which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to make all children eligible for Medicaid from birth until age 26, to require States to automatically enroll children and young adults under age 26 in the State Medicaid program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>MediKids Act</short-title></quote>.</text></section><section id="idB7DFF85984B24572A2933414F479953B"><enum>2.</enum><header>MediKids</header><subsection id="id04D5581684464D16A0809815FD64A478"><enum>(a)</enum><header>Eligibility until age 26</header><paragraph commented="no" display-inline="no-display-inline" id="id6472c269cf2f49098638b3fe0a8a2fe5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1902(a)(10)(A)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)(i)</external-xref>) is amended—</text><subparagraph id="idF0AA118DB181472A8A7E6180FB3FF056"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of subclause (VIII);</text></subparagraph><subparagraph id="id560F8B07AE8B4C698DAE032461E7E45A"><enum>(B)</enum><text>in subclause (IX)(dd), by inserting <quote>or</quote> at the end; and</text></subparagraph><subparagraph id="idE1633CDBE6FE4E96B8767688EB94C595"><enum>(C)</enum><text>by adding at the end the following new subclause:</text><quoted-block style="traditional" id="idF94150DB50CA4533987DFF2CB351BC23" act-name=""><subclause id="id7E6F225E8D704F2893D33E35835201C0"><enum>(X)</enum><text display-inline="yes-display-inline">beginning on the date that is 2 years after the date of enactment of this subclause, who are individuals who have not attained 26 years of age;</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd6235de0375e4517810203cb8987b2da"><enum>(2)</enum><header>Effective date</header><text>The amendment made by this subsection shall take effect on the date of enactment of this Act.</text></paragraph></subsection><subsection id="id8BBE345E0D184330B1F1D2A60DF9FE6F"><enum>(b)</enum><header>Automatic enrollment</header><text display-inline="yes-display-inline">Section 1902(e) of the Social Security Act is amended by striking paragraph (4) and inserting the following:</text><quoted-block style="traditional" id="id6FA8882FF9C847E0ADEBA5C01732AE7C" act-name=""><paragraph id="idD69B672E85EE4A8B846F78C525C941E2"><enum>(4)</enum><header>Automatic enrollment of children</header><subparagraph id="id6AA3E847F4BA486093C38438F2135560"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any child born in a State on or after the date that is 2 years after the date of enactment of the <short-title>MediKids Act</short-title> shall be considered to have applied for medical assistance under the State plan and shall be automatically enrolled for such assistance on the date of their birth.</text></subparagraph><subparagraph id="id9410FA2A65C24A968423B2E0E70F08B1"><enum>(B)</enum><header>Notification requirement</header><text display-inline="yes-display-inline">The State shall inform the parent, guardian, or custodial relative of a child who is automatically enrolled in the State plan under subparagraph (A) of the services that will be covered, appropriate methods for using such services, medical support obligations (under section 1912(a)) created by enrollment (if applicable), the actions the parent, guardian, or relative must take (if any) to maintain enrollment, and the actions the parent, guardian, or relative may take to disenroll the child.</text></subparagraph><subparagraph id="id71F9C6E20CCD4BF49FC9849FA34E5307"><enum>(C)</enum><header>Opt-out if other coverage is available</header><text>The State shall establish a process to allow the parent, guardian, or custodial relative of a child who is automatically enrolled in the State plan under subparagraph (A) to disenroll the child from the State plan through affirmation in writing if the child is enrolled in other health benefits coverage that—</text><clause id="id4013DA80ABFE4DE4A093F1EF85CD2D0C"><enum>(i)</enum><text>at a minimum, provides the essential health benefits defined by the Secretary under section 1302(b) of the Patient Protection and Affordable Care Act; and</text></clause><clause id="idCBC99672FAF34A6089E2A081C7A27C47"><enum>(ii)</enum><text>meets such other requirements as the Secretary determines appropriate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3a835d46bc64adda956174b00945f7c"><enum>(D)</enum><header>Special rule</header><text display-inline="yes-display-inline">With respect to an individual who is automatically enrolled in the State plan under subparagraph (A) as a child and has attained 18 years of age, the notification requirement described in subparagraph (B) and the opt-out requirement described in subparagraph (C) shall apply to such individual in lieu of the parent, guardian, or custodial relative of such individual.