which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Foreign Assistance Act of 1961 by limiting nonmilitary foreign assistance to organizations that provide or promote abortion, promote gender ideology, or promote discriminatory equity ideology, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Human Flourishing in Foreign Assistance Act</short-title></quote>.</text></section><section id="id5acbee93bd8447daaeb4a8e04c003167"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idbc79d22c40e648f79ae24bcccc52aff3"><enum>(1)</enum><header>Abortion</header><text>The term <term>abortion</term> means the use or prescription of any instrument, medicine, drug, or any other substance or device—</text><subparagraph id="id9a12ac9c537c4d9289a32989cda5a4db"><enum>(A)</enum><text>to intentionally kill the unborn child of a woman known to be pregnant; or</text></subparagraph><subparagraph id="id53923790e3364405913873939291f9f8"><enum>(B)</enum><text>to intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—</text><clause id="id1d23b1eaf9b347c8a916fd102c45ed39"><enum>(i)</enum><text>after viability to produce a live birth and preserve the life and health of the child born alive; or</text></clause><clause id="idef2db9be21484fc68ee2a07197675785"><enum>(ii)</enum><text>to remove a dead unborn child.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id500536c5ac3a463593f93be1cb1ed16b"><enum>(2)</enum><header>Discriminatory equity ideology</header><text>The term <term>discriminatory equity ideology</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idccfae1733b7e440ea0f6bd623210a312"><enum>(A)</enum><text display-inline="yes-display-inline">means an ideology that—</text><clause commented="no" display-inline="no-display-inline" id="ida7639174d7fa43a99332579c47c5bfaa"><enum>(i)</enum><text display-inline="yes-display-inline">treats individuals as members of preferred or disfavored groups, rather than as individuals; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9247def4f64a495bb53fcd88687dfa94"><enum>(ii)</enum><text display-inline="yes-display-inline">minimizes agency, merit, and capability in favor of generalizations; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd44f37cae9f9460f8feac843475ab089"><enum>(B)</enum><text display-inline="yes-display-inline">includes any of the following concepts:</text><clause commented="no" display-inline="no-display-inline" id="id5030e5cb936847dab7f6a02f4d1cfb7b"><enum>(i)</enum><text display-inline="yes-display-inline">Members of one race, color, religion, sex, or national origin are morally or inherently superior to members of another race, color, religion, sex, or national origin.</text></clause><clause commented="no" display-inline="no-display-inline" id="id9364042ef2134f61ba60e5f9cc36be9e"><enum>(ii)</enum><text display-inline="yes-display-inline">An individual, by virtue of the individual's race, color, religion, sex, or national origin, is inherently racist, sexist, or oppressive, whether consciously or unconsciously.</text></clause><clause commented="no" display-inline="no-display-inline" id="id3fd82acf80074c3da441275d4b0eb666"><enum>(iii)</enum><text display-inline="yes-display-inline">An individual's moral character or status as privileged, oppressing, or oppressed is primarily determined by the individual's race, color, religion, sex, or national origin.</text></clause><clause commented="no" display-inline="no-display-inline" id="id9848d12ffc4e43d79bc5b6bdc4f552b5"><enum>(iv)</enum><text display-inline="yes-display-inline">Members of one race, color, religion, sex, or national origin cannot and should not attempt to treat others without respect to their race, color, religion, sex, or national origin.</text></clause><clause commented="no" display-inline="no-display-inline" id="idfc8d56d96ef34ce7962178d5e9f300f5"><enum>(v)</enum><text display-inline="yes-display-inline">An individual, by virtue of the individual's race, color, religion, sex, or national origin, bears responsibility for, should feel guilt, anguish, or other forms of psychological distress because of, should be discriminated against, blamed, or stereotyped for, or should receive adverse treatment because of actions committed in the past by other members of the same race, color, religion, sex, or national origin, in which the individual played no part.</text></clause><clause commented="no" display-inline="no-display-inline" id="id7284591e2306446f8d57b0bb9251c0ce"><enum>(vi)</enum><text display-inline="yes-display-inline">An individual, by virtue of the individual's race, color, religion, sex, or national origin, should be discriminated against or receive adverse treatment to achieve diversity, equity, or inclusion.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0c378df0b8dd41f2a5fe8a333d5a371b"><enum>(vii)</enum><text display-inline="yes-display-inline">Virtues, such as merit, excellence, hard work, fairness, neutrality, objectivity, and racial colorblindness are racist or sexist or were created by members of a particular race, color, religion, sex, or national origin to oppress members of another race, color, religion, sex, or national origin.</text></clause><clause commented="no" display-inline="no-display-inline" id="id8e8f8aa34f9449fd97cd59139cb43d04"><enum>(viii)</enum><text display-inline="yes-display-inline">The United States is fundamentally racist, sexist, or otherwise discriminatory.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74a2cc02560f493dbf800172d119129f"><enum>(3)</enum><header display-inline="yes-display-inline">Female</header><text>The term <term>female</term> means a person who naturally has, had, or will have, but for a congenital anomaly or intentional or unintentional disruption, a reproductive system that produces, transports, and utilizes the large gamete (ova) for fertilization.