<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5102</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260723">July 23, 2026</action-date><action-desc><sponsor name-id="S427">Mr. Schiff</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to clarify certain conduct that is prohibited for purposes of bribery of public officials and witnesses, and for other purposes.</official-title></form><legis-body><section changed="not-changed" id="id6556c3dd-d8b6-418c-a6f6-7f514c0d8c10" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Closing Bribery Loopholes Act</short-title></quote>.</text></section><section changed="not-changed" commented="no" display-inline="no-display-inline" id="id53b1bacc4b80439da533d8047342067e" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Clarification of definition of official Act</header><text display-inline="no-display-inline">Section 201(a)(3) of title 18, United States Code, is amended to read as follows:</text><quoted-block changed="not-changed" display-inline="no-display-inline" id="id15ec551f-98ee-493d-8030-edcebeaa56bb" style="OLC"><paragraph id="ide14136b2-b20d-4395-8089-837a2e4cc19e" changed="not-changed"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id543f48882e094c9c85441ea59f5f0798" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>official act</term> means any act within the range of official duty, and any decision, recommendation, or action on any question, matter, cause, suit, proceeding, or controversy, which may at any time be pending, or which may by law be brought before any public official, in such public official’s official capacity or in such official’s place of trust or profit, including any pardon, commutation, or reprieve, or an offer of any such pardon, commutation, or reprieve; and</text></subparagraph><subparagraph changed="not-changed" commented="no" display-inline="no-display-inline" id="id9f51880934454aa4aa60f02adc927697" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">for purposes of subparagraph (A), an official act—</text><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="idf1688b23c79d4830921ece5176d594be"><enum>(i)</enum><text display-inline="yes-display-inline">may be comprised of a single act, more than one act, or a course of conduct to effect the official act; and</text></clause><clause changed="not-changed" commented="no" display-inline="no-display-inline" id="id24b3071eb46647cfbad467328623b688"><enum>(ii)</enum><text display-inline="yes-display-inline">may occur whether or not it successfully achieves a desired outcome.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
