which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to protect against high out-of-pocket expenditures for Medicare fee-for-service benefits, and to amend titles XVIII and XIX of the Social Security Act to enhance programs that protect low-income Medicare beneficiaries.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Cost Cap Act of 2026</short-title></quote>.</text></section><section id="id1230690CB04749348E3C1CE3F926D1A4"><enum>2.</enum><header>Protection against high out-of-pocket expenditures for Medicare fee-for-service benefits</header><subsection commented="no" display-inline="no-display-inline" id="id7eb3f5c17cf1432eab75090a667e3485"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="id1D8C00D9FC7540969687BAEE02887181" display-inline="no-display-inline" style="OLC"><section id="id8F0D1CF66A53458FB581957746ED509A"><enum>1899D.</enum><header>Protection against high out-of-pocket expenditures</header><subsection id="idB3601FDA7E6F4C70A3BB750B4F99E7A4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, in the case of an applicable individual (as defined in subsection (c)), if the amount of the out-of-pocket cost-sharing (as defined in subsection (d)) incurred by such individual for a year (beginning with 2028) equals or exceeds the annual out-of-pocket limit under subsection (b) for that year, the individual shall not be responsible for additional out-of-pocket cost-sharing incurred during that year.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id640A234D435D48ABB87731A65012BB38"><enum>(b)</enum><header>Annual out-of-Pocket limit</header><paragraph commented="no" id="idACFCB044011649F7981C7C88783EC3ED"><enum>(1)</enum><header>In general</header><text>The amount of the annual out-of-pocket limit under this subsection shall be—</text><subparagraph commented="no" id="idDE53C29A28BD4EA9A671686DD86F42A6"><enum>(A)</enum><text>for 2028, $5,000; or</text></subparagraph><subparagraph commented="no" id="id214CC2B09CD94A4888453F7561ABF180"><enum>(B)</enum><text>for a subsequent year, the amount specified in this subsection for the preceding year increased by the annual percentage increase in average per capita aggregate expenditures under parts A and B, as determined by the Secretary for the 12-month period ending in July of the previous year using such methods as the Secretary shall specify.</text></subparagraph></paragraph><paragraph commented="no" id="id1C89442DF0AA40D19E85AD2841D695F5"><enum>(2)</enum><header>Rounding</header><text display-inline="yes-display-inline">If any amount determined under paragraph (1)(B) is not a multiple of $5, such amount shall be rounded to the nearest multiple of $5.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7466226c49dc45ccac034fa43ccc7105"><enum>(c)</enum><header>Applicable individual defined</header><text>In this section, the term <term>applicable individual</term> means an individual who is entitled to, or enrolled for, benefits under part A or enrolled in part B.</text></subsection><subsection id="id40D68E8B0FE648CDA9704720336DCD86"><enum>(d)</enum><header>Out-of-Pocket cost-Sharing defined</header><paragraph id="id68530BBB30CB478F8C7C13BCDF8ECCB8"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), in this section, the term <term>out-of-pocket cost-sharing</term> means, with respect to an applicable individual, the amount of the expenses incurred by the individual that are attributable to coinsurance, deductible, copayment, or other cost-sharing otherwise applicable under part A or B.</text></paragraph><paragraph id="id1B68663E80854043B8D72D1D237C855C"><enum>(2)</enum><header>Certain costs not included</header><subparagraph id="idFDCDB5375AC44EE880AC7456FDDFD536"><enum>(A)</enum><header>Non-covered items and services</header><text>Expenses incurred for items and services which are not covered under part A or B shall not be considered incurred expenses for purposes of determining out-of-pocket cost-sharing under paragraph (1).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0FB4D76467C248B4844CB1A49F2DD09A"><enum>(B)</enum><header display-inline="yes-display-inline">Items and services not furnished on an assignment-related basis</header><text display-inline="yes-display-inline">If an item or service is furnished to an individual under this title and is not furnished on an assignment-related basis, any additional expenses the individual incurs above the amount the individual would have incurred if the item or service was furnished on an assignment-related basis shall not be considered incurred expenses for purposes of determining out-of-pocket cost-sharing under paragraph (1).</text></subparagraph></paragraph><paragraph id="id919E32CD3E53494D932DD70044E185DF" commented="no"><enum>(3)</enum><header>Application</header><text>For purposes of paragraph (1), the Secretary shall consider expenses to be incurred by the individual regardless of whether such costs are reimbursed through insurance or otherwise, a group health plan, or other third-party payment arrangement.