which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food Security Act of 1985 to establish State assistance for soil health and wildlife habitat, and for other purposes.</official-title></form><legis-body><section id="id4ceebd60e06748e1bf2732d1526814aa" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Conservation through Advancing Local Efforts Act of 2026</short-title></quote> or the <quote><short-title>SCALE Act of 2026</short-title></quote>.</text></section><section id="HE06AB162638842BD9233CC9C03604711" section-type="subsequent-section"><enum>2.</enum><header>State assistance for soil health and wildlife habitat</header><text display-inline="no-display-inline">Subchapter B of chapter 4 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-21">16 U.S.C. 3839aa–21 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H5114B0A94FD8452FABF18A5EAB3A33B4" display-inline="no-display-inline" style="OLC"><section id="H8C7ED80D020A47ECA6122C70CF53014A"><enum>1240L–2.</enum><header>State assistance for soil health and wildlife habitat</header><subsection id="H351312CBFA21409CBE6E0308B2C96D30"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ide824316706784219b1d0363f90a7672a"><enum>(1)</enum><header>Agricultural land</header><text>The term <term>agricultural land</term> means—</text><subparagraph id="ide546bfbf41fa4e1f8ed23d975465aa50"><enum>(A)</enum><text>cropland;</text></subparagraph><subparagraph id="idf786eeeeabb74319a37f715e2674c314"><enum>(B)</enum><text>grassland;</text></subparagraph><subparagraph id="id174bd915d1f0475e9caaf13f21dccb7f"><enum>(C)</enum><text>rangeland;</text></subparagraph><subparagraph id="id182e7701270d4dbbb97e8e5d86b0beb3"><enum>(D)</enum><text>pasture land;</text></subparagraph><subparagraph id="idaa5196fb715b4a99a0ef99d007057f9e"><enum>(E)</enum><text>nonindustrial private forest land; and</text></subparagraph><subparagraph id="id3e459856c47c430ab6d71312ef4131da"><enum>(F)</enum><text>other land in agricultural areas (including wetlands, marshes, and agricultural land used or capable of being used for the production of livestock), as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="HBAC73C75D2E142D19F4909993347E0DD"><enum>(2)</enum><header>Eligible Indian Tribe</header><text>The term <term>eligible Indian Tribe</term> means an Indian Tribe that is—</text><subparagraph id="HF8091747F8E6403EA53918138E9AA155"><enum>(A)</enum><text>implementing a soil health and wildlife habitat program for the area over which the Indian Tribe has jurisdiction; and</text></subparagraph><subparagraph id="HDFCA3A0BF74F4AEB823021475FFE97F4"><enum>(B)</enum><text display-inline="yes-display-inline">meeting or exceeding performance measures established by the Indian Tribe for the soil health and wildlife habitat program.</text></subparagraph></paragraph><paragraph id="HB2368D8232EA42BB963D55282549E871"><enum>(3)</enum><header>Eligible State</header><text display-inline="yes-display-inline">The term <term>eligible State</term> means a State that is—</text><subparagraph id="H5C5F8FAA76734F5890D1A7019E42A32D"><enum>(A)</enum><text>implementing a new or existing soil health and wildlife habitat program for the State; and</text></subparagraph><subparagraph id="H7D2F0109EB584A3E97EAF3C6E795163C"><enum>(B)</enum><text>meeting or exceeding performance measures established by the State for the soil health and wildlife habitat program.</text></subparagraph></paragraph><paragraph id="H469647D079BF4FC6B6CE89F197BC319C"><enum>(4)</enum><header>Soil health and wildlife habitat program</header><text display-inline="yes-display-inline">The term <term>soil health and wildlife habitat program</term> means a program to improve soil health and wildlife habitat on agricultural land that—</text><subparagraph id="H993C1CDD967446E796F7678A95EFB2C2"><enum>(A)</enum><text>is broadly consistent with the soil health principles of the Natural Resources Conservation Service, as determined by the Secretary, including the use of perennial grasses; and</text></subparagraph><subparagraph id="H1AA3272B440C4AF7B26CB7D8769E6D76"><enum>(B)</enum><text>may include—</text><clause id="HEA0BCBE7D06F4F6EB13797CDED3A740B"><enum>(i)</enum><text>technical assistance;</text></clause><clause id="H316CA1C9833D4FC19B9A4138E8929325"><enum>(ii)</enum><text>financial assistance;</text></clause><clause id="H85F991968FAD47BD9C88E641DA360D14"><enum>(iii)</enum><text>on-farm research and demonstration;</text></clause><clause id="H8900223DB50A4EAD8D490F260E3E87CB"><enum>(iv)</enum><text>education, outreach, and training;</text></clause><clause id="HA9837D8C9307484892C637F58174781D"><enum>(v)</enum><text>monitoring and evaluation; or</text></clause><clause id="H494043751B614C00B309288FF3908EA1"><enum>(vi)</enum><text>such other components as the Secretary determines appropriate.</text></clause></subparagraph></paragraph></subsection><subsection id="H3C4DD3E7A8254B87B8293F3D67C62845"><enum>(b)</enum><header>Availability and purpose of grants</header><text>For fiscal years 2027 through 2031, the Secretary shall make grants to eligible States and eligible Indian Tribes for the purpose of improving soil health and wildlife habitat on agricultural lands through the implementation of State and Tribal soil health and wildlife habitat programs.