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id10a2d25f8aa440079badc392b87a7a3c"><enum>(4)</enum><header>Foreign nongovernmental organization</header><text display-inline="yes-display-inline">The term <term>foreign nongovernmental organization</term> means any nongovernmental organization or entity (including any commercial firm and educational institution) that is not organized or existing under the laws of the United States, any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, or any other territory or possession of the United States.</text></paragraph><paragraph id="id3379596c1deb4c53bb845d502ee18485"><enum>(5)</enum><header>Gender identity</header><text>The term <term>gender identity</term>—</text><subparagraph id="id680f12e65fe54018bac735836d33f212"><enum>(A)</enum><text>means a purely internal, subjective sense of self that is disconnected and separate from biological sex;</text></subparagraph><subparagraph id="id30082466ee2748399b37c5fb447e915c"><enum>(B)</enum><text>does not provide a meaningful basis for identification; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9da5831c4b764931813365115c5e77de"><enum>(C)</enum><text display-inline="yes-display-inline">cannot be recognized as a replacement for sex.</text></subparagraph></paragraph><paragraph id="id94b287c18044493480cea4005e57a25d"><enum>(6)</enum><header>Gender ideology</header><text>The term <term>gender ideology</term>—</text><subparagraph id="id39dc2093b55249e791d45c086f56de61" commented="no"><enum>(A)</enum><text>means an ideology that replaces, or treats as superior to, the biological category of sex with an ever-shifting concept of a self-proclaimed gender identity, which permits the false claim that males can identify as and become females and females can identify as and become males; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb97039e5bcb4ffeae9ec088e9b161f1"><enum>(B)</enum><text display-inline="yes-display-inline">includes the idea that there is a vast spectrum of genders that are disconnected from a person's sex.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbec7b73f606840ada70b5d2834f1c28d"><enum>(7)</enum><header display-inline="yes-display-inline">International organization</header><text>The term <term>international organization</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf1f86e62ce0344e2af0e499621d3ab7b"><enum>(A)</enum><text display-inline="yes-display-inline">any organization designated as being entitled to enjoy the privileges, exemptions, and immunities under the International Organizations Immunities Act (<external-xref legal-doc="usc" parsable-cite="usc/22/288">22 U.S.C. 288 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7271a9e062664f5196ab3a1ed8ff87bc"><enum>(B)</enum><text display-inline="yes-display-inline">any organization treated as a public international organization pursuant to the regulations or policies of the Department of State;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida4fcec71c27b4d919bba077e82a561a3"><enum>(C)</enum><text display-inline="yes-display-inline">any organization established by international agreement and whose governing body is composed principally of representatives of national governments; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ed2714b619c42639f50d457b599fff4"><enum>(D)</enum><text display-inline="yes-display-inline">any other multilateral entity in which sovereign nations participate.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6f979e4b60c443838bf6e9f51ffc22df"><enum>(8)</enum><header display-inline="yes-display-inline">Male</header><text>The term <term>male</term> means a person who naturally has, had, or will have, but for a congenital anomaly or intentional or unintentional disruption, a reproductive system that produces, transports, and utilizes the small gamete (sperm) for fertilization.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3736d165be9d420d9ef42b6d31e56714"><enum>(9)</enum><header display-inline="yes-display-inline">Nonmilitary foreign assistance</header><text>The term <term>nonmilitary foreign assistance</term> means foreign assistance to be used for nonmilitary purposes, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc6d518312c9f46169f1a9c73665c62cc"><enum>(A)</enum><text display-inline="yes-display-inline">global health programs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaa6be132ce2e465ca8e7c109645c6dbe"><enum>(B)</enum><text display-inline="yes-display-inline">humanitarian assistance;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf19eb542dd624970b4feb14facf7f2ed"><enum>(C)</enum><text display-inline="yes-display-inline">economic and development assistance;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1273f4193f81418aa75121047534472d"><enum>(D)</enum><text display-inline="yes-display-inline">stabilization assistance;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd53fb76e054b488f82bf0171c522bcd6"><enum>(E)</enum><text display-inline="yes-display-inline">civil society and democracy programming;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2fe34faa0dd143348943b0beb0e0b721"> <enum>(F)</enum> <text display-inline="yes-display-inline">migration and refugee assistance; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb6809af88a37428faf5af9e5c2bd8423"><enum>(G)</enum><text display-inline="yes-display-inline">voluntary contributions to international organizations.