<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4992</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260715">July 15, 2026</action-date><action-desc><sponsor name-id="S375">Mr. Daines</sponsor> (for himself and <cosponsor name-id="S388">Ms. Hassan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of the Army to issue guidance relating to the review of applications for alteration or temporary or permanent occupation or use of certain hydropower projects, and for other purposes.</official-title></form><legis-body><section id="id73522d29984d4e9fbc2c15819010cdd9" section-type="section-one"><enum>1.</enum><header>Standardized review procedures for hydropower projects</header><subsection id="id85024ec49fb044a281c602926860e23d"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id53af4c91275a4723bb6660841f624253"><enum>(1)</enum><header>Completeness review</header><text>The term <term>completeness review</term> means a review by the Secretary (or a designee) regarding whether a section 408 application is complete.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67c081f789024a97bd89cab8a969aa2b"><enum>(2)</enum><header display-inline="yes-display-inline">Hydropower project</header><text>The term <term>hydropower project</term> means any non-Federal hydropower project requiring a license or exemption under the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/791a">16 U.S.C. 791a et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc7295af7b06441f1a358abbd0596edcd"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Army.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1f3a47d9a1fd4ecc94874f609ccef0d6"> <enum>(4)</enum> <header display-inline="yes-display-inline">Section 408 application</header> <text>The term <term>section 408 application</term> means an application relating to a hydropower project for permission under section 14 of the Act of March 3, 1899 (30 Stat. 1152, chapter 425; <external-xref legal-doc="usc" parsable-cite="usc/33/408">33 U.S.C. 408</external-xref>), for an alteration, or temporary or permanent occupation or use, described in subsection (a) of that section.</text>
 </paragraph></subsection><subsection id="id4a6f46f315094091a43b01ad40cd79d3"><enum>(b)</enum><header>Standardized review procedures</header><paragraph id="id94886dfdca6f4b32a5fd4c50c9667927"><enum>(1)</enum><header>Mandatory guidance</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall issue guidance establishing the following:</text><subparagraph id="idc4f5ed5f00394f1fbccd941bb3c000d4"><enum>(A)</enum><header>Application checklist</header><text>A standardized checklist of required materials for section 408 applications, to be developed in consultation with—</text><clause id="id3cac4c56cde540eb89d718cbbe3ada0f"><enum>(i)</enum><text>the Federal Energy Regulatory Commission;</text></clause><clause id="id2555b8bde8b94b639531ecce874fe0b5"><enum>(ii)</enum><text>the Hydroelectric Design Center of the Corps of Engineers;</text></clause><clause id="id79b573246e9f4f2692ecced9f85ba5bc"><enum>(iii)</enum><text>hydropower project operators; and</text></clause><clause id="ide2d0c9aa1b5f471382b5fb8e8ce495ac"><enum>(iv)</enum><text>relevant industry associations.</text></clause></subparagraph><subparagraph id="id832e92423d7749a49f4fce2a80022382"><enum>(B)</enum><header>Completeness criteria</header><text>A clear description of what constitutes a complete section 408 application, including with respect to—</text><clause id="idf731ba85469245d292b108891966e636"><enum>(i)</enum><text>required documents and analyses;</text></clause><clause id="ide4f6bff2a5c74f5c9965e18d6e331e31"><enum>(ii)</enum><text>formatting and submission requirements; and</text></clause><clause id="id9f11097f5ed24a149bf01f69558694f6"><enum>(iii)</enum><text>evidence of compliance with any applicable Federal Energy Regulatory Commission license.</text></clause></subparagraph><subparagraph id="id0d2a1b7aac17479daea72719074fd6eb"><enum>(C)</enum><header>Phased review procedures</header><text>For section 408 applications for which a phased design review is required—</text><clause id="idd62105482cbe4eaaa8732db1bf0905c9"><enum>(i)</enum><text>the specific scope and objectives of each review phase;</text></clause><clause id="id3c1f844398184ce18440f73a60a5a06b"><enum>(ii)</enum><text>a timeline for each review phase;</text></clause><clause id="id77a2e471e1714e54aeaf8b43db78bade"><enum>(iii)</enum><text>an applicable definition of the terms <term>fatal flaw</term>, <term>final quality assurance</term>, and <term>technical review</term>; and</text></clause><clause id="id9a0707dc0060475282ea7d008452efeb"><enum>(iv)</enum><text>a clear statement that a completeness review shall not include—</text><subclause commented="no" display-inline="no-display-inline" id="idc6aa7cfea86d4e76811927a16cc93cd7"><enum>(I)</enum><text display-inline="yes-display-inline">detailed technical analysis; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1ce8114a1fec45ee8a8f2ed685273a44"><enum>(II)</enum><text display-inline="yes-display-inline">any engineering-related judgment with respect to design adequacy.</text></subclause></clause></subparagraph><subparagraph id="idcbeec475d6ab4d42a527cebbeb86263a"><enum>(D)</enum><header>Escalation procedures</header><text>Procedures for referring a section 408 application to the head of the applicable Division Office of the Corps of Engineers or an official at the Corps of Engineers headquarters in any case in which a deadline applicable to the section 408 application is not met.</text></subparagraph></paragraph><paragraph id="id79d67a5999e6409081f90d1413cac712"><enum>(2)</enum><header>Scope of completeness reviews</header><text>The guidance issued under paragraph (1) shall establish that a completeness review shall be limited to verification that—</text><subparagraph id="id3d730c2fca07489daa34f04831efd5f2"><enum>(A)</enum><text>all required documents have been submitted;</text></subparagraph><subparagraph id="id46dc7bdd2f834fe4a103ef5056924648"><enum>(B)</enum><text>those documents are in the required format; and</text></subparagraph><subparagraph id="idaac8ac67f6454759891d5ee377122979"><enum>(C)</enum><text>the section 408 application addresses the applicable requirements of the checklist under paragraph (1)(A).</text></subparagraph></paragraph><paragraph id="id278042659044486dbed59a1354022678"><enum>(3)</enum><header>Prohibitions</header><text>In conducting a completeness review, the Secretary (or a designee) may not—</text><subparagraph id="id9f2d385960de4c919ff324a046b09217"><enum>(A)</enum><text>conduct a detailed technical review of any engineering calculations;</text></subparagraph><subparagraph id="ida38165b456a141be9cd8cbb996898331"><enum>(B)</enum><text>evaluate the design adequacy of, or alternative approaches to, the hydropower project that is the subject of the section 408 application;</text></subparagraph><subparagraph id="id149bfaf4612f4f4197c6a3fa207bd991"><enum>(C)</enum><text>request any design modification to, or additional analysis of, the hydropower project that is the subject of the section 408 application;</text></subparagraph><subparagraph id="idb543b3b7096d4c938f200b6cab1ad687"><enum>(D)</enum><text>consider any factor other than a factor included in the standardized checklist under paragraph (1)(A); or</text></subparagraph><subparagraph id="id1c209d00848e492e86c7f7ee0ebb6dff"><enum>(E)</enum><text>require compliance with any environmental standard that was not established by a Federal or relevant State agency before the date of submission of the section 408 application.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
