<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4965</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260714">July 14, 2026</action-date><action-desc><sponsor name-id="S373">Mr. Cassidy</sponsor> (for himself, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, <cosponsor name-id="S429">Mr. Banks</cosponsor>, and <cosponsor name-id="S362">Mr. Kaine</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Railroad Retirement Act of 1974 to establish a Railroad Retirement Board Administrative Account, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Railroad Retirement Board Stability Act of 2026</short-title></quote>.</text></section><section id="id78b46150958d4d19b8ba5197a56d4e1d"><enum>2.</enum><header>Railroad Retirement Board Administrative Account</header><subsection commented="no" display-inline="no-display-inline" id="id58aab119f910409db4b5c748c8203919"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 15(h) of the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231n">45 U.S.C. 231n(h)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idaf2e831ad52946b8be922f6543c3d2fd"><subsection id="id2269aeac750341c68812276240adbfb7"><enum>(h)</enum><header>Railroad Retirement Board Administrative Account</header><paragraph id="id8f38985b6a5b4f08a3dc6b9e4a8801da"><enum>(1)</enum><header>In general</header><text>There is created within the Treasury an account known as the Railroad Retirement Board Administrative Account (in this subsection, referred to as the <term>Account</term>). All amounts within the Account are permanently and continuously available to the Board for purposes of administering this Act and the Railroad Unemployment Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/45/351">45 U.S.C. 351 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide3be5f587d5d4a78bab2ee942e4c6899"><enum>(2)</enum><header>Transfers and limitations</header><subparagraph commented="no" display-inline="no-display-inline" id="id32b0aba733ce49c8b49b46ea02f7f315"><enum>(A)</enum><header display-inline="yes-display-inline">Transfer authority</header><text>Subject to subparagraph (B), the Board may transfer from the Railroad Retirement Account, the Social Security Equivalent Benefits Account, and the Railroad Unemployment Insurance Administration Fund amounts the Board determines to be necessary for the purposes described in paragraph (1).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id185a8237dfc745f193058e02006ef45d"><enum>(B)</enum><header>Limitations on amounts</header><clause commented="no" display-inline="no-display-inline" id="id7ae482896ce348168aabd1f7b0d6add5"><enum>(i)</enum><header>Fiscal years 2027 through 2031</header><text display-inline="yes-display-inline">For fiscal years 2027 through 2031, the Board shall not transfer funds in a fiscal year to the Account in an amount that is greater than—</text><subclause commented="no" display-inline="no-display-inline" id="idb642b0c1c0344e5c8d1df9fe5660aeda"><enum>(I)</enum><text display-inline="yes-display-inline">the lesser of—</text><item commented="no" display-inline="no-display-inline" id="ide7318837f00a4dcca5cac6f0826d4b5f"><enum>(aa)</enum><text display-inline="yes-display-inline">1.25 percent of the total benefits paid under this Act and the Railroad Unemployment Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/45/351">45 U.S.C. 351 et seq.</external-xref>) during the preceding fiscal year; or</text></item><item commented="no" display-inline="no-display-inline" id="id429f5436edec4502a5bb616773d0df53"><enum>(bb)</enum><text>0.75 percent of the total amounts in the National Railroad Retirement Investment Trust as of the close of the preceding fiscal year; minus</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id9deb543b6b6943f2a8442d025b9082a4"><enum>(II)</enum><text display-inline="yes-display-inline">the unobligated amounts in the Account as of the close of the previous fiscal year.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1d1174069ae64563964b50706efcb1b7"><enum>(ii)</enum><header>Fiscal year 2032 and subsequent fiscal years</header><text>For fiscal year 2032 and subsequent fiscal years, the Board shall not transfer funds in a fiscal year to the Account in an amount that is greater than—</text><subclause commented="no" display-inline="no-display-inline" id="idc5350799c4b0460fad4a656b997c5be4"><enum>(I)</enum><text display-inline="yes-display-inline">the lesser of—</text><item commented="no" display-inline="no-display-inline" id="id8d6a1bb522b64d82b28ceec2932e1269"><enum>(aa)</enum><text display-inline="yes-display-inline">1.15 percent of the total benefits paid under this Act and the Railroad Unemployment Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/45/351">45 U.S.C. 351 et seq.</external-xref>) during the preceding fiscal year; or</text></item><item commented="no" display-inline="no-display-inline" id="id712f0c03b6354b74a20df53d1c7441ee"><enum>(bb)</enum><text>0.75 percent of the total amounts in the National Railroad Retirement Investment Trust as of the close of the preceding fiscal year; minus</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idf77a1394188e420897e5e7c27114585f"><enum>(II)</enum><text>the unobligated amounts in the Account as of the close of the previous fiscal year.