Establishment of Inspector General of the Office of the United States Trade Representative.</toc-entry></toc></subsection></section><title style="OLC" commented="no" level-type="subsequent" id="idac2975a4f03c4da9b00f707b99cdd67d"><enum>I</enum><header>Authority of Congress over trade actions</header><section id="id3e75b1d5dfc841ad89cd2a8ca5c58d9f"><enum>101.</enum><header>Authority of Congress over trade actions</header><text display-inline="no-display-inline">The Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1304">19 U.S.C. 1304 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd1cdcbd4ad9f4b4fbc93a691bccb7c1e"><title id="id73d85842a2fb446f999d7b4de6daf23f" style="OLC"><enum>X</enum><header>Authority of Congress over trade actions</header><subtitle style="OLC" commented="no" level-type="subsequent" id="ide4cc20399f99415fb58c493ea5fef7dc"><enum>A</enum><header display-inline="yes-display-inline">Process for approval of trade actions by Congress</header><section id="id3628f23aaa874d10a88679bb136769b2"><enum>1001.</enum><header>Process for approval of trade actions by Congress</header><subsection id="id9835df194e5d4857902fe8ed7b3d0374"><enum>(a)</enum><header>In general</header><text>An action may be taken under section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>) or section 201, 203, or 301 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2251">19 U.S.C. 2251</external-xref>, 2253, and 2411) only if—</text><paragraph id="id09e93d47b01d4a2fbc4347c5595e9c40"><enum>(1)</enum><text>the President submits to the Joint Committee on Tariffs and Trade a proposal for the action;</text></paragraph><paragraph id="id3a3b05f6726a4db2a46d9fed0804d7c5"><enum>(2)</enum><text>the Joint Committee reviews the proposal of the President;</text></paragraph><paragraph id="idc96911641c1d4b4a8fa5172aff945485"><enum>(3)</enum><text>not later than 30 days after receiving the proposal of the President under paragraph (1), the Joint Committee recommends to Congress that the action be taken; and</text></paragraph><paragraph id="iddcca3795443542f882b98f1082385e59"><enum>(4)</enum><text>during the 30-day period after the submission to Congress of the recommendation under paragraph (3), there is enacted into law a joint resolution of approval pursuant to subsection (d) with respect to the action.</text></paragraph></subsection><subsection id="ida88f1ec8d64d4e5a8cc0d398df3d0992"><enum>(b)</enum><header>Duration</header><text>An action approved in accordance with subsection (a) shall—</text><paragraph id="ide6cd0d7a062f458f842d715ba9b2e240"><enum>(1)</enum><text>take effect on the date that is 30 days after the enactment of a joint resolution described in paragraph (4) of that subsection; and</text></paragraph><paragraph id="id5abe6a471faa4885912d4ccddf588c68"> <enum>(2)</enum> <text>except as provided by subsection (c), terminate not later than the date that is 180 days after the date specified in paragraph (1).</text>
                                    </paragraph></subsection><subsection id="idabb7469f425a4abf96660893e19b9689">
                                    <enum>(c)</enum>
                                    <header>Extension, modification, and termination</header>
 <text>An action approved in accordance with subsection (a) may be extended for additional periods of 180 days, modified, or terminated, if—</text>
                                    <paragraph id="id332ca240517f4b26b083c252975c4379">
                                        <enum>(1)</enum>
 <text>the President submits to the Joint Committee on Tariffs and Trade a proposal for the extension, modification, or termination;</text>
                                    </paragraph>
                                    <paragraph id="id024a3f4f0f344e4fa0c345408d003ee4">
                                        <enum>(2)</enum>
 <text>the Joint Committee reviews the proposal of the President;</text>
                                    </paragraph>
                                    <paragraph id="ided83455c98d04d0899c0827391fb1590">
                                        <enum>(3)</enum>
 <text>the Joint Committee recommends to Congress that the action be extended, modified, or terminated; and</text>
                                    </paragraph>
                                    <paragraph id="id0642394666104b20b932a133ebfb16c6">
                                        <enum>(4)</enum>
 <text>during the 30-day period after the submission to Congress of the recommendation under paragraph (3), there is enacted into law a joint resolution of approval pursuant to subsection (d) with respect to the extension, modification, or termination.</text>
                                    </paragraph>
