subclause id="id02f40f428bae4dcb96d65e07f5b7f4ce"><enum>(II)</enum><text>a statement that the individual is not less than 18 years of age, unless no reasonable person could conclude that the individual is less than 30 years of age;</text></subclause><subclause id="id09071257f75f403cae81c796c52d028a"><enum>(III)</enum><text>a statement that the consent is for distribution of the specific pornographic image;</text></subclause><subclause id="idb8d7fbac0ffa49639028d7098301169b"><enum>(IV)</enum><text>the geographic area and medium, meaning online, print, or other distribution method, for which the individual provides consent to distribution of the pornographic image;</text></subclause><subclause id="idf3bbca45b4de46fe962251d9dd617aaa"><enum>(V)</enum><text>the duration of time for which the individual provides consent to distribution of the pornographic image;</text></subclause><subclause id="id0aaca00c02ea4c00b547080477cb0f1d"><enum>(VI)</enum><text>a list of the specific sex acts that the person agrees to engage in for the pornographic image; and</text></subclause><subclause id="id9cc761d8fe294006a766e09c211068ea"><enum>(VII)</enum><text>a statement that explains coerced consent and that the individual has the right to withdraw the individual’s consent at any time; and</text></subclause></clause><clause id="idd72d005f3ffc4108a1072a0a92f57119"><enum>(ii)</enum><text>not less than 1 form of valid identification for each individual appearing in the pornographic image—</text><subclause id="id16e6afa57afd41d3b567b17c5f455ec5"><enum>(I)</enum><text>that—</text><item id="id2f65ddb729884546b633d448592a429b"><enum>(aa)</enum><text>was issued by an agency of the Federal Government or of a State, local, or foreign government; and</text></item><item id="idbe98048a3e7c43c39c220c86b1f6a738"><enum>(bb)</enum><text>contains the name, date of birth, signature, and photograph of the individual; and</text></item></subclause><subclause id="id49d0db147c2b4527b6f8c95d3e550f3a"><enum>(II)</enum><text>on which the name, date of birth, and signature of the individual match the name, date of birth, and signature of the individual on the consent form required under clause (i).</text></subclause></clause></subparagraph><subparagraph id="id2b1685ff8f9b4e6a9a46a3d725c62159"><enum>(D)</enum><header>Creation and approval of consent forms by Attorney General</header><clause id="id903efa01dd6d4b59b76eca1ff3a26e05"><enum>(i)</enum><header>Attorney General consent form</header><subclause id="id75b7d0d3952443cabd0f1377c126bc65"><enum>(I)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of the <short-title>Preventing Rampant Online Technological Exploitation and Criminal Trafficking Act of 2026</short-title>, the Attorney General shall create and make available to the public a consent form for purposes of subparagraph (C)(i).</text></subclause><subclause id="ida33a33f583804aba82edffbb96e8e3f7"><enum>(II)</enum><header>Availability</header><text>On and after the date that is 90 days after the date of enactment of the <short-title>Preventing Rampant Online Technological Exploitation and Criminal Trafficking Act of 2026</short-title>, a provider of a covered platform shall make the consent form created under subclause (I) available to users in both written and electronic format.</text></subclause></clause><clause id="id702190a3153b4a6d96e09ce4d085feba"><enum>(ii)</enum><header>Approval of alternative consent forms</header><text>For purposes of subparagraph (C)(i), a user may submit to a covered platform an alternative consent form created by a user or the provider of the covered platform if the alternative consent form has been approved by the Attorney General.</text></clause></subparagraph></paragraph><paragraph id="id3040f966780b4f32b64c6a1cfa7f0d2e"><enum>(3)</enum><header>Effective date; applicability</header><text>This subsection shall—</text><subparagraph id="id39c5357810c94d0790519ca40db3a20b"><enum>(A)</enum><text>take effect on the date that is 90 days after the date of enactment of the <short-title>Preventing Rampant Online Technological Exploitation and Criminal Trafficking Act of 2026</short-title>; and</text></subparagraph><subparagraph id="id5e36eef7b7fd43c283ff7ba5834ff6f5"><enum>(B)</enum><text>apply to any pornographic image uploaded to a covered platform before, on, or after that effective date.</text></subparagraph></paragraph><paragraph id="id1441caedddb344489f8fa039633992a7"><enum>(4)</enum><header>Rules of construction</header><subparagraph id="id51013f37c6724632adb93cb758b5441d"><enum>(A)</enum><header>Obligations and criminal liability under other laws</header><text>Nothing in this subsection shall be construed to—</text><clause id="idD4BAB229D67D444F9D6C181B8832C538"><enum>(i)</enum><text>affect any obligation of a provider of a covered platform under any other provision of Federal or State law; or</text></clause><clause id="id9F0843FCED244B65B29EA0E5A6FE75FA"><enum>(ii)</enum><text>impact or otherwise limit the criminal liability of a user or other individual under a Federal or State obscenity law.</text></clause></subparagraph><subparagraph id="id3d02936cf66e4e4f9382b0c386794e55" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>First Amendment-protected speech</header><text>Nothing in this subsection shall be construed to prohibit or impose a prior restraint on speech that is protected by the First Amendment to the Constitution of the United States.