which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to require medicare administrative contractors, unified program integrity contractors, and qualified independent contractors to pay the legal fees for certain durable medical equipment suppliers that were incorrectly denied payment.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fee Awards for Incorrect Reviews DME Appeals Act</short-title></quote> or the <quote><short-title>FAIR DME Appeals Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idfce2afa784664c4da7ca79e6ec32abd4"><enum>2.</enum><header>Payment of legal fees for certain durable medical equipment suppliers incorrectly denied payment</header><subsection commented="no" display-inline="no-display-inline" id="idce18c940bef2471f89a90fe0f5615235"><enum>(a)</enum><header>In general</header><text>Section 1869 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ff">42 U.S.C. 1395ff</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddabd017de91a41d1ba737ee5c8158b98"><subsection commented="no" display-inline="no-display-inline" id="id76192d9683c2458ba1fdb826437a1c03"><enum>(j)</enum><header>Payment of certain legal fees for certain durable medical equipment suppliers incorrectly denied payment</header><paragraph commented="no" display-inline="no-display-inline" id="id07cd669527c04661a824e3fece3c548b"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><subparagraph commented="no" display-inline="no-display-inline" id="idb250b8671ef341d489f7a0880bc5ce60"><enum>(A)</enum><header>Payment of fees</header><text display-inline="yes-display-inline">Notwithstanding section 504 of title 5, United States Code and section 2412 of title 28, United States Code (commonly known as the <quote>Equal Access to Justice Act</quote>), subject to the succeeding subparagraphs of this paragraph, in the event a supplier of durable medical equipment wins a favorable final appeal of an initial determination (and at the time of such initial determination, such supplier was a small business concern, as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)) by a covered contractor arising from or relating to the claims administration process involving durable medical equipment under this title, such appeal was heard by the Office of Medicare Hearings and Appeals, and the administrative law judge hearing such appeal determines that such initial determination was clearly erroneous, was not supported by substantial evidence, or failed to follow applicable provisions of law, regulation, or instruction issued by the Secretary in effect at the time of the initial determination, such contractor (regardless of whether such contractor is a named party in the appeal) shall pay the reasonable attorney fees (as applicable) and litigation costs of such supplier resulting from the appeal of the initial determination—</text><clause commented="no" display-inline="no-display-inline" id="id97af59220b9e4bae8400740a5b2dc17b"><enum>(i)</enum><text display-inline="yes-display-inline">at each stage of the appeal up to and including the hearing before the Office of Medicare Hearings and Appeals; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc4a7d5fb0d914ea19894d07df8578c9c"><enum>(ii)</enum><text display-inline="yes-display-inline">including any stage of the appeal at which such supplier did not receive a favorable decision.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2a4cccd59c924b52a686dc4d3549f514"><enum>(B)</enum><header>Splitting of fees</header><text>If, during the claims administrative process under this title, a covered contractor affirmed an initial determination that resulted in a favorable final appeal described in subparagraph (A), such covered contractor and the covered contractor who made the initial determination shall evenly split the reasonable attorney fees and litigation costs described in such subparagraph.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8b21222b34af4945adb087b0f25cde21"><enum>(C)</enum><header>Application</header><text display-inline="yes-display-inline">A supplier of durable medical equipment seeking the payment of reasonable attorney fees and litigation costs under subparagraph (A) shall, by not later than 30 days after the date the favorable final appeal was issued—</text><clause commented="no" display-inline="no-display-inline" id="id2275f0b1550a4eef898dfc918f51ade7"><enum>(i)</enum><text display-inline="yes-display-inline">submit an application for such fees and costs with evidence of such fees and costs to the administrative law judge who heard such appeal; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id000f805779d94bab92762d302198eb0b"><enum>(ii)</enum><text display-inline="yes-display-inline">serve such application on each covered contractor that made the initial determination or affirmed such initial determination.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcba933e7a86d4cc2bccd9fb16973d393"><enum>(D)</enum><header>Contractor response</header><text display-inline="yes-display-inline">A covered contractor shall have 30 days after the date on which such contractor is served an application under clause (ii) of subparagraph (C) to submit a response to the administrative law judge described in clause (i) of such subparagraph.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e182b067438488b8c1b8f0940a4b170"><enum>(E)</enum><header>Determination</header><clause commented="no" display-inline="no-display-inline" id="idc3b7a9291cbc40119369595d6479ac62"> <enum>(i)</enum> <header>In general</header> <text display-inline="yes-display-inline">Not later than 60 days after the end of the 30-day period described in subparagraph (D), an administrative law judge described in subparagraph (C)(i) shall issue a determination as to the amount (if any) of reasonable attorney fees and litigation costs that shall be awarded to a supplier of durable medical equipment pursuant to subparagraph (A). In making such determination, the administrative law judge shall—</text>