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="id6D816AF7CD944A15A64FFFF941887A4E"><enum>(c)</enum><header>Continuous eligibility</header><text display-inline="yes-display-inline">Section 1902(e)(12) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(e)(12)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id216f27e69825493db0ff4169a717ad5c"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading by inserting <quote><header-in-text level="paragraph" style="OLC">and young adults</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">children</header-in-text></quote>;</text></paragraph><paragraph id="ide6cfe8809cab45b68688a38f686b517c"><enum>(2)</enum><text>in the matter preceding subparagraph (A), by striking <quote>19</quote> and inserting <quote>26</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id367aa39f21d243c09fc35eda6867fdfe"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subparagraph (A);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1cfb659a7bb849e696f1221089d18aa7"><enum>(4)</enum><text>by redesignating subparagraphs (B) and (C) as subparagraphs (A) and (B); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54cd10e11f194ce6853818011c73feb0"><enum>(5)</enum><text>in subparagraph (A), as so redesignated, by striking <quote>19</quote> and inserting <quote>26</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id82ec18b9dae94e5681ceda4ab8332651"><enum>(d)</enum><header display-inline="yes-display-inline">Exclusion from definition of minimum essential coverage</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B(c)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text><quoted-block style="tax" id="idD05B2170FBA04D70AE6A028CDB7E9E4A" act-name=""><subparagraph id="idBE52772A263B47078D0A6C8C5B8DAE77"><enum>(D)</enum><header>Treatment of certain coverage under the Medicaid program</header><text>For purposes of subparagraph (B), an individual shall not be treated as eligible for minimum essential coverage if—</text><clause id="id9058A023298B45068A43CBB557516DF8"><enum>(i)</enum><text>such coverage consists of eligibility for medical assistance under a State Medicaid program under section 1902(a)(10)(A)(i)(X) of the Social Security Act; and</text></clause><clause id="idF86E9F8F995746F3A68976A8540DD8D9"><enum>(ii)</enum><text>the individual is not enrolled in such a program for such medical assistance.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1898831FCC3F4396AF5FE83A524AC13D"><enum>(e)</enum><header>Coverage of children and young adults without regard to immigration status</header><paragraph commented="no" display-inline="no-display-inline" id="iddd5b2fb275124572b722164adc2ce870"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Section 1903(v) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(v)</external-xref>) is amended—</text><subparagraph id="idE7D49CA93F3C441A959BE54DBE1CBAE8"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and (5)</quote> and inserting <quote>(5), and (6)</quote>;</text></subparagraph><subparagraph id="idA1E6897E97E04D358951F3C4FC21422E"><enum>(B)</enum><text>in paragraph (4)(A)(ii)—</text><clause id="id1C5BBA39DC68422D90E02FA341631B31"><enum>(i)</enum><text>in the clause header, by inserting <quote><header-in-text level="clause" style="traditional">and young adults</header-in-text></quote> after <quote><header-in-text level="clause" style="traditional">Children</header-in-text></quote>; and</text></clause><clause id="id93D09F1D099C44C28AC76A8C79BE52B5"><enum>(ii)</enum><text>by striking <quote>21</quote> and inserting <quote>26</quote>; and</text></clause></subparagraph><subparagraph id="idFB9251225735487CB4FD7C8201A83205"><enum>(C)</enum><text>by adding at the end the following paragraph:</text><quoted-block style="traditional" id="idE991B3CD0B8F473D9DB96A887663E2BF" act-name=""><paragraph id="id5B84032AD65B4EDBB3F3256F1F38EC20" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE2B03BD887754453BFE05E7381F141D3"><enum>(A)</enum><text>Notwithstanding any other provision of law, on and after the date that is 2 years after the date of enactment of this paragraph, a State shall provide medical assistance under this title to any individual residing or present in the United States who is eligible for medical assistance under section 1902(a)(10)(A)(i)(X), without regard to whether the individual is lawfully residing or lawfully present in the United States.