<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4903</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260624">June 24, 2026</action-date><action-desc><sponsor name-id="S317">Mr. Barrasso</sponsor> (for himself, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S380">Mr. Peters</cosponsor>, and <cosponsor name-id="S383">Mr. Sullivan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To improve the point-in-time count conducted by the Department of Housing and Urban Development, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Improvements to point-in-time count</header><subsection commented="no" display-inline="no-display-inline" id="idf34d63a359004cdbb2c9d28bc3ef32f8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Section 427(b)(3) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11386a">42 U.S.C. 11386a(b)(3)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id834cb8ec65a8407aaadcfb6338e469bf"><enum>(1)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id019C358AA3CA48B49E7FF1D1432C0BDD"><subparagraph commented="no" display-inline="no-display-inline" id="id9be7e5605c0e4fc8b295b71de69b3f25"><enum>(A)</enum><header>Limitation on scope</header><text>The Secretary</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbccd07f48c1d43468361994c720b70cb"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="id34E73C94C218440B910C48570B5F2BD3" display-inline="no-display-inline" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="idef2e4907383f4847a29204723d4d9683"><enum>(B)</enum><header>Annual point-in-time count</header><clause commented="no" display-inline="no-display-inline" id="id0eebd3a513824c528ab850849858fcca"><enum>(i)</enum><header display-inline="yes-display-inline">Definition</header><text>In this subparagraph, the term <term>annual point-in-time count</term> means the annual point-in-time count of homeless individuals required under clause (ii).</text></clause><clause commented="no" display-inline="no-display-inline" id="id698b877d73374066b25a830f78359209"><enum>(ii)</enum><header display-inline="yes-display-inline">Requirement</header><subclause commented="no" display-inline="no-display-inline" id="id6277681de59642b2b1dc0d78466b58dd"> <enum>(I)</enum> <header display-inline="yes-display-inline">In general</header> <text>The Secretary shall require each recipient to participate in an annual point-in-time count of homeless individuals during the last 10 days of April of each year beginning after the date of enactment of this subparagraph.</text>
 </subclause><subclause commented="no" display-inline="no-display-inline" id="id73f9011327cc41c0aa6fc8ff0ca64ec3"><enum>(II)</enum><header>Supplemental counts</header><text display-inline="yes-display-inline">Authorization from the Secretary shall not be required in order for a recipient to conduct a supplemental point-in-time count of homeless individuals during a different time of year than the annual count described in subclause (I).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id145a7d8226924f5e8e23ccb395881383"><enum>(iii)</enum><header>Use of standardized tools</header><text>In conducting the annual point-in-time count, a recipient shall use a community-wide homeless management information system (commonly known as an <term>HMIS</term>) for client-level data collection.</text></clause><clause id="id8019a8927f6d4cf5a147bdf31a71174b"><enum>(iv)</enum><header>Technical assistance and support for rural and resource-limited continuums of care</header><text>The Secretary shall provide training in HMIS integration to rural or resource-limited recipients for purposes of conducting the annual point-in-time count.</text></clause><clause id="idef3fc9e558fd47a29d7e8cc7c279d9ec"><enum>(v)</enum><header>Reporting and compliance</header><subclause commented="no" display-inline="no-display-inline" id="id9892934081ce42af803c7de2b37d21c7"><enum>(I)</enum><header display-inline="yes-display-inline">Continuum of care standardized HMIS reporting requirements</header><text>The Secretary shall establish standardized HMIS reporting requirements for recipients conducting the annual point-in-time count with respect to the geographic scope and spatial analysis of unsheltered and sheltered populations.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc16dde16c1a24ed8957b271f7892362a"><enum>(II)</enum><header>HUD report</header><text display-inline="yes-display-inline">The Secretary shall submit an annual report to Congress on—</text><item id="id9e3d7ccf400e49828bf9ccc1dab1a609"><enum>(aa)</enum><text>compliance by recipients with the data collection, HMIS reporting, and annual point-in-time count requirements under this subparagraph;</text></item><item id="id6646a24241d34eadacded52810cd4769"><enum>(bb)</enum><text>technical assistance and guidance provided by the Secretary to recipients to support implementation of the requirements described in item (aa); and</text></item><item id="id185dff6c0408428db6015b080bc0c233"><enum>(cc)</enum><text>improvements in the consistency, accuracy, and quality of data collected through the annual point-in-time count.</text></item></subclause></clause><clause id="ida99ed300ae714481bf24a7df43751d83"><enum>(vi)</enum><header>Rolling HMIS updates and midpoint HMIS data</header><subclause commented="no" display-inline="no-display-inline" id="id0ee34468246f4452b7d2064fa15a00bb"><enum>(I)</enum><header>HMIS updates</header><text>A recipient shall maintain up-to-date HMIS data year-round regarding participation in homelessness assistance projects funded by the Secretary, including entries into and exits from emergency shelters, homeless street outreach programs, transitional housing, and other eligible activities under this subtitle.