which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish consumer transparency and protection requirements for artificial intelligence chatbots, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Senior Chatbot Protection Act of 2026</short-title></quote>.</text></section><section id="idd28eff151681498bb2b409efe2f77ec0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id7a78a200b0cd4bc3b4dec13c9cecc2a0"><enum>(1)</enum><header>Artificial intelligence chatbot</header><text>The term <term>artificial intelligence chatbot</term>—</text><subparagraph id="id86adb48d20fa4dec906a5aa4c73efc8b"><enum>(A)</enum><text>means an interactive computer service or software application, including such a service or application made available through a website, mobile application, voice interface, avatar, connected device, or other user interface, that—</text><clause id="idbc260cb680af4ccb9c3c2b1cb1c92250"><enum>(i)</enum><text>generates prompts, responses, or other outputs that are not fully predetermined by the developer or operator of the service or application;</text></clause><clause id="idc50be6001ef8420d89978794576d44a9"><enum>(ii)</enum><text>accepts open-ended natural-language or multimodal user input; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb83a18ef154b4037a4510ba5d81b2767"><enum>(iii)</enum><text display-inline="yes-display-inline">produces adaptive or context-responsive output; and</text></clause></subparagraph><subparagraph id="id00135b7e61304a5b836066666e80b9f7"><enum>(B)</enum><text>does not include an interactive computer service or software application—</text><clause id="id37bec16c0fab47a191817046141778de"><enum>(i)</enum><text>the responses of which are limited to predetermined or contextualized replies; and</text></clause><clause id="id59cd55b0f4294befbf3733777f91d55b"><enum>(ii)</enum><text>that is unable to respond on a range of topics outside of a narrow specified purpose.</text></clause></subparagraph></paragraph><paragraph id="idd005ae4446104e3eb7cf3528fbd4d00e"><enum>(2)</enum><header>Affirmative consent</header><text>The term <term>affirmative consent</term> means, with respect to an artificial intelligence chatbot, a clear affirmative act signifying a user’s freely given, specific, informed, and unambiguous authorization for an act or practice—</text><subparagraph commented="no" display-inline="no-display-inline" id="id24e936fdcb4e4e8b992fe225b5472eb9"><enum>(A)</enum><text display-inline="yes-display-inline">that is in response to a specific request from a covered entity that—</text><clause id="id63235d07f0644d58a74250109e32dadc"><enum>(i)</enum><text>is provided to the user in a clear and conspicuous standalone disclosure; and</text></clause><clause id="ide4b4690cf659477980d2a10ddb527d4b"><enum>(ii)</enum><text>includes a description, written in easy-to-understand language, of the act or practice for which the user’s consent is sought; and</text></clause></subparagraph><subparagraph id="ide6462bcd6b6840e3bed0ac3430c43ba3"><enum>(B)</enum><text>in which—</text><clause commented="no" display-inline="no-display-inline" id="idb96530f529c74560a910a35b0116a45a"><enum>(i)</enum><text display-inline="yes-display-inline">the option to refuse to give consent is at least as prominent as the option to give consent;</text></clause><clause commented="no" display-inline="no-display-inline" id="id089a26b015e24cdd8586e65dfb4f4c8b"><enum>(ii)</enum><text display-inline="yes-display-inline">the option to refuse to give consent takes the same number of steps or fewer as the option to give consent; and</text></clause><clause id="id240d41db341149c9b4bf6f807980d4e5"><enum>(iii)</enum><text>affirmative consent to an act or practice is not inferred from the inaction of the user or the user’s continued use of the artificial intelligence chatbot.</text></clause></subparagraph></paragraph><paragraph id="id704eadb5f1a041688eb63ccfba514015"><enum>(3)</enum><header>Crisis</header><text>The term <term>crisis</term> means a situation in which a user expresses—</text><subparagraph id="id5fca014aa53249e49feccafbf534f581"><enum>(A)</enum><text>suicidal ideation, suicide planning, or intent to self-harm;</text></subparagraph><subparagraph id="id7042ad8af2624825be0e24c6b28bad1e"><enum>(B)</enum><text>intent to harm others;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf3fbc8fd30bf4ebda3ccd1054c8e2150"><enum>(C)</enum><text display-inline="yes-display-inline">an imminent threat to the safety of the user or another individual; or</text></subparagraph><subparagraph id="id4abbecdbdee14482ab3fc77877c3fca3"><enum>(D)</enum><text>a medical emergency requiring immediate professional assistance.</text></subparagraph></paragraph><paragraph id="idddd7da3b332f430baa8bc656052c8c14" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Crisis service provider</header><text>The term <term>crisis service provider</term> means an organization that provides immediate assistance to individuals experiencing mental health crises, suicidal ideation, or medical emergencies, including the 988 Suicide and Crisis Lifeline.</text></paragraph><paragraph id="ide7e9440aa916431da9e4eb0028e5f636"><enum>(5)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="idad59c9d5a26b4d969f2d4185bbafb466" commented="no"> <enum>(6)</enum> <header>Covered entity</header> <text>The term <term>covered entity</term> means any person that makes an artificial intelligence chatbot available to individuals in the United States, including by owning or operating such chatbot.</text>