</text></paragraph></subsection><subsection id="id7A0B17DC564E4C16AF070606DF1D152B" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Announcement</header><text>Not later than the first Monday in April of each year (beginning with 2027), the Secretary shall determine, and shall announce (in a manner intended to provide notice to interested parties), the annual out-of-pocket limit under this section for the succeeding year.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idfd52a48279c54e19bf71e8de2268cfdc"><enum>(f)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Secretary shall establish procedures to carry out this section, including procedures—</text><paragraph commented="no" display-inline="no-display-inline" id="ide5bd4f5e8c3747aa92db6bcf8c2195ad"><enum>(1)</enum><text display-inline="yes-display-inline">to track the amount of out-of-pocket cost-sharing incurred by applicable individuals for items and services covered under this title during a year; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idff53d493224944deb7ffda1651d54e9b"><enum>(2)</enum><text display-inline="yes-display-inline">provide notice to the applicable individual and providers of services and suppliers who furnish items and services to the applicable individual when the applicable individual has incurred expenses that exceed the annual out-of-pocket limit under subsection (b) for the year.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id70dbf28dded9419494c46adf6483dc6a"><enum>(g)</enum><header>Payment</header><text display-inline="yes-display-inline">For provisions relating to payment for items and services furnished to an applicable individual once the annual out-of-pocket limit has been met, see sections 1813(c) and 1833(ee).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="IDAD12775BADEE4272A218BA2A98387F7B"><enum>(b)</enum><header>Conforming amendments</header><paragraph commented="no" display-inline="no-display-inline" id="idc5791409719c4c27af51a2c97579f2ae"><enum>(1)</enum><header display-inline="yes-display-inline">Part A</header><text>Section 1813 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395e">42 U.S.C. 1395e</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7155f12507bd4df4ba2037158c6816b7"><subsection commented="no" display-inline="no-display-inline" id="id0d5e9ca6d1964d8fbb1e1a3efd264fb6"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id3af339df22d242fea3cd6d8e492e2c33"><enum>(1)</enum><text>Notwithstanding subsections (a) and (b), if the amount of the out-of-pocket cost-sharing for an applicable individual for a year (beginning with 2028) equals or exceeds the annual out-of-pocket limit under section 1899D(b) for that year, payment under this part with respect to any additional incurred expenses for items or services furnished to the applicable individual in the calendar year shall be made as if any reduction in the amount payable for such items or services under subsection (a) due to any deductible or coinsurance that would (but for the application of section 1899D) otherwise be applicable no longer applied.</text></paragraph><paragraph indent="up1" commented="no" display-inline="no-display-inline" id="idde0be15f8990432781e7b85548316e9c"><enum>(2)</enum><text>In this subsection, the terms <term>applicable individual</term> and <term>out-of-pocket cost sharing</term> have the meaning given those terms in section 1899D.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf903d584c5d74fcc8cc6cabc49ea9e6d"><enum>(2)</enum><header display-inline="yes-display-inline">Part B</header><subparagraph id="ID845995632D3145D996D01EC678781049"><enum>(A)</enum><header>Payment</header><text>Section 1833 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l</external-xref>) is amended—</text><clause id="IDCBCF3DF0769A4EA19926607764CC4AE5"><enum>(i)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="IDCC58E13E111D4D249C1116FE8BD14C43" display-inline="no-display-inline" style="OLC"><subsection id="ID8BBD4A0C8F7B43398BB83DD829988B59"><enum>(ee)</enum><paragraph commented="no" display-inline="yes-display-inline" id="IDB1D73D95A3664FABBF4ADFF3BB61D0C1"><enum>(1)</enum><text>Notwithstanding subsections (a) and (b), if the amount of the out-of-pocket cost-sharing for an applicable individual for a year (beginning with 2028) equals or exceeds the annual out-of-pocket limit under section 1899D(b) for that year, payment under this part with respect to any additional incurred expenses for items or services furnished to the applicable individual in the calendar year shall be made as if—</text><subparagraph indent="up1" id="ID07DF502F30C74D179C50E6E1F84A2C91"><enum>(A)</enum><text>the deductible under subsection (b) no longer applied;</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id9e031f67a06f4136a0ff7d7c413313c2"><enum>(B)</enum><text display-inline="yes-display-inline">the deduction described in the second sentence of subsection (b) (relating to blood) no longer applied; and</text></subparagraph><subparagraph indent="up1" id="ID83076C0D2CF94E33A54EB38F4E3DB0DE"><enum>(C)</enum><text><quote>100 percent</quote> and <quote>0 percent</quote> were substituted for <quote>80 percent</quote> and <quote>20 percent</quote>, respectively, each place either appears in subsection (a), in subsection (i)(2), in section 1835(b)(2), and in subsections (b)(2) and (b)(3) of section 1881.