risk-based oversight, defining risk to organic integrity, and authorizing regulatory reforms, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H291C0AA51B9D4525A0380905042DAE85"><section section-type="section-one" id="HDC191AEA6D5C43E49AD7E0D8F9E08885"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Risk-based Oversight for Integrity Act</short-title></quote>.</text></section><section id="H3BEA16C76B2E49A69E2B1AF1241258A8"><enum>2.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="idc075864429cc487ebd30d598a5665618"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 2103 of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6502">7 U.S.C. 6502</external-xref>) is amended—</text><paragraph id="H187CAFEC65704BEEBD231CE77FFED350"><enum>(1)</enum><text>by redesignating paragraphs (2), (3), and (6) through (22) as paragraphs (3), (6), (7), (8), (9), (10), (11), (12), (13), (15), (17), (18), (20), (21), (22), (23), (25), (26), and (27), respectively, and moving all paragraphs of that section so as to appear in numerical order;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc71443106376405bb74b4eca4147beaa"><enum>(2)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3e41279108664fe1b66b007d8cba6c06"><paragraph commented="no" display-inline="no-display-inline" id="id4b62fdaf71af4778bd9639225bc132f9"><enum>(2)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id454f04667d494ce0b0cebcfdf230c940"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Agriculture, Nutrition, and Forestry of the Senate; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2c5853e8247543f695cdf4d06788268f"><enum>(B)</enum><text>the Committee on Agriculture of the House of Representatives.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1beea734d8774605bf66511e70fbea49"><enum>(3)</enum><text>by inserting after paragraph (13) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7b2968128b2145a4801444ea0648a6d4"><paragraph commented="no" display-inline="no-display-inline" id="id5518fbffc57d4d2fab9f06c5cebb4a0c"><enum>(14)</enum><header>National organic program</header><text>The term <term>national organic program</term> means the national organic program established under this title.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb287961d49cf4d2fa6351647617afd57"><enum>(4)</enum><text>by inserting after paragraph (15) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id96f85e56a6a64bc48dd07238153daf1c"><paragraph commented="no" display-inline="no-display-inline" id="id3ace08fd80ad49a990416c312dbd30c9"><enum>(16)</enum><header>National Organic Standards Board</header><text>The term <term>National Organic Standards Board</term> means the National Organic Standards Board established under section 2119.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HBE0F6DB366DD4D868DD81C8EC15B2116"><enum>(5)</enum><text>by inserting after paragraph (18) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3C3BAE86110F4CAEB50F93C6CD797080"><paragraph id="H5AC6F7CA9B5E46609204263FCF445408"><enum>(19)</enum><header>Oversight protocols</header><text display-inline="yes-display-inline">The term <term>oversight protocols</term> means the regulations, policies, and procedures issued by the Secretary under the authorities provided by sections 2104, 2107, 2114, 2115, 2116, and 2120.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HA5A4D1F6A7894FA3B884B0BB6531C140"><enum>(6)</enum><text>by inserting after paragraph (23) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF7E7E5D131F94C2DBE9876F33639BF74"><paragraph id="HAC104A04302C4F0DBE43E23C8C90FF44"><enum>(24)</enum><header>Risk to organic integrity</header><text display-inline="yes-display-inline">The term <term>risk to organic integrity</term> means the likelihood that a product marketed as organically produced is, or contains, an agricultural product that—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddc1b8359f3d843b3b47052f2e84cf387"><enum>(A)</enum><text display-inline="yes-display-inline">was not produced using a system of organic farming in compliance with this title; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76d029ca1caf41d7961271531204783a"><enum>(B)</enum><text display-inline="yes-display-inline">was not processed in compliance with this title.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id98355caaea7f4b98ba66c788cb23fcf5"><enum>(b)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="idb8723e0fbe594b3483be1423d4c20cc9"><enum>(1)</enum><text>Section 2104(c) of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6503">7 U.S.C. 6503(c)</external-xref>) is amended by striking <quote>established under section 2119</quote>.