 </paragraph><paragraph id="id6009c68277ab46fe9a6c53786fc5acbc"><enum>(7)</enum><header>High-stakes decision</header><subparagraph id="id1625307a06c4497fa37c42fc8877a020"><enum>(A)</enum><header>In general</header><text>The term <term>high-stakes decision</term> means a decision or course of action—</text><clause commented="no" display-inline="no-display-inline" id="ide26375bc7dfa48739b00aa14e31233b6"><enum>(i)</enum><text>involving a circumstance in which an individual makes a decision under uncertainty affecting the health, safety, financial security, or independence of the individual;</text></clause><clause commented="no" display-inline="no-display-inline" id="idce241a1aee354f2b8da2e9b2d26e613d"><enum>(ii)</enum><text display-inline="yes-display-inline">that may carry a significant or potentially irreversible consequence; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0c5d3c8a2ca84f4f9eb231e397e337b8"><enum>(iii)</enum><text>that is—</text><subclause commented="no" display-inline="no-display-inline" id="id55511ab539764df09e5f77ebe3198948"><enum>(I)</enum><text>a decision or course of action regarding whether to seek, initiate, discontinue, or materially alter health care, including mental and behavioral health care, medication, treatment, diagnostic testing, a care plan, or selection of a health care provider;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd94b859808114ea8b7436d59c1a03818"><enum>(II)</enum><text>a decision or course of action regarding estate planning, such as the drafting of a will, the creation of a trust, the granting of power of attorney, or the designation of beneficiaries;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc2e93024fc6b447fb1930915fcc600fb"><enum>(III)</enum><text>a decision or course of action regarding guardianship or conservatorship; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id3890c7d8dc404caaa1492086c0cafe98"><enum>(IV)</enum><text>a decision or course of action regarding the—</text><item commented="no" display-inline="no-display-inline" id="iddfaf27ffee93438baabfc520d6d90656"><enum>(aa)</enum><text display-inline="yes-display-inline">transfer, withdrawal, investment, or disposition of money or financial assets, including retirement assets; or</text></item><item commented="no" display-inline="no-display-inline" id="id7bc4b198a4934c28b5dd9d9d7cc85795"><enum>(bb)</enum><text display-inline="yes-display-inline">disclosure of financial, account, payment, or authentication information.</text></item></subclause></clause></subparagraph><subparagraph id="id3bdcea917ce9474d9fecf35c4da3d2bc"><enum>(B)</enum><header>Rulemaking authority</header><text>The Commission may, by rule, identify additional categories of decisions that constitute high-stakes decisions for purposes of this Act, provided that such categories—</text><clause id="id8c10b67b01cb459790f8ab331e2cad6f"><enum>(i)</enum><text>are limited to decisions that involve matters of comparable significance to those described in subparagraph (A); and</text></clause><clause id="idbee86f43e56e4989946e7890d4d5f0dc"><enum>(ii)</enum><text>present a heightened risk of harm to older adults.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61e58950450541239440eb5ee6529eb0"><enum>(8)</enum><header>Material adverse incident</header><text>The Commission, in consultation with the Director of the National Institutes of Health, may, by rule, define the term <term>material adverse incident</term>.</text></paragraph><paragraph id="idf0798417b17a437b86bbe0b4921e4216"><enum>(9)</enum><header>Older adult</header><text>The term <term>older adult</term> means an individual who has attained 65 years of age.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf509563437cc45418350ef4106133474"><enum>(10)</enum><header>Service provider</header><text>The term <term>service provider</term> means a person that processes information on behalf of a covered entity pursuant to a contractual arrangement and in accordance with the instructions of such covered entity.</text></paragraph><paragraph id="id0a1ba2e41ce7470fa738ffccee225cce"><enum>(11)</enum><header>User</header><text>The term <term>user</term> means an individual who interacts with an artificial intelligence chatbot.</text></paragraph></section><section id="id6e155df86aa94266ac110ecc172ed55c"><enum>3.