<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4842</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260618">June 18, 2026</action-date><action-desc><sponsor name-id="S427">Mr. Schiff</sponsor> (for himself, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>, and <cosponsor name-id="S437">Mr. Justice</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Agricultural Marketing Act of 1946 to permanently authorize the Resilient Food Systems Infrastructure Program, to establish regional food systems hubs, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="id165db2a9db0148c7b6bfa037acf5e09b" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Food Supply Chain Resiliency Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id2298f2a2288e4daf8137afacc55deab4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="id55d5c0d70132489f97076890749a135c"><enum>(1)</enum><text display-inline="yes-display-inline">a secure domestic food supply is a national security imperative for the United States;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id112ab6def7bb461388a265700a747a03"><enum>(2)</enum><text display-inline="yes-display-inline">a resilient food supply chain in the United States is necessary for the production of an abundant, affordable supply of highly nutritious specialty crops, dairy, grains for human consumption, meat and poultry, aquaculture, and other food products, which are vital to the health and well-being of all people in the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3aebf98b43264715ad55138bd1242b2e"><enum>(3)</enum><text display-inline="yes-display-inline">expanded capacity for the aggregation, processing, manufacturing, storing, transporting, wholesaling, and distribution of locally and regionally produced food products, including specialty crops, dairy, grains for human consumption, meat and poultry, aquaculture, and other food products, is needed to increase domestic supply chain resiliency and expand local, regional, and national market opportunities for producers.</text></paragraph></section><section id="id0ec1f5f0f33e449abceabd527da65153"><enum>3.</enum><header>Resilient food systems infrastructure program</header><text display-inline="no-display-inline">Subtitle A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2b35e5818149469996ed25f0935b37dd"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idbbf0dcf1d1a04d5784fadcba74354495"><enum>210B.</enum><header>Resilient food systems infrastructure program</header><subsection commented="no" display-inline="no-display-inline" id="id7b19e89ee0f64f43ad5a9ca280dc475b"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id7043feb38005416d94c8bdbf6a4f6f12"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="idf1323b2e3e18449298d03b37ff70a389"> <enum>(A)</enum> <text>a local government entity that carries out middle-of-the-supply-chain activities;</text>
              </subparagraph><subparagraph id="id79cfd6af27354d949d18c86c7d511769">
                <enum>(B)</enum>
 <text>a Tribal government that carries out middle-of-the-supply-chain activities;</text>
 </subparagraph><subparagraph id="id92c1579d39754314b8218955f5a3ade7"><enum>(C)</enum><text>an agricultural producer or processor, or group of agricultural producers or processors;</text></subparagraph><subparagraph id="ideb536cfebf7f4e409eca9579ee8e8557"> <enum>(D)</enum> <text>a nonprofit organization that carries out middle-of-the-supply-chain activities;</text>
 </subparagraph><subparagraph id="id9fab27fa9cc24d2e81db8f455ef59d21"><enum>(E)</enum><text>a for-profit entity—</text><clause commented="no" display-inline="no-display-inline" id="idf4d7f6bbb033430ca3b951592be51b71"> <enum>(i)</enum> <text display-inline="yes-display-inline">that carries out middle-of-the-supply-chain activities;</text>
 </clause><clause commented="no" display-inline="no-display-inline" id="id4e59725aed994fd1bc69152f0f71f2e5"><enum>(ii)</enum><text>that is a small business concern (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id14448619fe9a43778294c8136b167019"><enum>(iii)</enum><text display-inline="yes-display-inline">the activities of which primarily benefit local and regional producers; and</text></clause></subparagraph><subparagraph id="id3f0269f4b6a94da2978f8bdce8120495" commented="no"> <enum>(F)</enum> <text>an institution, such as an institution of higher education or hospital, in a partnership with agricultural producers to establish cooperative or shared infrastructure, or to invest in equipment, that will benefit middle-of-the-supply-chain activities of multiple producers.</text>
