Mr. Scott of Florida introduced the following bill; which was read twice and referred to the Committee on Health, Education, Labor, and Pensions


A BILL

To amend the Elementary and Secondary Education Act of 1965 to enable schools to teach elementary school and secondary school students about the dangers, limitations, and responsible use of artificial intelligence technologies, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. Short title.

This Act may be cited as the “Safeguard Kids Act”.

SEC. 2. Artificial Intelligence Safeguards for Elementary and Secondary Education.

Subpart 1 of part A of title IV of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7111 et seq.) is amended—

(1) in section 4102 (20 U.S.C. 7112)—

(A) by redesignating paragraphs (1) through (8) as paragraphs (3) through (10), respectively; and

(B) by inserting before paragraph (3) (as so redesignated) the following:

“(1) ARTIFICIAL INTELLIGENCE.—The term ‘artificial intelligence’ has the meaning given such term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (15 U.S.C. 9401).

“(2) ARTIFICIAL INTELLIGENCE CHATBOT.—The term ‘artificial intelligence chatbot’ means an artificial intelligence system, marketed to and available for use by consumers, that—

“(A) engages in interactive, natural-language communication with a user and generates or selects content in response to user inputs (including text, voice, or other inputs) using a conversational context; and

“(B) is capable of multi-turn conversation or personalized responses.”;

(2) in section 4104(b)(3) (20 U.S.C. 7114(b)(3))—

(A) in subparagraph (B)(ii)(II), by inserting “, which may include providing counseling for mental health issues arising from the use of an artificial intelligence chatbot” before the semicolon at the end; and

(B) in subparagraph (C)—

(i) in clause (v), by striking “and” after the semicolon;

(ii) in clause (vi), by striking the period and inserting “; and”; and

(iii) by adding at the end the following:

“(vii) supporting schools in teaching elementary school and secondary school students about the dangers, limitations, and responsible use of artificial intelligence technologies, including artificial intelligence chatbots.”;

(3) in section 4108(5)(B) (20 U.S.C. 7118(5)(B))—

(A) in clause (i), by striking “and” after the semicolon;

(B) in clause (ii)(II)(cc), by inserting “and” after the semicolon at the end; and

(C) by adding at the end the following:

“(iii) counseling for mental health issues arising from the use of artificial intelligence chatbots;”; and

(4) in section 4109(a) (20 U.S.C. 7119(a))—

(A) in paragraph (5), by striking “and” after the semicolon;

(B) in paragraph (6), by striking the period and inserting “; and”; and

(C) by adding at the end the following:

“(7) teaching elementary school and secondary school students about the dangers, limitations, and responsible use of artificial intelligence technologies, including artificial intelligence chatbots.”.