</enum><header>Consumer protections for users</header><subsection id="idcf4148efc9ae4c4c866435a1163f4236"><enum>(a)</enum><header>Tiered disclosure and safety requirements</header><paragraph commented="no" display-inline="no-display-inline" id="idc0639ac3acfe42f1b9839d1a751add3f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each covered entity shall ensure that its artificial intelligence chatbot meets the following requirements:</text><subparagraph id="id05157dde23f54a37ab6c8652faef668b"><enum>(A)</enum><header>Baseline disclosure</header><text>An artificial intelligence chatbot shall—</text><clause id="id55e38d69b1ba4fb5a54ab4fb9f56efd1"><enum>(i)</enum><text>at the initiation of each conversation with a user and during any extended interaction, at reasonably regular intervals, clearly and conspicuously disclose to the user that the chatbot is an artificial intelligence chatbot and not a human being;</text></clause><clause id="id28d49e9234be4bdf87787b5ff26a08f7"><enum>(ii)</enum><text>not falsely represent that the chatbot is a human being or that a response is generated by a human being;</text></clause><clause commented="no" display-inline="no-display-inline" id="id625a47d882cb4c87b6e75c1523d5cc4a"><enum>(iii)</enum><text>not falsely represent that the chatbot is a licensed professional, including a therapist, physician, lawyer, financial advisor, or other licensed or certified professional, or that a response is generated by such a professional; and</text></clause><clause id="id3be55d74c78847519626221ce765b0b8"><enum>(iv)</enum><text>disclose, in a form and manner prescribed by the Commission, whether and under what circumstances the chatbot interaction is subject to human oversight or review.</text></clause></subparagraph><subparagraph id="idc51fba5a92594e25ac382e7a52bad6bc"><enum>(B)</enum><header>Detection of high stakes decisions</header><text>An artificial intelligence chatbot shall be designed and maintained using reasonable and appropriate methods to identify when a user is seeking or receiving guidance tailored to the circumstance of the user or another individual from the artificial intelligence chatbot concerning a high-stakes decision.</text></subparagraph><subparagraph id="id014b68e838de4055abd11612ac83ea30"><enum>(C)</enum><header>Disclosure regarding high-stakes decisions</header><text>If an artificial intelligence chatbot identifies that a user is seeking or receiving guidance tailored to the circumstance of the user or another individual concerning a high-stakes decision, such chatbot shall disclose that—</text><clause id="ida322bd17cc794a0b9504bae74be3de63"><enum>(i)</enum><text>it is not a licensed professional and does not provide medical, legal, financial, psychological, or other licensed and certified professional services;</text></clause><clause id="ide464e3c7017f4a6eaa82ea8e0b43c1c3"><enum>(ii)</enum><text>information provided by the chatbot should not be relied upon as the sole basis for making a high-stakes decision and should be verified with an appropriate trusted individual, caregiver, or licensed professional before taking action; and</text></clause><clause id="idf05a2b1e2c434b32bf2ac753d43904a8"><enum>(iii)</enum><text>the user’s conversation with such chatbot is not protected by attorney-client, physician-patient, psychotherapist-patient, or other professional privilege.</text></clause></subparagraph><subparagraph id="id964c3f90d0204492870403d0fa64ac7a"><enum>(D)</enum><header>Detection of user crisis</header><text>An artificial intelligence chatbot shall be designed and maintained using evidence-based methods for identifying reasonably apparent indicators of a crisis, consistent with evidence-based crisis intervention practices and applicable Federal guidance, including guidance issued by the National Institute of Standards and Technology under section 6 or guidance issued by other relevant Federal agencies.</text></subparagraph><subparagraph id="iddcc4e0478401499ca713ec897349c5de"><enum>(E)</enum><header>Disclosure and intervention regarding user crisis</header><text>If an artificial intelligence chatbot detects indicators of a crisis, such chatbot shall—</text><clause id="id95a353e2feac456c9a17d92992409d38"><enum>(i)</enum><text>refer the user, as appropriate, to emergency services, a human professional, or crisis service provider, including the 988 Suicide and Crisis Lifeline;</text></clause><clause id="id761e5450fe564ace9b294034e59c77d9"><enum>(ii)</enum><text>not provide advice to such user regarding—</text><subclause id="idb41397c4931448c6852d0be6f3fb9eef"><enum>(I)</enum><text>self-harm or suicide;</text></subclause><subclause id="ida22d61a5f90548d19ad2b47549b51c6e"><enum>(II)</enum><text>adjusting, discontinuing, or managing medication; or</text></subclause><subclause id="idba2077909ce9402fbfec485800c1b672"><enum>(III)</enum><text>managing a medical emergency without professional assistance;</text></subclause></clause><clause id="ida9110814ef744ce0897284d961d8c295"><enum>(iii)</enum><text>provide information that prioritizes referral to a crisis service provider or human professional support; and</text></clause><clause id="ida05655fc171c497590dbb5d1275755d2"><enum>(iv)</enum><text>not provide instructions or encouragement relating to self-harm, suicide, harm to others, medication changes, or management of a medical emergency without professional assistance.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e66fff3d7d941c7abe659de143873de"><enum>(F)</enum><header>Accessibility and usability</header><text>An artificial intelligence chatbot shall provide each disclosure required under this paragraph in a manner that is clear, accessible, readable, compatible with assistive technologies, and easy to understand, taking into consideration the needs of older adults.</text></subparagraph></paragraph><paragraph id="idd6ea86dc217e403ea088bffef88c293a"><enum>(2)</enum><header>Protocol publication</header><text>Each covered entity shall develop protocols to comply with this subsection and publish details of such protocols on the covered entity’s publicly accessible internet website.