which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Agriculture to establish a program to provide hazardous fuels transportation grants, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id682c6ea8ed194db689efacfd639449a9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hazardous Fuels Transportation Assistance Act of 2026</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id1f0111f7337f4ce38e6ee5a7c3e521e3"><enum>2.</enum><header>Hazardous Fuels Transportation Assistance Program</header><subsection id="id1bd33a0be7f3470c93f329823ed49c27"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd5943344d600427d8dc955c320aaa41b"><enum>(1)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> means—</text><subparagraph id="id33911a0fb0d24a6fa8456f25ea725d2e"><enum>(A)</enum><text>a for-profit entity;</text></subparagraph><subparagraph id="id43eb70b8195345a1b82549130ad221d1"><enum>(B)</enum><text>a nonprofit organization;</text></subparagraph><subparagraph id="ide866a21cd24c44b3b21f4b0059f7adf4"><enum>(C)</enum><text>a State;</text></subparagraph><subparagraph id="id8eb5b8edb8cb4ba7b004c2ce7ff218fa"><enum>(D)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="id4f1d4048999a4f4a9cdaee13f3c3d2e8"><enum>(E)</enum><text>an Indian Tribe; and</text></subparagraph><subparagraph id="id85a23ca37b09478d85468aabc7adb176"><enum>(F)</enum><text>an institution of higher education.</text></subparagraph></paragraph><paragraph id="idadf66b2831e14c3abee6a65c52eaed48"><enum>(2)</enum><header>Fireshed</header><text>The term <term>fireshed</term> means a landscape-scale area, as delineated using methods developed through research conducted by the Forest Service, that represents similar source levels of community exposure to wildfire.</text></paragraph><paragraph id="idd21ed26985994bf496a63dfe84ddb9a5"><enum>(3)</enum><header>Hazardous fuels management activity</header><text>The term <term>hazardous fuels management activity</term> means a vegetation management activity conducted on National Forest System land that reduces the risk of wildfire, including mechanical thinning, mastication, timber harvest, grazing, the removal of downed or damaged timber resulting from a tornado, hurricane, ice storm, windthrow event, or other natural disaster that the Secretary determines increases the risk of wildfire, and any combination of those activities.</text></paragraph><paragraph id="id3286fbb2021540578a57724bfd83a5b9"><enum>(4)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="idec738020672646f1bb15feee34a9963b"><enum>(5)</enum><header>National Forest System</header><text>The term <term>National Forest System</term> has the meaning given the term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="idedeacc0e4b9341f7a35dff1559cd3f02"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph><paragraph id="id21cbb3b68fc14ae5a4e242db394798ac"><enum>(7)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="id7a131704a2cf42dfac751088876d3506"><enum>(A)</enum><text>each of the several States;</text></subparagraph><subparagraph id="id45fd6313d1744bd19ce0eb5681c7c951"><enum>(B)</enum><text>the District of Columbia; and</text></subparagraph><subparagraph id="id5aeb2f48c3d241efad6c44702182a0fa"><enum>(C)</enum><text>the Commonwealth of Puerto Rico.</text></subparagraph></paragraph></subsection><subsection id="id243371f6629f469bb5899f3546aff9e8"><enum>(b)</enum><header>Hazardous fuels transportation grants</header><paragraph commented="no" display-inline="no-display-inline" id="idedf90c0ea6ff4a88aaea13a37d45c6f4"><enum>(1)</enum><header>Establishment and purpose</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a program to provide grants on a competitive basis to eligible recipients for the purpose of incentivizing the removal of material from a hazardous fuels management activity conducted under a contract or agreement entered into with the Secretary, acting through the Chief of the Forest Service, as of the date of the application submitted under paragraph (2).</text></paragraph><paragraph id="id6e5cd3690f3a4e4e9dead2211e0e0f58"><enum>(2)</enum><header>Application</header><text>To be eligible to receive a grant under paragraph (1), an eligible recipient shall submit to the Secretary an application that includes, at a minimum, a description of—</text><subparagraph id="id22fd8cb6e5e44bcf9b509fd5d723a4b6"><enum>(A)</enum><text>the project to be carried out using the grant, including the estimated cost of the project and how the grant would be used for the project; and</text></subparagraph><subparagraph id="idd285408663e5443091758bf10c956e7a"><enum>(B)</enum><text>how the project would meet the purpose described in paragraph (1), including one or more reasons the material from the hazardous fuels management activity would not be utilized without the grant.</text></subparagraph></paragraph></subsection><subsection id="id7183193a6f454b61882f14852c26913e"><enum>(c)</enum><header>Eligible uses</header><text>An eligible recipient that receives a grant under subsection (b) shall use the grant for one or more of the following:</text><paragraph id="id58e12169c2e24949b29bed3d19bdd75e"><enum>(1)</enum><text>Transportation of byproducts from the hazardous fuels management activity, including roundwood, chips, biomass, and other byproducts, as determined by the Secretary.</text></paragraph><paragraph id="id51261ec281e94c87badd1de5e7a70331"><enum>(2)</enum><text>Costs associated with woodyards, loading facilities, scales, and custom chipping.</text></paragraph><paragraph id="idb54d191b35444dfdaf42bf50a9682750"><enum>(3)</enum><text>Purchasing, modifying, or leasing equipment that shall be used primarily to facilitate the efficient transport of material from a hazardous fuels management activity, which may include equipment to process such material into a form more conducive to such transport.</text></paragraph><paragraph id="idc1b10b87a7f14eaaa5a9e608f839c5ac"><enum>(4)</enum><text>Maintenance of equipment directly related to the transportation of hazardous fuels from a hazardous fuels management activity.