<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5118</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260723">July 23, 2026</action-date><action-desc><sponsor name-id="S409">Mr. Luján</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of the Interior to meaningfully involve the public and State, Tribal, and local government officials prior to determining whether to offer certain parcels of land for oil or gas leasing, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H517827143F5B479CA6BACEC4E321A52F"><section section-type="section-one" id="H5F102C0EABDD47C0A341546B57AC6D6D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Input Act</short-title></quote>.</text></section><section id="HDED170ACE1D04A109D6C2426D9D76CCF"><enum>2.</enum><header>Requirement for meaningful involvement in leasing determinations</header><subsection id="HA23589E58D4D44BA845A1ACBB11830F5"><enum>(a)</enum><header>Meaningful involvement</header><paragraph id="HAA81179CAE554E5E8407B546283777E7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Prior to offering a parcel of land for oil or gas leasing under section 17 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226</external-xref>), the Secretary of the Interior shall meaningfully involve the public and State, Tribal, and local government officials in determining whether to offer that parcel for leasing under that section.</text></paragraph><paragraph id="H7285E35979C049CEAA149D5A69A4461C"><enum>(2)</enum><header>Minimum requirements</header><text display-inline="yes-display-inline">The meaningful involvement required under paragraph (1) for a parcel of land shall include, at a minimum—</text><subparagraph id="HF8C7888BBC2D409380C2C306719BDA2A"><enum>(A)</enum><text>public disclosure of—</text><clause id="H25299C6369DC47608706690F18974487"><enum>(i)</enum><text display-inline="yes-display-inline">the proposal to offer the parcel for leasing; and</text></clause><clause id="H71B5CEE652354B6BA7FD45A88EFDBB10"><enum>(ii)</enum><text display-inline="yes-display-inline">an analysis of the expected effects of offering the parcel for leasing on—</text><subclause id="HDF147DECD3DD4F18A9533B2926FF3BA5"><enum>(I)</enum><text display-inline="yes-display-inline">the surface and subsurface resources of the parcel; and</text></subclause><subclause id="HEE0235152EF94A74AB71F387AA84909F"><enum>(II)</enum><text>uses of the parcel other than uses for oil or gas activities, including any uses considered in a land use plan developed for the parcel under section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>);</text></subclause></clause></subparagraph><subparagraph id="H6687505783FE41718223CC89DC50BEEA"><enum>(B)</enum><text display-inline="yes-display-inline">an opportunity for the public to comment on the proposal; and</text></subparagraph><subparagraph id="H541FEC19D5964044A334D71F5DDE1992"><enum>(C)</enum><text display-inline="yes-display-inline">consideration of any input, including from—</text><clause id="H831B53080F4842D4940220AE35D27D81"><enum>(i)</enum><text>the public;</text></clause><clause id="HB1DA05868D9E4F73A1D40FFB0A28475A"><enum>(ii)</enum><text>State and local governments; and</text></clause><clause id="HC462608D9AE4424CB0BCCB01A01624A1"><enum>(iii)</enum><text>government-to-government consultation with federally recognized Indian Tribes.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="HE5CC827B17CD4F12B82CC24EEC9BE560"><enum>(b)</enum><header>Leasing determination</header><text display-inline="yes-display-inline">Based on the meaningful involvement required under subsection (a) for a parcel of land, the Secretary of the Interior may decide not to offer that parcel for oil or gas leasing under section 17 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226</external-xref>).</text></subsection></section></legis-body></bill>