 </subparagraph></paragraph><paragraph id="idb49f468202b041d9924dcebddf2bb043"><enum>(2)</enum><header>Infrastructure grant</header><text>The term <term>infrastructure grant</term> means a grant made by a State under subsection (e).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd56de6d7ada34267b25b6383cb01ace5"><enum>(3)</enum><header>Middle-of-the-supply-chain activity</header><text>The term <term>middle-of-the-supply-chain activity</term> means aggregation, processing, manufacturing, storing, transporting, wholesaling, or distribution of a targeted agricultural product.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7a03f32793d94c50a4f2146f1d5bfebd"><enum>(4)</enum><header>Program</header><text>The term <term>program</term> means the resilient food systems infrastructure program established under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided6e39c2bea5440faaf77680ec87ce34"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Administrator of the Agricultural Marketing Service.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb0a224c4a68c417db318b09ce0f6e697"><enum>(6)</enum><header>Specialty crop</header><text display-inline="yes-display-inline">The term <term>specialty crop</term> has the meaning given the term in section 3 of the Specialty Crops Competitiveness Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/465">Public Law 108–465</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide183032c5dda43a2a252c666a35f7ffa"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida651b003e3d44024a46b5df0ea4e5819"><enum>(A)</enum><text display-inline="yes-display-inline">American Samoa;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7076047a441d4a3fbf6122bda2873633"><enum>(B)</enum><text display-inline="yes-display-inline">the Commonwealth of the Northern Mariana Islands; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc2757d1433cb4b698032a59869055ce7"><enum>(C)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id578af45249314b83be3075a54e3c9df7"><enum>(8)</enum><header>Targeted agricultural product</header><subparagraph commented="no" display-inline="no-display-inline" id="idbe026d0af16b47259c317f4941a7f05e"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>targeted agricultural product</term> means—</text><clause commented="no" display-inline="no-display-inline" id="idf6d5c062f1e742cabf02593e20e9f538"><enum>(i)</enum><text display-inline="yes-display-inline">a specialty crop;</text></clause><clause commented="no" display-inline="no-display-inline" id="id30d963b7dda945019094a85c2d543673"><enum>(ii)</enum><text>dairy;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd5996b8db192434596b4a838ca11db29"><enum>(iii)</enum><text>grain;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6cd1624fa4cb4619bf78862ea1f1213d"><enum>(iv)</enum><text>meat;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4417da536c724dc38ba6e712bccae85d"><enum>(v)</enum><text>poultry; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id946c5ff4372f437e95b62369c38a8fcb"><enum>(vi)</enum><text>an aquacultural product.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id01e3066ef3f8498fa14d7f0c9f26e454"><enum>(B)</enum><header>Exclusions</header><text>The term <term>targeted agricultural product</term> does not include—</text><clause commented="no" display-inline="no-display-inline" id="idfa7dd547e7984ed29cd0d128d3c84a85"><enum>(i)</enum><text display-inline="yes-display-inline">animal feed;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf5f5273c3b044915b2abc9507764b762"><enum>(ii)</enum><text>fuel;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf6ace5e45b1842539af0e06376a4d8ed"><enum>(iii)</enum><text>cotton;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2fdc808cebf2446f916afa4db5755f6c"><enum>(iv)</enum><text>fiber; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idf61c1bbaec444b4794074295c7d2b005"><enum>(v)</enum><text>any other product not intended for human consumption.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id636bdced041744c786636e9d6eb6efbb"><enum>(9)</enum><header>Underserved producer</header><text>The term <term>underserved producer</term> means—</text><subparagraph id="id2898f9b6be6f488780c9a2c693066828" commented="no"><enum>(A)</enum><text>a beginning farmer or rancher (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>));</text></subparagraph><subparagraph id="id1139248d8cfa4c1682c9c865ed1253fd" commented="no"><enum>(B)</enum><text>a veteran farmer or rancher (as defined in that section); and</text></subparagraph><subparagraph id="id7f69395e6ebc4ae1a398d8e631445514" commented="no"><enum>(C)</enum><text>a socially disadvantaged farmer or rancher (as defined in that section).</text></subparagraph></paragraph></subsection><subsection id="id3a3afec42595401d881dc35dda77c9f1"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a program, to be known as the <quote>resilient food systems infrastructure program</quote>, under which the Secretary shall seek to enter into cooperative agreements with States—</text><paragraph commented="no" display-inline="no-display-inline" id="id729db51167ec4a5799a2eb87a5adc782"><enum>(1)</enum><text display-inline="yes-display-inline">to build resilience in the middle of the supply chain; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6a6528527e7c4a679ea00302939a709f"><enum>(2)</enum><text display-inline="yes-display-inline">to strengthen local and regional food systems by creating new revenue streams for producers in those States.