which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to modify the definition of renewable biomass for purposes of the renewable fuel standard, and for other purposes.</official-title></form><legis-body><section id="id88b2e62d0c8a46ffb58d90230c93785d" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildfire Reduction Market Expansion Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id25fcacde8eda4fbdac9dd1583e96b6e5" section-type="subsequent-section"><enum>2.</enum><header>Definition of renewable biomass</header><text display-inline="no-display-inline">Section 211(o)(1)(I) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)(I)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id14e51f38cbad4d3c93f2ff0ad80dcbe9"><enum>(1)</enum><text>by redesignating each of clauses (i) through (vii) as subclauses (I) through (VII), respectively, and indenting appropriately;</text></paragraph><paragraph id="id53343f991b904b1691f41ba044c77e93"><enum>(2)</enum><text>in the matter preceding subclause (I) (as so redesignated), by striking <quote>The term</quote> and inserting the following:</text><quoted-block id="id03FD90590DF342BBB9A9A3D3BA2D8C71" style="OLC" act-name=""><clause id="id05A699CE11FB4AE88988BC72273C6880"><enum>(i)</enum><header>In general</header><text>The term</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idde940e8822bd42009b8abc031a209d65"><enum>(3)</enum><text>by striking subclause (II) (as so redesignated) and inserting the following:</text><quoted-block id="id7056F2DCE1EC43DE91DD1F645DA24F50" style="OLC" act-name=""><subclause id="id79971D4884D54086BEADB6AF33E97A49"><enum>(II)</enum><text>Materials generated from forest products manufacturing and wood products manufacturing, including wood residuals, paper residuals, sawdust, wood, wood chips, shavings, bark, sanderdust, and paper recycling residuals (excluding paper in the form and type commonly recycled).</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id596c908d182043859005d8d853a39d38"><enum>(4)</enum><text>by striking subclauses (IV) and (V) (as so redesignated) and inserting the following:</text><quoted-block id="idC7747162EA6E4D2EB06AE0252EE78C81" style="OLC" act-name=""><subclause id="id0041D72173A849E6ABDB769A5A21D03E"><enum>(IV)</enum><text>Trees, shrubs, and parts of trees or shrubs, including slash and storm debris, from—</text><item commented="no" display-inline="no-display-inline" id="id846579c7f1e649bf9516d2f333d86d72"><enum>(aa)</enum><text display-inline="yes-display-inline">non-Federal land that—</text><subitem commented="no" display-inline="no-display-inline" id="ide976ef3b2f0a4edfb5b39a4c93e0a623"><enum>(AA)</enum><text display-inline="yes-display-inline">is managed under a forest sustainability or logging company certification program;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id3beb6cf73e1e45598d83306878a19724"><enum>(BB)</enum><text>is classified for State or local property tax purposes as forest land, timberland, or land in current use for forestry; or</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id4390bd6fd91b46a2add553eb77441439"><enum>(CC)</enum><text>in accordance with clause (ii), the landowner provides to the Administrator an attestation that the land is being managed for long-term timber production;</text></subitem></item><item commented="no" display-inline="no-display-inline" id="id0bd989b60203445a861df297a4126180"><enum>(bb)</enum><text display-inline="yes-display-inline">land within the National Forest System (as defined in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>)) or public lands (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)), if the Secretary of Agriculture or the Secretary of the Interior, as applicable and in accordance with clause (ii), certifies to the Administrator, directly or through an authorized officer, that the materials are—</text><subitem commented="no" display-inline="no-display-inline" id="idccbf60c1789244fa8edef24bdb0a1017"><enum>(AA)</enum><text display-inline="yes-display-inline">by-products from commercial or noncommercial land management activities or material generated from fuel reduction treatments, ecological restoration projects, or pre-commercial thinning;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id69652882b8354b4f94dfbe296b483609"><enum>(BB)</enum><text display-inline="yes-display-inline">not reasonably suitable for use as a sawlog, as determined by the Secretary of Agriculture or the Secretary of the Interior, as applicable; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id73694c69b73a45ca9d59e6a896ceb377"><enum>(CC)</enum><text display-inline="yes-display-inline">sourced in a manner consistent with all applicable Federal laws and regulations governing forest management activities and the applicable forest plan or resource management plan; or</text></subitem></item><item commented="no" display-inline="no-display-inline" id="id757b4153e8e64163a90728ac2cf29e51"><enum>(cc)</enum><text display-inline="yes-display-inline">land—</text><subitem commented="no" display-inline="no-display-inline" id="id9d87cfc8fd2149628888eb1ea2a2cad6"><enum>(AA)</enum><text display-inline="yes-display-inline">owned by an Indian tribe; or</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id099a01330f86485d92e58120abac6e8a"><enum>(BB)</enum><text display-inline="yes-display-inline">held in trust by, or subject to a restriction against alienation imposed by, the United States for an Indian tribe or individual Indian.</text></subitem></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idc3a2862011c94a2f842117a2191f6ff9"><enum>(V)</enum><text display-inline="yes-display-inline">Vegetation obtained from—</text><item commented="no" display-inline="no-display-inline" id="iddb3532a4aecc44ebb77a8dd467fd0ee0"><enum>(aa)</enum><text display-inline="yes-display-inline">within the reasonably established defensible space of a structure or an infrastructure asset, including a residential structure, a commercial building, and a public facility, in accordance with applicable local law or, if there is no applicable local law, the most recent publication of the International Wildland-Urban Interface Code of the International Code Council; or</text></item><item commented="no" display-inline="no-display-inline" id="id324b9ce708e94853b4d1fc401eaee315"><enum>(bb)</enum><text display-inline="yes-display-inline">wildfire risk reduction activities within the wildland-urban interface (as defined in section 101 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6511">16 U.S.C. 6511</external-xref>)).</text></item></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idd1bdcf6cb3a740498641f118e0663730"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block id="id0790E39811014BEFBC7FA710F55C17BF" style="OLC" act-name=""><clause commented="no" display-inline="no-display-inline" id="id4e40485398f64d59b389367e8e14aa0e"><enum>(ii)</enum><header>Certification and attestation requirements</header><text>A certification or attestation to the Administrator under this subparagraph may be in the form of a letter given to the person seeking to generate credits under this subsection from—</text><subclause commented="no" display-inline="no-display-inline" id="id2827b7f13121487f945b6d7c1bd7b084"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to the attestation required under clause (i)(IV)(aa)(CC), the non-Federal landowner; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id091bf11fe0044f1c886c931d00c33443"><enum>(II)</enum><text>with respect to the certification required under clause (i)(IV)(bb), the local office of the Department of Agriculture or the Department of the Interior with authority over the applicable forest plan or resource management plan.</text></subclause></clause><clause id="id4b8ab223a15f40ed9caa61cb6dad25bb"><enum>(iii)</enum><header>Inclusion</header><text>For the purpose of this subparagraph, the term <quote>non-Federal land</quote> includes land owned by a Native Corporation (as defined in section 3 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1602">43 U.S.C. 1602</external-xref>)).</text></clause><clause commented="no" display-inline="no-display-inline" id="id516c1dae6ac64365912a9580164f7fb2"><enum>(iv)</enum><header>Savings clause</header><text display-inline="yes-display-inline">Nothing in clause (i)(IV)(bb) requires the applicable forest plan or resource management plan to expressly identify renewable fuel or biomass energy as an intended end use of the material, provided that the underlying project, removal, sale, or disposition of the material is otherwise authorized and consistent with the applicable forest plan or resource management plan.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
