which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to modify the handling of air quality monitoring with respect to prescribed fires, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildfire Emissions Prevention Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id94c1a836e2424975a89454eab88c278f"><enum>2.</enum><header>Air quality monitoring data influenced by exceptional events</header><subsection commented="no" display-inline="no-display-inline" id="id5fdb8cc36b294f39900c839c836e1b60"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 319(b) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idcada68865e0e4e6b8891dd348953f68f"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="id40fff99db08b4ea185e2f84763c70536"><enum>(A)</enum><text>in subparagraph (B)—</text><clause commented="no" display-inline="no-display-inline" id="idca232201dddb4dde98c53fcf716082fc"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by striking <quote>In this subsection, the</quote> and inserting <quote>The</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id58b165a33f00430995dcb463b0294f06"><enum>(ii)</enum><text display-inline="yes-display-inline">by redesignating clauses (i) through (iii) as subclauses (I) through (III), respectively, and indenting appropriately;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id721f26ed6250491695e977eb06611469"><enum>(B)</enum><text>by redesignating subparagraph (B) as clause (ii) and indenting appropriately;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99b6e689aa044df7808a748adebb6325"><enum>(C)</enum><text>by striking the paragraph designation and heading and all that follows through <quote>exceptional event.</quote> at the end of subparagraph (A)(iv) and inserting the following:</text><quoted-block style="OLC" id="idF1E80312E110453DAB08D0799C2CDA14" act-name=""><paragraph id="id8F99D286C1174108922398875426C2CA"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="id3c0e92bad188420eb71d95a7bbbd5515"><enum>(A)</enum><header>Exceptional event</header><clause commented="no" display-inline="no-display-inline" id="idf99c45dbb5634741a7815e758f1d3b98"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>exceptional event</term> means an event—</text><subclause commented="no" display-inline="no-display-inline" id="idb0c2dfb0696b42bc8b7bce147e2542f4"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="idbcff9e3a55cd4a8bbef72254e37dae14"><enum>(aa)</enum><text display-inline="yes-display-inline">that—</text><subitem commented="no" display-inline="no-display-inline" id="id5fad4c97d51f43f89704f2adcbe6ce7d" indent="up1"><enum>(AA)</enum><text display-inline="yes-display-inline">affects air quality;</text></subitem><subitem commented="no" display-inline="no-display-inline" indent="up1" id="id9a3736d33571486ca1633a92bddee903"><enum>(BB)</enum><text display-inline="yes-display-inline">is not reasonably controllable or preventable; and</text></subitem><subitem commented="no" display-inline="no-display-inline" indent="up1" id="id5a8bf43f085740368907b918f96319d4"><enum>(CC)</enum><text display-inline="yes-display-inline">is an event caused by human activity that is unlikely to recur at a particular location or a natural event; or</text></subitem></item><item commented="no" display-inline="no-display-inline" indent="up1" id="id8412dee16f824b939d35a88151f9cee3"><enum>(bb)</enum><text display-inline="yes-display-inline">that is a prescribed fire; and</text></item></subclause><subclause id="id715d065d51654f69a28d2f88e06e4392"><enum>(II)</enum><text>that is—</text><item commented="no" display-inline="no-display-inline" id="ide3d508c08e204bcea70b495a8f2812e2"><enum>(aa)</enum><text display-inline="yes-display-inline">determined by the Administrator, through the process established in the regulations revised under paragraph (2)(B), to be an exceptional event; or</text></item><item commented="no" display-inline="no-display-inline" id="id5f4ecf70e6e147468949d858407cdb4a"><enum>(bb)</enum><text display-inline="yes-display-inline">deemed to be an exceptional event pursuant to a State petition deemed to be approved pursuant to paragraph (3)(B)(v).</text></item></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id552f41738b49494c976284cbcff51dfa"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="id1314D23FE8F54A6FA93F695CFFBB1E83" act-name=""><subparagraph id="id4F8743B199F14A9CB1A6701B5B0FA84C"><enum>(B)</enum><header>Prescribed fire</header><clause commented="no" display-inline="no-display-inline" id="idb7e841823da5481280f6dd8baf7b0f24"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>prescribed fire</term> means a fire deliberately ignited in accordance with applicable law (including regulations) to burn wildland fuels in a natural or modified state under specified environmental conditions that are intended to allow the fire to be confined to a predetermined area and produce the fireline intensity and rate of spread required to attain planned resource management objectives.</text></clause><clause commented="no" display-inline="no-display-inline" id="id617bfa6f1b11457eb3b129fa4f7725bc"><enum>(ii)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>prescribed fire</term> includes cultural burning activities, as determined by an Indian tribe.