</text></subparagraph></paragraph><paragraph indent="up1" id="ID69E6C1DA0F63421EA4FA8BCC9B42FB63"><enum>(2)</enum><text>In this subsection, the terms <term>applicable individual</term> and <term>out-of-pocket cost sharing</term> have the meaning given those terms in section 1899D.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="IDCBEF33EE602740BF8C23E8165EC61C03"><enum>(ii)</enum><text>in subsections (c) and (g), by striking <quote>(a) and (b)</quote> each place it appears and inserting <quote>(a), (b), and (ee)</quote>.</text></clause></subparagraph><subparagraph id="ID28B9F066D8504F918196E5F03E371950"><enum>(B)</enum><header>Limitation on charges when annual limit reached</header><text>Section 1866(a)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(a)(2)(A)</external-xref>) is amended by adding at the end the following new sentence: <quote>A provider of services may not impose a charge under the first sentence of this subparagraph for services for which payment is made to the provider pursuant to section 1833(ee) (relating to protection against high out-of-pocket expenses).</quote>.</text></subparagraph><subparagraph id="IDB9917D7029B04A7D91D9597E8927AB09" commented="no"><enum>(C)</enum><header>Beneficiary protections</header><text>Section 1842(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(3)</external-xref>) is amended—</text><clause id="ID0D3794B5206F4D519E521457DAAC1E26"> <enum>(i)</enum> <text>in subparagraph (L), by striking the period at the end and inserting <quote>; and</quote>; and</text>
 </clause><clause id="ID3C0256DF7E4245209A50979E1B2B10D7"><enum>(ii)</enum><text>by inserting after subparagraph (L) the following new subparagraph:</text><quoted-block id="ID20820320FE9B4BDFA65C0EEF52D181CB" display-inline="no-display-inline" style="OLC"><subparagraph indent="up1" id="ID09CBAFD30C6A4BD6AD006D658683B0D7"><enum>(M)</enum><text>if it makes determinations or payments with respect to items and services furnished by a physician for which payment is made pursuant to section 1833(ee) but not on an assignment-related basis, provide to the physician a notice that—</text><clause id="ID99A6CBD479B24267A0A8EEC98FC09C91"><enum>(i)</enum><text>states that the individual provided the service has reached the annual out-of-pocket limit under section 1899D(b) for the year, and</text></clause><clause id="ID1707A7877FB44BB2AF090C1D0414EE09" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>encourages the physician not to charge the individual amounts in excess of the reasonable charge recognized under this section and to accept payment on an assignment-related basis for physicians' services furnished the individual during the remainder of the year.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id5993b3e6fa914f30a260cfebbf662bc3"><enum>3.</enum><header>Enhancements to programs that protect low-income Medicare beneficiaries</header><subsection id="id8d6884eada5f473bb2cab45958a0e0e0"><enum>(a)</enum><header>Elimination of resource standard for eligibility and enrollment determinations</header><paragraph commented="no" display-inline="no-display-inline" id="id261be18a14374bafac3ba5a6f4394c11"><enum>(1)</enum><header>LIS</header><text display-inline="yes-display-inline">Section 1860D–14(a)(3)(A)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)(3)(A)(iii)</external-xref>) is amended by striking <quote>meets</quote> and inserting <quote>with respect to a plan year beginning before January 1, 2028, meets</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddf97d9d505b94e6cb31735b49b061ad0"><enum>(2)</enum><header>MSP</header><text>Section 1905(p)(1)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(p)(1)(C)</external-xref>) is amended by striking <quote>whose resources</quote> and inserting <quote>prior to January 1, 2028, whose resources</quote>.