</text></subparagraph></paragraph></subsection><subsection id="idddf657fee9a04c32ad092823a24815df"><enum>(c)</enum><header>Obligations of users</header><paragraph id="idbffa566d1d634fe8b65dec77e5d443ff"><enum>(1)</enum><header>Consent requirement</header><text>A user of a covered platform may not upload a pornographic image of an individual to the covered platform without the consent of the individual.</text></paragraph><paragraph id="id981570e9610a4c24b26a5e01c167b512" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Determination of consent</header><text>For purposes of paragraph (1), whether an individual has provided consent to the uploading of an image shall be determined in accordance with this section and applicable State law.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id567dae02cd7e4981b20cf5a43d73931f"><enum>(d)</enum><header display-inline="yes-display-inline">Civil enforcement</header><paragraph id="id8c7ddb0ee92a44f6ab79b893b3f66c1d"><enum>(1)</enum><header>Verification obligations of providers of covered platforms</header><subparagraph id="id73d18c2a5cbd4c4986b51841e2f4f6ae"><enum>(A)</enum><header>Civil penalty for failure to verify users</header><clause id="idf96ad04423084060b5b8c6756d5be398"><enum>(i)</enum><header>In general</header><text>The Attorney General may impose a civil penalty on any provider of a covered platform that violates subsection (b)(1) in an amount of not more than $10,000 for each day during which a pornographic image remains on the covered platform in violation of that subsection, beginning 24 hours after the Attorney General provides notice of the violation to the provider.</text></clause><clause id="idF2415F82A9B24B2D943FD6704542CD89"><enum>(ii)</enum><header>Per-day and per-image basis</header><text>A civil penalty under clause (i) shall accrue on a per-day and per-image basis.</text></clause><clause id="idd25a0c42e10b47148b4a87c0b4ad9971"><enum>(iii)</enum><header>Use of proceeds</header><text>Notwithstanding section 3302 of title 31, the Attorney General may use the proceeds from a civil penalty collected under clause (i) of this subparagraph to carry out enforcement under this subparagraph.</text></clause></subparagraph><subparagraph id="ida270f18ceb3848638ec7c5e8b1d16261"><enum>(B)</enum><header>Civil liability for failure to verify participants</header><text>If a provider of a covered platform violates subsection (b)(2) with respect to a pornographic image, any person aggrieved by the violation may bring a civil action against the provider in an appropriate district court of the United States for damages in an amount equal to the greater of—</text><clause id="id2bceeb18f8c74c388fbebb6545cc5497"><enum>(i)</enum><text>$10,000 for each day during which a pornographic image remains on the covered platform in violation of that subsection, calculated on a per-day and per-image basis; or</text></clause><clause id="idb929126a17de4b6e94cbf4fc65fadba9"><enum>(ii)</enum><text>actual damages.</text></clause></subparagraph></paragraph><paragraph id="idd75c4c3405414789a90a80e3d37179b5"><enum>(2)</enum><header>Civil liability for violation of user obligations</header><text>If a user of a covered platform violates subsection (c) with respect to a pornographic image, any person aggrieved by the violation may bring a civil action against the user in an appropriate district court of the United States for damages in an amount equal to the greater of—</text><subparagraph id="idb324620d2b9b44f389e9d511bccb2820"><enum>(A)</enum><text>$10,000 for each day during which the pornographic image remains on the covered platform in violation of that subsection, calculated on a per-day and per-image basis; or</text></subparagraph><subparagraph id="idd3bf9a48c2394fffb94b8a801a204244"><enum>(B)</enum><text>actual damages.</text></subparagraph></paragraph><paragraph id="id4ac0861c5cc14e6683f8b8de1ce83e4a" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Relation to Communications Decency Act</header><text>Nothing in this subsection shall be construed to affect section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfc44925f9c5143f7873245c6e4cc4fc2"> <enum>(e)</enum> <header>Criminal penalties</header> <paragraph commented="no" display-inline="no-display-inline" id="id52a795d32e504bfe86ad9a8240837d7e"> <enum>(1)</enum> <header display-inline="yes-display-inline">Initial violation</header> <text display-inline="yes-display-inline">Any person who violates this section shall be imprisoned for not more than 5 years, fined in accordance with this title, or both.</text>
                                </paragraph>
                                <paragraph commented="no" display-inline="no-display-inline" id="ide785fd112242415ba9526c9e08d207ac">
                                    <enum>(2)</enum>
                                    <header>Subsequent violations</header>
 <text display-inline="yes-display-inline">Any person who violates this section after having been convicted of a violation punishable under this section shall be imprisoned for not less than 2 years and not more than 10 years, fined in accordance with this title, or both.</text>
                                </paragraph>
 </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1d6aff489eb4dd98af2d2773d52ef21"><enum>(2)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/2257A">section 2257A</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id323b9352571c4920955d908dc4216f79"><toc><toc-entry level="section" bold="off">2257B.