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2bc0d6a4ccc74bbda18eda8a770fb083"><enum>(2)</enum><text>in paragraph (2), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" id="id91C0BDFEBAC4489D8859ADE6B5B01DDA" act-name=""><subparagraph id="id48729F672E4E464FA7E3CB1C7C9814BE"><enum>(B)</enum><header>Revision of regulations</header><clause commented="no" display-inline="no-display-inline" id="id11466adac0e94e36885807c9b81362f2"><enum>(i)</enum><header display-inline="yes-display-inline">Proposed revisions</header><text>Not later than 270 days after the date of enactment of the <short-title>Wildfire Emissions Prevention Act of 2026</short-title>, the Administrator, after consultation with Federal land managers, State air pollution control agencies, State foresters, State fish and wildlife agencies, and Indian tribes, shall publish in the Federal Register any necessary revisions to existing regulations promulgated under this section—</text><subclause commented="no" display-inline="no-display-inline" id="id765b7e2205204efab473c643a3f9c933"><enum>(I)</enum><text>to reduce the burden and cost for States to demonstrate an exceptional event;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id2a6913157c8347708232f8674bcc2dd9"><enum>(II)</enum><text display-inline="yes-display-inline">to clarify the eligibility of prescribed fires as exceptional events pursuant to the definition in paragraph (1)(A); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4abcfafffbae4248bd6d268463f41046"><enum>(III)</enum><text display-inline="yes-display-inline">to establish the procedure for the review of State petitions described in paragraph (3)(B)(iv).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id398eef4a951f468fab9aee4f1258cdfb"><enum>(ii)</enum><header>Final revisions</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which the Administrator publishes proposed revisions to regulations promulgated under this section under clause (i), and after providing an opportunity for interested persons to make oral presentations of views, data, and arguments regarding the proposed revisions, the Administrator shall finalize those revisions to govern air quality monitoring data influenced by exceptional events that are consistent with paragraph (3).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idb18d8572ed2c4ce18d8f1c9b77983790"><enum>(3)</enum><text>in paragraph (3)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd8d5a4ffca5f444ab2a05806a7f51993"><enum>(A)</enum><text>in subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="ide417991f141c462fa8d31d98058df51e"><enum>(i)</enum><text>by redesignating clauses (ii) through (v) as clauses (iii) through (vi), respectively;</text></clause><clause commented="no" display-inline="no-display-inline" id="id461b61f1956648538b20b15aeb8fa6e5"><enum>(ii)</enum><text>by inserting after clause (i) the following:</text><quoted-block id="id53F9DC4D3CA440CFB3724444D329E21F" style="OLC" act-name=""><clause id="idC98F0E3E1500446C8E9763B6E23DF0E6"><enum>(ii)</enum><text>the principle that prescribed fire can play an important role in reducing the magnitude and frequency of wildfires;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="id2125e70840c94fa7a38e18e7c32e2628"> <enum>(iii)</enum> <text display-inline="yes-display-inline">in clause (iv) (as so redesignated), by striking <quote>manner, an appropriate</quote> and inserting <quote>manner in an appropriate</quote>; and</text>
 </clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7e93d59378514008a01dc261361c5148"><enum>(B)</enum><text>in subparagraph (B)—</text><clause commented="no" display-inline="no-display-inline" id="id9d8dd845ebbd4b55afd3792bd8c3f061"><enum>(i)</enum><text display-inline="yes-display-inline">in clause (ii), by inserting <quote>or, for prescribed fire, be reasonably expected to exist,</quote> after <quote>must exist</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id496cfb1092bb46a6be97d417e4286df9"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (iii), by striking <quote>and</quote> at the end;</text></clause><clause commented="no" display-inline="no-display-inline" id="id94072ade2ae1434188dac2f5ad3e7e24"><enum>(iii)</enum><text display-inline="yes-display-inline">in clause (iv)—</text><subclause commented="no" display-inline="no-display-inline" id="id4ceec73436b144c9b6e9489363fac19a"><enum>(I)</enum><text>by striking <quote>with respect to exceedances</quote> and inserting the following: “with respect to—</text><quoted-block style="OLC" id="idE2144831DC894EC18A5AECD9DA8D877E" act-name=""><subclause id="id6F4694B102F542FD96A06FC6BEB4FAC9"><enum>(I)</enum><text>exceedances</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subclause><subclause commented="no" display-inline="no-display-inline" id="id9879acdab4134a149b89557af4097c47"><enum>(II)</enum><text>in subclause (I) (as so designated), by striking the period at the end and inserting <quote>; and</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id12842e0079444dd1a76bf8f573aac917"><enum>(III)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="idCCB7D8FB41DC4D06834C1C4B41B91C5B" act-name=""><subclause