<congress display="yes">119th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 4850</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To amend title 28, United States Code, to adjust thresholds relating to jurisdiction for inflation.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section id="S1" section-type="section-one" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Diversity Jurisdiction Inflation Adjustment Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idff77726c9415455e921c74912078ba90" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Inflation adjustments</header><text display-inline="no-display-inline">Section 1332 of title 28, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id38a54fffaf14496082febe40ed2f00f8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>of $75,000</quote> and inserting <quote>described in subsection (b)</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id39ec7b04b3d64e3993e5a81af8e8c7b1"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddab5188efd7e41f898291140108edbaa"><subsection id="id17236870bebe4fcb9b66e209e54aa644" commented="no" display-inline="no-display-inline"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="ideb196739f3fb4e3d8858e329dd611f19"><enum>(1)</enum><text display-inline="yes-display-inline">The matter in controversy described in this subsection is not less than $150,000, as adjusted under paragraph (2), exclusive of interest and costs.</text></paragraph><paragraph indent="up1" commented="no" display-inline="no-display-inline" id="idf45bb1c362fa4575b222006cba57ee52"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9cb0c0dfd03e484aa04b39d30ac68323"><enum>(A)</enum><text display-inline="yes-display-inline">In this paragraph—</text><clause indent="up1" commented="no" display-inline="no-display-inline" id="id4399d1e778c64e32884f4210c227f771"><enum>(i)</enum><text display-inline="yes-display-inline">the term <term>appropriate year</term> means the calendar year preceding the calendar year in which the adjustment under paragraph (1) is to take effect; and</text></clause><clause indent="up1" commented="no" display-inline="no-display-inline" id="idc58bd3ecbf6f41a997d470ef68e22c53"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>Consumer Price Index</term> means the Consumer Price Index for All Urban Consumers published by the Department of Labor.</text></clause></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id67984826e7eb4556b1e6086295156405"><enum>(B)</enum><text display-inline="yes-display-inline">Effective on January 1, 2030, and January 1 of each tenth year thereafter, the dollar amount then in effect as the minimum amount in controversy applicable under paragraph (1) shall be adjusted by an amount, rounded to the nearest $25,000 (or, if midway between multiples, to the next higher multiple of $25,000) which reflects the change in the Consumer Price Index for the month of September of the appropriate year, over the Consumer Price Index for—</text><clause commented="no" display-inline="no-display-inline" id="id6834b131c2724181836004582925e7cc"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of the initial adjustment, the month of September 2025; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7f5c464a493d4239ae8441ea232bbe15"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of each subsequent adjustment, September of the year preceding the last adjustment.</text></clause></subparagraph><subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="id28bba16094984cb589a882690d4be870"><enum>(C)</enum><text display-inline="yes-display-inline">The Director of the Administrative Office of the United States Courts shall determine the amount of each adjustment under paragraph (1) and, not later than November 15 of the appropriate year, shall submit for publication in the Federal Register the amount (and the percentage change in the Consumer Price Index that is the basis for the amount) and the new minimum amount in controversy to take effect on January 1 of the succeeding calendar year.</text></subparagraph></paragraph><paragraph indent="up1" commented="no" display-inline="no-display-inline" id="ideba7dc876973458b8e7f20db73ddf9ac"><enum>(3)</enum><text display-inline="yes-display-inline">Except when express provision therefor is otherwise made in a statute of the United States, where the plaintiff who files the case originally in the Federal courts is finally adjudged to be entitled to recover less than the sum or value required under paragraph (1) without regard to any setoff or counterclaim to which the defendant may be adjudged to be entitled, and exclusive of interest and costs, the district court may deny costs to the plaintiff and, in addition, may impose costs on the plaintiff.</text></paragraph></subsection><after-quoted-block display="yes">.</after-quoted-block></quoted-block></paragraph></section></legis-body><attestation><attestation-group><attestation-date date="20260807" chamber="Senate">Passed the Senate August 7, 2026.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
