<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4993</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260715">July 15, 2026</action-date><action-desc><sponsor name-id="S347">Mr. Moran</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans’ Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Veterans Affairs to establish a precision oncology program for cancer of the prostate at the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Precision Oncology Program for Cancer of the Prostate Authorization Act of 2026</short-title></quote> or the <quote><short-title>POPCaP Act of 2026</short-title></quote>.</text></section><section id="idda940ff6159941878b5b0fd2668a11a3"><enum>2.</enum><header>Establishment of precision oncology program for cancer of the prostate</header><subsection id="id8af704a7223a4a8cbb43422c4eb0ddc1"><enum>(a)</enum><header>Establishment of program</header><paragraph commented="no" display-inline="no-display-inline" id="id00d23600fa024a54a4b3f82a86d84f99"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/73">chapter 73</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id3f03d66359054bfcb42ce34b722dd132"><section id="id5de170a4d12d4f00bfe54701c7dd70e1"><enum>7330E.</enum><header>Precision oncology program for cancer of the prostate</header><subsection id="id4f0bbed21cd04fff993e0b1be1f73659"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish within the Department a precision oncology program for cancer of the prostate in accordance with this section (in this section referred to as the <quote>Program</quote>).</text></subsection><subsection id="id3da02669adf3457286d99bcc4bfd45b3"><enum>(b)</enum><header>Eligibility</header><text>A veteran is eligible to participate in the Program if the veteran has a diagnosis of prostate cancer.</text></subsection><subsection id="id4bfe58be33b347558b5301ad93d2e5e1"><enum>(c)</enum><header>Centers of excellence</header><paragraph id="idbca551c5e84f44e39dac6dd451a126a6"><enum>(1)</enum><header>Designation of centers</header><text>Effective on the date of the enactment of this section, the Secretary shall designate the following medical facilities of the Department as provisional centers of excellence for the Program:</text><subparagraph id="idb5b8f2c572ca458e8616305c8b876339"><enum>(A)</enum><text>The Seattle VA Medical Center, Seattle, Washington.</text></subparagraph><subparagraph id="id257abd4bad414fa38c5b73050e0fd565"><enum>(B)</enum><text>The James J. Peters VA Medical Center, Bronx, New York.</text></subparagraph><subparagraph id="id0f06aaa45ec9494cbf6d84317775ed15"><enum>(C)</enum><text>The Lieutenant Colonel Charles S. Hayden Veterans’ Administration Medical Center, Phoenix, Arizona.</text></subparagraph><subparagraph id="id0077143ac5a34ee687e334fdca98ee93"><enum>(AA)</enum><text>The Dallas VA Medical Center, Dallas, Texas.</text></subparagraph><subparagraph id="id13429c56636c4b7c99292bbfc32082b2"><enum>(BB)</enum><text>The Malcom Randall Department of Veterans Affairs Medical Center, Gainesville, Florida.</text></subparagraph></paragraph><paragraph id="id38d89e5d25e244e596f3ae387931a97c"><enum>(2)</enum><header>Operational requirements</header><subparagraph id="idd789558f2a224421a4a578aa3ec7b080"><enum>(A)</enum><header>Minimum number of centers</header><text>The Secretary shall ensure that, at all times, not fewer than 21 medical facilities of the Department are designated and operating as centers of excellence under the Program, with not fewer than one center maintained in each Veterans Integrated Service Network.</text></subparagraph><subparagraph id="id2fc19efcb47041ff8e5e13172d87ecb3"><enum>(B)</enum><header>Duration of secretarial designation</header><text>Subject to paragraph (3), each center designated under this section shall be so designated for a period of not less than five years.</text></subparagraph></paragraph><paragraph id="id44afc7a868d749579014afb52d6c4d46"><enum>(3)</enum><header>Additional designations</header><subparagraph id="id3699a723d1cb432e986d4f303eb57dd4"><enum>(A)</enum><header>In general</header><text>The Secretary may designate medical facilities as centers of excellence in addition to those designated under paragraph (1).</text></subparagraph><subparagraph id="id815bf7b817bf433d898f1af4a82349f0"><enum>(B)</enum><header>Protection of initial centers</header><text>For purposes of complying with the minimum number of designated centers of excellence requirement under paragraph (2), the Secretary shall count toward such minimum number any medical facilities designated pursuant to paragraph (1) and not terminated under paragraph (4).