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61b06b66aab94b2fb859e75d6ed5ef57"><enum>(3)</enum><header>Training</header><text>Each covered entity shall train a machine learning or artificial intelligence model using any information about or provided by a user only if the user has provided affirmative consent authorizing such training.</text></paragraph></subsection><subsection id="id39a8d282edff4239a30a282a570ef061"><enum>(b)</enum><header>Data protection</header><paragraph id="id8614354e5e10492e9dfcf514a0c24b59"><enum>(1)</enum><header>In general</header><subparagraph commented="no" display-inline="no-display-inline" id="ide58029f5cb1c45459ce77dbc82ed555b"><enum>(A)</enum><header>Any conversation</header><text display-inline="yes-display-inline">Except as described in subparagraph (C), a covered entity shall not collect, process, transcribe, record, retain, or disclose a conversation with a user or data obtained from a conversation with a user, including through machine learning or artificial intelligence, unless necessary to—</text><clause commented="no" display-inline="no-display-inline" id="idb32a664f49a64abf9d0c9bbbe7d29ca3"><enum>(i)</enum><text display-inline="yes-display-inline">provide the artificial intelligence chatbot service requested by the user;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0bb61a4ffc3940349656b46302b7ec3b"><enum>(ii)</enum><text display-inline="yes-display-inline">comply with the requirements of this Act;</text></clause><clause commented="no" display-inline="no-display-inline" id="id7b48d834daa34cb3a2aec0ea14f9e40f"><enum>(iii)</enum><text display-inline="yes-display-inline">prepare reports required under section 4;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0f7015e098644ec391fd2175ddc13df4"><enum>(iv)</enum><text display-inline="yes-display-inline">protect against fraud, abuse, a security incident, or imminent harm; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id54c1e173291648b6a63bf28baf2f5500"><enum>(v)</enum><text display-inline="yes-display-inline">comply with other applicable law.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id110d505bce964b15a5824d3a22e67da1"><enum>(B)</enum><header>Service providers</header><text>A covered entity shall require any service provider that processes data obtained from a conversation on behalf of the covered entity to process such data only pursuant to written instructions and only for purposes permitted under subparagraph (A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idec5815a49f8f4b8e8a21fd87056a884a"><enum>(C)</enum><header>Affirmative consent for non-covered conversations</header><text>A covered entity may transcribe, record, retain, or disclose a conversation with a user that is not a covered conversation or data obtained from a conversation with a user that is not a covered conversation for purposes other than the purposes described in subparagraph (A) if such covered entity has obtained affirmative consent from such user prior to such transcription, recording, retention, or disclosure.</text></subparagraph><subparagraph id="id05b56059b0c64f709d36c9a0d276d227"><enum>(D)</enum><header>Covered conversations</header><text>In this paragraph, the term <term>covered conversation</term> means a conversation with a user and an artificial intelligence chatbot—</text><clause id="ida504fda7db24475bb5749b944f80dee7"><enum>(i)</enum><text>that involves a high-stakes decision; or</text></clause><clause id="id86227edef3b244f6984020d702bae44b"><enum>(ii)</enum><text>during which the artificial intelligence chatbot detects a crisis.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id642fba84e98f4ab2bb2b3b8f9a4ecc70"><enum>(2)</enum><header>Deletion of user conversation history</header><text>A covered entity shall provide each user with a clear and readily accessible ability to delete conversation history with an artificial intelligence chatbot.</text></paragraph></subsection><subsection id="id1ce3d5e8c6e6400d9b8e1af041ea9c7f"><enum>(c)</enum><header>Deceptive or manipulative interaction design practices</header><paragraph id="id96fbcb512f25486985eea72e34418c7e"><enum>(1)</enum><header>In general</header><text>Each covered entity shall take reasonable steps to prevent an artificial intelligence chatbot from employing deceptive or manipulative interaction design practices that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbbda5625d6054ddd820f9e02bbb30b65"><enum>(A)</enum><text display-inline="yes-display-inline">encourage excessive reliance on, or prolonged engagement with, such chatbot;</text></subparagraph><subparagraph id="id12125cd641ee4162963e31872692cec4"><enum>(B)</enum><text>take advantage of age-related cognitive limitations or impairments, including memory impairment, reduced executive function, or limitations related to social isolation;</text></subparagraph><subparagraph id="id35b1d53141b84d86b7244ee44ca12902"><enum>(C)</enum><text>discourage users from seeking assistance or support from family members, caregivers, licensed professionals, or other real-world relationships;</text></subparagraph><subparagraph id="idb02bab1677424cfb9fca4660106e246b"><enum>(D)</enum><text>encourage users to prioritize interactions with the chatbot over real-world relationships or activities;</text></subparagraph><subparagraph id="id2e4e51852be340afacf440ed6021dbe8"><enum>(E)</enum><text>persistently urge continued interaction after a user has attempted to end, pause, or disengage from a conversation; or</text></subparagraph><subparagraph id="id684fbd6089d548448dc2f3f9e10bdbb6"><enum>(F)</enum><text>use emotionally coercive language intended to create guilt, distress, or fear associated with ending or reducing interaction with the chatbot.