                                </subsection><subsection id="idde22ffb80ac5453ab0d8de1eaf59dc52"><enum>(d)</enum><header>Joint resolution of approval</header><paragraph id="id7ce623bd9c694341985473474c853ce1">
                                        <enum>(1)</enum>
                                        <header>Joint resolution of approval defined</header>
 <text>In this subsection, the term <term>joint resolution of approval</term> means a joint resolution of either House of Congress the sole matter after the resolving clause of which is the following: <quote>Congress approves of the proposal of the President relating to a trade action under section 1001 of Tariff Act of 1930 submitted to the Joint Committee on Tariffs and Trade on ___ and recommended to Congress on ___.</quote>, with blank spaces being filled with the appropriate dates.</text>
 </paragraph><paragraph id="idc53f66c92533405aa19ce7e13cd52547"><enum>(2)</enum><header>Introduction</header><text>During the 30-day period provided for under subsection (a)(4) or (c)(4), as applicable, a joint resolution of approval may be introduced in either House by any Member.</text></paragraph><paragraph id="id40773bfb06fa442ea2dda535fac35377"><enum>(3)</enum><header>Consideration in House of Representatives</header><subparagraph id="idE636C5577F2E4169A10F127FDF34046E"><enum>(A)</enum><header>Committee referral</header><text>A joint resolution of approval introduced in the House of Representatives shall be referred to the Committee on Ways and Means.</text></subparagraph><subparagraph id="id5B2E09F3605846BCBE1BD0FBE64CCC02"><enum>(B)</enum><header>Reporting and discharge</header><text>If the Committee on Ways and Means has not reported the joint resolution of approval within 10 calendar days after the date of referral, the Committee shall be discharged from further consideration of the joint resolution.</text></subparagraph><subparagraph id="id3F8F66BC48FF4452A22D45D319F01F93"><enum>(C)</enum><header>Proceeding to consideration</header><text>Beginning on the third legislative day after the Committee on Ways and Means reports the joint resolution of approval to the House or has been discharged from further consideration thereof, it shall be in order to move to proceed to consider the joint resolution in the House. All points of order against the motion are waived. Such a motion shall not be in order after the House has disposed of a motion to proceed on the joint resolution. The previous question shall be considered as ordered on the motion to its adoption without intervening motion. The motion shall not be debatable. A motion to reconsider the vote by which the motion is disposed of shall not be in order.</text></subparagraph><subparagraph id="id6B8CF5928ADB4A7BAC09C26C59ABB484"><enum>(D)</enum><header>Floor consideration</header><text>The joint resolution of approval shall be considered as read. All points of order against the joint resolution and against its consideration are waived. The previous question shall be considered as ordered on the joint resolution to final passage without intervening motion except 2 hours of debate equally divided and controlled by the sponsor of the joint resolution (or a designee) and an opponent. A motion to reconsider the vote on passage of the joint resolution shall not be in order.</text></subparagraph></paragraph><paragraph id="id51fca1b4248048818e66cb4d1876dbaa"><enum>(4)</enum><header>Consideration in the Senate</header><subparagraph id="id3c3dda2a4b3948adb9e19d9a5db83bbc"><enum>(A)</enum><header>Committee referral</header><text>A joint resolution of approval introduced in the Senate shall be referred to the Committee on Finance.</text></subparagraph><subparagraph id="ida505544b751047e19af3a89cdd9c89ef"><enum>(B)</enum><header>Reporting and discharge</header><text>If the Committee on Finance has not reported the joint resolution of approval within 10 calendar days after the date of referral of the joint resolution, the Committee shall be discharged from further consideration of the joint resolution and the joint resolution shall be placed on the appropriate calendar.</text></subparagraph><subparagraph id="idb2ed053b02334766a55f3001f230ec4d"><enum>(C)</enum><header>Proceeding to consideration</header><text>Notwithstanding Rule XXII of the Standing Rules of the Senate, it is in order at any time after the Committee on Finance reports a joint resolution of approval or has been discharged from consideration of such a joint resolution to move to proceed to the consideration of the joint resolution. The motion to proceed is not debatable. The motion is not subject to a motion to postpone. A motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order.