</text></subparagraph></paragraph><paragraph id="id3f2c9e90d8b44aed962355e68bb9b6b3"><enum>(4)</enum><header>Termination of designation</header><subparagraph id="id4259c0bf6f7d4efc8853ae691ce2536a"><enum>(A)</enum><header>In general</header><text>Beginning not earlier than January 1, 2030, the Secretary may terminate the designation of a medical facility as a center of excellence under the Program if the Secretary determines the facility is failing to serve the purposes of the Program required by this section.</text></subparagraph><subparagraph id="id5ee2752353a74c30ad4d6cfe691f13e0"><enum>(B)</enum><header>Process</header><text>The Secretary—</text><clause id="idf07699eb7f4a4c6e980efa8500db821d"><enum>(i)</enum><text>before terminating a designation under subparagraph (A), shall submit to the Committee on Veterans’ Affairs and the Committee on Appropriations of the Senate and the Committee on Veterans’ Affairs and the Committee on Appropriations of the House of Representatives a notice of the intent to terminate the designation; and</text></clause><clause id="id26d362f904cf423bb0cb00a3bf09b9ba"><enum>(ii)</enum><text>may not terminate the designation until the date that is 60 days after the date of the submission of such notice.</text></clause></subparagraph></paragraph><paragraph id="id83731b3195ec4fdfa206cfd10b2064de"><enum>(5)</enum><header>Performance reviews</header><subparagraph id="idb4b67ac4151b488792dc2b3d0c43d7a0"><enum>(A)</enum><header>In general</header><text>Beginning in 2030, the Secretary shall conduct reviews of the performance of the centers of excellence designated under the Program.</text></subparagraph><subparagraph id="idd137cc3055bc483fba4845e4833d5b1f"><enum>(B)</enum><header>Rolling cycle</header><text>In carrying out subparagraph (A), the Secretary shall ensure that—</text><clause id="ide88348c8e3c141d0a3d6f7e265353b15"><enum>(i)</enum><text>in 2030 and each year thereafter, the Secretary reviews and makes a determination on not more than seven centers;</text></clause><clause id="id851e61b9ceee4f568b8747bb0093e15f"><enum>(ii)</enum><text>the centers selected for review in any given year constitute a class of centers distinct from the classes reviewed in the preceding four years; and</text></clause><clause id="id34bd968339164920b966402fae3d6e0f"><enum>(iii)</enum><text>not later than the date of the submission of the fifth annual report under subsection (f) following the initial conduct of reviews under this paragraph, and not later than every fifth year thereafter, every center operating under the Program has been reviewed.</text></clause></subparagraph><subparagraph id="idfb109c2509774f3e87f5876cae1e75fa"><enum>(C)</enum><header>Scope of review</header><text>Each review of a center under this paragraph shall assess whether the performance of the center in providing the services required under this section is adequate to justify the continued designation of the center as a center of excellence under the Program.</text></subparagraph></paragraph></subsection><subsection id="id02068cc344b74352873f092f82eb1b30"><enum>(d)</enum><header>Activities and staffing of centers</header><paragraph id="id1a76174a5cb64d789a8ff38306d91c5e"><enum>(1)</enum><header>Activities</header><text>Each center designated under subsection (c) shall carry out the following activities:</text><subparagraph id="ida5c63d5a45b44c7db45522989725fa0b"><enum>(A)</enum><text>Establishing a program of genetic sequencing for veterans with advanced prostate cancer.</text></subparagraph><subparagraph id="idd66024e133ae400a8215317de9a53aab"><enum>(B)</enum><text>Instituting a uniform genetic sequencing platform to allow for coordination across all centers.</text></subparagraph><subparagraph id="id40ce2aef739d45a788b497c1c409d988"><enum>(C)</enum><text>Participating in the telemedicine tumor board of the Program.</text></subparagraph><subparagraph id="idc5153a4fb1d748c585534b3f07a9f740"><enum>(D)</enum><text>Participating in the registry study of the Program to track mutations.</text></subparagraph><subparagraph id="id8d2d6b1dd25243fa91dc48df4b19d99e"><enum>(E)</enum><text>Providing travel support to veterans with mutations to facilitate access to studies.</text></subparagraph><subparagraph id="id161d5f5e3cd94ffc83fee20707f1a1ac"><enum>(F)</enum><text>Developing clinical trials that are biomarker specific.</text></subparagraph><subparagraph id="idec9065fed08e4e728969ec0015266222"><enum>(G)</enum><text>Participating in industry-sponsored precision oncology studies.</text></subparagraph><subparagraph id="id1e7e704e46f04304a83455b4dae1e32f"><enum>(H)</enum><text>Participating in monthly calls and not less than three in-person meetings per year with the Program Leadership team established under subsection (e) to assess progress.