<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5128</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260723">July 23, 2026</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself and <cosponsor name-id="S412">Mr. Tuberville</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the award of Federal education funds to educational institutions and agencies that do not allow for religious exemptions to vaccination requirements, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guaranteeing Religious Accommodation in Childhood Education Act</short-title></quote> or the <quote><short-title>GRACE Act</short-title></quote>.</text></section><section id="id12636ddcc4b744b597b3e27037f6065f"><enum>2.</enum><header>Prohibition on award of Federal education funds to certain educational institutions and agencies</header><subsection commented="no" display-inline="no-display-inline" id="id3d7896ae81fb422292aad32d44719767"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No Federal education funds may be made available to an educational institution or agency that has a vaccination requirement, unless such institution or agency maintains a policy under which—</text><paragraph commented="no" display-inline="no-display-inline" id="id666dac76062a439b97b3e41c3cc25921"><enum>(1)</enum><text display-inline="yes-display-inline">an individual may be exempted from such requirement if such individual (or their parent or guardian, in the case of an individual who is a child) asserts that receiving the vaccination would violate a sincerely held religious belief; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46e153f71951494480059d2fdce93a18"><enum>(2)</enum><text display-inline="yes-display-inline">no documentation or other information is required to be submitted by the individual (or their parent or guardian) to support the validity of such assertion.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9776eb8dd386481d8a1bc9b0ef895f64"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id50a5274d0d634b5cb91eb1b294308fff"><enum>(1)</enum><header>Child</header><text display-inline="yes-display-inline">The term <term>child</term> means an individual who has not attained the age of 18 years.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6366469dba6947e6be68c3fd24d11d36"><enum>(2)</enum><header>Educational institution or agency</header><text display-inline="yes-display-inline">The term <term>educational institution or agency</term> means an elementary school, secondary school, local educational agency, or State educational agency (as those terms are defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0bf3347d78944ded9fe2274e28144fd7"><enum>(3)</enum><header>Vaccination requirement</header><text display-inline="yes-display-inline">The term <term>vaccination requirement</term> means any requirement by an educational institution or agency that, as a condition for enrollment, attendance, participation in athletics or other student activities, or employment at the institution or agency, requires an individual to have received one or more vaccinations.</text></paragraph></subsection></section></legis-body></bill>