</text></subparagraph><subparagraph id="idf34973e79c9b4d0a9757bfcb7f5ecf9d"><enum>(D)</enum><header>Rulings of the chair on procedure</header><text>Appeals from the decisions of the Chair relating to the application of the rules of the Senate to the procedure relating to a joint resolution of approval shall be decided by the Senate without debate.</text></subparagraph></paragraph><paragraph id="id55a325bf3a0346e5ba4fed0270373873"><enum>(5)</enum><header>Treatment of House joint resolution in Senate</header><subparagraph commented="no" display-inline="no-display-inline" id="IDFEF03D0609374B7A80C6B647F0B8ACEB"><enum>(A)</enum><header>Committee referral</header><text>Except as provided in subparagraph (B), a joint resolution of approval that has passed the House of Representatives shall, when received in the Senate, be referred to the Committee on Finance for consideration in accordance with paragraph (4).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBB253092E7BD4E6983B2CE0D1863B803"><enum>(B)</enum><header>Consideration of House resolution</header><text>If a joint resolution of approval was introduced in the Senate before receipt of a joint resolution of approval that has passed the House of Representatives—</text><clause commented="no" display-inline="no-display-inline" id="id6407A3EDE5F94E72AE816700A37F7824"><enum>(i)</enum><text>the joint resolution from the House of Representatives shall, when received in the Senate, be placed on the calendar; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0F660FB070094BF2BFE394A8C425773E"><enum>(ii)</enum><text>the procedures in the Senate with respect to a joint resolution of approval introduced in the Senate shall be the same as if no joint resolution of approval had been received from the House of Representatives, except that the vote on passage in the Senate shall be on the joint resolution that passed the House of Representatives.</text></clause></subparagraph><subparagraph id="id1c9d412b3c6e40f4ab729aeef7b146a0"><enum>(C)</enum><header>House resolution received after passage by Senate</header><text>If the Senate passes a joint resolution of approval before receiving a joint resolution of approval from the House of Representatives, the joint resolution of the Senate shall be held at the desk pending receipt of the joint resolution from the House of Representatives. Upon receipt of the joint resolution of approval from the House of Representatives, such joint resolution shall be deemed to be read twice, considered, read the third time, and passed.</text></subparagraph><subparagraph id="id66b3c147b9a84fe7ae37df7dbb75415a"><enum>(D)</enum><header>Consideration of House resolution if no resolution introduced in Senate</header><text>If the Senate receives a joint resolution of approval from the House of Representatives, and no joint resolution of approval has been introduced in the Senate, the procedures described in paragraph (4) shall apply to consideration of the joint resolution of the House.</text></subparagraph></paragraph><paragraph id="id398c47c1b04b4e01b8be9e2038ce3c98"> <enum>(6)</enum> <header>Rules of the House of Representatives and Senate</header> <text>This subsection is enacted by Congress—</text>
                                        <subparagraph id="id8db8dd0510b94edfa96269f7655ee3a7">
                                            <enum>(A)</enum>
 <text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, and supersedes other rules only to the extent that it is inconsistent with such rules; and</text>
                                        </subparagraph>
                                        <subparagraph id="id9e023f15c8aa4ff8b729ac3d770feab5">
                                            <enum>(B)</enum>
 <text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text>
                                        </subparagraph>
 </paragraph></subsection></section></subtitle><subtitle id="id95045ceda40847bd89ea1d13316c6cfb"><enum>B</enum><header>Joint Committee on Tariffs and Trade</header><section id="ide6c2b8164d044aea9005d76a9a1847aa"><enum>1011.</enum><header>Establishment of the Joint Committee on Tariffs and Trade</header><text display-inline="no-display-inline">There shall be a joint congressional committee known as the Joint Committee on Tariffs and Trade (in this subtitle referred to as the <quote>Joint Committee</quote>).</text></section><section id="id0a0ad34965a14856ab8a4a1d7a009638"><enum>1012.</enum><header>Membership</header><subsection id="id7d37db695dc446bfb215fcca04481e41"><enum>(a)</enum><header>In general</header><text>The Joint Committee shall be composed of 10 members as follows:</text><paragraph id="id382f9632a1c941f6b772199d0b76379c"><enum>(1)</enum><header>From Committee on Finance</header><text>Five members who are members of the Committee on Finance of the Senate, 3 from the majority and 2 from the minority party, to be chosen by such Committee.