which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Elementary and Secondary Education Act of 1965 to enable schools to teach elementary school and secondary school students about the dangers, limitations, and responsible use of artificial intelligence technologies, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguard Kids Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ideb3faef08eae48919e597496b8ad9748"><enum>2.</enum><header>Artificial Intelligence Safeguards for Elementary and Secondary Education</header><text display-inline="no-display-inline">Subpart 1 of part A of title IV of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7111">20 U.S.C. 7111 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idcf4f80f1e05645e992166f1ffe9a1cb3"><enum>(1)</enum><text>in section 4102 (<external-xref legal-doc="usc" parsable-cite="usc/20/7112">20 U.S.C. 7112</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfa6b989ddfbe4a20989ff80c5d201146"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (8) as paragraphs (3) through (10), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6e5a4bf9ec0646c88f2e1012412d4238"><enum>(B)</enum><text>by inserting before paragraph (3) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide82cd49a3ca0479aac78caa3625a243d"><paragraph commented="no" display-inline="no-display-inline" id="id6ccb42ab32374f85bb476694a42faf69"><enum>(1)</enum><header>Artificial intelligence</header><text>The term <term>artificial intelligence</term> has the meaning given such term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>).</text></paragraph><paragraph id="idcd2c89c149ab433ca9aa1ebcc0adc4b9"><enum>(2)</enum><header>Artificial intelligence chatbot</header><text>The term <term>artificial intelligence chatbot</term> means an artificial intelligence system, marketed to and available for use by consumers, that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbc389423ad264cc9945d045cc3acc2d8"><enum>(A)</enum><text display-inline="yes-display-inline">engages in interactive, natural-language communication with a user and generates or selects content in response to user inputs (including text, voice, or other inputs) using a conversational context; and</text></subparagraph><subparagraph id="ida7c87906a37b41ec9db93909ede600b4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>is capable of multi-turn conversation or personalized responses.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45c207bf158e4504871502d7b1451eb9"><enum>(2)</enum><text display-inline="yes-display-inline">in section 4104(b)(3) (<external-xref legal-doc="usc" parsable-cite="usc/20/7114">20 U.S.C. 7114(b)(3)</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaede4a6253f6437188f391664cff8d66"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii)(II), by inserting <quote>, which may include providing counseling for mental health issues arising from the use of an artificial intelligence chatbot</quote> before the semicolon at the end; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d14ccc368da452eb9a78d7c9efe3bd6"><enum>(B)</enum><text>in subparagraph (C)—</text><clause commented="no" display-inline="no-display-inline" id="id8e001f429a5e4484b927219bd609aacf"><enum>(i)</enum><text display-inline="yes-display-inline">in clause (v), by striking <quote>and</quote> after the semicolon;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf47870f58e694176832c27a99d8f4ed4"><enum>(ii)</enum><text>in clause (vi), by striking the period and inserting <quote>; and</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9a922cdad13a4e6aa2a98885982afcec"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9b3fb006a53b496aaf00af4076e1124d"><clause commented="no" display-inline="no-display-inline" id="idfb8fe241c4ac43198f9d06a0d6909692"><enum>(vii)</enum><text>supporting schools in teaching elementary school and secondary school students about the dangers, limitations, and responsible use of artificial intelligence technologies, including artificial intelligence chatbots.</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2a7d163aa2024a9dac57b7d20c82bbcb"><enum>(3)</enum><text>in section 4108(5)(B) (<external-xref legal-doc="usc" parsable-cite="usc/20/7118">20 U.S.C. 7118(5)(B)</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb36ba3e3f83b45f793996c58ddf10a6f"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddeb4ea8970034ce1b1271f759a0c6b49"><enum>(B)</enum><text>in clause (ii)(II)(cc), by inserting <quote>and</quote> after the semicolon at the end; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee0f726b08e44fdeac01cd17cbc8f878"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1071f989a61b45feb5018228d8c88bf0"><clause commented="no" display-inline="no-display-inline" id="id5d8ec7f1322c41d9b1bb732a7fc76c01"><enum>(iii)</enum><text>counseling for mental health issues arising from the use of artificial intelligence chatbots;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0004b7bdf77f474cbc20d1b8c1b7833f"><enum>(4)</enum><text>in section 4109(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/7119">20 U.S.C. 7119(a)</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2bfeba53cb8e42bab3b4b790310348e9"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>and</quote> after the semicolon;</text></subparagraph><subparagraph id="idb7cd3fd46a5d49a59b418716d4f6b109"><enum>(B)</enum><text>in paragraph (6), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1b7a3a40348545878aeb499de6bbeffc"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddeca1ac17447454d9ac3ed7167cfccc5"><paragraph commented="no" display-inline="no-display-inline" id="id1ae3edbf3f484906bfd0f3f7e267fb1b"><enum>(7)</enum><text>teaching elementary school and secondary school students about the dangers, limitations, and responsible use of artificial intelligence technologies, including artificial intelligence chatbots.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
