which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Federal Food, Drug, and Cosmetic Act with respect to food safety.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making America's Food Safer Act</short-title></quote>.</text></section><section id="idf41fa5bc62a5482493ce5de54a6f2f9e"><enum>2.</enum><header>Expansion of the accredited third-party certification program</header><subsection commented="no" display-inline="no-display-inline" id="id7eb51d11e7d24945bd8c895803c04158"><enum>(a)</enum><header display-inline="yes-display-inline">Revised definitions</header><text>Section 808(a) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/384d">21 U.S.C. 384d(a)</external-xref>) is amended—</text><paragraph id="id14d011dfe16040d38389152ba09f5749" commented="no"><enum>(1)</enum><text>by striking paragraph (6) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id40c58c27d8ea44e4b590cbf2d28a7b00"><paragraph id="id6598bd12f82d4e8cb3843eb3ddc6a302" commented="no"><enum>(6)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a foreign or domestic entity, including a foreign or domestic facility subject to registration under section 415, in the food supply chain that chooses to be audited by an accredited third-party auditor or the audit agent of such accredited third-party auditor.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id4205c91df43742bb84e36bbbf4aa8668"><enum>(2)</enum><text>in paragraph (7)(B)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb617c9f25d934f91b0d082a3f818ab91"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbbb5fabbedeb4fb1b84246bb218efe1c"><enum>(B)</enum><text>in clause (ii), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0b2a63e4f8d446ad9f71b3f6ccd609f0"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idaa3cc1600f2849f9a5dc9f347108547b"><clause id="idc786c5888f824b78a34f67b10e1f501b" commented="no"><enum>(iii)</enum><text>whether a facility is eligible to receive a food or facility certification for other purposes described in subsection (c)(2)(B)(ii).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id32d91ade647b4916aa3f21bd103895e8"><enum>(b)</enum><header>Removing limitations on the use of certifications</header><text>Section 808(c)(2) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/384d">21 U.S.C. 384d(c)(2)</external-xref>) is amended—</text><paragraph id="id4fb89f9e23c64dc78749643e02d63d5a"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>food certification, described in section 801(q), or facility certification under section 806(a), as appropriate, to accompany each food shipment for import into the United States from an eligible entity</quote> and inserting <quote>food certification or facility certification for purposes described in subparagraph (B), as appropriate,</quote>; and</text></paragraph><paragraph id="id65ed5c4509b04aa28847419dfcbd9109"><enum>(2)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6a148f52e39a4a97ac44263f3e51a3fe"><subparagraph id="id45247b51a1f445f49728657fab23d583"><enum>(B)</enum><header>Purpose of certification</header><clause id="id557607ecdf0b4e15a510492efa7da3d9"><enum>(i)</enum><header>In general</header><text>The Secretary shall use certification provided by accredited third-party auditors to—</text><subclause commented="no" display-inline="no-display-inline" id="id0a0c95eef60b4f92b89e4730889a977f"><enum>(I)</enum><text display-inline="yes-display-inline">determine, in conjunction with any other assurances the Secretary may require under section 801(q), whether a food satisfies the requirements of such section; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id928b940af52941f689e5d64fa9b488e4"><enum>(II)</enum><text display-inline="yes-display-inline">determine whether a facility is eligible to be a facility from which food may be offered for import under the voluntary qualified importer program under section 806.</text></subclause></clause><clause id="ided84374900b649e89ead4aa6964756e0"><enum>(ii)</enum><header>Other considerations</header><text>The Secretary may consider the results of regulatory audits and food or facility certifications provided by accredited third-party auditors under this section in analyzing risks and prioritizing inspections and other regulatory activities, as appropriate for the protection of public health.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idab18e34272684c26937ebcb533d7cc13"><enum>(c)</enum><header>Technical and conforming amendments</header><text display-inline="yes-display-inline">Section 808 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/384d">21 U.S.C. 384d</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8147d215829b49d29f800578bc6b2050"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7092aa677e734ca6a57e5fb289773c7d"><subparagraph id="id559a9d4c48754520800b314e96856c92" commented="no"><enum>(A)</enum><header>Recognition of accreditation bodies</header><text>Not later than 2 years after the date of enactment of the <short-title>Making America's Food Safer Act</short-title>, the Secretary shall establish a system for the recognition of accreditation bodies that accredit third-party auditors to certify that eligible entities meet the applicable requirements of this section.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id619416f8b6f4497ba86357fd59ac6316"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id408e0ce5c185483982e94b5445f67949"><enum>(A)</enum><text>in paragraphs (1) and (2), by striking <quote>(or, in the case of direct accreditation under subsection (b)(1)(A)(ii), the Secretary)</quote> each place it appears;</text></subparagraph><subparagraph id="id740c40e6fabd4e2da35b7e8099c46418"><enum>(B)</enum><text>in paragraph (2)(C)(i), by striking <quote>food certification under section 801(q) or a facility certification described under this subparagraph (B)</quote> and inserting <quote>food certification or a facility certification described in this section</quote>;</text></subparagraph><subparagraph id="idb741e0d14c6244888cedc6eb960a2bc2"><enum>(C)</enum><text>in paragraph (6)(A)(i), by striking <quote>food certified under section 801(q) or from a facility certified under paragraph (2)(B)</quote> and inserting <quote>food or facility certified under this section</quote>;</text></subparagraph><subparagraph id="idabc5fd191d3f4ef7b2e7eea614e83233"><enum>(D)</enum><text>in paragraph (6)(C), by striking <quote>requirements under section 801(q), of certifying the food, or the requirements under paragraph (2)(B) of certifying the entity</quote> and inserting <quote>requirements for certifying the food or facility under this section</quote>; and</text></subparagraph><subparagraph id="idc1b6908e0e154267be00e5f9269524bd"><enum>(E)</enum><text>in paragraph (7)(B)(i), by striking <quote>, through direct accreditation under subsection (b)(1)(A)(ii) or</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9e813aae1b86408192a932e5fc44412f"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="idb43c0cb1add1483299bcf0b3358ac558"> <enum>(A)</enum> <text>in paragraph (1), by striking <quote>or</quote>;</text>
