which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Leahy-Smith America Invents Act to limit intellectual property protection for plants, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFD5DF0C5547547CD861D106C2E4CF373"><section id="idfbabf9e944324f3ebc1108e8e11847fa" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fair Seeds for Farmers Act</short-title></quote>.</text></section><section id="HE771F4857280493597E223B097F9EA3B" section-type="subsequent-section"><enum>2.</enum><header>Limitation on intellectual property protection for plants</header><subsection commented="no" display-inline="no-display-inline" id="id34b03278a0984bc8a9c1fdfbfe25ac1e"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Leahy-Smith America Invents Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/29">Public Law 112–29</external-xref>; 125 Stat. 284) is amended—</text><paragraph id="HBEA6A0160CE44E0F8E6ACA990735E6B4"><enum>(1)</enum><text display-inline="yes-display-inline">in section 33 (<external-xref legal-doc="usc" parsable-cite="usc/35/101">35 U.S.C. 101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/29">Public Law 112–29</external-xref>), in the section heading, by inserting before the period at the end the following: <quote><header-in-text level="section" style="OLC">for human organisms</header-in-text></quote>; and</text></paragraph><paragraph id="HCD0A0C33045340E484395B3258CF41D6"><enum>(2)</enum><text>by inserting after section 33 (<external-xref legal-doc="usc" parsable-cite="usc/35/101">35 U.S.C. 101</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/29">Public Law 112–29</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H786ADCE013024F68BFAC31075DD8A1B1"><section id="HDA6268374C4944979A10C0C25E99E726"><enum>33A.</enum><header>Limitation on intellectual property protection for plants</header><subsection id="H8F0AFCBE8E324F5297F90C4F3A6DFF64"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HB2567BE169004D29A4AE3341A22675AD"><enum>(1)</enum><header>Germplasm</header><text display-inline="yes-display-inline">The term <term>germplasm</term> means plant material capable of propagation, including seeds, pollen, tubers, or rootstock for use in breeding, conservation, or research.</text></paragraph><paragraph id="H94EC142E311D424282125381B9A30D74"><enum>(2)</enum><header>Plant variety</header><text display-inline="yes-display-inline">The term <term>plant variety</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id994391c4842c4f16ab1f6606424a5429"><enum>(A)</enum><text display-inline="yes-display-inline">means a plant grouping within a single botanical taxon of the lowest known rank that can be defined by the expression of the characteristics resulting from a given genotype or combination of genotypes, distinguished from any other plant grouping by the expression of at least 1 characteristic and considered as a unit with regard to the suitability of the plant grouping for being propagated unchanged; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4d84f018fba8402791cffb9bfdf9287e"><enum>(B)</enum><text display-inline="yes-display-inline">may be represented by seed, transplants, plants, tubers, tissue culture plantlets, or other matter.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5dc6bdbc358a47fbadc77b39ea38004a"><enum>(b)</enum><header>Limitation</header><paragraph commented="no" display-inline="no-display-inline" id="idd3157a7e566041da8f443e92f0449612"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law—</text><subparagraph id="HDBD5C950A092419AB01E9119EBD7F322"><enum>(A)</enum><text>no protection may be provided under any Federal law with respect to a plant, plant variety, or plant germplasm, except pursuant to a law described in subsection (c); and</text></subparagraph><subparagraph id="H52B879FB5E3A4FBF905586669C3981A1"><enum>(B)</enum><text>no contractual obligation or agreement that may be allowable under a law described in subsection (c) that limits the use of a plant, plant variety, plant germplasm, or other biological material for research, breeding, experimentation, seed saving, or propagation may be enforced.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id157dc68632c04eb08ae10f43eec8f202"><enum>(2)</enum><header>Application</header><subparagraph commented="no" id="H3D670852360E4190981A2DCE1CAA0E3A"><enum>(A)</enum><header>In general</header><text>Paragraph (1) shall apply to—</text><clause id="HBA0D797800C7417B8D1579CBBC9E5F5C"><enum>(i)</enum><text>any application for a patent that is pending on, or filed on or after, the date of enactment of this section; and</text></clause><clause id="HB39D891B18614401AF1DE818E2FEEE39"><enum>(ii)</enum><text>any contractual obligation or agreement entered into on or after the date of enactment of this section.</text></clause></subparagraph><subparagraph commented="no" id="H346B35557EA646319701345055A8D32C"><enum>(B)</enum><header>Prior applications</header><text>Paragraph (1) shall not affect the validity of any patent issued on an application to which subparagraph (A) does not apply.</text></subparagraph></paragraph></subsection><subsection id="H5FC23D75B57A4555AFE6050C6F736076"><enum>(c)</enum><header>Laws described</header><text display-inline="yes-display-inline">The laws described in this subsection are the following:</text><paragraph display-inline="no-display-inline" id="H2B5138C133CF49CB803E33F8616204B0"><enum>(1)</enum><text display-inline="yes-display-inline">The Plant Variety Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2321">7 U.S.C. 2321 et seq.</external-xref>).</text></paragraph><paragraph id="H3ADFA26BC52B4B3EAAEB25E9D044C0FB"><enum>(2)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/15">Chapter 15</external-xref> of title 35, United States Code (commonly known as the <quote>Plant Patent Act of 1930</quote>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id85b23dc9616646d795df28f7978b8588"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Leahy-Smith America Invents Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/29">Public Law 112–29</external-xref>) is amended by inserting after the item relating to section 33 the following:</text><quoted-block id="idDFC20B84BAFC4D52A2203A7E428E78CE" style="OLC" act-name=""><toc><toc-entry level="section">Sec. 33A.