</text></paragraph><paragraph id="id9276c6342bd442ce9d912076d8b042f1"><enum>(2)</enum><header>From Committee on Ways and Means</header><text>Five members who are members of the Committee on Ways and Means of the House of Representatives, 3 from the majority and 2 from the minority party, to be chosen by such Committee.</text></paragraph></subsection><subsection id="id9217abaff7914d4b880d11adc1db9d3c"><enum>(b)</enum><header>Chairperson and Vice Chairperson</header><paragraph id="id127a2893abf942b5839b5bc60034c9fe"><enum>(1)</enum><header>Chairperson</header><text>The Joint Committee shall be chaired by the Chairperson of the Committee on Ways and Means of the House of Representatives for the first session of each Congress and by the Chairperson of the Committee on Finance of the Senate for the second session of each Congress.</text></paragraph><paragraph id="idcb16b84af1ee408ea0abb51255b3de5d"><enum>(2)</enum><header>Vice Chairperson</header><text>The Chairperson of the Committee on Finance of the Senate shall serve as the Vice Chairperson of the Joint Committee for the first session of each Congress and the Chairperson of the Committee on Ways and Means of the House of Representatives shall serve as the Vice Chairperson of the Joint Committee for the second session of each Congress.</text></paragraph></subsection><subsection id="id42d336911264401ea6da0bbeb7acab34"><enum>(c)</enum><header>Tenure of office</header><paragraph id="id868a81bfd5254611b570167191ff645d"><enum>(1)</enum><header>General limitation</header><text>Except as provided by paragraph (2), no individual shall continue to serve as a member of the Joint Committee after the individual has ceased to be a member of the Committee by which the individual was chosen.</text></paragraph><paragraph id="idada83ce18ca94e859aaf076f95b84435"><enum>(2)</enum><header>Exception</header><text>The members chosen by the Committee on Ways and Means who have been reelected to the House of Representatives may continue to serve as members of the Joint Committee notwithstanding the expiration of the Congress.</text></paragraph></subsection><subsection id="iddda335a16f6e49adb365b48a80610b7d"><enum>(d)</enum><header>Vacancies</header><paragraph id="idb1a25c8b74d14678b935a1737af83ee2"><enum>(1)</enum><header>Effect</header><text>A vacancy in the Joint Committee shall not affect the power of the remaining members to execute the functions of the Joint Committee.</text></paragraph><paragraph id="id589c31da553f4a7bbadce71b12c16ddd"><enum>(2)</enum><header>Filling vacancies</header><subparagraph id="idd1fbf015f2ed47b190cf9c4988cb2c7e"><enum>(A)</enum><header>In general</header><text>Except as provided by subparagraph (B), a vacancy in the Joint Committee shall be filled in the same manner as the original selection.</text></subparagraph><subparagraph id="id3e118cfc19f94c148e59c3f61f2b03ad"><enum>(B)</enum><header>Exceptions</header><clause id="id2745decab0f541b284a8a698f4ac291d"><enum>(i)</enum><header>Adjournment or recess of Congress</header><text>If there is a vacancy in the Joint Committee for a period of more than 2 weeks during an adjournment or recess of Congress, the members of the Joint Committee who are members of the Committee entitled to fill the vacancy may designate a member of the Committee to serve until the successor of the member is chosen in accordance with subsection (a).</text></clause><clause id="idcf46fd1514cc4b45896cf73a8ebc93a3"><enum>(ii)</enum><header>Expiration of Congress</header><text>If a position of a member of the Joint Committee appointed by the Committee on Ways and Means of the House of Representatives becomes vacant after the expiration of a Congress, the members of the Joint Committee who are members of the Committee on Ways and Means of the House of Representatives may designate an individual who, immediately prior to such expiration, was a member of the Committee on Ways and Means of the House of Representatives and who is re-elected to the House of Representatives to serve until the successor of the member is chosen in accordance with subsection (a).</text></clause></subparagraph></paragraph></subsection><subsection id="id26771c959bf94334a9c9a7f9a88ecbe1"><enum>(e)</enum><header>Compensation and allowances</header><text>Members of the Joint Committee shall serve without compensation in addition to compensation received as Members of Congress, but shall be reimbursed for travel, subsistence, and other necessary expenses incurred in the performance of the duties vested in the Joint Committee, other than expenses in connection with meetings of the Joint Committee held in the District of Columbia during such times as the Congress is in session.