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc5e5975482254a28bff7cab5adee1c90"><enum>(II)</enum><header>Midpoint HMIS data</header><text display-inline="yes-display-inline">A recipient shall collect and maintain HMIS data on unsheltered and sheltered homeless populations as of the midway point between each annual point-in-time count (in this subparagraph referred to as <term>midpoint HMIS data</term>).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id747718652a584972a322c5584d10e78f"><enum>(III)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the midpoint HMIS data collected under subclause (II) are to—</text><item commented="no" display-inline="no-display-inline" id="idc2dd1992d8fc4c9d85e65663a767ec82"><enum>(aa)</enum><text display-inline="yes-display-inline">track seasonal or emerging trends;</text></item><item commented="no" display-inline="no-display-inline" id="idb6a4c28354044bb5aa2ea50228dc4f60"><enum>(bb)</enum><text display-inline="yes-display-inline">inform planning for programs carried out under this subtitle; and</text></item><item commented="no" display-inline="no-display-inline" id="id079db662e7654618bd0acb710ba5a1e3"><enum>(cc)</enum><text display-inline="yes-display-inline">supplement, but not replace, the annual point-in-time count.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id94e5660d726145de95b974e10214cef2"><enum>(vii)</enum><header>Guidance for rural and resource-limited continuums of care</header><text display-inline="yes-display-inline">The Secretary shall provide guidance for rural or resource-limited recipients regarding—</text><subclause commented="no" display-inline="no-display-inline" id="ide1c91f18eb3a4230b3971736c5e73426"><enum>(I)</enum><text display-inline="yes-display-inline">standardized data collection methodologies for the annual point-in-time count;</text></subclause><subclause id="id2fb6117cdff248ad867b9bfb65ac4489"><enum>(II)</enum><text>implementation and integration of HMIS tools for mapping sheltered and unsheltered populations;</text></subclause><subclause id="id9aba5a260095407f9f3a1c32a0ae83a7"><enum>(III)</enum><text>midpoint HMIS data collection and spatial mapping requirements under this subparagraph; and</text></subclause><subclause id="idc386eeadc4de4b9190e39d859d9bc617"><enum>(IV)</enum><text>staffing, training, and technology best practices necessary to comply with the requirements of this subparagraph.</text></subclause></clause><clause id="id6a7a355fff8241a48ca7b5c57102d539"><enum>(viii)</enum><header>Funding flexibility</header><text>The Secretary may—</text><subclause commented="no" display-inline="no-display-inline" id="id5f24ea63e26542e595feb4eb4354043e"><enum>(I)</enum><text display-inline="yes-display-inline">allow a recipient to use assistance received under subtitle B to support the training of employees or volunteers in HMIS integration; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id99bac1229c5d4a9db486d37af7f5599f"><enum>(II)</enum><text display-inline="yes-display-inline">provide guidance on ensuring that the use of assistance under subclause (I) does not disrupt service delivery to homeless shelters.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id15c1d182d5f542b886b2f831d5069691"><enum>(b)</enum><header display-inline="yes-display-inline">GAO study</header><paragraph commented="no" display-inline="no-display-inline" id="idc5e48e2de9c14ad1b8ed752213ffe2ed"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text>In this subsection, the term <term>Continuum of Care</term> means a recipient, as that term is defined in section 401 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2c77ad1ffda4c7182d9d427af9ff7a5"><enum>(2)</enum><header display-inline="yes-display-inline">Study</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd013bd77192d45d2b932be4faa05a271"><enum>(A)</enum><text>conduct a study of the annual point-in-time count conducted by the Department of Housing and Urban Development (in this subsection referred to as the <term>Department</term>), including the methodology used by the Department; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0949306c77244c2cbf9e8a6d1a829598"><enum>(B)</enum><text>submit to Congress a report that contains—</text><clause commented="no" display-inline="no-display-inline" id="id223889a69cc34a29ab913ef5460dda31"><enum>(i)</enum><text>the results of the study conducted under subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id40a9cb196e534cf98992b5b5e8b039cd"><enum>(ii)</enum><text>as appropriate, recommendations on how to modernize the annual point-in-time count in a way that leads to greater accuracy in counting the homeless, including how the Department can—</text><subclause commented="no" display-inline="no-display-inline" id="id97d80b4b200d4ac285851179d10c4edf"><enum>(I)</enum><text>standardize collection methodology across Continuums of Care; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id04b2a2e2e3304d989a0088b9dcb3b175"><enum>(II)</enum><text>increase consistency, modernization, and efficiency of data collection and reporting processes with respect to the annual point-in-time count within each Continuum of Care.</text></subclause></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