</text></subparagraph><subparagraph id="idbf7bb6061eda4e759b085f7b4d758aa2"><enum>(I)</enum><text>Providing ongoing reporting to the Program Leadership team regarding trial accruals and research conducted by investigators of the Department with limited experience who are undergoing mentorship.</text></subparagraph><subparagraph id="idbc4cdf9730984808826b3a50a78f831c"><enum>(J)</enum><text>Establishing metastasis biopsy capability.</text></subparagraph><subparagraph id="ida9d2e0038583467ca0f37b4b2dfb9dbd"><enum>(K)</enum><text>Extending resources to affiliated centers in the Veterans Integrated Service Network in which the center is located.</text></subparagraph></paragraph><paragraph id="id134b1fd38def444382620e06bfedf355"><enum>(2)</enum><header>Staffing</header><text>The Secretary shall ensure that each center designated under subsection (c) employs, at a minimum—</text><subparagraph id="id7ff247352e164ad898e2b107c85ff2fa"><enum>(A)</enum><text>a medical oncologist;</text></subparagraph><subparagraph id="ide9eeae51154e4fe6b6e45e1d32d1eec3"><enum>(B)</enum><text>an interventional radiologist;</text></subparagraph><subparagraph id="id94d955c6a7b04323b99dddf3e6959af3"><enum>(C)</enum><text>a urologist;</text></subparagraph><subparagraph id="id7d65482858854e5c8942946f158924ad"><enum>(D)</enum><text>a radiation oncologist;</text></subparagraph><subparagraph id="id777132dc4077443081c0bdea66280da6"><enum>(E)</enum><text>a pathologist; and</text></subparagraph><subparagraph id="ida97c147e650d42f38084a0b61b5cecd3"><enum>(F)</enum><text>two full-time equivalent research staff members.</text></subparagraph></paragraph></subsection><subsection id="id1de09612979c441fb76401f6c442f406"><enum>(e)</enum><header>Program leadership</header><paragraph id="ida5bffdfc0e7048d195d3c581a8a6a929"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a Program Leadership team located at the medical facility designated under subsection (c)(1)(A) (in this section referred to as the <quote>Program Leadership team</quote>).</text></paragraph><paragraph id="idd49b9fd0348240e3806e6051e129477c"><enum>(2)</enum><header>Composition</header><text>The Program Leadership team shall include, at a minimum, an Executive Director, a Clinical Director, and a Research Director.</text></paragraph><paragraph id="id05e21e7ab8e6486d90cba4f88799b20d"><enum>(3)</enum><header>Duties</header><text>The Program Leadership team shall be responsible for—</text><subparagraph id="idcc8cd4c8b1b2406bb7b15d7e07c35897"><enum>(A)</enum><text>providing strategic liaison services with industry to ensure engagement by the Department with study design and participation;</text></subparagraph><subparagraph id="id59a4535604444895b41591d4e713a4fb"><enum>(B)</enum><text>coordinating participation by the Department in prostate cancer group studies sponsored by the National Cancer Institute;</text></subparagraph><subparagraph id="id6e947590f9e34c9bb75fe7dff0794964"><enum>(C)</enum><text>facilitating the development of study concepts, design, and start-up with investigators of the Department with limited experience who are undergoing mentorship;</text></subparagraph><subparagraph id="ide4d776b6135f4b0c8d8b8899226831c5"><enum>(D)</enum><text>creating and executing a model for hybrid decentralized clinical trials, including remote research coordination, regulatory start-up and maintenance, data management, and approval by an institutional review board;</text></subparagraph><subparagraph id="idb1b3633239e8459abadb88608b8410ca"><enum>(E)</enum><text>creating and maintaining a prostate cancer registry and data repository of the Department; and</text></subparagraph><subparagraph id="ided7ca1a762674f32b67a28b5f20360cb"><enum>(F)</enum><text>maintaining relevant working groups to bring together expertise of the Department from across the country.</text></subparagraph></paragraph><paragraph id="id50ded37b878f4cc59e2c7e6f79172067"><enum>(4)</enum><header>Specific responsibilities</header><subparagraph id="id996351a446db4d718a8671f59fc792a9"><enum>(A)</enum><header>Executive director</header><text>The Executive Director of the Program Leadership team shall—</text><clause id="iddf0c4d34a95745f4a8096a1498913df4"><enum>(i)</enum><text>provide administrative leadership to the Program network in partnership with the Clinical Director;</text></clause><clause id="id3a4a06df125946d4a6bef2745c8e988c"><enum>(ii)</enum><text>maintain responsibility for the development, execution, and monitoring of the national strategic plan of the Program; and</text></clause><clause id="id020ace37fac648e3bad11e29da6a4656"><enum>(iii)</enum><text>serve as the liaison to the executive steering committee and other leadership of the Department and centers of excellence.