 </subparagraph><subparagraph id="id11ec7dc988454c49ac05ba4e4a0fcb71"><enum>(B)</enum><text>at the end of paragraph (2), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="idb427e69f50144604a89f5cedfbe115df"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idfb4954f4a2204247baeb5a5a0b429f7f"><paragraph id="idf7c01ea692d74fa78be5caaa07172439"><enum>(3)</enum><text>otherwise seeks certification for purposes of subsection (c)(2)(B)(ii).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="id1ccb63da30dc48b581acba7da5094035"><enum>3.</enum><header>Sharing food safety information with State, local, Tribal, and territorial authorities</header><subsection id="id1d8642b1fb3542ec827e4c0870eb6ea1"><enum>(a)</enum><header>In general</header><text>Section 708 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/379">21 U.S.C. 379</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idecd11c723919458fae7defb7e6b72c2a"><subsection id="iddff4f7a401ad432887a8078892aaabab"><enum>(d)</enum><header>Sharing food safety information with State, local, Tribal, and territorial authorities</header><paragraph id="idf8c17e9adaf74edb8e4f20c20d9d69c7"><enum>(1)</enum><header>Authorization</header><text>Notwithstanding section 301(j) and any other law, regulation, or policy, the Secretary may share, with a State, local, Tribal, or territorial authority with counterpart functions related to the protection of public health, unredacted information in the possession of the Food and Drug Administration relating to any of the following:</text><subparagraph id="idca64fc751f1a4f4fad4dfca9bb0c5426"><enum>(A)</enum><text>Foodborne illness surveillance data.</text></subparagraph><subparagraph id="id09a97a7e78034ceba43da460e8378cec"><enum>(B)</enum><text>Laboratory sampling testing information.</text></subparagraph><subparagraph id="id7787e6ae2e6c445e9ed9b3d0390456b0"><enum>(C)</enum><text>Inspectional information and results.</text></subparagraph><subparagraph id="id150eb5f3b7194848b516e5fdc6e94134"><enum>(D)</enum><text>Distribution lists for recalls and outbreaks.</text></subparagraph><subparagraph id="id6d3271ae87e0477a8529209be629a617"><enum>(E)</enum><text>Consumer complaints.</text></subparagraph><subparagraph id="id8763532a4790416e91aeafa5f43ae59a"><enum>(F)</enum><text>Any other information the Secretary determines will assist such authority in protecting the public.</text></subparagraph></paragraph><paragraph id="id925e34daccf242d4b3a7250a40c7b2a9"><enum>(2)</enum><header>Timing</header><text>The Secretary may share information pursuant to paragraph (1) as soon as is reasonably practicable.</text></paragraph><paragraph id="id79720dc8190b4e23be58b39d6377c8c9"><enum>(3)</enum><header>Limitation on further disclosure</header><text>A State, local, Tribal, or Territorial authority in receipt of information provided by the Secretary under this subsection shall not further disclose such information without permission of the Food and Drug Administration unless such authority determines that disclosure of such information is necessary to contain a foodborne illness outbreak, carry out a recall, or carry out other State enforcement activities.</text></paragraph><paragraph id="ida95e98b861774c9eb7ccd9d6193e1b95"><enum>(4)</enum><header>Effect of subsection</header><text>Nothing in this subsection affects the authority of the Secretary to enter into any written agreement authorized by other provisions of law to share confidential information.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3c8b27ca896c4e6fb9db0a71f305f842"><enum>(b)</enum><header>Conforming amendment</header><text>The first sentence of section 301(j) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331(j)</external-xref>) is amended by striking the second period at the end.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id1319d48a25914849915b8e50f61eae08"><enum>4.</enum><header>Destruction of certain refused articles</header><text display-inline="no-display-inline">Section 801 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7a67930d450b40bf94f30ce5a2dd8cea"><subsection id="idedf4403044c44b8682bc0c15faea4443"> <enum>(v)</enum> <header>Order To destroy certain refused articles</header> <text>For any article that has been refused admission and is in violation of this Act, the Secretary of Health and Human Services may issue to the owner or consignee an order that the article shall be destroyed, without the opportunity to export, if the Secretary of Health and Human Services finds that the article presents a significant public health concern. Before issuing an order to destroy an article under this subsection, the Secretary of Health and Human Services shall issue regulations providing for notice and an opportunity to appear before the Secretary of Health and Human Services and introduce testimony on the order to destroy. The regulations shall provide that prior to the destruction of any such article, appropriate due process is available to the owner or consignee seeking to challenge the Secretary of Health and Human Service’s decision to order destruction. Such process may be combined with the notice and opportunity to appear before the Secretary and introduce testimony on the refusal as long as appropriate notice is provided to the owner or consignee about the potential order to destroy. The Secretary of the Treasury shall cause the owner or consignee to complete the destruction of any such article within 90 days of the order for destruction and the owner or consignee shall be responsible for the costs of such destruction.</text>
