A BILL
To require the Secretary of State to establish a memorial to honor
victims of genocide and crimes against humanity committed by the
Chinese Communist Party and individuals otherwise persecuted in the
People's Republic of China, and for other purposes.
Be it enacted by the Senate and House of Representatives of the
United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the ``Honoring the Victims of Communist
China's Tyranny Act''.
SEC. 2. DEFINITIONS.
In this Act:
(1) International park.--The term ``International Park''
means the public park and landscaped area located in Northwest
Washington, District of Columbia, in the vicinity of 3505
International Place NW, bounded generally by International
Place NW and International Drive NW.
(2) Memorial.--The term ``memorial'' means the memorial
established under section 3.
(3) Secretary.--The term ``Secretary'' means the Secretary
of State.
SEC. 3. ESTABLISHMENT OF MEMORIAL.
(a) In General.--Not later than 2 years after the date of the
enactment of this Act, the Secretary shall establish a memorial in
International Park.
(b) Purpose.--The memorial shall honor--
(1) victims of genocide and crimes against humanity
committed by the Chinese Communist Party, especially those who
have suffered persecution under policies implemented during Xi
Jinping's tenure as General Secretary of the Chinese Communist
Party; and
(2) individuals otherwise persecuted for the peaceful
exercise of fundamental human rights, including the free
exercise of their political and religious beliefs, in the
People's Republic of China.
(c) Message of the Memorial.--The memorial shall include language
expressing--
(1) the solidarity and friendship of the people of the
United States with the people of the People's Republic of
China; and
(2) the hope and prayer that the Chinese people may one day
enjoy the blessings of liberty.
(d) Educational and Interpretive Elements.--To the extent
practicable, the memorial shall include--
(1) educational or interpretive elements (including
inscriptions and artwork) describing--
(A) the genocide of Uyghurs and other ethnic and
religious minorities in Xinjiang;
(B) efforts to suppress the culture, religion,
history, and language of Tibetans and Southern
Mongolians;
(C) the imprisonment and persecution of democracy
advocates, journalists, religious leaders, and
political prisoners in the People's Republic of China,
including Jimmy Lai;
(D) restrictions on freedom of religion, speech,
association, and the press in the People's Republic of
China; and
(E) the broader historical consequences of
authoritarian repression and crimes against humanity;
and
(2) other educational or interpretive elements as the
Secretary determines appropriate.
(e) Existing Memorials.--In establishing the memorial, the
Secretary shall not remove, relocate, or materially alter any memorial
located within International Park as of the date of the enactment of
this Act.
SEC. 4. ADMINISTRATION.
(a) In General.--The memorial shall be administered by the
Secretary.
(b) Consultation.--In designing, constructing, and maintaining the
memorial, the Secretary may consult with--
(1) survivors of persecution, genocide, imprisonment, or
political repression in the People's Republic of China,
especially those persecuted during Xi Jinping's tenure as
General Secretary of the Chinese Communist Party;
(2) family members of victims;
(3) organizations promoting democracy, human rights, ethnic
and religious freedom, or freedom of expression in the People's
Republic of China; and
(4) any other individual, organization, or Federal agency
as the Secretary determines appropriate.
SEC. 5. FUNDING.
(a) Use of Existing Funds.--Subject to subsection (b), the
Secretary may use amounts otherwise appropriated to the Department of
State, including the Bureau of Administration, to carry out this Act.
(b) Limitation.--
(1) In general.--The amount of Federal funds expended for
the design and construction of the memorial may not exceed
$500,000.
(2) Exception.--The expenditure of donated funds shall not
be subject to the limitation under paragraph (1).
(c) Acceptance of Donations.--The Secretary may, in accordance with
applicable law, solicit, accept, and use private donations for the
establishment, maintenance, preservation, and improvement of the
memorial.
(d) No Additional Authorization of Appropriations.--No additional
funds are authorized to be appropriated to carry out this Act.
