<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5103</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260723">July 23, 2026</action-date><action-desc><sponsor name-id="S427">Mr. Schiff</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to provide that officers and employees of the executive branch are required to recuse themselves in matters affecting the financial interests of their previous employers, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB175A91487D54CE6A95C0BF834F4C8D7"><section section-type="section-one" id="idcceeb36a07754b40a41f9cb1f9fe3ae4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Millionaires Using Service for Kickbacks Act</short-title></quote> or the <quote><short-title>Stop MUSK Act</short-title></quote>.</text></section><section id="HFD19ED1044314076ADCAADFF5CBB74AB"><enum>2.</enum><header>Recusal of executive branch officers and employees in matters affecting financial interests of previous employers</header><text display-inline="no-display-inline">Section 208(a) of title 18, United States Code, is amended by inserting after <quote>organization in which he is serving as officer, director, trustee, general partner or employee,</quote> the following: <quote>organization for which he, during the 4-year period preceding such participation, served as an officer, director, trustee, general partner, agent, attorney, consultant, contractor, employee, or direct competitor, organization (other than a political organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/527">section 527(e)</external-xref> of the Internal Revenue Code of 1986) in which he is an active participant,</quote>.</text></section></legis-body></bill>
