which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to preserve consumer vehicle choice, protect the electric grid, and impose limits on regulations under that Act, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H996B399B0E404853A8D58493754E6B6E"><section section-type="section-one" id="H54AFAAF011D143B98E44394638A6FA7E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End EPA Abuse Act of 2026</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HFFE5CD5A354547CAB4AD2D30F8ECCCBE"><enum>2.</enum><header>Administration</header><text display-inline="no-display-inline">Section 301 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7601">42 U.S.C. 7601</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HD8528D2DC65D4CA8854FFA3267AD2044"><enum>(1)</enum><text>by striking the section designation and heading and all that follows through <quote>The Administrator</quote> in the first sentence of subsection (a)(1) and inserting the following:</text><quoted-block style="OLC" id="H25C62BD1DD774EA0A64EA0D2A5905FD1" act-name=""><section id="H7A4C91CE16AF4EC6B50310970A067D84"><enum>301.</enum><header>Administration</header><subsection commented="no" display-inline="no-display-inline" id="H93C978889F1F469DA76B966113128DFF"><enum>(a)</enum><header display-inline="yes-display-inline">Regulatory authority</header><paragraph commented="no" display-inline="no-display-inline" id="HCC0E345C7CB9411194EAD7521EB305A0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to paragraph (3), the Administrator</text></paragraph></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4E89613253D64BA39C68315BBBEEA6A3"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H9825D4A19D984B95B88DCA4D129CF9F2"><enum>(A)</enum><text>in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="HD5CB876BB3E545B4A44F307095E55116"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>(2) Not later than</quote> and inserting the following:</text><quoted-block style="OLC" id="H29F6F7C3432B4E189A433AC4FF8F2A4F" act-name=""><paragraph id="H13D626C9F5754165897A90628D3BC2B2"><enum>(2)</enum><header>Regional offices</header><text>Not later than</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" display-inline="no-display-inline" id="H486BB565D06D4798B22C3D0A2153FFAF"><enum>(ii)</enum><text>by indenting subparagraphs (A) through (C) appropriately; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAE7E9DAA4F814A688E53B6B185D5BE6B"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H598F45368F9649D8B212B89FBE08E8B4" act-name=""><paragraph id="H698F5966AF3D40A1B35746311A842A39"><enum>(3)</enum><header>Limitations on regulations</header><text display-inline="yes-display-inline">Nothing in this Act authorizes the Administrator to prescribe any regulations, including the granting of a waiver or authorization otherwise authorized under this Act, if the regulation can reasonably be determined—</text><subparagraph id="H5CA656BBAE1447E687BEE896B8B3113D"><enum>(A)</enum><text>to restrict or in effect restrict the sale or use of any type of vehicle or engine, including a new motor vehicle with an internal combustion engine (as defined in section 63.9375 of title 40, Code of Federal Regulations (as in effect on January 1, 2026));</text></subparagraph><subparagraph id="HF34E79E23C79404282026356E82CBAE7"><enum>(B)</enum><text>to require or necessitate fuel-switching at a power plant;</text></subparagraph><subparagraph id="H5633FB4700614AFFB629FAC6BD59B237"><enum>(C)</enum><text>to reduce the reliability of the electric grid;</text></subparagraph><subparagraph id="HD788A7BABC6F49669AC053C5B485CE9C"><enum>(D)</enum><text>to require or necessitate the use of a technology that is—</text><clause id="H0D8FF0C7F17C4D4B9E5FD5D3AAF8366A"><enum>(i)</enum><text>commercially unavailable;</text></clause><clause id="HF14B752A2AD542C890251FF888C43C58"><enum>(ii)</enum><text>cost-prohibitive or unachievable independent of any subsidies, including any subsidies provided directly or indirectly to cover the cost of the technology or to demonstrate the feasibility of the technology;</text></clause><clause id="HC5AA24B1F0DD43F499402E21CB12B8F6"><enum>(iii)</enum><text>infeasible due to factors beyond the control of the entity to which the regulation would apply, including geographic, geologic, or climatic factors, or the lack of critical enabling infrastructure; or</text></clause><clause id="H9417AB51FBDC4AB1B1CB3FFFFC526390"><enum>(iv)</enum><text>otherwise technically, economically, or practically infeasible; or</text></clause></subparagraph><subparagraph id="HE5A999DEB9414EA58C9CDCB6F846E186"><enum>(E)</enum><text>to otherwise significantly expand the authority of the Administrator beyond the intent of Congress.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