</text></paragraph></subsection><subsection id="id7fe52d01f9d849118df276ee596d9b12"><enum>(c)</enum><header>Application</header><paragraph commented="no" display-inline="no-display-inline" id="id740fc8c980104463b8b9f76c8f8fc034"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A State seeking to enter into a cooperative agreement under the program shall submit an application at such time, in such manner, and containing such information as the Secretary may require, including a State plan described in paragraph (2).</text></paragraph><paragraph id="idc23cd1a17dd244b4b767fb31129a67a5"><enum>(2)</enum><header>State plan</header><text>A State plan submitted as part of an application under paragraph (1) shall include—</text><subparagraph id="id8d7daeccb9de4c6aa409cc05269d0e2f"><enum>(A)</enum><text>the anticipated priorities and needs of the State in carrying out the cooperative agreement;</text></subparagraph><subparagraph id="id9e0c5a3bccd84689a0819c8a0968383e"><enum>(B)</enum><text>a plan for awarding infrastructure grants, including—</text><clause commented="no" display-inline="no-display-inline" id="id54d4016c1139497e85b6460676b44d04"><enum>(i)</enum><text display-inline="yes-display-inline">how the State will ensure that the purpose and priorities of the program are fulfilled; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7bd47453551d4614be62d0e8bd3c50ed"><enum>(ii)</enum><text>how the State will ensure the prioritization described in subsection (e)(2);</text></clause></subparagraph><subparagraph id="id5ab5c5b6d9044324a065902124f12f0e"><enum>(C)</enum><text>whether and in what manner the State will use funds for supply chain coordination under subsection (f)(1);</text></subparagraph><subparagraph id="id4e83f4de67954c2c9d7ae9d31603370b"><enum>(D)</enum><text>a plan for conducting outreach required under subsection (g); and</text></subparagraph><subparagraph id="id01aa1502785a4c8ea2e8bf0e4e25ca3d"><enum>(E)</enum><text>metrics that will be tracked by the State in carrying out the cooperative agreement.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0d9a634dae654a7a872e6ee0630c0f73"><enum>(d)</enum><header>Cooperative agreement amounts</header><paragraph commented="no" display-inline="no-display-inline" id="idde7595ab676b4fcbb462311340bbe448"><enum>(1)</enum><header display-inline="yes-display-inline">Value basis</header><text display-inline="yes-display-inline">Subject to paragraph (2), the amount that a State shall receive under a cooperative agreement under the program for a fiscal year shall bear the same ratio to the total amount made available under subsection (j)(1) for that fiscal year as the ratio that the average of the most recent available value of the combined targeted agricultural product production in the State bears to the average of the most recent available value of the combined targeted agricultural product production in all States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1880c4ed1b04132b900d9b441946ed1"><enum>(2)</enum><header>Minimum amount</header><text display-inline="yes-display-inline">A cooperative agreement under the program shall provide not less than $1,000,000 to a State in a fiscal year.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id752dcd7126824a03b57b60a3d3f2602e"><enum>(e)</enum><header>Infrastructure grants</header><paragraph commented="no" display-inline="no-display-inline" id="idca32bf7dddd2439d9bf980ed54e78a66"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A State entering into a cooperative agreement under the program shall award, on a competitive basis, grants to eligible entities for the purposes of—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1f1306a473194f0fba295eac1f2650d9"> <enum>(A)</enum> <text display-inline="yes-display-inline">expanding middle-of-the-supply-chain capacity for locally or regionally produced targeted agricultural products;</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc2bcd53f2ad04de894dd313fd7bed4f7"><enum>(B)</enum><text display-inline="yes-display-inline">offering more and better market opportunities and new streams of revenue to small and mid-sized producers of locally or regionally produced targeted agricultural products; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id60f481b00fff45dba9a45d6dcb7e353d"> <enum>(C)</enum> <text display-inline="yes-display-inline">expanding capacity and infrastructure for middle-of-the-supply-chain activities.</text>
