<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 5001</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260715">July 15, 2026</action-date><action-desc><sponsor name-id="S439">Mrs. Moody</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSRA00">Committee on Rules and Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Help America Vote Act of 2002 to require ballots in elections for Federal office to be received by the close of the polls on the date of election.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ballots by Election Day Act</short-title></quote>.</text></section><section id="H5C4E18EAAF6B4AD58C06CE0FCEDA8136"><enum>2.</enum><header>Deadline for receipt of ballots</header><subsection id="H73313FA6265F4EE98D461C4A69ECC9FF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title III of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/20901">52 U.S.C. 20901 et seq.</external-xref>) is amended—</text><paragraph id="H0FF3140D352C473EA1BF9A20A0E9BBC3"><enum>(1)</enum><text>by redesignating sections 305 and 306 as sections 306 and 307, respectively; and</text></paragraph><paragraph id="H4A65CA2F85D24FE385F75FA47E494FAE" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by inserting after section 304 the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBBCAF1AC8AEE413AB6CA1D3B00DFC2D3"><section display-inline="no-display-inline" commented="no" id="H76ABDE5910EC4AF5930C5B22246960D8"><enum>305.</enum><header>Deadline for receipt of ballots</header><subsection id="H5B02B2C777114C12805BEC91DE6BC615"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">To be considered validly cast and eligible to be counted in any election for Federal office, including a primary, runoff, or special election, all ballots (including absentee and mail-in ballots) must be received by the appropriate election official no later than the time polls close on the date of the election and, in the case of a general election for Federal office, no later than the time polls close on the date established under section 25 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/2/7">2 U.S.C. 7</external-xref>) for each general election for Federal office.</text></subsection><subsection id="HD30BF922F44B4D7D97FB66062D0DFBD6" commented="no"><enum>(b)</enum><header>Untimely ballot</header><text display-inline="yes-display-inline">No State may accept for tabulation any ballot (including an absentee or mail-in ballot) that is received by the appropriate election official following the time polls close on the date of the election.</text></subsection><subsection id="H34A041947999440AB7B0640F3967D992"> <enum>(c)</enum> <header>Exception</header> <text display-inline="yes-display-inline">The deadline described in subsection (a) shall not apply with respect to ballots cast by absent uniformed services voters or overseas voters, as defined in section 107 of the Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20310">52 U.S.C. 20310</external-xref>).</text>
 </subsection><subsection id="H3D4EF47CBD5E4E5285BFD95CA124AE91" commented="no"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall apply with respect to elections for Federal office held in 2027 or any succeeding year.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida7c5ee94517d44178faa67f8cbf7947d"><enum>(b)</enum><header>Enforcement</header><text>Section 401 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/52/2111">52 U.S.C. 2111</external-xref>) is amended by striking <quote>and 304</quote> and inserting <quote>304, and 305</quote>.</text></subsection><subsection id="H89E3FFB3EC984283AD88DB7573EDBD41"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents of such Act is amended—</text><paragraph id="H539F7F5D9FDB49158744C5FA8BA09891"><enum>(1)</enum><text>by redesignating the items relating to sections 305 and 306 as relating to sections 306 and 307, respectively; and</text></paragraph><paragraph id="HD75C856F90884D20A8378A3C7B557120"><enum>(2)</enum><text>by inserting after the item relating to section 304 the following new item:</text><quoted-block style="OLC" id="HEAE4FB3778094AF3A7AF5D18C4F60F02" display-inline="no-display-inline"><toc><toc-entry level="section" idref="H76ABDE5910EC4AF5930C5B22246960D8">Sec. 305.
