<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>1st Session</session><legis-num>S. 484</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20250206" legis-day="20250205">February 6 (legislative day, February 5), 2025</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S399">Mr. Hawley</cosponsor>, <cosponsor name-id="S373">Mr. Cassidy</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, and <cosponsor name-id="S417">Mr. Budd</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Protection of Lawful Commerce in Arms Act to provide for the removal and dismissal of qualified civil liability actions. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC90A0BF3C91F4796B48E9563274FE345"><section section-type="section-one" id="H5CEC050CB90C49D48F3F4923509612AA"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protection of Lawful Commerce in Arms Act Federal Jurisdiction Act</short-title></quote> or the <quote><short-title>PLCAA Federal Jurisdiction Act</short-title></quote>. </text></section><section id="H08AB416F47424302A6D488A96B23BBCF"><enum>2.</enum><header>Removal and dismissal of qualified civil liability actions</header><text display-inline="no-display-inline">Section 3 of the Protection of Lawful Commerce in Arms Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7902">15 U.S.C. 7902</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H9E3A267014DF4C97A2BE864C8FCF2898"><subsection id="H10363DDE1C14428489C38AE9E2402668"><enum>(c)</enum><header>Removal and dismissal</header><paragraph commented="no" display-inline="no-display-inline" id="id57d3ee1da18d400398c7856df07f7ae3"><enum>(1)</enum><header display-inline="yes-display-inline">Removal</header><text display-inline="yes-display-inline">In any civil action in a State court in which a defendant that is a manufacturer, seller, or trade association asserts that the civil action is a qualified civil liability action, that defendant may remove the civil action to the district court of the United States for the district and division embracing the place where the civil action is pending.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8149c68f2e3c43ea90a4dec578c9886c"><enum>(2)</enum><header>Dismissal</header><text display-inline="yes-display-inline">The district court of the United States to which a civil action is removed under paragraph (1) may—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9538d88a9da04876aff3f6d920d85174"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether the civil action is a qualified civil liability action; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12270e84393b4b8999104d27c553d95f"><enum>(B)</enum><text display-inline="yes-display-inline">dismiss the civil action accordingly.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