</text></subparagraph></paragraph><paragraph id="id33fb2ae1a8b64d79b43c2154d07a7a02"><enum>(10)</enum><header>Parastatal</header><text>The term <term>parastatal</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd8b6a7f81b2c4d08a69793f49eae3545"><enum>(A)</enum><text display-inline="yes-display-inline">a foreign-government-owned organization operated as a commercial company; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb9fc9dbbdb624fd1bec4fe467fe5e1ad"><enum>(B)</enum><text display-inline="yes-display-inline">any other organization, including nonprofits, or enterprises in which foreign governments or foreign government agencies have a controlling interest.</text></subparagraph></paragraph><paragraph id="id1ad3bb2f40224ea09ddddab5aadd0326"><enum>(11)</enum><header>Promote abortion</header><text>The term <term>promote abortion</term> means—</text><subparagraph id="id6f8c43c773284bc38735e375811ce7cc"><enum>(A)</enum><text>committing financial or other resources to increase the availability or use of abortion;</text></subparagraph><subparagraph id="iddc25afa759194f9292b3556d7d320ce8"><enum>(B)</enum><text>operating a service delivery site that provides counseling, including advice and information, regarding the benefits or availability of abortion, excluding a site operated by a United States nongovernmental organization that is in full compliance with the physical and financial separation requirements under this Act with respect to foreign assistance;</text></subparagraph><subparagraph id="ida078957275af4152b8a6c3dd676770af"><enum>(C)</enum><text>providing advice that abortion is an available option, or referring for, or encouraging females to consider abortion;</text></subparagraph><subparagraph id="id6225f1fa02764b26bd4affad49a99d3b"><enum>(D)</enum><text>lobbying, pressuring, or encouraging a foreign government to legalize or make available abortion or to continue the legality of abortion;</text></subparagraph><subparagraph id="id1f98fd9fc38549c38a8ad4f74b25a483"><enum>(E)</enum><text>conducting a public information campaign in a foreign country regarding the benefits or availability of abortion; or</text></subparagraph><subparagraph id="id9c6d7dee7ba74e42953ac0d1c773fc64"><enum>(F)</enum><text>using or teaching from sex education materials or other educational materials, including books, curricula, and media, which encourage abortion.</text></subparagraph></paragraph><paragraph id="id7efb850e54bf4f8181e9f44de9823045"><enum>(12)</enum><header>Promote discriminatory equity ideology</header><subparagraph commented="no" display-inline="no-display-inline" id="id6d1079a46b5e46f3819e0cc4b2ca86af"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>promote discriminatory equity ideology</term> means using or teaching education materials (including books, curricula, and media) that advance discriminatory equity principles.</text></subparagraph><subparagraph id="idde81fbca96d944c089d32104473ffd63"><enum>(B)</enum><header>Exception</header><text>An action by an individual who is acting in his or her personal capacity may not be attributed to an organization with which the individual is associated if—</text><clause commented="no" display-inline="no-display-inline" id="id9ec99669edd141548d633be8ed572f62"><enum>(i)</enum><text display-inline="yes-display-inline">such individual—</text><subclause commented="no" display-inline="no-display-inline" id="id0d8ee3b6f1db459e8cfc3d6c1a742764"><enum>(I)</enum><text display-inline="yes-display-inline">is not on duty; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide360f175a4d54d9885755bbb5a6ff859"><enum>(II)</enum><text display-inline="yes-display-inline">is not acting on the organization’s premises; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1f66653c54464056ab6e7f2436abf42a"><enum>(ii)</enum><text display-inline="yes-display-inline">such organization—</text><subclause commented="no" display-inline="no-display-inline" id="id6de5f784a262445182b84bea414a486b"><enum>(I)</enum><text display-inline="yes-display-inline">does not endorse or provide financial support for such action; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id18663ff7ad0d4f36bb8ff31e59b79a5e"><enum>(II)</enum><text display-inline="yes-display-inline">takes reasonable steps to ensure such individual does not improperly represent that he or she is acting on behalf of the organization.</text></subclause></clause></subparagraph></paragraph><paragraph id="idfd0dfaa0ce3846cd9058abd986016000"><enum>(13)</enum><header>Promote gender ideology</header><text>The term <term>promote gender ideology</term> means any activity in support of the possibility of changing one's gender, including—</text><subparagraph id="id4388ba819aa543d8afb5259b20571739"><enum>(A)</enum><text>the provision or promotion of sex-rejecting procedures or sex-rejecting social transition;</text></subparagraph><subparagraph id="idcf05b8f91cac4fe79c2b890cd6fa5af3"><enum>(B)</enum><text>committing financial or other resources to increase the availability or use of sex-rejecting procedures or sex-rejecting social transition;</text></subparagraph><subparagraph id="idc462ed836e144ea59cb869cb1edb030b"><enum>(C)</enum><text>operating a service-delivery site that provides counseling, including advice and information, regarding the benefits or availability of sex-rejecting procedures or sex-rejecting social transition, excluding a site operated by a United States nongovernmental organization that is in full compliance with the physical and financial separation requirements under this Act with respect to foreign assistance;</text></subparagraph><subparagraph id="id6ace43412abe4f2aa23e20af835fe624"><enum>(D)</enum><text>providing advice that sex-rejecting procedures or sex-rejecting social transition is an available option for treatment of gender dysphoria, or referring or encouraging individuals to consider such procedures or transition;</text></subparagraph><subparagraph id="id899ecaa8a0174e959f192b0d5275c588"><enum>(E)</enum><text>lobbying, pressuring, or encouraging a foreign government—</text><clause