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd22ef00efc7f4acb97f79d138dbf8c95"><enum>(5)</enum><text>Workforce development for training and certifications necessary for projects carried out under this section, including in partnership with Indian Tribes.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2390558a594a410cbd9e782c8e99eb08"><enum>(6)</enum><text>Any other expenses determined necessary and appropriate by the Secretary for the transport of hazardous fuels.</text></paragraph></subsection><subsection id="id6659fff292534a85b5e23245814845b6"><enum>(d)</enum><header>Ineligible uses</header><text>An eligible recipient that receives a grant under subsection (b) shall not use the grant for—</text><paragraph id="idaa7d863aa89044babd6b6235480137f1"><enum>(1)</enum><text>construction or capital improvements, including processing facilities;</text></paragraph><paragraph id="idbea4766ac309455593d53088f91b2c4f"><enum>(2)</enum><text>stumpage or timber purchases; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idce78baa3f56a4adab3d0efde9e8c72b0"><enum>(3)</enum><text>any other expenses the Secretary determines ineligible.</text></paragraph></subsection><subsection id="id9bfdad94d19a4f03bbfdea0893f81330"><enum>(e)</enum><header>Prioritization</header><text>In awarding grants under subsection (b), the Secretary shall give priority to proposals that would—</text><paragraph id="id1ecc589a2fe244cb98162f71f02f44c8"><enum>(1)</enum><text>treat hazardous fuels in high-risk firesheds, as determined by the Secretary;</text></paragraph><paragraph id="id6ef9b22adae54695ac565356108bbfa1"><enum>(2)</enum><text>maximize the number of acres treated for hazardous fuels;</text></paragraph><paragraph id="idbe8dbbabf5644084ad68e5bebf9d1bab"><enum>(3)</enum><text>maximize the volume of hazardous fuels to be transported;</text></paragraph><paragraph id="id395b8362c57c4da8a004aaf02594d47a"><enum>(4)</enum><text>maximize the retention of existing forest products infrastructure;</text></paragraph><paragraph id="id544d6b44e34d4ce4b6d768a57431c541"><enum>(5)</enum><text>develop new or expand existing wood processing facilities;</text></paragraph><paragraph id="idbcf8a67927ad4f7bbf2906d17307600d"><enum>(6)</enum><text>maximize the potential to increase the utilization of forest products long-term;</text></paragraph><paragraph id="iddb123d423a4046bb9ddffff5ffeb55a9"><enum>(7)</enum><text>utilize material from a hazardous fuels management activity as part of a project under—</text><subparagraph id="idefa291a62f4142a5aea6f0fa5b21b4a5"><enum>(A)</enum><text>the Collaborative Forest Landscape Restoration Program established under section 4003 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/16/7303">16 U.S.C. 7303</external-xref>); or</text></subparagraph><subparagraph id="id7c699211491d47d8b525a1c219785516"><enum>(B)</enum><text>the Joint Chiefs Landscape Restoration Partnership program established under section 40808 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6592d">16 U.S.C. 6592d</external-xref>); and</text></subparagraph></paragraph><paragraph id="id7492dc5f7c83443284a0950e08187ae4"><enum>(8)</enum><text>remove material from a hazardous fuels management activity using one or more of—</text><subparagraph id="id8d97767188904c8cb56e4c3b1be55ec8"><enum>(A)</enum><text>a good neighbor agreement under section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>);</text></subparagraph><subparagraph id="idbd1f1507ec014f8f9b0f4d1a42fd8cbc"><enum>(B)</enum><text>a stewardship contracting project entered into under section 604 of the Healthy Forests Restoration Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/16/6591c">16 U.S.C. 6591c</external-xref>);</text></subparagraph><subparagraph id="id84641c6133ec4b9bbc661e4111a94139"><enum>(C)</enum><text>a self-determination contract or self-governance compact agreement entered into under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>); and</text></subparagraph><subparagraph id="ide477dec5fe274dc69c6c45c38e3d5489"><enum>(D)</enum><text>an agreement or contract entered into under the Tribal Forest Protection Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/278">Public Law 108–278</external-xref>; 118 Stat. 868).</text></subparagraph></paragraph></subsection><subsection id="idbd905e8e2d8d41448e4abd7a11708549"><enum>(f)</enum><header>Funding</header><paragraph id="id32be771e87644a2390385235a12feba2"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $25,000,000 for each of fiscal years 2027 through 2031.</text></paragraph><paragraph id="idd55ba246e17140bcbe10a001636244c9"><enum>(2)</enum><header>Limitations</header><subparagraph commented="no" display-inline="no-display-inline" id="idd1731cff86394706882dfbe95cdb97aa"><enum>(A)</enum><header>Grant amount</header><text display-inline="yes-display-inline">The Secretary shall not expend more than $3,000,000 for any one grant under this section in any one fiscal year.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72fe937ba19a489fa862c3c9578680ff"><enum>(B)</enum><header>Purchasing equipment</header><text display-inline="yes-display-inline">An eligible recipient shall not use more than $250,000 of the amount of a grant under this section in any one fiscal year for purchasing equipment under subsection (c)(3).</text></subparagraph></paragraph><paragraph id="id64ece32f34444e7fa2a475254dfa22bd"><enum>(3)</enum><header>Cost-share</header><subparagraph commented="no" display-inline="no-display-inline" id="id0620700084604e31b3440d4aaca0a544"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), an eligible recipient may receive a grant under this section in an amount equal to not more than 75 percent of the cost of carrying out the project under this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd103fe7342f45faaac31bd6f455b6b7"><enum>(B)</enum><header>Indian Tribes</header><text>An Indian Tribe may receive a grant under this section in an amount equal to not more than 90 percent of the cost of carrying out the project under this section.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