</text></subparagraph></paragraph><paragraph id="id718f145782e247a58341ff1f45c28b5e"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to prohibit a covered entity from designing an artificial intelligence chatbot intended to reduce loneliness, support social connection, facilitate access to information, or provide benign companionship.</text></paragraph></subsection><subsection id="id55d3f3d86ff54adaa3ba4faa31ff37b3"><enum>(d)</enum><header>User understanding</header><text>Each covered entity shall take reasonable steps to ensure users understand the nature and limitations of artificial intelligence chatbots through clear disclosures, user interface design, and other appropriate measures.</text></subsection><subsection id="id7a5070dfdc6546faa4ca1033f55b5a8a"><enum>(e)</enum><header>Effective dates</header><paragraph id="idbe890b39918043a4bac9656ba55a61cb"><enum>(1)</enum><header>In general</header><text>Except as described in paragraph (2), this section shall take effect on the date that is 180 days after the date of enactment of this Act.</text></paragraph><paragraph id="id3b2719337a3149a5851957a32c6be450"><enum>(2)</enum><header>Crisis detection and response</header><text>Subparagraphs (D) and (E) of subsection (a)(1) shall take effect on the date that is 1 year after the date of enactment of this Act.</text></paragraph></subsection></section><section id="id0aed9f9bfb69476684c3061b25af3c80"><enum>4.</enum><header>Recordkeeping and incident information</header><subsection id="id9f77563fa34e4eb480e7bc20259f544c"><enum>(a)</enum><header>Reporting requirement</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, each covered entity shall submit to the Director of the National Institutes of Health and the Commission a report regarding material adverse incidents (as determined by the Commission) involving an artificial intelligence chatbot and a high-stakes decision or crisis.</text></subsection><subsection id="idffc3a9287f10452f8eb6b4a051d1e6c4"><enum>(b)</enum><header>Content of reports</header><text>Each report described in subsection (a) shall include, for the period covered by the report—</text><paragraph id="id2d7988272d074cbaa398d0d8cb2deab3"><enum>(1)</enum><text>the total number of material adverse incidents that occurred, disaggregated by—</text><subparagraph id="id05d5fbf06745473797f884d84eaf4343"><enum>(A)</enum><text>the type of material adverse incident;</text></subparagraph><subparagraph id="ida14fa0902b5a4b78808fc195b543a5b7"><enum>(B)</enum><text>subject to subsection (d), whether the affected user was—</text><clause id="id437af2b60a444fe495051fda8dfbb494"><enum>(i)</enum><text>younger than 50 years of age;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5cd4bf3aa71e42468174c8872e244ca9"><enum>(ii)</enum><text display-inline="yes-display-inline">50 to 64 years of age;</text></clause><clause id="id99beea691ba94b6da0c74a0abdf2c36e"><enum>(iii)</enum><text>65 to 74 years of age;</text></clause><clause id="idc0fe96be21574e13828526a5a71e023d"><enum>(iv)</enum><text>75 to 84 years of age; or</text></clause><clause id="id2ce4393c9e674443ac8e4da3fb107a58"><enum>(v)</enum><text>85 years of age or older; and</text></clause></subparagraph><subparagraph id="id0cd9fb873b51497d8d81d37c8f3438ad"><enum>(C)</enum><text>the outcome of any crisis response protocol, including—</text><clause id="id7d7ad91a5f844e11bacb6dd8ce289173"><enum>(i)</enum><text>whether the user was referred to a crisis service provider;</text></clause><clause id="id056dfb7e586449f592dc4c595f5f2803"><enum>(ii)</enum><text>to the extent known by the covered entity, whether the user completed the referral; and</text></clause><clause id="id09add0fc4b784433916e73f5e51924ac"><enum>(iii)</enum><text>any follow-up actions taken by the covered entity.</text></clause></subparagraph></paragraph><paragraph id="id4e2a4b4859da4da1a114774308245378"><enum>(2)</enum><text>a description of the crisis detection methods employed by the covered entity and any modifications made to such methods during the reporting period; and</text></paragraph><paragraph id="idb8d34639d7a24995b1f356b856c59a50"><enum>(3)</enum><text>any corrective actions taken by the covered entity in response to any material adverse incident.</text></paragraph></subsection><subsection id="idbfc9a321a5074bec8ad6a611f82462aa"><enum>(c)</enum><header>Reporting standards</header><text>By not later than 180 days after the date of enactment of this Act, the Commission, in consultation with the Director of the National Institutes of Health, shall prescribe standards for the format and submission of reports under this section, including how to ensure that the information submitted in such reports is limited to aggregate, anonymized, and operational metrics.