</text></paragraph></subsection><subsection id="idfc1a2650ce3b43f4b9ae440eb46809b1"><enum>(b)</enum><header>Aligning eligibility criteria across MSP and LIS</header><paragraph commented="no" display-inline="no-display-inline" id="ida33bf110ebf9474d9640be978e878645"><enum>(1)</enum><header display-inline="yes-display-inline">LIS</header><text>Section 1860D–14(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9491b55cca7b43ad9b9cf30c1a94e248"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>or, with respect to a plan year beginning on or after January 1, 2028, 200 percent</quote> after <quote>150 percent</quote>; and</text></subparagraph><subparagraph id="ida9132cfe05bb4fe59a5f155e0591f0df"><enum>(B)</enum><text>in paragraph (3)(A)(ii), by inserting <quote>(or, with respect to a plan year beginning on or after January 1, 2028, 200 percent</quote> after <quote>150 percent</quote>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc12a554683ea437291f0b56129fb7519"><enum>(2)</enum><header display-inline="yes-display-inline">MSP</header><subparagraph commented="no" display-inline="no-display-inline" id="id1cd4b52dcb494d2a841f2e861164121e"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Section 1905(p) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(p)</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="id874b03ef0dcf4793ba4a844ad12c2ebd"><enum>(i)</enum><text>in paragraph (1)(B), by inserting <quote>, except that, beginning with January 1, 2028, the methodology used in determining income eligibility under this subsection shall be no more restrictive than the methodology used by the Social Security Administration in making income determinations under section 1860D–14(a)(3)(C)</quote> after <quote>income program</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id09b11f03ce0f4e9db9bbc2b1efd9e367"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subclause commented="no" display-inline="no-display-inline" id="id5f7ea88a9c9a4533b9645aa561d1324d"><enum>(I)</enum><text>in subparagraph (A)—</text><item commented="no" display-inline="no-display-inline" id="id5668979691044a3381aa7d1f0375ed68"><enum>(aa)</enum><text display-inline="yes-display-inline">by striking <quote>shall be at least</quote> and inserting “shall be—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb4a0a0775da044b9b97a0912042b581e"><clause commented="no" display-inline="no-display-inline" id="ided4b393574ec4e42a71ced28b5d08611" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">prior to January 1, 2028, at least</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></item><item commented="no" display-inline="no-display-inline" id="id67bad6afdcfb41f48b0b3ca1d57a6c78"><enum>(bb)</enum><text>in clause (i), as added by item (aa), by striking the period and inserting <quote>; and</quote>; and</text></item><item commented="no" display-inline="no-display-inline" id="id2503143a95fb4fc5ac1f46c3c47d74b9"><enum>(cc)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id60fc849e4e084187aa87f7ebf5dcde24"><clause commented="no" display-inline="no-display-inline" id="idab4437874d8b4c5ca0f818d27b6fcdfe" indent="up2"><enum>(ii)</enum><text>on or after January 1, 2028, 200 percent of the poverty line applicable to a family of the size involved.</text></clause> <after-quoted-block>; and</after-quoted-block></quoted-block></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id883c5f55583a40e2ad90a49a47d82b9d"><enum>(II)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1196a9c6a57a4e0f99c0b9b1740399c5"><subparagraph commented="no" display-inline="no-display-inline" id="id0e6831eabde34a87844edc8e64134482" indent="up2"><enum>(E)</enum><text>With respect to eligibility for medical assistance on or after January 1, 2028, in this paragraph, the definition of the term <term>family of the size involved</term> shall be no more restrictive than the definition of that term for purposes of section 1860D–14.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id203d3b68245c476fb502a42ba9a8a602"> <enum>(B)</enum> <header>Conforming amendments</header> <text>Title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) is amended—</text>

 <text display-inline="yes-display-inline">in section 1902(a)(10)(E)—</text> <subclause commented="no" display-inline="no-display-inline" id="id6d5f749faf81459b92a1fc30ab5a51cb"> <enum>(I)</enum> <text display-inline="yes-display-inline">in clause (iii), by striking <quote>for making</quote> and inserting <quote>prior to January 1, 2028, for making</quote>; and</text>
              </subclause>
              <subclause commented="no" display-inline="no-display-inline"

                <enum>(II)</enum>
 <text>in clause (iv), by striking <quote>subject to</quote> and inserting <quote>prior to January 1, 2028, subject to</quote>; and</text>