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9174d39ad6bb48969372bb2aa84ac526"><enum>(C)</enum><header>Purpose limitations</header><text>Amounts transferred to the Account from—</text><clause id="id45824608836e4c0daba5adcf10ba3f8f"><enum>(i)</enum><text>the Social Security Equivalent Benefits Account may only be used to provide for the administrative expenses of the Board allocable to social security equivalent benefits under section 15A(c)(1); and</text></clause><clause id="idec4ff5a954bf4ba0979bad6c069e4498"><enum>(ii)</enum><text>the Railroad Unemployment Insurance Administration Fund—</text><subclause commented="no" display-inline="no-display-inline" id="id04313e01f0d24e6694ce4593d0c9f987"><enum>(I)</enum><text display-inline="yes-display-inline">may only be used for the administrative expenses of the Board allocable for administering the Railroad Unemployment Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/45/351">45 U.S.C. 351 et seq.</external-xref>); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id63a07072d9c24dc9bd47fa00703d63bd"><enum>(II)</enum><text>shall be subject to the same restrictions described in section 11(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/45/361">45 U.S.C. 361(c)</external-xref>).</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4c0898295bc34342bbb17fdbb1cff02f"><enum>(3)</enum><header>Technology fund</header><subparagraph commented="no" display-inline="no-display-inline" id="idfb87c9456a904bd59b285aed20c2c5f9"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Within the Account, there is created a Railroad Retirement Technology Fund (in this subsection, referred to as the <quote>Fund</quote>). In addition to amounts otherwise available, the Board shall use amounts in the Fund to complete its modernization of legacy benefit processing systems.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44b209f0bdd64bfd9ca7a10b0f69eb93"><enum>(B)</enum><header>Transfers</header><text>Of the amounts transferred to the Account under paragraph (2)(A), the Board shall transfer not less than the following amounts to the Fund:</text><clause commented="no" display-inline="no-display-inline" id="id385f2816e5f04048baa61d3b0483a58d"><enum>(i)</enum><text>For fiscal year 2027, $10,000,000.</text></clause><clause commented="no" display-inline="no-display-inline" id="id06dcf6a5c08a4437b3e382804bfa3acd"><enum>(ii)</enum><text>For each of fiscal years 2028 through 2031, $20,000,000.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8967931750034bd1a73c9573127fccab"><enum>(C)</enum><header>Availability</header><text>Amounts transferred under this paragraph shall remain available to the Board to complete its modernization of legacy benefit processing systems through fiscal year 2032. On the last day of fiscal year 2032, the Board shall transfer any unobligated amounts remaining in the Fund to the Account.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd34f665621534089945f12b8df2270d1"><enum>(4)</enum><header>Additional amounts</header><text>In addition to amounts transferred under paragraph (2)(A) or amounts otherwise available, there is authorized to be appropriated to the Account from the Railroad Retirement Account, the Social Security Equivalent Benefits Account, and the Railroad Unemployment Insurance Administration Fund—</text><subparagraph commented="no" display-inline="no-display-inline" id="id70d698998bcf462f88029c00b3729cfb"><enum>(A)</enum><text display-inline="yes-display-inline">for fiscal year 2027 and subsequent fiscal years, for any additional administrative expenses of the Board with respect to unforeseen needs relating to processing claims for benefits, such sums as are necessary; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9be74cdda01943a0896435a1b000ee3f"><enum>(B)</enum><text display-inline="yes-display-inline">for fiscal year 2033 and subsequent fiscal years, for modernization of the Board's legacy benefit processing systems, such sums as are necessary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id41ef82a6ff7e487991d90df8217ad909"><enum>(b)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="id319d28e8e7e743cc972b756d30f19232"><enum>(1)</enum><header>Railroad Retirement Act</header><text display-inline="yes-display-inline">The Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231">45 U.S.C. 231 et seq.</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6a17c6fd265d40f4b3443849fe61a6e3"><enum>(A)</enum><text>in section 15(a), by inserting <quote>to transfer to the Railroad Retirement Board Administrative Account established under subsection (h)</quote> before <quote>to provide for expenses</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0bd05ac5f8d242f2ab519f7c0d4d5f51"><enum>(B)</enum><text display-inline="yes-display-inline">in section 15A(c), by striking <quote>to provide</quote> and inserting <quote>to transfer to the Railroad Retirement Board Administrative Account established under section 15(h)</quote>.</text></subparagraph></paragraph><paragraph id="id67fea48428f94f73b78fd37348404539"><enum>(2)</enum><header>Railroad Unemployment Insurance Act</header><text>Section 11(c) of the Railroad Unemployment Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/45/361">45 U.S.C. 361(c)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc73026a9d13d4f84ad837c4da5e107e5"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Notwithstanding</quote> and inserting <quote>Subject to section 15(h) of the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231">45 U.S.C. 231(h)</external-xref>) and notwithstanding</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf2f705c932554a249ea2ce50e8fa5e1b"><enum>(B)</enum><text>by inserting <quote>for transferring to the Railroad Retirement Board Administrative Account established under section 15(h) of the Railroad Retirement Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/45/231">45 U.S.C. 231(h)</external-xref>)</quote> before <quote>for any expenses necessary</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id761b90e48e7143668885efb97fa551ee"><enum>(c)</enum><header>Savings clause</header><text>Nothing in this section shall be construed as changing any requirement in law for the Railroad Retirement Board to submit any annual budget estimate, request, or other budget information to Congress, the President, the Office of Management and Budget, or any other Federal agency.