commented="no" display-inline="no-display-inline" id="id678e4e69603344b18e1bcdc5154f2ff3"><enum>(i)</enum><text display-inline="yes-display-inline">to provide special legal status or protections based on gender identity;</text></clause><clause commented="no" display-inline="no-display-inline" id="id98a7a44d07d94e96b7b1d6ba7c9e0106"><enum>(ii)</enum><text display-inline="yes-display-inline">to legalize or make available sex-rejecting procedures or sex-rejecting social transition;</text></clause><clause commented="no" display-inline="no-display-inline" id="id21bf6eefe5294c8289b55ca4e6c4f273"><enum>(iii)</enum><text display-inline="yes-display-inline">to otherwise promote gender ideology; or</text></clause><clause commented="no" display-inline="no-display-inline" id="iddc88d66868084c3ea3ca1f7d135392e8"><enum>(iv)</enum><text display-inline="yes-display-inline">to continue the legality of any such activities or otherwise to change policies to reflect gender ideology;</text></clause></subparagraph><subparagraph id="id8c0f4ee3c05e4658bcbfc2bb4c4a3980"><enum>(F)</enum><text>conducting a public-information campaign in foreign countries regarding acceptance of gender ideology, or the benefits or availability of sex-rejecting procedures or sex-rejecting social transition;</text></subparagraph><subparagraph id="idf9dbdde5a1da4b62bc1b2ea224dc8ef2"><enum>(G)</enum><text>using or teaching from sex education materials, including books, curricula, and media, which include gender ideology, such as—</text><clause commented="no" display-inline="no-display-inline" id="idf33d19f3920546448c2637774adc0680"><enum>(i)</enum><text display-inline="yes-display-inline">it is possible to change one’s sex;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc547150fb4e94d37a0ee94f8fad0f4d3"><enum>(ii)</enum><text display-inline="yes-display-inline">it is possible to be born in the wrong body; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idf0fe65b883864613a5699173eb562630"><enum>(iii)</enum><text display-inline="yes-display-inline">instructing on the use of pronouns that do not correspond to an individual’s sex; and</text></clause></subparagraph><subparagraph id="id84fdd1a6d8564604a6156800f3630b1c"><enum>(H)</enum><text>conducting drag queen workshops, performances, or documentaries.</text></subparagraph></paragraph><paragraph id="id09c0a91f35fb4c60908554e2b8923969"><enum>(14)</enum><header>Provide a sex-rejecting procedure</header><text>The term <term>provide a sex-rejecting procedure</term> means any act of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf8cd3e218f7f4d6c9c5dfa319b7e6143"><enum>(A)</enum><text display-inline="yes-display-inline">performing any procedure, or prescribing, dispensing, or utilizing any drug or device, for a sex-rejecting procedure; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida38edb9afbdd4af4ad3ff68837ccb961"><enum>(B)</enum><text display-inline="yes-display-inline">paying for, assisting in carrying out, or operating a facility that carries out, any act described in subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c0e55f6a0f54415958f5052eed9ae93"><enum>(15)</enum><header>Sex</header><text>The term <term>sex</term> means a person's immutable biological classification, determined at the moment of conception, as either male or female.</text></paragraph><paragraph id="idb315ca74469e4212a74fcc3d7bd3822b"><enum>(16)</enum><header>Sex-rejecting procedure</header><text>The term <term>sex-rejecting procedure</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide420aaaafec849838eb118dfc4d2ed7c"><enum>(A)</enum><text display-inline="yes-display-inline">means any pharmaceutical or surgical intervention that is provided for the purpose of attempting to align an individual's physical appearance or body with an asserted identity that differs from the individual's sex by intentionally—</text><clause id="ide572e7fd4c914ae7b8eea8dd48009528"><enum>(i)</enum><text>disrupting or suppressing the normal development of natural biological functions, including primary or secondary sex-based traits; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id9a79c05947c941f5947fc6df6ef387ce"><enum>(ii)</enum><text display-inline="yes-display-inline">altering an individual's physical appearance or body, including amputating, minimizing or destroying primary or secondary sex-based traits, such as the sexual and reproductive organs; and</text></clause></subparagraph><subparagraph id="id94c192c2c34145758b0dfb03e7940db6"><enum>(B)</enum><text>does not include any procedure undertaken—</text><clause commented="no" display-inline="no-display-inline" id="id639e7a74a2ca4d2089217e8bafe2871b"><enum>(i)</enum><text display-inline="yes-display-inline">to treat a person with a medically verifiable disorder of sexual development;</text></clause><clause commented="no" display-inline="no-display-inline" id="idcb0d78271abe456cab08e7916b9fc9f0"><enum>(ii)</enum><text display-inline="yes-display-inline">for purposes other than attempting to align an individual's physical appearance or body with an asserted identity that differs from the individual's sex; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idcad69c139e0a49e08c366833285a10e5"><enum>(iii)</enum><text display-inline="yes-display-inline">to treat complications of, including any infection, injury, disease, or disorder that has been caused by or exacerbated by, the performance of, such a sex rejecting procedure.