id="id56C95A453F5A45F09AFB68CC889B9948"><enum>(II)</enum><text>the designation, redesignation, classification, or reclassification of an area, the determination of attainment of a national ambient air quality standard, or other determinations by the Administrator for determining compliance with this Act; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ide35589f85e4c4f7e955ea06c9ea8fd9e"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="id85B20F8EFD13479E9EEB460A8035B56B" act-name=""><clause id="idAA7F2C9FCD6B4DE6AD45FD456D658F4F"><enum>(v)</enum><subclause commented="no" display-inline="yes-display-inline" id="id7b4ef8732a34409ba40fe992766d5605"><enum>(I)</enum><text>a State petition described in clause (iv) be approved, disapproved, or approved-in-part and disapproved-in-part by the Administrator by the date that is 1 year after the date on which the petition is submitted; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6367a97a944c4165ab1aeb8ef69790d7" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">if the Administrator does not act on a State petition described in clause (iv) by that date, the State petition be deemed approved unless the Administrator, through the process established in the regulations revised under paragraph (2)(B), subsequently determines that the event is not an exceptional event.</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd3bfd7c577d84c0cbd9c0be165b7cc0f"><enum>(4)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idaa62e7f42e4d431593d73347c3dbc24f"><paragraph id="idbd81418a257c40bb9d2b360b92fb3774"><enum>(4)</enum><header>Regional, national, or international exceptional events</header><text>At the request of multiple State or local government agencies or Tribal authorities, the Administrator shall conduct analyses or otherwise collaborate with such agencies or authorities to lead the development of regional, national, or international exceptional event demonstrations when exceptional events impact multijurisdictional areas.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id95b39532cfb94bba990085c83324050e"><enum>(b)</enum><header>Savings provision</header><text>Nothing in this section or an amendment made by this section makes stationary source (as defined in section 51.491 of title 40, Code of Federal Regulations (as in effect on the date of enactment of this Act)) emissions that did not qualify as an exceptional event (as defined in section 319(b)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7619">42 U.S.C. 7619(b)(1)</external-xref>)) on the day before the date of enactment of this Act an exceptional event under that section after that date of enactment.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id43ba38a4429149329cf71d6d9c069350"><enum>3.</enum><header>Smoke ready communities program</header><subsection id="id152d2508f18d4d968a7a1d997eb67fd4"><enum>(a)</enum><header>Establishment</header><text>Subject to the availability of appropriations, the Administrator of the Environmental Protection Agency (referred to in this section as the <term>Administrator</term>) may make competitive grants under section 103(b)(3) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7403">42 U.S.C. 7403(b)(3)</external-xref>) to eligible entities for the assessment, prevention, control, or abatement of wildfire smoke hazards in community buildings, including school buildings (as defined in section 11 of the Asbestos School Hazard Detection and Control Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/20/3610">20 U.S.C. 3610</external-xref>)), and related activities.</text></subsection><subsection id="id3c1bf0de81aa4941a1b8cff151f2e2de"><enum>(b)</enum><header>Eligible entities</header><text>The entities eligible for a grant under subsection (a) are—</text><paragraph id="id56f010f8457549fda9b76d7cac82fb58"><enum>(1)</enum><text>States;</text></paragraph><paragraph id="id820eaa5fafd34042929b6b0fe8c36e9e"><enum>(2)</enum><text>federally recognized Indian Tribes; and</text></paragraph><paragraph id="id2fe571af481143d69e1e13e19f5272de"><enum>(3)</enum><text>any entities eligible for grants under section 103(b)(3) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7403">42 U.S.C. 7403(b)(3)</external-xref>).</text></paragraph></subsection><subsection id="id2ff0607ed7ef417a83813475b3010368"><enum>(c)</enum><header>Cost share</header><paragraph id="ida4f3afaec9974579bec20ffb517c9a6d"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Federal share of the cost of an activity carried out using a grant under subsection (a) shall be not more than 90 percent.</text></paragraph><paragraph id="id7a066d7fa764473fa16634da4b275ba7"><enum>(2)</enum><header>Waiver</header><text>The Administrator may waive the cost-share requirement under paragraph (1) if the facility that is the subject of the activity for which the grant is provided is in an economically distressed community.</text></paragraph></subsection><subsection id="idb298699b1db94a89ab78707197e41dea"><enum>(d)</enum><header>Limitation</header><text>Of the amounts made available each fiscal year for grants under this section, not more than 25 percent may be awarded to recipients in any 1 State.</text></subsection></section></legis-body></bill>