 </subparagraph></paragraph><paragraph id="id1ab02935ecc041bcb7901b0a14c19d3a" commented="no"><enum>(2)</enum><header>Priority</header><text>In awarding infrastructure grants under the program, a State shall give priority to projects that will benefit—</text><subparagraph id="id1d750c715e1b48efa8545a65e4789812" commented="no"><enum>(A)</enum><text>underserved producers;</text></subparagraph><subparagraph id="id928ec294e29c4e619ea0ffd49708b258" commented="no"> <enum>(B)</enum> <text>processors and other middle-of-the-supply-chain businesses owned by socially disadvantaged individuals (as defined in section 8 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637</external-xref>)); and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6b338a674bf2486aaf47e41629776491"><enum>(C)</enum><text display-inline="yes-display-inline">institutions described in subsection (a)(1)(F);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id09006fd815974c659b2c6c99e8909774"><enum>(D)</enum><text display-inline="yes-display-inline">retail markets; and</text></subparagraph><subparagraph id="id06d0d8094f6c453699eb7e8f2ffd8b8e" commented="no"><enum>(E)</enum><text>intermediaries in the food supply chain, such as food hubs, aggregators, wholesalers, and distributors.</text></subparagraph></paragraph><paragraph id="idc6820d89578f4302a4a84210dc162250"><enum>(3)</enum><header>Grant amount</header><text>The amount of an infrastructure grant shall be not less than $100,000 and not more than $3,000,000.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd7655799f2304e33b2b2f579a0ea3c2a"><enum>(4)</enum><header>Eligible uses</header><text display-inline="yes-display-inline">An eligible entity may use an infrastructure grant—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida65e6e5ddf51457ea665c400b53b6d3e"><enum>(A)</enum><text display-inline="yes-display-inline">to expand capacity for processing, aggregation, and distribution of targeted agricultural products to create improved local and regional markets for targeted agricultural products;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52cbdaa09de44b51b4034a70fd0b4a7d"><enum>(B)</enum><text display-inline="yes-display-inline">to modernize manufacturing, tracking, storage, and information technology systems;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9fb72dc0aa994c1181d5078d69280161"><enum>(C)</enum><text display-inline="yes-display-inline">to enhance worker safety through adoption of new technologies or investment in equipment or facility improvements;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb88676af74ea41a0b94ad860dfae098b"><enum>(D)</enum><text display-inline="yes-display-inline">to improve the capacity of the eligible entity to comply with Federal, State, and local food safety requirements;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1411b17ae7fd4a53aed626093ee347cf"><enum>(E)</enum><text display-inline="yes-display-inline">to improve operations through training opportunities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcf609572b5e247609b9798a37bb6c5f3"><enum>(F)</enum><text display-inline="yes-display-inline">to support construction of a new facility;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6e188c2f399547b5acba2f22f7f1edd8"><enum>(G)</enum><text display-inline="yes-display-inline">to modernize or expand an existing facility, including expansion and modifications to existing buildings and construction of new buildings at existing facilities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc23f0ddbf0e54718acb4e22d30fb55d6"><enum>(H)</enum><text display-inline="yes-display-inline">to construct wastewater management structures;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfb582cf7e0654a79b78167284e9bef87"><enum>(I)</enum><text display-inline="yes-display-inline">to modernize processing and manufacturing equipment;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc54b8f0ee9a74bf490615059a147395c"><enum>(J)</enum><text>to develop, customize, or install equipment that improves energy efficiency, increases efficiency in water use, and improves air or water quality; and</text></subparagraph><subparagraph id="iddcec6076ffcd409681818cd5cc7c8acd"><enum>(K)</enum><text>for such other purposes as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="ida3ea114dfada4eb2a897a7e65ddc751f" commented="no"><enum>(5)</enum><header>Simplified equipment-only projects</header><subparagraph commented="no" display-inline="no-display-inline" id="id47964715d99b44dea314fa5a074413be"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A State may award small infrastructure grants—</text><clause commented="no" display-inline="no-display-inline" id="id8311b8e1cccc4d6198841249788563b8"><enum>(i)</enum><text display-inline="yes-display-inline">in an amount that is not less than $10,000 and not more than $100,000; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id616fb538dd83484eb54f27fa9f852e94"><enum>(ii)</enum><text display-inline="yes-display-inline">that are to be used solely for purchasing equipment.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4b1a6ed09a7d4c2586c39a052daff60b"><enum>(B)</enum><header>Simplified application</header><text display-inline="yes-display-inline">The Secretary shall establish a simplified application for small infrastructure grants awarded under subparagraph (A).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id962d2142ec844a9a9bc30e70afa2d662"><enum>(6)</enum><header>Domestic requirement</header><text>An eligible entity shall not use an infrastructure grant for any facility or equipment that is not located in or will not be used in any State.