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id810b6fe540784729a573d8bbc4c8f22d"><enum>(17)</enum><header display-inline="yes-display-inline">Social transition</header><text>The term <term>social transition</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc8fc5f0dd80348eb961dd15f191efc27"><enum>(A)</enum><text display-inline="yes-display-inline">means the nonchemical and nonsurgical aspects of the process of adopting a gender identity or gender marker that differs from a person's sex;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf072577c3f694d2194f20690c2c4641b"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text><clause commented="no" display-inline="no-display-inline" id="idd7b20971f8e04a7b885a3485d3673215"><enum>(i)</enum><text display-inline="yes-display-inline">psychological or psychiatric counseling or treatment by a counselor or other provider;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf5bd49c6c9f748409730b31e3fcdd9d6"><enum>(ii)</enum><text display-inline="yes-display-inline">modifying a person's name or pronouns;</text></clause><clause commented="no" display-inline="no-display-inline" id="id1c1c2c5d60834d2f999cfbbbb86f2a70"><enum>(iii)</enum><text display-inline="yes-display-inline">referring to a person by a term that is inconsistent with the person's biological sex of male or female;</text></clause><clause commented="no" display-inline="no-display-inline" id="id21fb3047f75f492ca509d69eaafdc033"><enum>(iv)</enum><text display-inline="yes-display-inline">enabling the use of intimate facilities and accommodations, such as bathrooms or locker rooms, specifically designated for persons of the opposite sex;</text></clause><clause commented="no" display-inline="no-display-inline" id="idcd5ecf22ea814cd0866561874ed439ee"><enum>(v)</enum><text display-inline="yes-display-inline">authorizing the participation in athletic competitions or other activities specifically designated for persons of the opposite sex; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida8d0ccca401242aeaa7f45ad3626f085"><enum>(vi)</enum><text display-inline="yes-display-inline">using non-medical, physical, sex-rejecting interventions, such as binders used to flatten female breasts; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9fe0f25532594df7b35fa2babff4b21a"><enum>(C)</enum><text display-inline="yes-display-inline">does not include the provision of sex-rejecting procedures.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida9ae0b1ae4f84675aed0abd51e804a18"><enum>(18)</enum><header>United States nongovernmental organization</header><text display-inline="yes-display-inline">The term <term>United States nongovernmental organization</term> means any nongovernmental organization or entity (including any commercial firm and educational institution) that is organized or existing under the laws of the United States, any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, or any other territory or possession of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idde7c88a8e9b34dbdaa20facf32232531"><enum>(19)</enum><header>Unlawful DEI-related discrimination</header><text>The term <term>unlawful DEI-related discrimination</term>—</text><subparagraph id="id3bce3e3baa6e4c478e6f67f7da0a4c5b"><enum>(A)</enum><text>means discrimination on the basis of race, color, religion, sex, or national origin, if such discrimination—</text><clause commented="no" display-inline="no-display-inline" id="idf892f99429cb494fa64c8dfbf1274a4b"><enum>(i)</enum><text display-inline="yes-display-inline">violates United States anti-discrimination law; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id72c9ee3297e64f1eaea5c9a8fd8103b1"><enum>(ii)</enum><text display-inline="yes-display-inline">would violate such law if such activity occurred inside the United States, including the use of such characteristics as a selection criterion or preference for, or basis for exclusion from, employment, contracting, program participation, resource allocation, or similar activities, opportunities, or benefits;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f85c7ed0d7741238c29235aeace76b0"><enum>(B)</enum><text display-inline="yes-display-inline">includes all conduct that discriminates on the basis of race, color, religion, sex, or national origin that violates United States Federal anti-discrimination laws or would violate such laws if such activity occurred inside the United States, including—</text><clause commented="no" display-inline="no-display-inline" id="idcdd0d68a3e114d278fff9a77fc40616b"><enum>(i)</enum><text display-inline="yes-display-inline">training sessions;</text></clause><clause commented="no" display-inline="no-display-inline" id="id61f6141aba5f459fbdc87b6823e16fe8"><enum>(ii)</enum><text display-inline="yes-display-inline">segregation in facilities or resources;</text></clause><clause commented="no" display-inline="no-display-inline" id="idaff9d2a4df84401c9ba62cf4aa1a7169"><enum>(iii)</enum><text display-inline="yes-display-inline">implicit segregation through program eligibility;</text></clause><clause commented="no" display-inline="no-display-inline" id="ided4baed30812411b860956ff395e8e0a"><enum>(iv)</enum><text display-inline="yes-display-inline">hiring panels;</text></clause><clause commented="no" display-inline="no-display-inline" id="id3d8e3767b45349839336e2f6eb5c4e3d"><enum>(v)</enum><text display-inline="yes-display-inline">candidate pools;</text></clause><clause commented="no" display-inline="no-display-inline" id="id0c0c77c6bc60465f8b8829d59d7e20cc"><enum>(vi)</enum><text display-inline="yes-display-inline">program participation;</text></clause><clause commented="no" display-inline="no-display-inline" id="id57ab1957a0f448559e1552f18e7ce688"><enum>(vii)</enum><text display-inline="yes-display-inline">DEI training programs that promote discrimination based on protected characteristics, such as by stereotyping, excluding, or disadvantaging individuals, or creating a hostile environment; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6f231f469bb14c54aac8df9b59960042"><enum>(viii)</enum><text display-inline="yes-display-inline">any