</text></subsection><subsection id="idb4d248beec6a47a79f3bd1c3b71804b1"><enum>(d)</enum><header>Construction regarding age information</header><text>Nothing in this section shall be construed to require a covered entity to collect, infer, verify, or retain a user’s age solely for purposes of complying with this section. A covered entity shall provide the information described in subsection (b)(1)(B) only to the extent such information is already known to the covered entity in the ordinary course of business or voluntarily provided by the user.</text></subsection><subsection id="id4f888987d8a44610a3cae0fa5a40e6c7"><enum>(e)</enum><header>Public availability</header><text>The Commission and the Director of the National Institutes of Health shall jointly publish aggregate, de-identified data from reports submitted under subsection (a) on a publicly accessible internet website not less frequently than annually.</text></subsection></section><section id="id5f344b32e2c348c5bfbee5e67774d7a7"><enum>5.</enum><header>Enforcement</header><subsection id="ide38b0e66456c4fb0b643c1949373a47d"><enum>(a)</enum><header>Enforcement by the Commission</header><paragraph id="id8430c3bf2c784936b72248cfcebfc71d"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of section 3 or 4 shall be treated as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="id6a7a54bef1944808b9d9c25a101744a2"><enum>(2)</enum><header>Powers of the Commission</header><subparagraph id="ida7353185205c430cb6bb328b54e6ba0e"><enum>(A)</enum><header>In general</header><text>The Commission shall enforce sections 3 and 4 in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph id="idb3b2d9d89aed466a887787a3ded33769"><enum>(B)</enum><header>Privileges and immunities</header><text>Any covered entity that violates section 3 or 4, or a regulation promulgated thereunder, shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph id="id49601afcf128468487d74a33973fa5ce"><enum>(C)</enum><header>Authority preserved</header><text>Nothing in this Act shall be construed to limit the authority of the Commission under any other provision of law.</text></subparagraph></paragraph><paragraph id="idc44be5c6e8a2423c882e133d4011a218"><enum>(3)</enum><header>Opportunity to cure</header><subparagraph id="id6e00c1996b934d708c777cdcbde3809e"><enum>(A)</enum><header>In general</header><text>Before initiating an enforcement action for a first violation of section 3 or 4, the Commission shall provide the covered entity that is in violation—</text><clause commented="no" display-inline="no-display-inline" id="id190126b2bec74f7e98977a4f864fa7eb"><enum>(i)</enum><text display-inline="yes-display-inline">a written notice identifying the alleged violation; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idfee3c3b37cfb41f694b0d3f3f0fc0d85"><enum>(ii)</enum><text display-inline="yes-display-inline">60 days to cure such violation.</text></clause></subparagraph><subparagraph id="id7b1d6efc4dfe4d0c965cd220d3f6de01"><enum>(B)</enum><header>Effect of cure</header><text>If a covered entity that receives a notice described in subparagraph (A) cures the violation subject to such notice within the period described in such subparagraph and provides written certification that the violation has been cured and will not recur, the Commission may not seek civil penalties with respect to such violation.</text></subparagraph><subparagraph id="id303fa20c22a240a8a0880790ce402a8c"><enum>(C)</enum><header>Exceptions</header><text>Subparagraphs (A) and (B) shall not apply if the Commission determines that the violation—</text><clause id="id7e486ae08a894aa99916216fa9cc522a"><enum>(i)</enum><text>involved intentional deception;</text></clause><clause id="idd1720948bf8643c9aff7f1651fcdde94"><enum>(ii)</enum><text>created a substantial risk of imminent harm; or</text></clause><clause id="idcb6c0fd2cb2d4e34b3daba9e30f57dd4"><enum>(iii)</enum><text>constitutes a repeated or ongoing violation.</text></clause></subparagraph></paragraph></subsection><subsection id="ide1b795b9d5c34300bd4210c8df6856f7"><enum>(b)</enum><header>Civil penalties</header><text>In addition to any other penalties as may be prescribed by law, each knowing or reckless violation of section 3, or a regulation promulgated under section 3, shall be subject to a civil penalty not to exceed $50,000 for each such violation.</text></subsection><subsection id="iddaaee975f1fe47d296157ac836cd5fcf"><enum>(c)</enum><header>State enforcement</header><paragraph id="id839cf2ef15df402aad6c92235683afae"><enum>(1)</enum><header>In general</header><text>In any case in which the attorney general of a State has reason to believe that an interest of the residents of the State has been or is threatened or adversely affected by the engagement of a covered entity in an act or practice that violates section 3, or a regulation promulgated thereunder, the attorney general of the State may, as parens patriae, bring a civil action on behalf of the residents of the State in a district court of the United States of appropriate jurisdiction to—</text><subparagraph id="id74faf1d6f9d549229273a2c3b7c6ada3"><enum>(A)</enum><text>enjoin such act or practice;</text></subparagraph><subparagraph id="idf6dfe500eb6b47fbaca7d3c1ddfacc88"><enum>(B)</enum><text>enforce compliance with section 3 or a regulation promulgated thereunder;</text></subparagraph><subparagraph id="id9a36174297164e98bef92c79beebb8d8"><enum>(C)</enum><text>obtain damages, civil penalties, restitution, or other compensation on behalf of residents of the State; or</text></subparagraph><subparagraph id="idba102f4ad9b64168bde3396ff191d51a"><enum>(D)</enum><text>obtain such other legal or equitable relief as the court may consider to be appropriate.