<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4877</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260624">June 24, 2026</action-date><action-desc><sponsor name-id="S324">Mrs. Shaheen</sponsor> (for herself and <cosponsor name-id="S389">Mr. Kennedy</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code, to allow suit against the United States for military sexual trauma.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H400F1795FEE54489AFA18F98EC0CA671"><section id="idfe2a2209e9c847fd8063be44c3aa34c6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Sexual Trauma Accountability Act</short-title></quote>.</text></section><section id="H7D7102A781F747D9A350DCE1EC6E2710"><enum>2.</enum><header>Allowing claims against the United States for failing to prevent or investigate sexual misconduct</header><subsection commented="no" display-inline="no-display-inline" id="id6ecc17718a7543f9bb690f4c3fb86752"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">Chapter 171</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block id="id937802b4f3e942fe8831b04d406c213e" display-inline="no-display-inline" style="USC"><section id="id932876b3e3154250b396e7194d7f09a7"><enum>2681.</enum><header>Claims against the United States for military sexual trauma</header><subsection id="id274ac2b28d434e5287355a9c957eaff0"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id5056e88b0fc24145907cf9f0161bd4da" commented="no"><enum>(1)</enum><header>Covered individual</header><text>The term <term>covered individual</term> means—</text><subparagraph id="id3122fb92d1aa4cb5951820f6846e362e"> <enum>(A)</enum> <text>a member of the Armed Forces, including a reserve component, who is serving on active duty or active Guard and Reserve duty (as those terms are defined in paragraphs (1) and (6), respectively, of section 101(d) of title 10);</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7842016b1f73471c8013bc5598ad6c55"><enum>(B)</enum><text display-inline="yes-display-inline">a member of the National Guard who is serving on full-time National Guard duty (as that term is defined in section 101(d)(5) of title 10); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3662da126684bb9bfec06a0f67b9d6d"><enum>(C)</enum><text display-inline="yes-display-inline">a member of a reserve component or the Space Force while performing inactive-duty training (as that term is defined in section 101(d)(7) of title 10).</text></subparagraph></paragraph><paragraph id="id2bf02b650d4b47d9a3d26c620fb9938d" commented="no"> <enum>(2)</enum> <header>Member of the armed forces</header> <text>The term <term>Armed Forces</term> has the meaning given the term in section 101(a)(4) of title 10.</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd420546202fb4163b34ac5722a435acb"><enum>(3)</enum><header>Reserve component</header><text display-inline="yes-display-inline">The term <term>reserve component</term> means a component specified in section 10101 of title 10.</text></paragraph><paragraph id="idd5ba29e2204d452892ba87c96877ca22"><enum>(4)</enum><header>Sexual misconduct</header><text>The term <term>sexual misconduct</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id217df84d8d924dfe9a4b110223c4c670"><enum>(A)</enum><text>wrongful broadcast or distribution of intimate visual images punishable under section 917a of title 10 (article 117a of the Uniform Code of Military Justice);</text></subparagraph><subparagraph id="idc2a513097e15401b83a96e8dfd1685b8"> <enum>(B)</enum> <text>rape (as that term is defined in section 920(a) of title 10 (article 120(a) of the Uniform Code of Military Justice));</text>
 </subparagraph><subparagraph id="idd5f471c3284b442ab381d5520000720d"><enum>(C)</enum><text>sexual assault (as that term is defined in section 920(b) of title 10 (article 120(b) of the Uniform Code of Military Justice));</text></subparagraph><subparagraph id="id61f0fccba5a14b3fb7cd588253b855bb"><enum>(D)</enum><text>aggravated sexual contact (as that term is defined in section 920(c) of title 10 (article 120(c) of the Uniform Code of Military Justice));</text></subparagraph><subparagraph id="idabc338f1cff949f49e469478301364e7"><enum>(E)</enum><text>abusive sexual contact (as that term is defined in section 920(d) of title 10 (article 120(d) of the Uniform Code of Military Justice));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85da88d693e44868993f3e3406a86d2b"><enum>(F)</enum><text>other sexual misconduct punishable under section 920c of title 10 (article 120c of the Uniform Code of Military Justice); and</text></subparagraph><subparagraph id="id6f7de3fff9fb425d9bc21988717e3a9b"><enum>(G)</enum><text>the standalone offense of sexual harassment punishable under section 934 of title 10 (article 134 of the Uniform Code of Military Justice).</text></subparagraph></paragraph></subsection><subsection id="idb8f13b8339cc4883bfcc52aedd68f65d"><enum>(b)</enum><header>Claims</header><text>An individual may bring suit against the United States for injury or death arising, while such individual was a member of the Armed Forces, including a reserve component, from—</text><paragraph id="idcad7c8913b414c10a79cc73c27a237ad"><enum>(1)</enum><text>sexual misconduct committed by a covered individual; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7d6540ae67044b3b9dfc85192fde82fe"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idebbf882e377d40f2bb11ed78f2b9ee48"><enum>(A)</enum><text>the negligent failure to prevent such sexual misconduct;</text></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id03c8d1fd830448ce8facb0b403af7084"> <enum>(B)</enum> <text>the negligent failure to investigate such sexual misconduct; or</text>
                                </subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline"
                                    id="id1e7df47e493d4ac8b41c067262570ac4">
                                    <enum>(C)</enum>
 <text>any other such wrongful or negligent actions that contributed to the sexual misconduct alleged.</text>
 </subparagraph></paragraph></subsection><subsection id="id28ccc5f186294c108e10169446d99a66"><enum>(c)</enum><header>No reduction for certain benefits</header><text>A claim under this section shall not be reduced by the amount of any health care or benefit provided under a provision of law administered by the Secretary of Veterans Affairs or the Secretary of Defense.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3e82a059d129400ebe2fe637d8f7bbd6"><enum>(d)</enum><header>Limitations period</header><text>Notwithstanding section 2401(b), a claim brought under this section shall have a 5-year statute of limitations beginning on the date any such claim accrues.</text></subsection><subsection id="ida337106e50b1499480e3f3d4c3c2b97a"><enum>(e)</enum><header>Procedures</header><text>For purposes of claims brought under this section—</text><paragraph commented="no" display-inline="no-display-inline" id="id415ff4f57723422eacfdac20c4ee1930"><enum>(1)</enum><text display-inline="yes-display-inline">subsections (a), (h), (j), and (k) of section 2680 do not apply; and</text></paragraph><paragraph id="idb0055727741c4b628d375b47d7a950f1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the filing period under subsection (d) shall be tolled during the pendency of any investigation or proceeding related to the alleged sexual misconduct underlying the claim.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idbc377ef285e14678accc51c70913ac6b"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="idcb41337a-ce28-47c3-95c6-3417bde80396"><toc><toc-entry level="section" idref="id932876b3e3154250b396e7194d7f09a7">2681. Claims against the United States for military sexual trauma.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id307d004bcc5b470c9488f6607ffa33b3"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in this Act or the amendments made by this Act shall be construed to limit the application of the administrative process and procedures of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code, to claims permitted under section 2681 of such chapter.</text></subsection><subsection id="id7fb626a3edce437f9cb7300821cffde6"><enum>(d)</enum><header>Effective date</header><text>This Act and the amendments made by this Act shall apply to—</text><paragraph id="id370c01df8d784c38a30efdc6cc941314"><enum>(1)</enum><text>a claim arising on or after the date of the enactment of this Act; and</text></paragraph><paragraph id="idfe52b2ab39724dba9dae71500656feb3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>a claim arising before the date of the enactment of this Act, with respect to which the period of limitations shall be deemed to begin on the date of the enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
