which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 5, United States Code, to create a right of public access to certain records relating to the courts of the United States, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H26628A91FD5D4DE69DF3172A77CD7C95"><section section-type="section-one" id="H9D05B10EF5094C7492285163AC443303"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Judicial FOIA Expansion Act</short-title></quote>.</text></section><section id="H53105B5B7F4F4F4F86C4E2D3E9EDB496"><enum>2.</enum><header>Application of the Freedom of Information Act and the Privacy Act to the Judiciary</header><subsection id="HAB9A17E6EC48409F9C38F4773B7B6E5D"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Title 5, United States Code, is amended—</text><paragraph id="H895FF72C87594D919FE9CCFB2C63C733"><enum>(1)</enum><text display-inline="yes-display-inline">in section 551—</text><subparagraph id="H90CCDEBF2058439BBA01F0957B2BBBAA"><enum>(A)</enum><text>in paragraph (1)(B), by inserting after <quote>the courts of the United States</quote> the following: <quote>, except for purposes of sections 552 and 552a</quote>;</text></subparagraph><subparagraph id="H87111001D2884042A5034EBB50FAC698"><enum>(B)</enum><text>in paragraph (13), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="H15513BD058774B14B36DBE9DE69BA3D0"><enum>(C)</enum><text>in paragraph (14), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H883E45F5C1B14B64A3820F4341848CA0"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H5084791378534D8097E86C7A11A82B98"><paragraph id="H8E3A4E77E637410C84CA5BF501653A29"><enum>(15)</enum><text display-inline="yes-display-inline"><term>court of the United States</term>—</text><subparagraph id="H7B0EE454314747288B02D59C951C2CFD"><enum>(A)</enum><text>means—</text><clause id="H7009B0D63D114FC99065153C6C3225A7"><enum>(i)</enum><text>a court or other entity in the judicial branch, including the Supreme Court of the United States, the United States Court of Appeals for the Federal Circuit, the United States Court of International Trade, the United States courts of appeals, the United States district courts, the Administrative Office of the United States Courts, the Federal Judicial Center, the United States Sentencing Commission, and Federal defender organizations; and</text></clause><clause commented="no" id="HC33F93F3842043A8842E24DF0568B2A3"><enum>(ii)</enum><text display-inline="yes-display-inline">an entity that provides security or protective services for a Federal courthouse, or for an officer or employee of the judicial branch; and </text></clause></subparagraph><subparagraph id="H1D4759B2BA00494FB3C69E7B9CB9CF19"><enum>(B)</enum><text display-inline="yes-display-inline">does not include the Foreign Intelligence Surveillance Court.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE958D26C385A4F19999F75D6D4542DA0"><enum>(2)</enum><text>by inserting after section 552b the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HF958560670414E2AA9FFB2BE8196DFAA"><section id="HDD313C5CE312431280B7E33595B47FA3"><enum>552c.</enum><header>Applicability to the courts of the United States</header><subsection id="H15ADBD1492014C34B15CC7644323AD25"><enum>(a)</enum><header>Applicability of section <enum-in-header>552</enum-in-header></header><paragraph id="H1FE35CE402704DE783D666D083BB2443"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to the requirements under section 552, the following types of information are subject to a record request with respect to the courts of the United States:</text><subparagraph commented="no" id="HA3A7F9D94D934BE68D2CE9A87DCA503E"><enum>(A)</enum><text>Any record of attorney disciplinary proceeding or sanction, excluding any case record relating to the deliberation of the disciplinary hearing in accordance with paragraph (2)(A).</text></subparagraph><subparagraph id="H848BF84BE82A47A5B421A73B93E15D2E"><enum>(B)</enum><text>Any complaint, investigation, and order against a judge or other court personnel.</text></subparagraph><subparagraph id="HE44FDD15997E404796D0322A53A0A44A"><enum>(C)</enum><text>Meeting calendars and minutes of the Federal Judicial Conference and the membership list for each committee.</text></subparagraph><subparagraph id="HE40D69C4360E49319653372B3750029A"><enum>(D)</enum><text>Research and educational material produced by the Federal Judicial Center.</text></subparagraph><subparagraph id="HF99B49D31526439F954D9CD294236656"><enum>(E)</enum><text>Any completed jury selection form.</text></subparagraph><subparagraph id="H6C1BAA50DFEC4F7B923C89213414601C"><enum>(F)</enum><text>Any performance report for a judge or personnel.</text></subparagraph><subparagraph id="HF0931C3BC2A44275B1F94259BF0AB701"><enum>(G)</enum><text>Any technical audit or update plan for PACER.</text></subparagraph><subparagraph id="H6C55F09D59EA4A27B28A71C08124CE60"><enum>(H)</enum><text>Any annual report to Congress, including each committee and subcommittee of Congress.</text></subparagraph></paragraph><paragraph id="HB86AF73AE5CE4C0D91002532EA6025F9"><enum>(2)</enum><header>Exemptions</header><text display-inline="yes-display-inline">In addition to the matters described under section 552(b), section 552 does not apply to the following with respect to the courts of the United States:</text><subparagraph id="HD05D27BE1FC444049B18B11A0610E8C4"><enum>(A)</enum><text display-inline="yes-display-inline">Any matter relating to an ongoing case.</text></subparagraph><subparagraph id="H2AF69A5182D24F82A95139F25A441B3B"><enum>(B)</enum><text>Any information not in the possession of the courts of the United States.</text></subparagraph></paragraph><paragraph commented="no" id="HB8259E422ABC48F7BA90A97052901F77"><enum>(3)</enum><header>Machine-readability</header><text display-inline="yes-display-inline">Any information published or provided under section 552 or 552a by a court of the United States shall be machine-readable (as such term is defined in section 3502 of title 44). </text></paragraph></subsection><subsection id="HB36B6ED026D5427F9E290FA4D1F3C3BF"><enum>(b)</enum><header>Representation</header><text>The Attorney General shall represent a court of the United States in any claim brought under section 552 or section 552a.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H431D8A974AA846BCA8CB9684D4AA0365"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section, or any amendment made by this section, may be construed as displacing the common law right of public access to judicial records.</text></subsection><subsection id="H1F7FF10D543549AAB44130DCEDD52931"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $10,000,000 for fiscal year 2027 to meet the requirements of this Act, including the creation of an office to meet such requirements within the Administrative Office of the United States Courts.</text></subsection><subsection commented="no" id="H822220FFF415445EB7FFB0FCDB22D33B"><enum>(d)</enum><header>Severability</header><text>If any provision of this Act, or the application thereof, is held invalid, the validity of the remainder of this Act and the application of such provision to other persons and circumstances shall not be affected thereby.</text></subsection></section></legis-body></bill>