</text></subparagraph></paragraph><paragraph id="id0e40d89b0ed045e6800a6cb5641e6cf4"><enum>(2)</enum><header>Rights of the Commission</header><subparagraph id="id272ad1bdffa94911ad61eaa18812a1bf"><enum>(A)</enum><header>Notice to the Commission</header><clause id="idbf62a3209eb9499485cf5c6b73cd85fe"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (iii), before initiating a civil action under paragraph (1), the attorney general of a State shall notify the Commission in writing that the attorney general intends to bring such civil action.</text></clause><clause id="ida9734291e0c44167a0f57ca1e0492a2b"><enum>(ii)</enum><header>Contents</header><text>The notification required by clause (i) shall include a copy of the complaint to be filed to initiate the civil action.</text></clause><clause id="id13df1763afcb41b5847e2d76f4f8343c"><enum>(iii)</enum><header>Exception</header><text>If it is not feasible for the attorney general of a State to provide the notification required by clause (i) before initiating a civil action under paragraph (1), the attorney general shall notify the Commission immediately upon instituting the civil action.</text></clause></subparagraph><subparagraph id="id45780961d28e4325850566861be6c4c1"><enum>(B)</enum><header>Intervention by the Commission</header><text>Upon receiving the notice required by subparagraph (A)(i), the Commission may intervene in the civil action and, upon intervening—</text><clause id="idf380e895081d4fca8a4e62cb8e827467"><enum>(i)</enum><text>be heard on all matters arising in the civil action; and</text></clause><clause id="id9f06978f9e4c4144ac34a37c49b3f1fc"><enum>(ii)</enum><text>file petitions for appeal of a decision in the civil action.</text></clause></subparagraph></paragraph><paragraph id="id57e863332d9a486bb591474447db9b23"><enum>(3)</enum><header>Investigatory powers</header><text>Nothing in this subsection may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to conduct investigations, to administer oaths or affirmations, or to compel the attendance of witnesses or the production of documentary or other evidence.</text></paragraph><paragraph id="id9866450484f04854b50de442c4dd4fb6"><enum>(4)</enum><header>Limitation on State action while Commission action is pending</header><text>If the Commission has instituted a civil action for a violation of section 3, no State attorney general may bring a civil action under paragraph (1) during the pendency of that action against any defendant named in the complaint of the Commission for any violation of section 3 alleged in that complaint. Nothing in this paragraph shall be construed to prohibit a State attorney general from bringing or continuing an action under State law.</text></paragraph><paragraph id="ide68bffc7d37242d4b4cd2ebde5ec1316"><enum>(5)</enum><header>Venue; service of process</header><subparagraph id="id2793b9b89e254251bd33ef6b7e4463e4"><enum>(A)</enum><header>Venue</header><text>Any action brought under paragraph (1) may be brought in the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code.</text></subparagraph><subparagraph id="id3f83c9f64d3b476cba4ccebf21ebc960"><enum>(B)</enum><header>Service of process</header><text>In an action brought under paragraph (1), process may be served in any district in which the defendant—</text><clause id="id9b1b697303494b7cb30096a6e201a053"><enum>(i)</enum><text>is an inhabitant; or</text></clause><clause id="id9d82d4a53b6245cf9dd5a8d03dfbac55"><enum>(ii)</enum><text>may be found.</text></clause></subparagraph></paragraph><paragraph id="idb59285347ec24f4991197602401271d9"><enum>(6)</enum><header>Actions by other State officials</header><text>In addition to a civil action brought by an attorney general under paragraph (1), any other consumer protection officer of a State who is authorized by the State to do so may bring a civil action under paragraph (1), subject to the same requirements and limitations that apply under this subsection to a civil action brought by an attorney general.</text></paragraph></subsection><subsection id="id3d37c2e139a5433cbaa5d10184142d94"><enum>(d)</enum><header>Savings clause</header><text>Nothing in this Act or any regulation promulgated thereunder shall be construed to prohibit or otherwise affect the enforcement of any State law or regulation that is at least as protective of users as this Act and the regulations promulgated thereunder.</text></subsection></section><section id="id98d893f2557045cebe4af2542f8dd367"><enum>6.</enum><header>National Institute of Standards and Technology guidelines</header><subsection id="id34b16f0df56045fe8298327217a1a15c"><enum>(a)</enum><header>Development of voluntary guidelines</header><paragraph id="idf772a906ff874101a1b54e7c5d407231"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Director of the National Institute of Standards and Technology shall develop voluntary guidelines regarding artificial intelligence chatbots interacting with older adults.