</text></subsection></section><section id="id8aa2ed2d001f49f18ae8f343cf38ac8c"><enum>1013.</enum><header>Duties</header><subsection id="id520f45dd19504fdbb593d12952400e34"><enum>(a)</enum><header>In general</header><text>The Joint Committee shall—</text><paragraph id="id910fd8a0589f434fa983806302525873"><enum>(1)</enum><text>conduct reviews of proposals submitted by the President and make recommendations to Congress under section 1001 with respect to trade actions;</text></paragraph><paragraph id="id311e07fac3604f9f97e072e9d03bb1cd"><enum>(2)</enum><text>be responsible for oversight of trade negotiations, including through the activities of the Chief Congressional Trade Representative for Negotiations appointed under section 1015(a)(2); and</text></paragraph><paragraph id="id29c933453037422994d944239cd740b2"><enum>(3)</enum><text>be responsible for oversight of implementation, compliance, and enforcement of trade agreements to which the United States is a party, including through the activities of the Chief Congressional Trade Representative for Monitoring and Enforcement appointed under section 1015(a)(3).</text></paragraph></subsection><subsection id="idef9fe3df1651421691c772c7d5a5e285"><enum>(b)</enum><header>Annual reports</header><text>Not less frequently than annually, the Joint Committee shall submit to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives a report on the efforts of the Joint Committee to carry out the duties described in subsection (a) during the year preceding submission of the report.</text></subsection></section><section id="id80201c16b02243b7b540bffba39f4164"><enum>1014.</enum><header>Powers</header><subsection id="id633e399e9bb749b992ba762fb5883b6e"><enum>(a)</enum><header>Relating to hearings and sessions</header><text>The Joint Committee may—</text><paragraph id="id890123dabadb40a89adc40f30f3ddcea"><enum>(1)</enum><text>hold hearings and sit and act at such places and times as the Joint Committee deems advisable;</text></paragraph><paragraph id="idde6c01364e484d76b244f00610dd394c"><enum>(2)</enum><text>require by subpoena (to be issued under the signature of the Chairperson or Vice Chairperson) or otherwise the attendance of witnesses and the production of books, papers, and documents;</text></paragraph><paragraph id="id9a48734120324acf8b1cfb3c76b93254"><enum>(3)</enum><text>administer oaths; and</text></paragraph><paragraph id="id6cdd0e317cf44c97a1a75cdddf44f042"><enum>(4)</enum><text>take testimony.</text></paragraph></subsection><subsection id="ida183fa2188b040a88d5ce0fccf1ac407"><enum>(b)</enum><header>Printing and binding</header><text>The Joint Committee may have such printing and binding done as the Joint Committee deems advisable.</text></subsection><subsection id="ide5389f3ca63e463b9a9c2ae42e0245ce"><enum>(c)</enum><header>Expenditures</header><text>The Joint Committee may make such expenditures as the Joint Committee deems advisable.</text></subsection></section><section id="id77b34fc7629a48f1b8eb66827d8ea5c8"><enum>1015.</enum><header>Staff of Joint Committee on Tariffs and Trade</header><subsection id="id4a58f911e4d841b2af424e8de6e9bc7a"><enum>(a)</enum><header>Appointment, employment, and compensation</header><paragraph id="id0ec50bf91c0f448faba1ab28d150352f"><enum>(1)</enum><header>Chief of staff</header><text>The Joint Committee shall appoint and fix the compensation of a Chief of Staff.</text></paragraph><paragraph id="id000ed1c606774dffa09db4765d723dce" commented="no"><enum>(2)</enum><header>Chief Congressional Trade Representative for Negotiations</header><subparagraph id="id4f9905d6906d417fbf353fee135a9bc8" commented="no"><enum>(A)</enum><header>In general</header><text>The Joint Committee shall appoint and fix the compensation of a Chief Congressional Trade Representative for Negotiations.</text></subparagraph><subparagraph id="idf3a795275ebf488a9c2f9c5de0aebf53" commented="no"><enum>(B)</enum><header>Duties</header><text>The Chief Congressional Trade Representative for Negotiations appointed under subparagraph (A) shall—</text><clause id="id82a197e0d50244588869cc202f3ae41b" commented="no"><enum>(i)</enum><text>be the chief representative of Congress for international trade negotiations, including all negotiations in which the United States participates on any matter considered under the auspices of the World Trade Organization or relating to commodities or direct investment;</text></clause><clause id="id18c28f10b6674e14b86aaef092451afa" commented="no"><enum>(ii)</enum><text>be accredited by the United States Trade Representative on behalf of the President as a member of United States delegations to conferences, meetings, and negotiating sessions relating to such negotiations; and</text></clause><clause id="id15d2562e3a8d4206ae956b407b0f931b" commented="no"><enum>(iii)</enum><text>report directly to the Joint Committee, the Committee on Finance of the Senate, and the Committee on Ways and Means of the House of Representatives on the conduct of such negotiations.