</text></paragraph><paragraph id="idcf95c36b09be4e51abe4f35184dfecfd"><enum>(2)</enum><text>Section 2107(c)(2)(A)(ii) of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6506">7 U.S.C. 6506(c)(2)(A)(ii)</external-xref>) is amended by striking <quote>established under section 2119</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7fb8f603576445e1a4d22fdb342fa06d"><enum>(3)</enum><text>Section 2115(c) of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6514">7 U.S.C. 6514(c)</external-xref>) is amended by striking <quote>established under this title</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b4ef3dad23a4fc0bdc08e93114f0a6e"><enum>(4)</enum><text>Section 2123(b) of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6522">7 U.S.C. 6522(b)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>established under this title</quote>.</text></paragraph></subsection></section><section id="H414F57E56EF0489EA003CB5C7F27CE51"><enum>3.</enum><header>Study and reform of national organic program oversight protocols</header><subsection commented="no" display-inline="no-display-inline" id="ida382bdeff9db43e3b263073ade8ff3ac"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Organic Foods Production Act of 1990 is amended by inserting after section 2122A (<external-xref legal-doc="usc" parsable-cite="usc/7/6521a">7 U.S.C. 6521a</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB948FD8B6254415A9FA6E0A0AD44E29B"><section id="H85F0ED5C88BE47FC876C5E01EB465F3E"><enum>2122B.</enum><header>Study and reform of national organic program oversight protocols</header><subsection id="H8E32B23CE820457FA70A82B328747927"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this section, the Secretary shall complete a comprehensive study for the purpose of determining whether the establishment of oversight protocols based on risk to organic integrity and the implementation of related reforms are necessary and appropriate.</text></subsection><subsection id="H21C02752EF3749AA96974D3CD50BF520"><enum>(b)</enum><header>Elements</header><paragraph id="H5527E39B3A124F0DAF8F9F8D6F319121"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In conducting the study under subsection (a), the Secretary shall examine the feasibility of, opportunities for, and implications of, implementing oversight protocols that—</text><subparagraph id="HB30A49BFC5D84D39A2E582AA20F0991E"><enum>(A)</enum><text>are based on risk to organic integrity;</text></subparagraph><subparagraph id="H7D6BBE1EB22142F6AA2B539147A5446C"><enum>(B)</enum><text>include differential treatment of noncompliance that increases the risk to organic integrity versus noncompliance that does not increase the risk to organic integrity;</text></subparagraph><subparagraph id="H4D3EF427F8164CB3B86A9C9D76869629"><enum>(C)</enum><text>utilize common organic plans under section 2114 that are aligned with the risk to organic integrity;</text></subparagraph><subparagraph id="HE4FD475DED5B405A984CC44E95417AB8"><enum>(D)</enum><text>include a multi-tiered approach to certification aligned with the risk to organic integrity and the scale of the organic operation;</text></subparagraph><subparagraph id="HBEC813196F1A49AC97F7AD80006F0449"><enum>(E)</enum><text>provide for increased guidance and interpretations of standards and criteria established under this title, to be provided by the national organic program to—</text><clause commented="no" display-inline="no-display-inline" id="id1e6254a9cba34ba3ae30d1f53f2e0167"><enum>(i)</enum><text display-inline="yes-display-inline">certifying agents;</text></clause><clause commented="no" display-inline="no-display-inline" id="id95bc8515b42f4023bcde233cc83873b6"><enum>(ii)</enum><text display-inline="yes-display-inline">certified organic farms; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idd6e1440e01bb424aa1e090411f7d73ec"><enum>(iii)</enum><text display-inline="yes-display-inline">certified organic handling operations; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8f438645f2248089ebf367c03c5d58a"><enum>(F)</enum><text>include virtual inspections as described in subsection (e)(4).