other <quote>unlawful practices</quote> under the Attorney General's Guidance for Recipients of Federal Funding Regarding Unlawful Discrimination (July 29, 2025) with respect to such characteristics; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf586721b3d84c0aa08e0e1a3c421dc7"><enum>(C)</enum><text display-inline="yes-display-inline">does not apply to—</text><clause commented="no" display-inline="no-display-inline" id="id18d581fe0a60450fb53fcfd233a45c29"><enum>(i)</enum><text display-inline="yes-display-inline">a religious corporation, association, or society with respect to the employment of individuals of a particular religion to perform work connected with the carrying on by such corporation, association, or society of its religious activities; or</text></clause><clause id="id274bcbd4eff04afab5c379c051f34d3a"><enum>(ii)</enum><text>screening, monitoring, and management of prenatal and postnatal care for the purpose of improving maternal and infant health outcomes and reducing maternal mortality for women.</text></clause></subparagraph></paragraph></section><section id="id528ab43f2a284c4db9670d153d1e9f90"><enum>3.</enum><header>Protecting life in foreign assistance</header><subsection commented="no" display-inline="no-display-inline" id="id3d7fa1a37a8f432e871d2e68ef3ff1df"><enum>(a)</enum><header display-inline="yes-display-inline">Foreign nongovernmental organizations and international organizations</header><text display-inline="yes-display-inline">Except as provided in subsection (f), any foreign nongovernmental organization or international organization that receives or implements a grant or cooperative agreement for nonmilitary foreign assistance shall agree that, during the period of the award, it will not, outside of the United States, provide or promote abortion or provide financial support to any other foreign nongovernmental organization or international organization that engages in such activities.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3eb51b52ffb0494fafc4499e909fb0c2"><enum>(b)</enum><header>United States nongovernmental organizations</header><text display-inline="yes-display-inline">Except as provided in subsection (f), any United States nongovernmental organization that receives or implements a grant or cooperative agreement for nonmilitary foreign assistance is not subject to the requirements under subsection (a), but shall agree that, during the period of the award—</text><paragraph commented="no" display-inline="no-display-inline" id="id1bcfea36c47742ba847d9dcd224864e7"><enum>(1)</enum><text display-inline="yes-display-inline">it will not, outside of the United States, provide abortion;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6029e1df688a4d108f4b8e41e317cbe5"><enum>(2)</enum><text display-inline="yes-display-inline">it will not, within the scope of any program, project, or activity funded by foreign assistance, provide or promote abortion; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id721570ac730b4b8a84e34bd5d291766b"><enum>(3)</enum><text display-inline="yes-display-inline">it will ensure the physical and financial separation of its nonmilitary foreign assistance funded programs projects and activities from the provision or promotion of abortion.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc9891024099a4320893cc12196621aed"><enum>(c)</enum><header>Foreign governments and parastatals</header><text display-inline="yes-display-inline">The Secretary of State or the Under Secretary of State for Foreign Assistance, Humanitarian Affairs, and Religious Freedom may require any foreign government or parastatal that receives or implements a grant or cooperative agreement for nonmilitary foreign assistance to agree that, during the period of the award, it will not use nonmilitary foreign assistance funds received under the award to provide or promote abortion.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf8068351767a4778be600730ee58d6c4"><enum>(d)</enum><header>Subrecipients</header><text display-inline="yes-display-inline">The restrictions set forth in subsections (a) through (c) shall apply to subrecipients of foreign assistance in the same manner as the principal recipient.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id22c576dc44604d47915163e8cb30e32d"><enum>(e)</enum><header>Applicability</header><text display-inline="yes-display-inline">The restrictions set forth in subsections (a) through (d) shall apply to all non-military foreign assistance programs, includes global health assistance, humanitarian assistance, and civil society and democracy programs.</text></subsection><subsection id="id861155a35743406ea83f83bea08f8e6f"><enum>(f)</enum><header>Exceptions</header><text>The restrictions set forth in subsections (a) through (c) shall not apply—</text><paragraph id="id1d59d266734c47cca9aeaa8344f8a639"><enum>(1)</enum><text>to an abortion involving a woman suffering from a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the woman in danger of death unless an abortion is performed, including a life-endangering physical condition caused by or arising from the pregnancy itself; or</text></paragraph><paragraph id="id6914faa7d30548cd8ba462205c315802"><enum>(2)</enum><text>to treatment for an ectopic pregnancy.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id7602e4768a7047979374b2171609b9d9"><enum>4.</enum><header>Combating gender ideology in foreign assistance</header><subsection commented="no" display-inline="no-display-inline" id="id2a6cdcdd666740d5bf6a6bb5b197fade"><enum>(a)</enum><header display-inline="yes-display-inline">Foreign nongovernmental organizations and international organizations</header><text display-inline="yes-display-inline">Any foreign nongovernmental organization or international organization that receives or implements a grant or cooperative agreement for nonmilitary foreign assistance shall agree that, during the period of the award, it will not, outside of the United States, promote gender ideology or provide financial support to any other foreign nongovernmental organization or international organization that promotes gender ideology.