</text></clause></subparagraph></paragraph><paragraph id="id878c9f82141e428e94220aed5230b06b" commented="no"><enum>(3)</enum><header>Chief Congressional Trade Representative for Monitoring and Enforcement</header><subparagraph id="idda63a32320c541b5bbe6b0fe49603111" commented="no"><enum>(A)</enum><header>In general</header><text>The Joint Committee shall appoint and fix the compensation of a Chief Congressional Trade Representative for Monitoring and Enforcement.</text></subparagraph><subparagraph id="id36e935416c974869b27a79e468daabf9" commented="no"><enum>(B)</enum><header>Duties</header><text>The Chief Congressional Trade Representative for Monitoring and Enforcement appointed under subparagraph (A) shall—</text><clause id="idd2f6e03f6b364585a58debe865212848" commented="no"><enum>(i)</enum><text>be responsible for monitoring—</text><subclause commented="no" display-inline="no-display-inline" id="idc46ac113a92448b58a4a3cd6420d6667"><enum>(I)</enum><text display-inline="yes-display-inline">implementation of and compliance with trade agreements to which the United States is a party; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0b8fad1ed63c40e9b6b3bd050f9e7421"><enum>(II)</enum><text display-inline="yes-display-inline">trade barriers in foreign countries;</text></subclause></clause><clause id="id6da25f7f4f484c38b571f40c1a2f1a24" commented="no"><enum>(ii)</enum><text>advise on enforcement of trade agreements, including the initiation of dispute settlement proceedings under the auspices of the World Trade Organization or pursuant to bilateral and regional trade agreements to which the United States is a party;</text></clause><clause id="id68421fed4d184679b2c5bd5278887d1f" commented="no"><enum>(iii)</enum><text>be the chief representative of Congress at the Interagency Center on Trade Implementation, Monitoring, and Enforcement; and</text></clause><clause id="id8573f8946b5b465f8fa23f47d8dacfbb" commented="no"><enum>(iv)</enum><text>report directly to the Joint Committee, the Committee on Finance of the Senate, and the Committee on Ways and Means of the House of Representatives on—</text><subclause commented="no" display-inline="no-display-inline" id="id6d7edc3d20f5442f8e352a9234511b3c"><enum>(I)</enum><text display-inline="yes-display-inline">implementation of, compliance with, and enforcement of trade agreements to which the United States is a party; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id74c01b579e4b47ceaf7cc15bd8b7abf9"><enum>(II)</enum><text display-inline="yes-display-inline">trade barriers in foreign countries.</text></subclause></clause></subparagraph></paragraph><paragraph id="idf43552b1acaf4a80851b72d89a377782"><enum>(4)</enum><header>Permanent staff</header><text>The Joint Committee may employ and fix the compensation of a permanent staff to facilitate the work of the Joint Committee, including economists, attorneys, and other professionals with significant international trade experience.</text></paragraph></subsection><subsection id="id9393b3b8f3bc415cbfaba799457e9798"> <enum>(b)</enum> <header>Non-Partisanship</header> <text>The staff of the Joint Committee shall serve on a professional, nonpartisan basis.</text>
 </subsection></section><section id="id2755df8a5d444bf29722b72140187cbc"><enum>1016.</enum><header>Payment of expenses</header><text display-inline="no-display-inline">The expenses of the Joint Committee shall be paid <fraction>1/2</fraction> from the contingent fund of the Senate and <fraction>1/2</fraction> from the contingent fund of the House of Representatives, upon vouchers signed by the Chairperson or the Vice Chairperson.</text></section></subtitle></title><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="id53d58b4a3606489d84a6d7c6e96a25cf"><enum>II</enum><header>Withdrawal of delegations of trade authorities</header><section id="id539a341ac654474b8c97674cb32c393b"><enum>201.</enum><header>Repeal of balance-of-payments authority</header><subsection id="id45f6e49749ab45bba8d3282ff7dc3e1c"><enum>(a)</enum><header>In general</header><text>Section 122 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2132">19 U.S.C. 2132</external-xref>) is repealed.</text></subsection><subsection id="id47f041abaa3b498e88e23f138520e454"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for the Trade Act of 1974 is amended by striking the item relating to section 122.