<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5048</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260721">July 21, 2026</action-date><action-desc><sponsor name-id="S375">Mr. Daines</sponsor> (for himself, <cosponsor name-id="S323">Mr. Risch</cosponsor>, and <cosponsor name-id="S288">Ms. Murkowski</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Power Act to modernize the hydropower licensing process, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H684F9CE19C714DDE980F1B3E8597A636"><section section-type="section-one" id="H57B6194751854C868ED5A2AE072BEABA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hydropower Licensing Affordability Act</short-title></quote>.</text></section><section commented="no" id="H5E6E6372835E400A9188F31737799B34"><enum>2.</enum><header>Ensuring proper scope of Federal reservation license conditions</header><text display-inline="no-display-inline">Section 4(e) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/797">16 U.S.C. 797(e)</external-xref>) is amended, in the first proviso, by inserting <quote>to reasonably mitigate the direct adverse effect of the applicable project on such reservation, so as to provide</quote> after <quote>deem necessary</quote>.</text></section><section id="H9A2BF96EC0F64603A31D14741F426BFB"><enum>3.</enum><header>Ensuring proper scope of prescribed fishways</header><text display-inline="no-display-inline">Section 18 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/811">16 U.S.C. 811</external-xref>) is amended, in the first sentence, by inserting <quote>, to reasonably mitigate the direct adverse effect of the applicable project on the population of a species of fish in the applicable river system</quote> before the period at the end.</text></section></legis-body></bill>