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id27ad54e31de14ffc80987fdc5425c05a"><enum>(f)</enum><header>Other uses of cooperative agreement funds</header><paragraph id="idcfdd43b0f43740d18c6960c0379be7c2"><enum>(1)</enum><header>Supply chain coordination</header><text>Of the amount that a State receives under a cooperative agreement under the program for a fiscal year, the State may use not more than the lesser of 20 percent and $1,000,000 for activities to develop or enhance supply chain coordination in a manner that focuses on business support and market development to benefit local and regional food systems and contributes to the success and impact of the infrastructure grants awarded by the State.</text></paragraph><paragraph id="idc18c59d9b6974d57b7cdb9f4b491f437"><enum>(2)</enum><header>Coordination and technical assistance</header><text>A State may coordinate with a regional food systems hub established under section 210C(b) to complement any technical assistance.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd86cb625b02a44f2ab146f03c4cc7bdd"><enum>(3)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">Of the amount that a State receives under a cooperative agreement under the program for a fiscal year, not more than 8 percent may be used for administrative costs.</text></paragraph></subsection><subsection id="id72118251a7234bd7b94b3cc0c3e60968"><enum>(g)</enum><header>Outreach</header><text>A State that enters into a cooperative agreement under the program shall conduct outreach to interested parties, including underserved producers, farm and food businesses in supply chains for locally and regionally produced targeted agricultural products, and regional communities—</text><paragraph commented="no" display-inline="no-display-inline" id="idb0e54cf37f1b40dfb1028a6f362ed183"><enum>(1)</enum><text display-inline="yes-display-inline">prior to opening submission for applications for infrastructure grants; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46c81801e08d43ffb6683d377ff6aecb"><enum>(2)</enum><text display-inline="yes-display-inline">through a transparent process of receiving and considering public comment to identify State funding priorities.</text></paragraph></subsection><subsection id="idc3763ee5861e47cb87b2de56f9786271"><enum>(h)</enum><header>Audit</header><text>Each State that enters into a cooperative agreement under the program shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idabf0d17ac60b42dbade80f11523dd2ee"><enum>(1)</enum><text display-inline="yes-display-inline">conduct an audit of the expenditures under that cooperative agreement for each fiscal year; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id78b79bff3a6640c9adec32edd9c8d326"><enum>(2)</enum><text display-inline="yes-display-inline">submit the audit to the Secretary not later than 30 days after the completion of the audit.</text></paragraph></subsection><subsection id="ida4c4ba10b88f4ccb9f751e83e6f542f3"><enum>(i)</enum><header>Performance measures and evaluation</header><paragraph id="id028875a553cc4b2eae2cce80ec8d7158"><enum>(1)</enum><header>Development</header><text>The Secretary, in consultation with State departments of agriculture and stakeholders, shall develop performance measures to be used as the sole measures for evaluating the program.</text></paragraph><paragraph id="id6f08c80fe9284688ae5daaef2714bd27"><enum>(2)</enum><header>Evaluation</header><text>The Secretary, in consultation with State departments of agriculture, shall periodically evaluate the performance of the program.</text></paragraph><paragraph id="idadaeaab1489b486eaedaa21a12aa9041"><enum>(3)</enum><header>Cooperative agreements</header><text>The Secretary may enter into cooperative agreements—</text><subparagraph id="id213d42bd124c4996bf0d9f77f241a29c"><enum>(A)</enum><text>to develop the performance measures under paragraph (1); or</text></subparagraph><subparagraph id="id9b7fabb7d01943fd8f0db7f57530f45a"><enum>(B)</enum><text>to conduct the evaluation under paragraph (2).</text></subparagraph></paragraph></subsection><subsection id="id88449781921c4d07b4ed6000b2737023"><enum>(j)</enum><header>Funding</header><paragraph id="id3904d5738bde4976b9145553b94d2d6d"><enum>(1)</enum><header>Authorization of appropriations</header><text>In addition to any other funds made available to carry out this section, there is authorized to be appropriated to the Secretary to carry out this section $200,000,000 for each of fiscal years 2027 through 2031, to remain available until expended.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id67acbe7cc5bf4e4d8edbc345dda706b1"><enum>(2)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">Of the funds made available to carry out this section for a fiscal year, the Secretary shall use not more than 3 percent for administrative expenses.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id45a7188dece8485499ad7596a67bb3ca"><enum>4.</enum><header>Regional food systems hubs</header><text display-inline="no-display-inline">Subtitle A of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) (as amended by section 3) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id24332374aa6147c99c9d9b1627e7bb18"><section id="id16b64506d38f4012aed7024a52170ea7"><enum>210C.