</text></subparagraph><subparagraph indent="up1" id="id0B567232E68E40019DEB3F4C03DE011C"><enum>(B)</enum><text> No debt shall accrue under an affidavit of support against any sponsor of an individual provided medical assistance in accordance with subparagraph (A) and the cost of such assistance shall not be considered as an unreimbursed cost.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idB54DEAE144EF48F1B42AC3E474359080"><enum>(2)</enum><header>Conforming amendments</header><subparagraph id="idA03C39A46AE9462899A48E0D054F7B71"><enum>(A)</enum><text>Section 1137(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-7">42 U.S.C. 1320b–7(f)</external-xref>) is amended by inserting <quote>or to individuals who are eligible for medical assistance under section 1902(a)(10)(A)(i)(X) and are provided such assistance in accordance with section 1903(v)(6)</quote> before the period.</text></subparagraph><subparagraph id="id2FDA165456E34E1B86C1D70A799D784D"><enum>(B)</enum><text>Section 2107(e)(1)(Q) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)(Q)</external-xref>) is amended by inserting <quote>and young adults</quote> after <quote>children</quote> each place it appears.</text></subparagraph><subparagraph id="ida462029bcde94d1295c5458be1a2fb60"><enum>(C)</enum><text>Section 402(b)(2) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1612">8 U.S.C. 1612(b)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7c58f0579169457292b51d69353303da"><subparagraph id="id58f3cc36b0b84a9394bea8ee7d3eae9b"><enum>(H)</enum><header>Medicaid exception for children and young adults</header><text>With respect to eligibility for benefits for the program defined in paragraph (3)(C) (relating to the Medicaid program), section 401(a) and paragraph (1) shall not apply to any individual who has not attained 26 years of age.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="idc6aacee80ee04db9916eb6b37d59ef4a"><enum>(D)</enum><text>Section 403(d) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1613">8 U.S.C. 1613(d)</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="id0543728e07be4eebbe715ceb2fd66056"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of paragraph (1);</text></clause><clause commented="no" display-inline="no-display-inline" id="idfc4255e92ea6432cac4f39ae4db9434d"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking the period at the end of paragraph (2) and inserting <quote>; or</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddbb6e23be3dc443983caf93cfc26da99"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96106d3b4dac40108c26f446ba8bfc22"><paragraph id="id73accdd80be642af8832bcaa131678c8"><enum>(3)</enum><text>an individual described in section 402(b)(2)(H), but only with respect to the program specified in subsection (b)(3)(C) of section 402.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id879f2e457dce42eaa080184c4e3573c7"><enum>(E)</enum><text>Section 431(b) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(b)</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="idd30cd69ee4f8439fb92fc959e2577072"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of paragraph (7);</text></clause><clause commented="no" display-inline="no-display-inline" id="id828b22a2d4e640e1a89a5b1e64641a81"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking the period at the end of paragraph (8) and inserting <quote>, or</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idb90e2fedc49c4ed6b695bfd88b96cfa7"><enum>(iii)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id16146e2bb8e34d5490076e71390341eb"><paragraph id="ide6c2e2a17cb248d69ad8cdd68c9abee2"><enum>(9)</enum><text>an individual who has not attained 26 years of age, but only with respect to the designated Federal program defined in section 402(b)(3)(C) (relating to the Medicaid program).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7708ad2d7f64961a706b78cddf78b19"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date of enactment of this Act.</text></paragraph></subsection><subsection id="idF197A69DCC624481AA0B8D5DD6CD213E"><enum>(f)</enum><header>100 percent Federal matching payments for medical assistance for children and young adults</header><paragraph commented="no" display-inline="no-display-inline" id="id852c86b55eb141ee9c2a109a92f23e6f"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text><subparagraph id="id678B5257C5184BB3B2B0D1166C59EEDA"><enum>(A)</enum><text>in subsection (b), by striking <quote>and (ii)</quote> and inserting <quote>(ii), and (ll)</quote>; and</text></subparagraph><subparagraph id="id18AF113E85AB4A38A092F90FFBF825DC"><enum>(B)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="traditional" display-inline="no-display-inline" id="id9306B2CCD3BC402688BC9248CABF88FA" act-name=""><subsection