</text></subsection><subsection id="id3fbefc48f5ea4c8797900180bac0b3e9"><enum>(c)</enum><header>Conforming amendment</header><text>Section 127(b) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2137">19 U.S.C. 2137(b)</external-xref>) is amended, in the matter preceding subparagraph (A), by striking <quote>(and from any action under section 122(c))</quote>.</text></subsection></section><section id="ide52c9c75827a4d369e2aabe081cc11ba"><enum>202.</enum><header>Repeal of authority to impose duties in response to discrimination by foreign countries</header><subsection id="idca4e399437f04e499a461b0001e6f1a2"><enum>(a)</enum><header>In general</header><text>Section 338 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1338">19 U.S.C. 1338</external-xref>) is repealed.</text></subsection><subsection id="idf84fc1c6b0c5442aa01e0362abbeb9c6"><enum>(b)</enum><header>Conforming amendment</header><text>Section 337(m) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1337">19 U.S.C. 1337(m)</external-xref>) is amended by striking <quote>and sections 338 and 340</quote>.</text></subsection></section><section id="idda487132af624e8ca0e8de26476dadd3"><enum>203.</enum><header>Modification of authority to take action in response to unfair trade practices</header><subsection id="idc5b3358b80a0492d8c77f1d027a455cb"><enum>(a)</enum><header>Actions of Trade Representative</header><text>Section 301(c) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2411">19 U.S.C. 2411(c)</external-xref>) is amended by adding at the end:</text><quoted-block id="idD6B8B4CD81AE4E8BAFB37FD154E8EEB2" style="OLC" act-name=""><paragraph id="idEA2FDC11851A46DDB2C86E6E2D4AC092"><enum>(7)</enum><text>Any action taken by the Trade Representative under this section shall be subject to the requirements of section 1001 of the Tariff Act of 1930.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idb269b1b2a92b407d961e41b9eec173fd"><enum>(b)</enum><header>Implementation of Actions</header><text display-inline="yes-display-inline">Section 305(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2415">19 U.S.C. 2415(a)</external-xref>) is amended—</text><paragraph id="id7ddbc88573c9458bb21a1e5a5ab05dc0"><enum>(1)</enum><text>in paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and (3)</quote>; and</text></paragraph><paragraph id="id3d3aa0177b654a8988207e0789880832"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8c8953052fe6459b99578be43a7d5111"><paragraph id="id0bbec32757ed4dfa9b2867f0d04a811b"><enum>(3)</enum><text>The Trade Representative may not implement any action under section 301 unless there is enacted into law, in accordance with section 1001 of the Tariff Act of 1930, a joint resolution approving the action.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id55951038763248f1963d5e19cf37f0de"><enum>(c)</enum><header>Modification and termination of actions</header><text>Section 307 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2417">19 U.S.C. 2417</external-xref>) is amended to read as follows:</text><quoted-block id="idD91CA646E1514972950CCEABAA289984" style="OLC" act-name=""><section id="idC688535DCAF8481C971342F628A0B9E2"><enum>307.</enum><header>Modification and termination of actions</header><subsection id="id00709fe079eb4a00b5659b367264d156"><enum>(a)</enum><header>In general</header><text>Subject to the requirements of section 1001 of the Tariff Act of 1930, the Trade Representative may modify or terminate any action, subject to the specific direction, if any, of the President with respect to such action, that is being taken under section 301 if—</text><paragraph id="idcaaab71c0faa4667ba1094b831b5efc6"><enum>(1)</enum><text>any of the conditions described in section 301(a)(2) exist;</text></paragraph><paragraph id="id797b51aadbfc47aeba6c25a8cea2aca3"><enum>(2)</enum><text>the burden or restriction on United States commerce of the denial rights, or of the acts, policies, and practices, that are the subject of such action has increased or decreased; or</text></paragraph><paragraph id="id4065339f38564ee5abd7afdf91300e62"><enum>(3)</enum><text>such action is being taken under section 301(b) and is no longer appropriate.</text></paragraph></subsection><subsection id="id4cdbb0877a2d4530a8843a4c13fef139"><enum>(b)</enum><header>Consultation requirement</header><text>Before taking any action under subsection (a) to modify or terminate any action taken under section 301, the Trade Representative shall consult with the petitioner, if any, and with representatives of the domestic industry concerned, and shall provide opportunity for the presentation of views by other interested persons affected by the proposed modification or termination concerning the effects of the modification or termination and whether any modification or termination of the action is appropriate.