</text></subparagraph></paragraph><paragraph id="H5941CBA496D04AF28C678DDE690C950E"><enum>(2)</enum><header>Consideration of relevant factors</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary shall, with respect to certified organic farms, certified organic handling operations, and certifying agents, take into account—</text><subparagraph id="HD1CBBFB102084CFCB06E750896DA99BD"><enum>(A)</enum><text>the scope of certification or accreditation of each entity;</text></subparagraph><subparagraph id="H42574FE85E58486585E6E245F27F3F0B"><enum>(B)</enum><text>the scale and complexity of each entity;</text></subparagraph><subparagraph id="H07EF8C11A9ED4759B0BD56AC835CD78A"><enum>(C)</enum><text>the domestic or international location of each entity;</text></subparagraph><subparagraph id="H4CF96B5C8E01438EB46A841C7FA498E2"><enum>(D)</enum><text>the history of compliance of each entity; and</text></subparagraph><subparagraph id="HE56B0ACBD0024B69B31B8F926309D359"><enum>(E)</enum><text>other relevant factors.</text></subparagraph></paragraph></subsection><subsection id="H0D34D81E50AE4E958E54CE2F2A3F80AF"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this section, the Secretary shall submit to the appropriate committees of Congress, and make publicly available on the website of the Department of Agriculture, a report describing the findings of the study conducted under subsection (a).</text></subsection><subsection id="H8DF0EC92BA154675AD203093B21185D4"><enum>(d)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the study under subsection (a), the Secretary shall consult with—</text><paragraph id="HA5DE2EB423FF4856A7A2175FC48E02E8"><enum>(1)</enum><text>the National Organic Standards Board;</text></paragraph><paragraph id="H305C9847121B4F8EA240B424B2C88262"><enum>(2)</enum><text>certifying agents;</text></paragraph><paragraph id="HAB75350E90F74C06989D1E15E2D7F6FD"><enum>(3)</enum><text>certified organic farms;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab1cf1f1d81f404786d17c74ec78e9a2"><enum>(4)</enum><text display-inline="yes-display-inline">certified organic handling operations;</text></paragraph><paragraph id="H311B5ECB586746FC88926E6D607A6DF3"><enum>(5)</enum><text>consumers of organically produced agricultural products; and</text></paragraph><paragraph id="H0DFB4773E6F74E4DAE8676D9BE70D98E"><enum>(6)</enum><text>other relevant stakeholders.</text></paragraph></subsection><subsection id="HCC1DC49DBF2F4B8E964F566C8201AF23"> <enum>(e)</enum> <header>Authority To establish additional terms and conditions</header> <paragraph id="H2344D4069CE44E72B1A2748B8A4FD665"> <enum>(1)</enum> <header>Oversight protocols</header> <text>Based on the findings described in the report under subsection (c), and after consultation with the appropriate committees of Congress, the Secretary may promulgate regulations to establish or modify oversight protocols under this title that the Secretary determines are necessary and appropriate, subject to the condition that such regulations—</text>
                <subparagraph commented="no" display-inline="no-display-inline"
                  id="id8ae095999bec4534be26f38ee88d2260">
                  <enum>(A)</enum>
 <text display-inline="yes-display-inline">maintain strong organic integrity;</text>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline"
                  id="id2ed35b42be4041508e316ed4325ec2e0">
                  <enum>(B)</enum>
 <text display-inline="yes-display-inline">support a resilient domestic organic sector; and</text>
                </subparagraph>
                <subparagraph commented="no" display-inline="no-display-inline"
                  id="id9a946571968b4acca73cfe67680e3b9f">
                  <enum>(C)</enum>
 <text display-inline="yes-display-inline">are consistent with the requirements of this title.</text>
                </subparagraph>
              </paragraph>
              <paragraph commented="no" display-inline="no-display-inline"
                id="idf663f3e36c034525899dff2b492118f6">
                <enum>(2)</enum>
                <header>Public comment period</header>
 <text>Any rulemaking proceeding relating to the promulgation of regulations under paragraph (1) shall include a public comment period of not less than 90 days.</text>
              </paragraph>
              <paragraph id="H45D8922263A7405ABFC0CEA7379F4AFA">
                <enum>(3)</enum>
                <header>Reducing oversight costs; prioritization</header>
 <text display-inline="yes-display-inline">In promulgating regulations under paragraph (1), the Secretary may seek—</text>
                <subparagraph id="HF175706DAE814A2CBE0FF931295EAA83">
                  <enum>(A)</enum>
 <text>to reduce oversight costs and administrative burdens for certified organic farms, certified organic handling operations, and certifying agents that present a lower risk to organic integrity; or</text>