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7037ec727c1643f997d842aa26c4c428"><enum>(b)</enum><header>United States nongovernmental organizations</header><text display-inline="yes-display-inline">Any United States nongovernmental organization that receives or implements a grant or cooperative agreement for nonmilitary foreign assistance is not subject to the requirements under subsection (a), but shall agree that, during the period of the award—</text><paragraph commented="no" display-inline="no-display-inline" id="id5da62dab3fe14893860c2003955cc972"><enum>(1)</enum><text display-inline="yes-display-inline">it will not, outside of the United States, provide or promote sex-rejecting procedures or sex-rejecting social transitions;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5c12eaeed6d74eddad38c52b856e113d"><enum>(2)</enum><text display-inline="yes-display-inline">it will not, within the scope of any program, project, or activity funded by foreign assistance, promote gender ideology; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id487e97b945554dfd99da57e62ce1d412"><enum>(3)</enum><text display-inline="yes-display-inline">it will ensure the physical and financial separation of its foreign assistance funded programs projects and activities from the promotion of gender ideology.</text></paragraph></subsection><subsection id="idfc23e8276ac545708c7f9f026be95cdb" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Foreign governments and parastatals</header><text display-inline="yes-display-inline">The Secretary of State or the Under Secretary of State for Foreign Assistance, Humanitarian Affairs, and Religious Freedom may require any foreign government or parastatal that receives or implements a grant or cooperative agreement for nonmilitary foreign assistance—</text><paragraph commented="no" display-inline="no-display-inline" id="idca0f631414b74177a4f84fec2a9517cb"><enum>(1)</enum><text display-inline="yes-display-inline">to agree that, during the period of the award, it will not use foreign assistance funds received under the award to promote gender ideology; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id927654a6c8b24d979d49101691ba7f4e"><enum>(2)</enum><text display-inline="yes-display-inline">to place any foreign assistance funds received under this award in a segregated account to ensure such funds are not used to promote gender ideology to the extent the foreign government conducts or supports such activity.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd94352d482e4436081a38fdfc0d48071"><enum>(d)</enum><header>Subrecipients</header><text display-inline="yes-display-inline">The restrictions set forth in subsections (a) through (c) shall apply to subrecipients of foreign assistance in the same manner as the principal recipient.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6e22ae89811e42458ec4e3022e8379d4"><enum>(e)</enum><header>Applicability</header><text display-inline="yes-display-inline">The restrictions set forth in subsections (a) through (d) shall apply to all non-military foreign assistance programs, includes global health assistance, humanitarian assistance, and civil society and democracy programs, to ensure that—</text><paragraph commented="no" display-inline="no-display-inline" id="id6cb6f07e614e4ec2a9d192ee5bd3800f"><enum>(1)</enum><text display-inline="yes-display-inline">foreign assistance programs do not support—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbd9b5e6cf6604a95acb0be3239eb7e9c"><enum>(A)</enum><text display-inline="yes-display-inline">foreign nongovernmental organizations and international organizations that promote gender ideology; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf0df455809f84ee9b22718ac5933b748"><enum>(B)</enum><text display-inline="yes-display-inline">United States nongovernmental organizations that provide sex-rejecting procedures; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id78b4b8e904c147bb90c4d95c9f12506b"><enum>(2)</enum><text display-inline="yes-display-inline">humanitarian assistance and gender-related programs receiving foreign assistance do not promote gender ideology.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8654ee67f66745d3b153e3a975161731"><enum>5.</enum><header>Combating discriminatory equity ideology in foreign assistance</header><subsection commented="no" display-inline="no-display-inline" id="id32a72f6f0edd4c0fb153e43d18b8a870"><enum>(a)</enum><header display-inline="yes-display-inline">Foreign nongovernmental organizations and international organizations</header><text display-inline="yes-display-inline">Any foreign nongovernmental organization or international organization that receives or implements a grant or cooperative agreement for foreign assistance shall agree that, during the period of the award, it will not, outside of the United States, promote discriminatory equity ideology, engage in unlawful DEI-related discrimination, or provide financial support to any other foreign nongovernmental organization or international organization that conducts such activities.