which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Water Pollution Control Act to modify allotments under that Act, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Water Allotment Modernization Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id13bc16d3238247818d42e2ec7bd4884e"><enum>2.</enum><header>Modification to allotments under the Federal Water Pollution Control Act</header><subsection commented="no" display-inline="no-display-inline" id="idf7d5253ed4c84a62aa808fd2ecfa7be1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 205 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1285">33 U.S.C. 1285</external-xref>) is amended by striking the section designation and heading and all that follows through the end of subsection (c) and inserting the following:</text><quoted-block id="id5B43835DAD3943FAB0112B57BAEBD31F" style="OLC" act-name=""><section id="id0C4E052834604B688D9976D8B6991FAB" section-type="subsequent-section"><enum>205.</enum><header>Allotments</header><subsection commented="no" display-inline="no-display-inline" id="idc6d007dd46be45549b261d2aa513e5f2"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="ida6b74520c94a474aa7bed534903d076f"><enum>(1)</enum><header>Buy American oversight</header><text display-inline="yes-display-inline">The term <term>Buy American oversight</term> means any activity carried out by the Administrator for the purposes of management or oversight with respect to section 608.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide786e863403540ae9f417ee8eed0081e"><enum>(2)</enum><header>Clean watersheds needs survey</header><text display-inline="yes-display-inline">The term <term>clean watersheds needs survey</term> means the assessment prepared by the Administrator under section 609.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id285f0af21cd1412baca059aa11de5273"><enum>(3)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9b8ac1c0cc2e4c87a7795e15afa75f89"><enum>(A)</enum><text display-inline="yes-display-inline">each of the 50 States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfe57286ab36447a8bd1e754b743e94f8"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc027b6e3678a4a33850e243a3186d8c2"><enum>(C)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69af756b06a34a3991b7179daec6f1c1"><enum>(4)</enum><header>United States territory</header><text display-inline="yes-display-inline">The term <term>United States territory</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id823dd05a5f6f47b183e60c52409e6280"><enum>(A)</enum><text display-inline="yes-display-inline">American Samoa;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfd4f4e213bf049469ebea166017b99b3"><enum>(B)</enum><text display-inline="yes-display-inline">the Commonwealth of the Northern Mariana Islands;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id95381697828f43a889c31bbb56268eac"><enum>(C)</enum><text display-inline="yes-display-inline">the United States Virgin Islands; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6340a5b51ca04c6f9c4ab4260f40d133"><enum>(D)</enum><text display-inline="yes-display-inline">Guam.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc60426430d864e6a8596cccfd0b5c75f"><enum>(b)</enum><header>Set asides</header><text display-inline="yes-display-inline">Before making an allotment to States under subsection (c), of the amounts made available from appropriation to carry out this section for a fiscal year, the Administrator shall set aside the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id2778e597753d46628bef7458661650c2"><enum>(1)</enum><header>Buy American oversight</header><text display-inline="yes-display-inline">Not less than 0.1 percent to carry out Buy American oversight.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idabb3a1e7292b46b5b7bd112eaafbe38d"><enum>(2)</enum><header>Allotments for Indian Tribes</header><text display-inline="yes-display-inline">Pursuant to section 518(c)(2), 2 percent for Indian tribes (as defined in section 518(h)) for the purposes described in section 518(c)(3).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc1e5fcbc056c4bf4b4df2073ae80a8aa"><enum>(3)</enum><header>Allotments for United States territories</header><text display-inline="yes-display-inline">1.5 percent for allotment to United States territories in an amount consistent with the allotment the United States territory received in fiscal year 2026.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4ccc7af28af34d378a6401e40aeda89b"><enum>(c)</enum><header>Allotments to States</header><paragraph commented="no" display-inline="no-display-inline" id="id34266abec93b4a559e2346ebdb96621d"><enum>(1)</enum><header display-inline="yes-display-inline">Formula</header><text>Beginning with the first fiscal year after the publication of the initial formula pursuant to paragraph (3)(A), of the amounts appropriated to carry out this section for a fiscal year that remain available after the set-asides required under subsection (b) and any other required set-asides, the Administrator shall allot to States—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2fd94206bbb64c819f68cc1b071f7eee"><enum>(A)</enum><text display-inline="yes-display-inline">60 percent based on the proportion that—</text><clause commented="no" display-inline="no-display-inline" id="id8353f4e1e50d45a891c422ee16cb470a"><enum>(i)</enum><text display-inline="yes-display-inline">the needs of a State, as identified in the categories and associated proportions included in the most recent clean watersheds needs survey; bears to</text></clause><clause commented="no" display-inline="no-display-inline" id="id196c404a3b594e6e8db5bb3b252ca6ec"><enum>(ii)</enum><text display-inline="yes-display-inline">the needs of all States, as identified in that most recent clean watersheds needs survey;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id43c193c4b62a40119276e23b43c39205"><enum>(B)</enum><text display-inline="yes-display-inline">20 percent based on the proportion that—</text><clause commented="no" display-inline="no-display-inline" id="id5e6bad06f61445bb93d54f2902c979d8"><enum>(i)</enum><text display-inline="yes-display-inline">the population of a State, as identified in the most recent decennial census or American Community Survey 1-year estimate of population; bears to</text></clause><clause commented="no" display-inline="no-display-inline" id="iddc2e0b607cad4635af912ebdebfad534"><enum>(ii)</enum><text display-inline="yes-display-inline">the population of all States, as identified in that most recent decennial census or American Community Survey 1-year estimate of population; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9a4087f92f2a484bb4de1540fc42347d"><enum>(C)</enum><text display-inline="yes-display-inline">20 percent based on the proportion that—</text><clause commented="no" display-inline="no-display-inline" id="idfcf494d155bb4ac5b1797973903b5072"><enum>(i)</enum><text display-inline="yes-display-inline">the share of the population of a State at or below 200 percent of the Federal poverty level, as identified in the most recent American Community Survey 1-year estimate of poverty; bears to</text></clause><clause commented="no" display-inline="no-display-inline" id="id1b23d628e78547ffa3bde3a4b5bba603"><enum>(ii)</enum><text display-inline="yes-display-inline">the total of the share of the population of all States at or below 200 percent of the Federal poverty level, as identified in that most recent American Community Survey 1-year estimate of poverty.