</text></clause></subparagraph><subparagraph id="id04111c815b0e4e88a640f73c0da9f0f0"><enum>(B)</enum><header>Clinical director</header><text>The Clinical Director of the Program Leadership team shall—</text><clause id="idaab33d14d8f3490989b2015450df4f91"><enum>(i)</enum><text>oversee the Program network to ensure eligible veterans receive access to care based on the latest research;</text></clause><clause id="idef7f1be75c29405fb19a49f266c01e2a"><enum>(ii)</enum><text>maintain responsibility for the development and implementation of strategies for program growth, quality improvement, and patient satisfaction;</text></clause><clause id="ida483aac81f824e90a1b72bbf6428d857"><enum>(iii)</enum><text>serve on the review committee of the Program for clinical trials to ensure studies are conducted ethically and efficiently; and</text></clause><clause id="id24100c9f67ab40f4b57d087d565387bd"><enum>(iv)</enum><text>serve as the liaison with stakeholders to integrate clinical services and research.</text></clause></subparagraph><subparagraph id="idb8f717869db74a46bdf8b7fd96a990b0"><enum>(C)</enum><header>Research director</header><text>The Research Director of the Program Leadership team shall—</text><clause id="id6937f0ebf9664703b18b3ad7c68a26b6"><enum>(i)</enum><text>provide leadership on national research objectives;</text></clause><clause id="id46bdce228e164be6825c3ed6eac6eb21"><enum>(ii)</enum><text>serve on committees to review new research concepts and projects in the Program network;</text></clause><clause id="ida812eb9c20784558bbab80d398aa8ef0"><enum>(iii)</enum><text>maintain a deep understanding of current research and emerging technologies in prostate cancer; and</text></clause><clause id="id6cd6721528c845e0abd4ed64a00f2cca"><enum>(iv)</enum><text>interact with stakeholders, including regulatory agencies, industry partners, and research institutions, to improve prostate cancer research within the Department.</text></clause></subparagraph></paragraph></subsection><subsection id="id1d190033c3ce42d796eb80cd78fac9ff"><enum>(f)</enum><header>Annual report</header><paragraph id="id81e7782dadfc48f69ab4c6d27988c9a1"><enum>(1)</enum><header>In general</header><text>Not later than March 1 of each year, the Secretary shall submit to the Committee on Veterans’ Affairs and the Committee on Appropriations of the Senate and the Committee on Veterans’ Affairs and the Committee on Appropriations of the House of Representatives a report on the Program.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ce0a31b510d4ffcaa1c2741653cf469"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1) shall include, with respect to the period covered by the report, the following:</text><subparagraph id="idd1cfcb70c37f46fa93f8e484b1389ee7"><enum>(A)</enum><text>The funding levels for each center of excellent designated under the Program;</text></subparagraph><subparagraph id="ida3168c3006c6482a87630dddf962fa69"><enum>(B)</enum><text>The number of veterans served by the Program;</text></subparagraph><subparagraph id="id6a6cf0d8327e41628f830e2769a14ee0"><enum>(C)</enum><text>The number of investigators and providers participating in the Program network;</text></subparagraph><subparagraph id="id42e7a30e6b2b48af9a550fbb42a43adf"><enum>(D)</enum><text>The number of publications by providers of the Department relating to prostate cancer;</text></subparagraph><subparagraph id="id509cf50eb7c34796836ca91a6925226c"><enum>(E)</enum><text>The number of clinical research studies supported by the network;</text></subparagraph><subparagraph id="idbb7c0dfb33764de9b21f2985d85f8830"> <enum>(F)</enum> <text>The number of veterans enrolled in such clinical research studies;</text>
                                    </subparagraph><subparagraph id="id3b9a90cb4d714d198ef675c9ead8e05c">
                                        <enum>(G)</enum>
 <text>The five-year survival rate of veterans enrolled in clinical research studies of the Program compared to other veterans and civilians with prostate cancer; and</text>