</text></subsection></section><section id="id12d84c39304b46f280a1e1ae97561b49"><enum>3.</enum><header>GAO reports on information technology modernization efforts</header><subsection id="idd8cebddf597b4ccd9e19ca76395989e1"><enum>(a)</enum><header>Initial report</header><paragraph commented="no" display-inline="no-display-inline" id="idc4242dbcfe3448daacceb67ca0363d3c"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later 10 months after the date of enactment of this Act, the Comptroller General of the United States (in this section, referred to as the <term>Comptroller General</term>) shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report with recommendations for legislation and administrative action on ways to modernize the legacy benefit processing systems used by the Railroad Retirement Board (in this section, referred to as the <term>Board</term>).</text></paragraph><paragraph id="id42aa1d70606b4bb4b9754c5ac2ae2a73"><enum>(2)</enum><header>Content of the report</header><text>In completing the report described in paragraph (1), the Comptroller General shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida58b08f4ed6249f992afa6d6b620fa39"><enum>(A)</enum><text display-inline="yes-display-inline">consider—</text><clause id="idec64dd766bc1499f9f2f105aa5197177"><enum>(i)</enum><text>experience and lessons learned from other Federal agencies’ modernization of their information technology systems, focusing on such agencies that have upgraded information technology systems that use the Common Business-Oriented Language (commonly referred to as <quote>COBOL</quote>) programming language; and</text></clause><clause id="idfba44fe1955d4f76842b2f478d3d7965"><enum>(ii)</enum><text>best practices that the Comptroller General identifies for Federal agency information technology modernization efforts; and</text></clause></subparagraph><subparagraph id="id83b4047bd416425a8e78f9cbc64dbb52" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>identify resources, technical assistance, and other forms of support available from other Federal agencies for the Board to carry out the modernization of the Board's legacy benefit processing systems.</text></subparagraph></paragraph></subsection><subsection id="id3d6d5aa676c64074bdb71233f080870a"><enum>(b)</enum><header>Stakeholders To consult</header><text>In carrying out subsection (a), the Comptroller General shall consult the following stakeholders:</text><paragraph id="id4dd09f7ab99d42e093c08c81845b1010"><enum>(1)</enum><text>Each of the 3 members of the Board.</text></paragraph><paragraph id="id460c1a0562094a098bb54287219271b7"><enum>(2)</enum><text>The Chief Information Officer of the Board.</text></paragraph><paragraph id="id65ca6449313f4e21b8406eab8eea11c5"><enum>(3)</enum><text>Representatives of each of the Class I railroads, as defined in section 20102 of title 49, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb4fe395bcc7b4340ab61297aca465feb"><enum>(4)</enum><text>Representatives of not less than 2 Class II or Class III railroads, as defined in such section.</text></paragraph><paragraph id="idc31f0665b9284cb7b3b5ec25d8a182d3"><enum>(5)</enum><text>Representatives of each rail union that represents rail workers who are eligible for benefits under the Railroad Retirement Act and Railroad Unemployment Insurance Act.</text></paragraph><paragraph id="id6c1f12bd35454eed90f8949530f9a70f"><enum>(6)</enum><text>Retirees and other beneficiaries that currently receive benefits from the Board.</text></paragraph></subsection><subsection id="idca90b62448f04a34a34eb161593ab1f6"> <enum>(c)</enum> <header>Follow-Up report</header> <text>Not later than 6 months after the end of fiscal year 2031, the Comptroller General shall submit a follow-up report to the report described in subsection (a), which shall include information regarding—</text>
        <paragraph id="id9febbc7ade9a42988cd1d3677eab2872">
          <enum>(1)</enum>
 <text>to what extent the Board followed the recommendations and best practices of the report described in subsection (a);</text>
        </paragraph>
        <paragraph id="id74d707693a584dcdbc48cebb1bd8e55b">
          <enum>(2)</enum>
 <text>how effectively the Board complied with its own internal project plans and milestones for completing the modernization of its legacy benefit processing systems;</text>
        </paragraph>
        <paragraph id="ide8a9799998b746abb564be645d2f4a1a">
          <enum>(3)</enum>
 <text>areas, if any, where the Board failed to modernize its legacy benefit processing systems; and</text>
        </paragraph>
        <paragraph id="idd3252c9006014e58853e190679450bbf" commented="no"
          display-inline="no-display-inline">
          <enum>(4)</enum>
 <text display-inline="yes-display-inline">the estimated remaining cost for completing the modernization of the Board's legacy benefit processing systems, if any.</text>
        </paragraph>