                                    <subclause commented="no" display-inline="no-display-inline"
                                        id="id5c8d3a0ee85e4ec6b0f0faec0564fbbf">
                                        <enum>(I)</enum>
 <text display-inline="yes-display-inline">consider evidence submitted in the application described in subparagraph (C)(i) and any response submitted under subparagraph (D);</text>
                                    </subclause>
                                    <subclause commented="no" display-inline="no-display-inline"
                                        id="id8b65f912472e42c88f95457855e82585">
                                        <enum>(II)</enum>
 <text display-inline="yes-display-inline">with respect to reasonable attorney fees, use the lodestar method; and</text>
                                    </subclause>
                                    <subclause commented="no" display-inline="no-display-inline"
                                        id="id73928be9045a4d70939a5ada9b98841e">
                                        <enum>(III)</enum>
 <text>if more than 1 covered contractor was served under subparagraph (C)(ii), specify the amount owed by each covered contractor.</text>
                                    </subclause>
 </clause><clause commented="no" display-inline="no-display-inline" id="id9c14d47556f34e09888f79590fa996d2"><enum>(ii)</enum><header>Non-appealable decision</header><text display-inline="yes-display-inline">Any determination made pursuant to clause (i) shall not be appealable.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id215258affc824bb6888219e73a635a0e"><enum>(2)</enum><header>Ineligibility of certain payments</header><text>Paragraph (1) shall not apply to a favorable final appeal of an initial determination by a covered contractor won by a supplier of durable medical equipment when the initial unfavorable determination resulted from—</text><subparagraph commented="no" display-inline="no-display-inline" id="id3b310f297e2e4e768265a39cd2f8f196"><enum>(A)</enum><text display-inline="yes-display-inline">such supplier failing to provide any required documentation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida15f06a2890d431188bebe1512b86211"><enum>(B)</enum><text>such supplier failing to comply with any billing or submission requirement; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd88ffc637c7c4e699f7f12d6c711ea22"><enum>(C)</enum><text>a covered contractor—</text><clause commented="no" display-inline="no-display-inline" id="idd1e41c8464f244c09001cba84a789a78"><enum>(i)</enum><text display-inline="yes-display-inline">applying current law or guidance issued by the Secretary in effect at the time the initial determination was made, and such law or guidance had changed at the time of the favorable final appeal; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id47d7b3b4972d4aa191619abccb3c7fc1"><enum>(ii)</enum><text>applying a local coverage determination in effect at the time of the initial determination.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide543ef6933c94f49956fce4a00c8da07"><enum>(3)</enum><header>Clawback</header><text display-inline="yes-display-inline">If, after any reasonable attorney fees or litigation costs have been awarded to a supplier of durable medical equipment under this subsection, a court or other adjudicator determines that such supplier obtained a favorable final appeal through fraud, misrepresentation, or bad-faith conduct, such supplier shall be required to return such fees or costs to each covered contractor who was required to pay such fees or costs to such supplier.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb511d528f80f4b71936d094321fa5374"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id6b235316599747b0b171785a770302a6"><enum>(A)</enum><header>Covered contractor</header><text display-inline="yes-display-inline">The term <term>covered contractor</term> means—</text><clause commented="no" display-inline="no-display-inline" id="id466ae1dddc5a4fcc842e42012fb6e6a4"><enum>(i)</enum><text display-inline="yes-display-inline">an eligible entity with a contract under section 1893;</text></clause><clause commented="no" display-inline="no-display-inline" id="idb8fe82df6809425e9c00887bf43de841"><enum>(ii)</enum><text display-inline="yes-display-inline">a qualified independent contractor (as defined in subsection (c)(2)); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id028a5452a97a4eb99a39898481e0e0c8"><enum>(iii)</enum><text display-inline="yes-display-inline">a medicare administrative contractor (as defined in section 1874A(a)(3)).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id214e53669f104391af7953ddeb62a0d8"><enum>(B)</enum><header>Favorable</header><text display-inline="yes-display-inline">The term <term>favorable</term> means, with respect to an appeal of a decision arising from or relating to the claims administration process under this title, a decision that is decided in the appellant’s favor with respect to every issue related to coverage and payment rules or the application of eligibility, entitlement, or premium rules.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc237997807104888943210091489f148"><enum>(C)</enum><header>Final appeal</header><text display-inline="yes-display-inline">The term <term>final appeal</term> means the last stage of review available within the claims administration process under this title in which—</text><clause commented="no" display-inline="no-display-inline" id="id9270c7b64ac147c7bc3b6991de48e398"><enum>(i)</enum><text display-inline="yes-display-inline">the only appeal available is a review by the Medicare Appeals Council; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide2b4a67e1b614c5e81dd5d3c96d79f2e"><enum>(ii)</enum><text display-inline="yes-display-inline">an administrative law judge enters a binding determination of the rights or obligations of the parties.