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id131a7c54d50345d2ab07149cdd6e22b1"><enum>(2)</enum><header>Transition period</header><text display-inline="yes-display-inline">For the first fiscal year after the publication of the initial formula pursuant to paragraph (3)(A), and for each of the 3 subsequent fiscal years thereafter, the Administrator shall ensure that the allotment pursuant to paragraph (1) for each State does not, as compared to the amount allotted to the State during the immediately prior fiscal year—</text><subparagraph commented="no" display-inline="no-display-inline" id="id199772eb87cd4eeaa6c4f3e899069a35"><enum>(A)</enum><text display-inline="yes-display-inline">increase by more than 200 percent; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8637c2ab4c054092849477853f95c8fc"><enum>(B)</enum><text display-inline="yes-display-inline">decrease by more than 25 percent.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e4a8233ecc04240a56b20c01c22146e"><enum>(3)</enum><header>Publication</header><subparagraph commented="no" display-inline="no-display-inline" id="id99571f58c2ce41ba8b3aa6677f68400b"><enum>(A)</enum><header display-inline="yes-display-inline">Initial formula</header><text>The Administrator shall publish in the Federal Register the formula and allotment amounts pursuant to this subsection by not later than September 30 of the first fiscal year after the publication of the first clean watersheds needs survey after the date of enactment of the <short-title>Clean Water Allotment Modernization Act of 2026</short-title>.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9f6b50c4caca4ff6bb170bbe8021d8e8"><enum>(B)</enum><header>Updates required</header><text display-inline="yes-display-inline">The Administrator shall publish annually in the Federal Register updates, as appropriate, to the allotments for each State based on the most recently released—</text><clause commented="no" display-inline="no-display-inline" id="id30bfea1949554d4bacc1bf480f3aebbb"><enum>(i)</enum><text display-inline="yes-display-inline">decennial census;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6b69b05bbaaf4e5c8a1e9e395d18415b"><enum>(ii)</enum><text display-inline="yes-display-inline">American Community Survey 1-year estimates of population and poverty; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id81a386f95c174454885f4cfebcac4acf"><enum>(iii)</enum><text display-inline="yes-display-inline">clean watersheds needs survey.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idb916c5e843e1493fa4659374712ece40"><enum>(b)</enum><header>Minimum allotments</header><text>Section 205(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1285">33 U.S.C. 1285(e)</external-xref>) is amended by striking <quote>(e) For</quote> and all that follows through <quote>1990</quote> in the first sentence and inserting the following:</text><quoted-block id="id2315E0B68DDF4FBABE2F2A211C34C89A" style="OLC" act-name=""><subsection id="id76062186B9054A25BFDC95630CFF532E"><enum>(e)</enum><header>Minimum allotment; additional appropriations; ratio of amount available</header><text>For fiscal year 2027 and each fiscal year thereafter</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide3942629fd4948f3a804c9d76152050a"><enum>(c)</enum><header>No effect on infrastructure funds</header><text>Nothing in this section or an amendment made by this section affects—</text><paragraph id="id3cfad5dfd1d34273a939dff4415e05cd"><enum>(1)</enum><text>amounts made available to carry out section 205 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1285">33 U.S.C. 1285</external-xref>) or title VI of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381 et seq.</external-xref>) under division J of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 1350); or</text></paragraph><paragraph id="idfc4a693701224b8ea4a900c8f9ea3231"><enum>(2)</enum><text>any allocations of those amounts.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ida2468e3d084d425a8b2ddae1d51939c3"><enum>3.</enum><header>Clean watersheds needs survey</header><text display-inline="no-display-inline">Section 516 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1375">33 U.S.C. 1375</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id213ea02ffb454ec68ad67b82d70c5f56"><enum>(1)</enum><text>by striking subsection (b); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbab798874c4f4e2c9afb6f48e6904c18"><enum>(2)</enum><text>by redesignating subsections (c) through (e) as subsections (b) through (d), respectively.</text></paragraph></section><section id="id19e75295fa0843b8aeef270218a3f4f1"><enum>4.</enum><header>Additional eligible use of capitalization grants</header><text display-inline="no-display-inline">Section 603(k) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(k)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id23447a9c8fd8461588356e7044da5507"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">use</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">uses</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04e12d2fa9584b2c8b95a1167954c96b"><enum>(2)</enum><text>by striking <quote>A State may</quote> and inserting the following:</text><quoted-block id="id9D9D848A88BD44BEA36C21609E4A0EC2" style="OLC" act-name=""><paragraph id="id932CD002A2E746CDA988B7791ADD3328"><enum>(1)</enum><header>Technical assistance</header><text>A State may</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id944f401974da4d97ba1d285293f65816"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="id664E4CD2AF84434AAC8932B7BD07263C" style="OLC" act-name=""><paragraph id="idA7A1CC786F4A42B28C2DD5821099168C"><enum>(2)</enum><header>Clean watersheds needs surveys</header><text>Notwithstanding any other provision of this section, of the amounts received by a State through a capitalization grant with funds made available under this title and section 205(m) each fiscal year, a State may use not more than 0.5 percent to carry out activities necessary for the assessment under section 609.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