</text></paragraph><paragraph id="id0118af5bac2c4fa28837ce6c599237d8"><enum>(2)</enum><header>Elements</header><text>The voluntary guidelines developed under paragraph (1) may include guidance on—</text><subparagraph id="id50461e17d5114c12960af446407d251c"><enum>(A)</enum><text>transparency, disclosure, and user understanding practices for artificial intelligence chatbots interacting with older adults;</text></subparagraph><subparagraph id="id8a1f00b74c1d45d48535cd170519c1f6"><enum>(B)</enum><text>accessibility, usability, and age-appropriate design practices, including compatibility with assistive technologies;</text></subparagraph><subparagraph id="id57fe00f2a4b04ccea406814fef2c91cf"><enum>(C)</enum><text>evidence-based practices for identifying and responding to crisis, high-stakes decisions, including directing users to appropriate national, State, local, or Tribal crisis and professional resources, and identifying indicators of exploitative or manipulative interactive design practices; and</text></subparagraph><subparagraph id="id4db598c495934060a5f9399ae090eb73"><enum>(D)</enum><text>cybersecurity, fraud-prevention, and privacy safeguards for artificial intelligence chatbots handling sensitive user conversations or personal information.</text></subparagraph></paragraph></subsection><subsection id="idfd8f8e478f0446e4b37887ec1376265b"><enum>(b)</enum><header>Consideration by covered entities</header><text>Covered entities shall take into consideration, as appropriate, the guidelines developed under subsection (a)(1) in designing and deploying artificial intelligence chatbots.</text></subsection><subsection id="id69e10d8eb63a49a796b8d73098078976"><enum>(c)</enum><header>Relationship to existing frameworks</header><text>The Director of the National Institute of Standards and Technology may incorporate, reference, or adapt the guidelines developed under subsection (a)(1) in guidance, best practices, or other voluntary resources developed pursuant to section 22A of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278h-1">15 U.S.C. 278h–1</external-xref>).</text></subsection><subsection id="idf32da32d5e7641be87af4bbe340f4413"><enum>(d)</enum><header>Consultation requirement</header><text>In developing the guidelines under subsection (a)(1), the Director of the National Institute of Standards and Technology shall consult with—</text><paragraph id="id28042149f19f486596d73ba2cc8f948c"><enum>(1)</enum><text>the Chairperson of the Commission;</text></paragraph><paragraph id="idc4f6b065331544748fb54c0124b6379a"><enum>(2)</enum><text>the Director of the National Institute on Aging;</text></paragraph><paragraph id="id3042b71ddce349b3988dfc78d03c3373"><enum>(3)</enum><text>the Director of the National Institute of Mental Health;</text></paragraph><paragraph id="id2542d41c4423475d8e333b3c4adcca26"><enum>(4)</enum><text>representatives from industry;</text></paragraph><paragraph id="id7a95cabe58d24b538c73e3726ef7904e"><enum>(5)</enum><text>consumer advocates;</text></paragraph><paragraph id="id7160d020c1ad4abaae7651ed95c57263"><enum>(6)</enum><text>older adults, including older adults who have direct experience using artificial intelligence chatbots;</text></paragraph><paragraph id="id1e73613d841a41dba4835d79202e2555" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text>caregivers of older adults, including caregivers who have direct experience supporting older adults who use artificial intelligence chatbots; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf0de245c8ce44ea6b4252322005a2ecc"><enum>(8)</enum><text>experts in psychology, mental health, cognitive aging, lifespan development, disability, accessibility, and assistive technology.</text></paragraph></subsection></section><section id="id5d9da4cd8cce4bf5b6f7cefb28c16a0b"><enum>7.</enum><header>Rulemaking</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall promulgate rules—</text><paragraph id="idf6498578d9a04856b1bb605898b9b3ab"><enum>(1)</enum><text>describing the form, content, timing, and frequency of the disclosures required under section 3(a)(1);</text></paragraph><paragraph id="id238e56e5323f4ae69b3018b66fc70113"><enum>(2)</enum><text>providing example templates for the disclosures required under section 3(a)(1);</text></paragraph><paragraph id="id6a1872ae9b4e4a67a6c851de8d92ecd8"><enum>(3)</enum><text>describing the form and manner for the submission of reports required under section 4; and</text></paragraph><paragraph id="id4db0843d39ff465e88c81d44e7c79b08"><enum>(4)</enum><text>establishing such other requirements as the Commission considers necessary to carry out this Act, except for section 6.</text></paragraph></section><section id="id0ca8e31fc21b44ef90d378bf8277690b"><enum>8.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the application thereof to any person or circumstance, is held invalid, the remainder of this Act and the application of such provision to other persons not similarly situated or to other circumstances shall not be affected by the invalidation.</text></section><section id="idff810bdd027f4e08a2d3c43574e45155"><enum>9.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to preempt or otherwise affect any right, claim, remedy, presumption, or defense available at law or in equity, including under consumer protection, privacy, or civil rights laws.</text></section></legis-body></bill>