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id841aa21dbc90412f8806b66ddbc3de1e"><enum>(D)</enum><header>Litigation costs</header><text display-inline="yes-display-inline">The term <term>litigation costs</term> means, with respect to a favorable final appeal by a supplier of durable medical equipment, out-of-pocket expenses (not including reasonable attorney fees) incurred in the course of litigation that are traditionally taxable or recoverable by a prevailing party under statute, rule, or contract.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5203706722c14ef1a360828cf35fc4a3"><enum>(E)</enum><header>Reasonable attorney fees</header><text display-inline="yes-display-inline">The term <term>reasonable attorney fees</term> means, with respect to a favorable final appeal by a supplier of durable medical equipment, compensation for the reasonable time expended by an attorney or paralegal on legal work necessary to litigation.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idef85a714a76c43809189ebe83e995d3b"><enum>(b)</enum><header>Medicare administrative contractors</header><text display-inline="yes-display-inline">Section 1874A(d)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395kk-1">42 U.S.C. 1395kk–1(d)(4)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idebfa7e762a4a4aecbe8a62c50fce43ba"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>(B) and (D)</quote> and inserting <quote>(B), (C), and (D)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68473b46ae0f428da3a3ae7e61fad3b3"><enum>(2)</enum><text>in subparagraph (C)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id23eacbb414b94a2c9cd4e18d96fefdc6"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text style="OLC" level="subparagraph">Indemnification</header-in-text>.—Indemnification</quote> and inserting</text><quoted-block id="id941b8c4e7dca4a7da89d4c70c5536e35" display-inline="yes-display-inline"><text><header-in-text level="subparagraph" style="OLC">Indemnification</header-in-text>.—</text><clause commented="no" display-inline="no-display-inline" id="id7bb2f2b0538a4db2a4cc9f56b559d57a"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), indemnification</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id445349244c2747259ff79c7c232152df"><enum>(B)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id02d1ce18826b4199858779af52a73e90"><clause commented="no" display-inline="no-display-inline" id="id9c21a27d2bc54a7aa6803e68f61cdb84"><enum>(ii)</enum><header>No indemnification for legal fees</header><text>No reasonable attorney fees or litigation costs awarded to a supplier of durable medical equipment under section 1869(j) shall be subject to indemnification by the Secretary under subparagraph (A).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idbb5ad6ef12d1475ca24bafc6e7b7c3bf"><enum>(c)</enum><header>Unified program integrity contractors</header><text>Section 1893(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ddd">42 U.S.C. 1395ddd(e)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id470f5e6101f34ec8887185060a216798"><enum>(1)</enum><text>by striking <quote><header-in-text style="OLC" level="subsection">Liability</header-in-text>.—The Secretary</quote> and inserting</text><quoted-block id="id3ceb9f8876df446f98c206cfc16fa0cc" display-inline="yes-display-inline"><text><header-in-text level="subsection" style="OLC">Liability</header-in-text>.—</text><paragraph commented="no" display-inline="no-display-inline" id="id820453fb80b8484391de99cf9f0e5581"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id972ed27aae5e426484ef16c8c2b00e8c"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc25e6899f7da4d9d8e17f843242922bc"><paragraph commented="no" display-inline="no-display-inline" id="id48e01ceb9a4e442cb742de427dac3d33"><enum>(2)</enum><header>Payment of certain legal fees</header><text display-inline="yes-display-inline">Any regulation promulgated by the Secretary under paragraph (1) shall not include any limitation of a contractor's liability for any reasonable attorney fees or litigation costs awarded to a supplier of durable medical equipment under section 1869(j).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb89d3e650c284c3da75edd8e1f79d57e"><enum>(d)</enum><header>Qualified independent contractors</header><text>Section 1869(c)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ff">42 U.S.C. 1395ff(c)(5)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id455f588eafa74719bd2c87cac9379fd2"><enum>(1)</enum><text>by striking <quote><header-in-text style="OLC" level="paragraph">liability</header-in-text>.—No qualified</quote> and inserting</text><quoted-block id="idfc7d6689413646198850400939680cbc" display-inline="yes-display-inline"><text><header-in-text level="paragraph" style="OLC">liability</header-in-text>.—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7b92fe14203e4fcb9aef53cc6fb67bc8"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), no qualified</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id671af225d1a74c388984bc9971bb68a1"><enum>(2)</enum><text>by inserting at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id89f9f32d7b954ac7ae7d610baf13fbc9"><subparagraph commented="no" display-inline="no-display-inline" id="idad945e4a1a1740aab69835b5a3d81922"><enum>(B)</enum><header>Payment of certain legal fees</header><text>Subparagraph (A) shall not apply to any reasonable attorney fees or litigation costs awarded to a supplier of durable medical equipment under subsection (j).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4c82a45d860d45eb8859b251bc647fe8"><enum>(e)</enum><header>Implementation</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall promulgate regulations to carry out the amendments made by this section.</text></subsection><subsection id="idce194dce61f34bc281c1ae143758f36b"><enum>(f)</enum><header>Effective date</header><text>The amendments made by this section shall apply to contracts entered into on or after January 1 of the year following the year in which the Secretary promulgates the regulations described in subsection (e).</text></subsection></section></legis-body></bill>