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="idffe48c670599432ab9a03553c0b70238"><enum>204.</enum><header>Modification of authority to take action in response to threats to national security</header><text display-inline="no-display-inline">Section 232 of the Trade Expansion Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/19/1862">19 U.S.C. 1862</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id83f05acc45924984ba32b3411491ed5b"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida36cf00c57dd4ee591733ba9c231d164"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id28365ac14d8c41eb980c17ee65866e84"> <enum>(i)</enum> <text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>the President shall—</quote> and all that follows through the period and inserting <quote>the President shall determine whether the President concurs with the finding of the Secretary.</quote>; and</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="idb7c7bec3c07c4020838086f3a311b512"><enum>(ii)</enum><text>by amending subparagraph (B) to read as follows:</text><quoted-block id="id3E12C00FA6414D349ECF889E95141B7E" style="OLC" act-name=""><subparagraph id="id0A9B186A869749E0BFF4E6B6DD67291E" indent="up2"><enum>(B)</enum><text>If the President concurs under subparagraph (A) with the finding of the Secretary with respect to an article, the President shall—</text><clause id="id407a85e518ae4b088aef3d7fdd0f2ff9"><enum>(i)</enum><text>determine the nature and duration of the action that, in the judgment of the President, must be taken to adjust the imports of the article and its derivatives so that such imports will not threaten to impair the national security; and</text></clause><clause id="id288482b8a3804f7c8e055e38917940f6"><enum>(ii)</enum><text>not later than 15 days the date on which the President makes a determination under clause (i) and in accordance with section 1001 of the Tariff Act of 1930, submit to Congress a proposal for action and a written statement supporting the determination of the President. </text></clause></subparagraph><subparagraph id="id8aabb6b384e242a891252c4aa67f5b06" indent="up2"><enum>(C)</enum><text>If the President does not concur under subparagraph (A) with the finding of the Secretary, the President shall, not later than 30 days after the date on which the President makes a determination under subparagraph (A), submit to the Congress a written statement supporting the determination of the President.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idc227a925c8494402b79ad46e34249375"><enum>(B)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idad63c68392a9420e963c8f21013620f6"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79cc660d8ba1450d9e983810ea0568be"><enum>(D)</enum><text>in paragraph (2)(A)(ii), as so redesignated—</text><clause commented="no" display-inline="no-display-inline" id="id9c03b1c03513414c82e9dac5c6e0db88"><enum>(i)</enum><text display-inline="yes-display-inline">in subclause (I), by striking <quote>paragraph (1)(A)</quote> and inserting <quote>paragraph (1)(B)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1389f1e154db459f807658961ba51e31"><enum>(ii)</enum><text display-inline="yes-display-inline">in the matter following subclause (II), by striking <quote>the President shall take</quote> and inserting <quote>the President shall, subject to the requirements of section 1001 of the Tariff Act of 1930, take</quote>;</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id426719e7f1a14c7883b1f7e86499d091"><enum>(2)</enum><text>by redesignating the second subsection (d) as subsection (e);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id380cae6e2fa54b44adf7bc6386042e37"><enum>(3)</enum><text>in subsection (e), as so redesignated, by amending paragraph (2) to read as follows:</text><quoted-block id="idDDF53E65B13C46B98D3E0E915821B206" style="OLC" act-name=""><paragraph id="id1F41E1FF03974AB481236DD15DE1E865"><enum>(2)</enum><text>A report submitted under paragraph (1) shall include the written statement supporting the determination of the President described in subparagraphs (B) and (C) of subsection (c)(1).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9f4b9e4cafa14292a08f67667d316aaa"><enum>(4)</enum><text>by striking subsection (f).</text></paragraph></section><section id="ided293950bc184cca9b51f6520cb69128"><enum>205.</enum><header>Modification of authority to take action in response to import competition</header><subsection id="ide104459de57e4f12b411d9ff9b40bcca"> <enum>(a)</enum> <header>Action To facilitate positive adjustment to import competition</header> <text>Section 201(a) of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2251">19 U.S.C. 2251(a)</external-xref>) is amended—</text>