 </subparagraph></paragraph><paragraph id="idcf4897e1c1144845b05642594d8d11b5"><enum>(3)</enum><header>Bidirectional eligibility deeming between MSP and LIS</header><subparagraph commented="no" display-inline="no-display-inline" id="idc42aa9452b7d4805972a3e6fb23f08af"><enum>(A)</enum><header display-inline="yes-display-inline">LIS</header><text>Section 1860D–14(a)(3)(B)(v) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)(3)(B)(v)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idedab69e45b7f4c1eb62e21e882851735"><clause id="ID15AB49285D0942AD99ABF328B8631636" commented="no" display-inline="no-display-inline"><enum>(v)</enum><header display-inline="yes-display-inline">Treatment of medicaid beneficiaries</header><text display-inline="yes-display-inline">Subject to subparagraph (F), the Secretary shall treat a part D eligible individual as a subsidy eligible individual described in paragraph (1) if they are—</text><subclause id="ID8229C79F90904FC298F2C03B89B42650" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text>a full-benefit dual eligible individual (as defined in section 1935(c)(6));</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida17dddcfd34743d79b0fb3e34550d135"><enum>(II)</enum><text display-inline="yes-display-inline">a recipient of supplemental security income benefits under title XVI; or</text></subclause><subclause id="ID91B3C581333B4CE185B283AD7A18A347" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>determined for purposes of the State plan under title XIX to be eligible for medical assistance under section 1902(a)(10)(E)(i).</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2ded9d00aaa444d7a82ab8c63153a447"><enum>(B)</enum><header>MSP</header><text display-inline="yes-display-inline">Section 1905(p) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(p)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id324bdea57a5c4aa9bb84bc040e6b509b"><paragraph commented="no" display-inline="no-display-inline" id="id28501cc1013b4908aaa0612d95f3dcac" indent="up1"><enum>(7)</enum><text>Beginning January 1, 2028, a State shall provide that an individual described in paragraph (1)(A) who is a subsidy eligible individual described in section 1860D–14(a)(3) shall be treated as a qualified medicare beneficiary described in paragraph (1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ac9187a2a9d40e881e4132ce1b3ea1c"><enum>(C)</enum><header>Treatment of leads data</header><clause commented="no" display-inline="no-display-inline" id="id8a236b170b2c4a6590cd8c08edd45160"><enum>(i)</enum><header display-inline="yes-display-inline">Transmittal</header><text>Section 1144(c)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-14">42 U.S.C. 1320b–14(c)(3)</external-xref>) is amended by striking <quote>which transmittal shall initiate an application of the individual for benefits under the Medicare Savings Program with the State Medicaid agency</quote> and inserting <quote>which the State Medicaid agency shall treat as an application of the individual for benefits under the Medicare Savings Program consistent with section 1935(a)(4)</quote>.</text></clause><clause commented="no" display-inline="no-display-inline" id="id348abe98d58d4da480070ccd1c0fa033"><enum>(ii)</enum><header>Consideration by States</header><text>Section 1935(a)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-5">42 U.S.C. 1396u–5(a)(4)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideecdbee3ef174c7591298b79f21f834b"><paragraph id="IDE77C97E2A2414288AE487C0BDF8D1F05" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Consideration of data transmitted by the Social Security administration for purposes of medicare savings program</header><subparagraph commented="no" display-inline="no-display-inline" id="ide4f94162643d441cabf77feff50a68d9"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The State shall accept data transmitted under section 1144(c)(3) and—</text><clause commented="no" display-inline="no-display-inline" id="idaa84913f7d3a4dc0bd9523ffe05cd841"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of an individual who is a subsidy eligible individual described in section 1860D–14(a)(3), promptly treat such individual as a qualified medicare beneficiary described in 1905(p)(1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf4605eeed4624e59a85c1038a975d21a"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of any other individual who is likely to be a qualified medicare beneficiary, as determined by the Secretary, act on such data in the same manner and in accordance with the same deadlines as if the data constituted an initiation of an application for benefits under the Medicare Savings Program (as defined for purposes of section 1144(c)(3)) that had been submitted directly by the applicant.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd95e074cf37a4b5c8d1ea6ce38f55f7f"><enum>(B)</enum><header>Date of application</header><text display-inline="yes-display-inline">For purposes of subparagraph (A)(ii), the date of the individual's application for the low income subsidy program from which the data have been derived shall constitute the date of filing of such application for benefits under the Medicare Savings Program.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf3b015be03d74fd5b0abc1b35387cb9d"><enum>(D)</enum><header>Effective date</header><text>The amendments made by this paragraph shall take effect on January 1, 2028.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