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id51d5398527dc41a5932716ccde8f5446"><enum>(b)</enum><header>United States nongovernmental organizations</header><text display-inline="yes-display-inline">Any United States nongovernmental organization that receives or implements a grant or cooperative agreement for foreign assistance is not subject to the requirements under subsection (a), but shall agree that, during the period of the award—</text><paragraph commented="no" display-inline="no-display-inline" id="ida607a3fb26b84644889feeb32cfcc69e"><enum>(1)</enum><text display-inline="yes-display-inline">it will not, outside of the United States, engage in unlawful DEI-related discrimination;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c1c253bd52f4dbea5b522045fcd1e0b"><enum>(2)</enum><text display-inline="yes-display-inline">it will not, within the scope of any program, project, or activity funded by nonmilitary foreign assistance, promote discriminatory equity ideology or engage in such discrimination; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idabf22bca9e8a4a808021cb96a0c3c2e0"><enum>(3)</enum><text display-inline="yes-display-inline">it will ensure the physical and financial separation of its nonmilitary foreign assistance-funded programs, projects, and activities from any activities described in paragraphs (1) and (2).</text></paragraph></subsection><subsection id="idd73fbaadc47c4a408202ae5b7f28ff9e" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Foreign governments and parastatals</header><text display-inline="yes-display-inline">The Secretary of State or the Under Secretary of State for Foreign Assistance, Humanitarian Affairs, and Religious Freedom may require any foreign government or parastatal that receives or implements a grant or cooperative agreement for nonmilitary foreign assistance—</text><paragraph commented="no" display-inline="no-display-inline" id="iddc78f2dece534cd48f80f716cc275e77"><enum>(1)</enum><text display-inline="yes-display-inline">to agree that, during the period of the award, it will not use nonmilitary foreign assistance funds received under the award to promote discriminatory equity ideology or engage in unlawful DEI-related discrimination; and</text></paragraph><paragraph id="id18e170d1484841a79ab1bd0bf54e7fcc" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">to place any nonmilitary foreign assistance funds received under such award in a segregated account to ensure such funds are not used to support the activities described in paragraph (1) to the extent the foreign government conducts or supports such activities.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfbc2c429dbd54166aaa63fb0509429c0"><enum>(d)</enum><header>Subrecipients</header><text display-inline="yes-display-inline">The restrictions set forth in subsections (a) through (c) shall apply to subrecipients of foreign assistance in the same manner as the principal recipient.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idcf7f89fc97734def91fcea4742f0285d"><enum>(e)</enum><header>Applicability</header><text display-inline="yes-display-inline">The restrictions set forth in subsections (a) through (d) shall apply to all nonmilitary foreign assistance programs, including global health assistance, humanitarian assistance, and civil society and democracy programs, to ensure that foreign assistance programs do not support—</text><paragraph commented="no" display-inline="no-display-inline" id="idcb8304d711064f94b451fd5e166a366f"><enum>(1)</enum><text display-inline="yes-display-inline">foreign nongovernmental organizations and international organizations that promote discriminatory equity ideology; or</text></paragraph><paragraph id="id3b11168e6e6d40f79d48d71b6ddf68bf" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">United States nongovernmental organizations that engage in unlawful DEI-related discrimination.</text></paragraph></subsection></section><section id="idf170dfc97cd6483ba9930e0ce49ec649"><enum>6.</enum><header>Waiver</header><text display-inline="no-display-inline">The Secretary of State may waive the application of any provision under this Act by certifying to the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="HFA00">Committee on Foreign Affairs of the House of Representatives</committee-name>, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, and the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform of the House of Representatives</committee-name> that—</text><paragraph id="id2a9884be27724c879f50719614a0afe5"><enum>(1)</enum><text>such waiver is in the national security or foreign policy interests of the United States;</text></paragraph><paragraph id="ide0899d096051496ab4203ab615378e11"><enum>(2)</enum><text>the implementing partner that would be negatively affected by such provision is the only provider of the specific services for which the nonmilitary foreign assistance would be used;</text></paragraph><paragraph id="idfedb4d8717f843da8929042327989b81"><enum>(3)</enum><text>the requested scope of the waiver is narrowly tailored to only include such services; and</text></paragraph><paragraph id="idb69b147205ee441983f7d39031417d71"><enum>(4)</enum><text>the implementing partner has made a good faith effort to comply with such provision.</text></paragraph></section><section id="iddfe365f043474defb42950bee53b5af4"><enum>7.</enum><header>Rule of construction</header><text display-inline="no-display-inline">The provisions of this Act affecting United States nongovernmental organizations—</text><paragraph id="id3e74b570d73c44dc8715476f3e690d35"><enum>(1)</enum><text>shall be construed in a manner that is consistent with the First Amendment to the Constitution of the United States; and</text></paragraph><paragraph id="id1566239c209540a8890c702625347948"><enum>(2)</enum><text>may not be construed to restrict the freedoms of speech or association of such organizations when using non-Federal funds outside the scope of a program, project, or activity for which foreign assistance is made available.</text></paragraph></section></legis-body></bill>