</enum><header>Regional food systems hubs</header><subsection commented="no" display-inline="no-display-inline" id="id36f20c2d888f49299b3897a83a7b8e28"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id5d8b266a62b84544a4640872afd5a8c1"><enum>(1)</enum><header>Beneficiary</header><text>The term <quote>beneficiary</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida377ea6e47d74743b5bea2a897c4d4ec"><enum>(A)</enum><text display-inline="yes-display-inline">a farm, including a small and medium-sized farm;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7959c6dde1ee4c0caf7680be2109ba7a"><enum>(B)</enum><text>an agribusiness; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8ecbd536b8774c9bb1c75408c3a5e1bd"><enum>(C)</enum><text>a food business.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94352d13a4534627ab4c4b49c9d9f86a"><enum>(2)</enum><header>Eligible entity</header><text>The term <quote>eligible entity</quote> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0859b76b4b9c45ca872300a6f9930d7b"><enum>(A)</enum><text display-inline="yes-display-inline">a nonprofit organization;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9a91a65a476a4abbaea097eb75f9ee25"><enum>(B)</enum><text>an institution of higher education; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd3cb3c5ecd484251a704259c63bfd315"><enum>(C)</enum><text>a Tribal organization.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f63156b4c98403083448f10b4b442e5"><enum>(3)</enum><header>Hub</header><text>The term <quote>Hub</quote> means a food systems hub established under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id22f93593b888464b9ba66c93ab6abf84"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture, acting through the Administrator of the Agricultural Marketing Service.</text></paragraph></subsection><subsection id="id68fb40b361d24d83b55831dea00966e8"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall enter into cooperative agreements with eligible entities, on a competitive basis, to establish—</text><paragraph commented="no" display-inline="no-display-inline" id="id1c5476fd53a14e60b3a02f57dddfaa75"><enum>(1)</enum><text display-inline="yes-display-inline">not fewer than 10 regional food systems hubs, which shall collectively geographically cover all States, territories, and possessions of the United States; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d94c874d67a4185b4269b71b27ac1e3"><enum>(2)</enum><text display-inline="yes-display-inline">1 intertribal food systems hub to provide assistance exclusively to Tribal producers and businesses nationally.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5e77f3c0c1d84346b558f56756dc4744"><enum>(c)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of a Hub is to provide localized assistance and market creation to beneficiaries to improve—</text><paragraph commented="no" display-inline="no-display-inline" id="idc9ca454329a346d2bc28e1a37b32341e"><enum>(1)</enum><text display-inline="yes-display-inline">local and regional food supply chains and markets, including aggregation, distribution, and processing needs; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide84c444f39a84696b2e154e95c129a91"><enum>(2)</enum><text display-inline="yes-display-inline">local and regional food system economic development.</text></paragraph></subsection><subsection id="id2a7489b1554d4fda939e5eb77ada9d74"><enum>(d)</enum><header>Activities</header><paragraph commented="no" display-inline="no-display-inline" id="id71996758c0684826809adeb99aae9813"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A Hub shall—</text><subparagraph id="id26b42ff602c441cdab748bc541979eed"><enum>(A)</enum><text>integrate the assistance and resources of the Department of Agriculture and other Federal agencies available to support beneficiaries;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6cd95d5931634601bd0622667b2c6a6d"><enum>(B)</enum><text>provide direct business technical assistance to beneficiaries, including financial coaching, business planning, market development, succession planning, and accessing land and capital;</text></subparagraph><subparagraph id="id79c19cee0b944da4b1632ee22847c7ce"><enum>(C)</enum><text>provide financial assistance to beneficiaries;</text></subparagraph><subparagraph id="id8e588096a8f64f48a5bae1df2a1fa462"><enum>(D)</enum><text>provide technical assistance to beneficiaries to create new, and expand or support existing, procurement opportunities from—</text><clause id="idf6107c31fb6941f3a019cc3395736840"><enum>(i)</enum><text>public agencies, including schools, child and senior centers, emergency food agencies participating in Department of Agriculture food programs, hospitals, correctional facilities, Department of Veterans Affairs hospitals, United States Armed Forces bases, food is medicine programs, and rural healthcare initiatives; and</text></clause><clause id="idceb398ca7f7441f49c9c247fec4a2296"><enum>(ii)</enum><text>grocery retailers, aggregators, distributors, and other private institutions, such as