<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5114</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260723">July 23, 2026</action-date><action-desc><sponsor name-id="S431">Mr. Curtis</sponsor> (for himself and <cosponsor name-id="S406">Mr. Kelly</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to include certain ridership forecasting methods in determinations of whether a project under the fixed guideway capital investment grants program is justified, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H6FD3A9B19C6746968F9B2AF2C1E753C6"><section section-type="section-one" id="H889F86E140B2431AB4D72236CB96D637"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Access to Transit in High-Growth Communities Act</short-title></quote> or the <quote><short-title>PATH Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HB03E656F14D4487E8D6B69E769036E13"><enum>2.</enum><header>Fixed guideway capital investment grants</header><text display-inline="no-display-inline">Section 5309 of title 49, United States Code is amended—</text><paragraph id="H39E041AD2E1A46CC8BE6FDF6D3FACCA2"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)(2)(B)—</text><subparagraph id="H161D31AC9BC4492AB0B87C7B317EE88F"><enum>(A)</enum><text>in clause (i), by striking <quote>recipient;</quote> and inserting <quote>recipient, which may include ridership forecasting methods that account for population density, population growth rate, and development planning activities as described in section 20005(b)(2) of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/49/5303">49 U.S.C. 5303</external-xref> note);</quote>; and</text></subparagraph><subparagraph id="HDB90483A739347A39A58F69765A60C30"><enum>(B)</enum><text>in clause (ii), by striking <quote>population density</quote> and all that follows through the period at the end and inserting <quote>population density or population growth rate, whichever population factor is most beneficial to ridership forecasting to the project, current public transportation ridership in the corridor, and development planning activities as described in section 20005(b)(2) of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/49/5303">49 U.S.C. 5303</external-xref> note).</quote>; and</text></subparagraph></paragraph><paragraph id="H445271ED27294AB3A29F992A8D25463D"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e)(2)(B)(i), by striking <quote>recipient;</quote> and inserting <quote>recipient, which may include ridership forecasting methods that account for population density, population growth rate, and development planning activities as described in section 20005(b)(2) of MAP–21 (<external-xref legal-doc="usc" parsable-cite="usc/49/5303">49 U.S.C. 5303</external-xref> note);</quote>.</text></paragraph></section></legis-body></bill>