 </subparagraph><subparagraph id="ided5c3a5e8a654c699d8e7d6413d86542"><enum>(H)</enum><text>The outcomes and survival data for veterans served at dedicated genitourinary centers under the Program compared to that of other veterans and civilians served at other centers of excellence under the Program.</text></subparagraph></paragraph><paragraph id="ida4ee6b01fe494f728527219a9eab26db"><enum>(3)</enum><header>Comprehensive plan</header><text>The Secretary shall include in the report submitted under paragraph (1) in 2029, a comprehensive plan for the designation and operation of the centers of excellence under subsection (c)(2)(A), including a timeline for center evaluations, performance criteria to be utilized in evaluations, and center selection process.</text></paragraph><paragraph id="id12288ea4b5bf406fa7c677839350a90b" commented="no"><enum>(4)</enum><header>Performance review findings</header><text>Beginning with the report submitted under paragraph (1) in 2031, and all subsequent such reports, the Secretary shall include results of the performance reviews conducted pursuant to subsection (c)(5), including a determination by the Secretary regarding whether the results of such review for each center justifies continued designation as a center of excellence.</text></paragraph><paragraph id="id9cda5ef207014a30a81d4b1884e22065"><enum>(5)</enum><header>Forecast</header><text>Each report submitted under paragraph (1) shall include forecasts of the matter described in paragraph (1)(A) for the upcoming review period.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id23c4a480fcb24023ae1913d501068c49"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 7330D the following new item:</text><quoted-block style="USC" id="id000a7183-25b4-4c1a-bacb-6bc4de177b6e"><toc><toc-entry level="section" idref="id5de170a4d12d4f00bfe54701c7dd70e1">7330E. Precision oncology program for cancer of the prostate.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf91429fb5f5d46c296c654dcbda85646"><enum>(b)</enum><header>Establishment, designation, and operation</header><paragraph commented="no" display-inline="no-display-inline" id="id4123a40aa02243e7a9945d4ed9de2d16"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall establish the program required under section 7330E of title 38, United States Code, as added by subsection (a)(1), including the designation of program leadership under subsection (e) of such section and the designation and operation of the centers of excellence under subsection (c) of such section, by not later than January 1, 2027.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2daaf6adbe194cc5b04a90b0997c25c9"><enum>(2)</enum><header>Terms and conditions</header><text>The designation and operation of the centers of excellence described in paragraph (1) shall be conducted under the same terms and conditions and in the same manner as those centers were designated and operated on January 1, 2023.</text></paragraph></subsection><subsection id="id47a99bdd7af44bceb3311c3316a1f6f5"><enum>(c)</enum><header>Implementation plan</header><paragraph commented="no" display-inline="no-display-inline" id="id3226c4babf984c56a5c5903fb48a0edc"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs and the Committee on Appropriations of the Senate and the Committee on Veterans’ Affairs and the Committee on Appropriations of the House of Representatives a plan for the implementation of section 7330E of title 38, United States Code, as added by subsection (a)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb02191731a23413baebf09b02de44420"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">The plan required by paragraph (1) shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7dc74db8603d440b9db16058d8f1651d"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment of staffing required at each center of excellence designated under section 7330E(c) of title 38, United States Code, as added by subsection (a)(1);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf55b9adb70bb4d43bd221c1176b6a270"><enum>(B)</enum><text display-inline="yes-display-inline">an identification of contracting requirements;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id779a74681fba49b5815bb1409c90f73e"><enum>(C)</enum><text display-inline="yes-display-inline">a plan for sequencing platform selection;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a1bd23b977c424aa6c91c35da8f7271"><enum>(D)</enum><text display-inline="yes-display-inline">a plan for registry creation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id379b70ef26ce45b78ba7e5a825364f6a"><enum>(E)</enum><text display-inline="yes-display-inline">a plan for coordination with a central institutional review board; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfc6dc5aa06174b48a892cf8380643515"><enum>(F)</enum><text display-inline="yes-display-inline">an identification of anticipated funding levels for the 10-year period beginning on the date of the submittal of the plan.</text></subparagraph></paragraph></subsection><subsection id="ida86107e23b6742a2a6a887e41a0ca7fe"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary of Veterans Affairs to carry out section 7330E of title 38, United States Code, as added by subsection (a)(1), $15,500,000 for each of fiscal years 2027 through 2029.</text></subsection></section></legis-body></bill>