id="id015D6A39F56D4409A9F1BD92F29D5D54"><enum>(ll)</enum><header>Enhanced FMAP for certain children and young adults</header><text display-inline="yes-display-inline">Notwithstanding subsection (b), beginning on the date that is 2 years after the date of enactment of this subsection, the Federal medical assistance percentage shall be 100 percent with respect to amounts expended by a State for medical assistance for individuals—</text><paragraph id="id50BF0D8D197B4B8ABBDC6EFB6370909A"><enum>(1)</enum><text display-inline="yes-display-inline">who are eligible for medical assistance under section 1902(a)(10)(A)(i)(X); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id607736AAF65B4709AD02E8829E722A4C"><enum>(2)</enum><text display-inline="yes-display-inline">who would not have been eligible for medical assistance for full benefits (as defined in subsection (y)(2)(B)) under the State plan under this title or a waiver of such plan as such plan or waiver was in effect on January 1, 2025.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37e64e9ee2484c36b3231717aed43f46"><enum>(2)</enum><header>Effective date</header><text>The amendment made by this subsection shall take effect on the date of enactment of this Act.</text></paragraph></subsection><subsection id="id47ca07eaaa1e4cbcbac7fdbfe82fe4c5"><enum>(g)</enum><header>Exclusion from community engagement requirement</header><paragraph commented="no" display-inline="no-display-inline" id="id333e503403b94344bcd2a483d93c03d1"><enum>(1)</enum><header display-inline="yes-display-inline">Mandatory exception for certain individuals</header><text>Section 1902(xx)(3)(A)(i)(II) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(xx)(3)(A)(i)(II)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc33616d4290e473c81ffd48eac96defa"><enum>(A)</enum><text display-inline="yes-display-inline">in item (aa), by striking <quote>19</quote> and inserting <quote>26</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51635eaa2e834c269dce97d9226f8194"><enum>(B)</enum><text>in item (cc), by inserting <quote>or (X)</quote> after <quote>(VII)</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4168108a600a40e48fd5d7843360ed7f"><enum>(2)</enum><header>Specified excluded individuals</header><subparagraph commented="no" display-inline="no-display-inline" id="iddd9c127ebc6f42318ad7e85275651b1a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(xx)(9)(A)(ii)(I) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(xx)(9)(A)(ii)(I)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb05acec7593e420684056b2300732440"><subclause id="idff8a72ca98164e38859c08929581713e"><enum>(I)</enum><text>who is described in subclause (IX) or (X) of subsection (a)(10)(A)(i);</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75de2633774344f688db80b904e98970"><enum>(B)</enum><header>Conforming amendment</header><text>Section 1902(xx)(9)(A)(i)(II)(bb) of the Social Security Act (42 U.S.C. 1396a(xx)(9)(A)(i)(II)(bb)) is amended by striking <quote>19</quote> and inserting <quote>26</quote>.</text></subparagraph></paragraph></subsection><subsection id="id55b11e76e1154222a541626c67e85efd"><enum>(h)</enum><header>Expansion of EPSDT</header><paragraph commented="no" display-inline="no-display-inline" id="idde64ae5f26894298b6cef2135067bf91"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1905(a)(4)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)(4)(B)</external-xref>) is amended by striking <quote>21</quote> and inserting <quote>26</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id29ca08033d91497f8b175c9b43707e09"><enum>(2)</enum><header>Conforming amendment</header><text>Title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) is amended in section 1902(a)(43)(A), by striking <quote>21</quote> and inserting <quote>26</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ideb9b773ff85044c78fbb2c2389830eed"><enum>(i)</enum><header>Other conforming amendments</header><text display-inline="yes-display-inline">Title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idd34de536b9a14c39ae4d1a9e564b024c"><enum>(1)</enum><text display-inline="yes-display-inline">in section 1905(a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id06b05ed52fa04fe1ba88ef6a979a7291"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="idc3a223780bff471e8b5022d026cc0d29"><enum>(i)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>21, or, at the option of the State, under the age of 20, 19, or 18 as the State may choose</quote> and inserting <quote>26</quote>;
