<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4973</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260714">July 14, 2026</action-date><action-desc><sponsor name-id="S420">Mr. Schmitt</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 301 of the Immigration and Nationality Act to clarify the meaning of the Citizenship Clause of the Fourteenth Amendment, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Citizenship Act</short-title></quote>.</text></section><section id="idec96d986fa2543089bd9825e646437c3"><enum>2.</enum><header>Birthright citizenship according to the United States Constitution</header><subsection id="id6cf8967dcecc4dff87f921a7f26f9811"><enum>(a)</enum><header>In general</header><text>Section 301(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1401">8 U.S.C. 1401(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideb473a057abf4488966f5db2bfb86c45"><subsection id="id8cd4ee1cb5a54e2c87920b382fb3475c"><enum>(a)</enum><text>a person born in the United States and not subject to any foreign power: <proviso><italic>Provided</italic></proviso>, That a person born in the United States shall be deemed subject to a foreign power if neither parent of such person is a United States citizen or has been lawfully admitted for permanent residence at the time of such person's birth;</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id57e794117f8f4bcbbe6b1dc5c28df7d8"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) may not be construed to affect the citizenship or nationality status of any person who was born before the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