                </subparagraph>
                <subparagraph id="H6908783931A8478D834A47279EEEA3D3">
                  <enum>(B)</enum>
 <text>to prioritize oversight resources for activities that present a higher risk to organic integrity.</text>
                </subparagraph>
              </paragraph>
              <paragraph commented="no" display-inline="no-display-inline"

                <enum>(4)</enum>
                <header>Limited virtual inspections</header>
                <subparagraph commented="no" display-inline="no-display-inline"
                  id="id07b546b9001f430dbfc04f36091fb908">
                  <enum>(A)</enum>
                  <header>In general</header>
 <text display-inline="yes-display-inline">If the Secretary determines, based on the study, report, and consultation required under subsections (a) through (d) and paragraph (1), that it would be appropriate to allow certifying agents to conduct a limited number of annual inspections under section 2107(a)(5) virtually pursuant to the protocol described in subparagraph (B), the Secretary may, subject to all other requirements of this subsection, include in any regulations promulgated under paragraph (1) provisions allowing for the use of virtual inspections consistent with that protocol.</text>
                </subparagraph>
                <subparagraph id="id645bdee748924802b555220e3049a4d1">
                  <enum>(B)</enum>
                  <header>Inspection protocol</header>
 <text>The protocol referred to in subparagraph (A) is the following:</text> <clause commented="no" id="idba537beb78b94c47b56d83555ae96638"> <enum>(i)</enum> <text display-inline="yes-display-inline">In the case of a farm or handling operation located outside the United States, all inspections shall be conducted on-site.</text>
                  </clause>
                  <clause commented="no" id="id1448225ba8334a289768eee80e00f110">
                    <enum>(ii)</enum>
 <text>In the case of a farm or handling operation located in the United States, inspections shall be conducted on-site once every 3 years with intervening annual inspections being conducted on-site or virtually based on the risk to organic integrity at the farm or handling operation, as determined by the Secretary.</text>
                  </clause>
                  <clause commented="no" id="id251c5501daac493f9e940fc7d4066d96">
                    <enum>(iii)</enum>
 <text>In the case of a handling operation that acquires but does not physically receive, process, package, or store organic product, inspections shall be conducted through inspection methods, including virtual methods, that provide sufficient assurance of compliance with this title, as determined by the Secretary.</text>
                  </clause>
                </subparagraph>
              </paragraph>
 </subsection><subsection id="H16CA76BA43004FE1BB92B5BFF6D39E67"><enum>(f)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section limits the authority of the Secretary to enforce compliance with this title to protect organic integrity.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id798a499f15f34633bae06fd0d1e3bab3"><enum>(b)</enum><header>Conforming amendment</header><text>Section 2107(a) of the Organic Foods Production Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/6506">7 U.S.C. 6506(a)</external-xref>) is amended by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id87b9f3434147449fb4a6b5fcf90e6296"><paragraph commented="no" id="idaa5a19b2b5cf4cdb829b2180439ee684"><enum>(5)</enum><text display-inline="yes-display-inline">provide for annual inspections by the certifying agent of each farm and handling operation that has been certified under this title, which shall be conducted—</text><subparagraph commented="no" id="id68481b90dce54c23bd6cf0979ffeb66f"><enum>(A)</enum><text display-inline="yes-display-inline">on-site; or</text></subparagraph><subparagraph id="ide0fe11cf7f7f4206ac8735a42180e58b"><enum>(B)</enum><text>if the Secretary has promulgated regulations under section 2122B(e) allowing for the limited use of virtual inspections, pursuant to those regulations.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idc921765338d045b0a548e0e8937a8f51"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/624">Public Law 101–624</external-xref>; 104 Stat. 3370) is amended by striking the item relating to section 2123 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id355cfe43c82442ff9c590f2ef6298e6d"><toc><toc-entry bold="off" level="section">Sec. 2122A.