</text></subsection><subsection id="H7594BDC1F5F342D0BC8FC8F23D380187"><enum>(c)</enum><header>Applications</header><paragraph id="HFC15544C60DF491C91C32C97F9664487"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To receive a grant under this section, an eligible State or eligible Indian Tribe shall submit to the Secretary an application that shall contain—</text><subparagraph id="HAC32D173C1734CAE9E806A142CDCCA4C"><enum>(A)</enum><text>a description of performance measures to be used to evaluate the State or Tribal soil health and wildlife habitat program and the expected results of any activities carried out using grant funds received under this section; and</text></subparagraph><subparagraph id="H4BCE6202713D4B76A369CCAAED6CA194"><enum>(B)</enum><text>an assurance that grant funds received under this section will supplement the expenditure of State or Tribal funds in support of soil health and wildlife habitat, rather than replace such funds.</text></subparagraph></paragraph><paragraph id="H4784AC7FA3744B05B63D1C825C102140"><enum>(2)</enum><header>Tribal option</header><text>An Indian Tribe shall have the option, at the sole discretion of the Indian Tribe, to be incorporated into the application of an eligible State.</text></paragraph></subsection><subsection id="HFCD6375AC71A434FBE739F7AFC52C2E5"><enum>(d)</enum><header>Grants</header><paragraph id="H5DCD9091D60344B4A2524098781A954F"><enum>(1)</enum><header>Amount</header><text>The amount of a grant to an eligible State or eligible Indian Tribe under this section for a fiscal year may not exceed $10,000,000.</text></paragraph><paragraph id="H1B5B84EF718E4B848511F64DF6F72004"><enum>(2)</enum><header>Term</header><text>A grant under this section shall be for 5 years, and may be renewed.</text></paragraph><paragraph id="id03cfef70112e4f8d9ddc2429f0eaa487"><enum>(3)</enum><header>Matching funds</header><subparagraph id="id8cc2a78fc2bc4c1a8bc6bace1f2c88ee"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), to be eligible to receive a grant under this section, a State shall provide matching funds in the form of cash or an in-kind contribution in an amount equal to the amount of Federal funds provided.</text></subparagraph><subparagraph id="idb4247abbc0a247d5bf4da96d694a84a1"><enum>(B)</enum><header>Exception</header><text>If a State is unable to provide matching funds under subparagraph (A) sufficient to receive the full amount for which the State is otherwise eligible, the Secretary shall provide the State a proportional amount of Federal funds equal to the amount of matching funds the State commits to provide.</text></subparagraph></paragraph></subsection><subsection id="HB27347FA9CDA452AADE4C1B388DFB6FF"><enum>(e)</enum><header>Audits and reviews</header><text>An eligible State or eligible Indian Tribe receiving a grant under this section shall submit to the Secretary, for each year for which the State or Indian Tribe receives such a grant, the results of an audit of the expenditures of the grant funds.</text></subsection><subsection id="H3F670885DA994F38AB02023A43518AEC"><enum>(f)</enum><header>Effect of noncompliance</header><text>If the Secretary, after reasonable notice to an eligible State or eligible Indian Tribe receiving a grant under this section, finds that the State or Indian Tribe has failed to comply with the terms of the grant, the Secretary may disqualify, for 1 or more years, the State or Indian Tribe from receipt of future grants under this section.</text></subsection><subsection id="H034D8F4321254684BB1E10B28DF63DEC" commented="no"><enum>(g)</enum><header>Funding</header><text>Of the funds of the Commodity Credit Corporation, the Secretary shall use to carry out this section $50,000,000 for each of fiscal years 2027 through 2031.</text></subsection><subsection id="H95635F8E74924688809F9654C3088C58"><enum>(h)</enum><header>Administration</header><paragraph id="HD0A28F4471FB4F0DBE405F8842C56124"><enum>(1)</enum><header>Department</header><text>The Secretary may not use more than 3 percent of the funds made available to carry out this section for a fiscal year for administrative expenses.</text></paragraph><paragraph id="H989530D29B1D4C47AEBB98F89ECC100D" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>States or Indian Tribes</header><text>An eligible State or eligible Indian Tribe receiving a grant under this section may not use more than 7 percent of the granted funds for a fiscal year for administrative expenses.</text></paragraph><paragraph id="id3a827e565626428db8ad4eb37211c745"><enum>(3)</enum><header>Deadline</header><text>The Secretary shall award the grants under this section not later than 180 days after the date of enactment of this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfc8bf3429d42480aac34afff7613af4b"><enum>(4)</enum><header>No conditions</header><text display-inline="yes-display-inline">A grant awarded under this section shall not—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida297d65681e14ae8a7235dd6e23ae068"><enum>(A)</enum><text display-inline="yes-display-inline">be conditioned on any requirement, guideline, technical standard, or administrative directive of the Department of Agriculture; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41b33266a66149ebbbef00e475edd84c"><enum>(B)</enum><text display-inline="yes-display-inline">direct or require modification of any soil health and wildlife habitat program established, funded, or administered by a State or local government.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