institutions of higher education, prisons, and hospitals; and</text></clause></subparagraph><subparagraph id="iddd2477f7c5e74c21a72fd822d5d5c4d8"><enum>(E)</enum><text>carry out any other activities that facilitate the development of a resilient domestic food system, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id187d81da74334b2c96483c20a30ecefe"><enum>(2)</enum><header>Priorities</header><text>A Hub shall prioritize providing services to—</text><subparagraph id="id351e5148d7e64921a3fa49bdbc55fd5f"><enum>(A)</enum><text>beneficiaries that are owned or operated by, or partner with, underserved producers (as defined in section 210B(a)); and</text></subparagraph><subparagraph id="id8925dc3d5d3242c9ac1a48a75f636cf3"><enum>(B)</enum><text>recipients of assistance under other Department of Agriculture programs, including—</text><clause commented="no" display-inline="no-display-inline" id="id4a8d7301c56c4309bb2ac52dea5d3f0b"><enum>(i)</enum><text display-inline="yes-display-inline">infrastructure grants (as defined in section 210B(a)) under the resilient food systems infrastructure program established under section 210B; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id87f8a780adfe4bb5b57f97e4319e6f70"><enum>(ii)</enum><text display-inline="yes-display-inline">grants awarded directly to producers for the purpose of expanding markets.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf5f6c680c2ca4e8d8f96945081dd0482"><enum>(3)</enum><header>Subawards</header><subparagraph commented="no" display-inline="no-display-inline" id="idf578df65abb543e58c9de879a8b036b7"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity entering into a cooperative agreement under subsection (b) may provide subawards, including to contractors, to carry out the activities of the Hub established pursuant to the cooperative agreement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idef4f6907383c497c8abeef64bf144cdb"><enum>(B)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">An entity receiving a subaward under subparagraph (A) may use not more than 20 percent for administrative costs.</text></subparagraph></paragraph></subsection><subsection id="id14ee97c051bb4cbdbfdc930a7238a59b"><enum>(e)</enum><header>Limitation on administrative costs</header><text display-inline="yes-display-inline">Of the amount that an eligible entity receives under a cooperative agreement under subsection (b) for a fiscal year, not more than 20 percent may be used for administrative costs.</text></subsection><subsection id="id7401e6e62ac14f229ac19bf08f580bec"><enum>(f)</enum><header>Consultation</header><text>In providing assistance, a Hub shall consult with—</text><paragraph commented="no" display-inline="no-display-inline" id="id84ecd6fd5f8a4c659fadcc1e2f597fe8"><enum>(1)</enum><text display-inline="yes-display-inline">the Small Business Administration;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b73e80631724ca18a954491cc2fcca2"><enum>(2)</enum><text display-inline="yes-display-inline">the Department of Commerce;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc6e97b473ef54f20bda1b9f1185c553d"><enum>(3)</enum><text display-inline="yes-display-inline">the Economic Development Administration;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbfa1262243a64a979c9b6f807be5ee8f"><enum>(4)</enum><text display-inline="yes-display-inline">the Farm Credit Administration; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida7d4da751d16401cbf9e1dae705fcf8a"><enum>(5)</enum><text display-inline="yes-display-inline">relevant stakeholders in each State, territory, or other area in which the Hub provides assistance, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida8e2478838a0485da10111a08b53a781"><enum>(A)</enum><text display-inline="yes-display-inline">State departments of agriculture;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id36d2f7eb3db346cd9db42ebf09fadd03"><enum>(B)</enum><text display-inline="yes-display-inline">economic development commissions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbe21b27569ed46b1ae89b43c014852d9"><enum>(C)</enum><text display-inline="yes-display-inline">small business development centers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85dbb11fdc404449995471624bbcd2a4"><enum>(D)</enum><text display-inline="yes-display-inline">private investment entities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb8c9aa6d49f44ca1b8445dc1ac5faca7"><enum>(E)</enum><text display-inline="yes-display-inline">philanthropic entities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2e2ff73de63e4c5aac888d4f8f904314"><enum>(F)</enum><text display-inline="yes-display-inline">other relevant financial entities, such as independent bankers and community development financial institutions.</text></subparagraph></paragraph></subsection><subsection id="idaeb3fb6ddc704029bcbe66accc3bbfef"><enum>(g)</enum><header>Reports</header><text>Each Hub shall submit to the Secretary an annual report describing the activities of the Hub, including—</text><paragraph id="id09aaf495e6f445b4ba820daad966e33e"><enum>(1)</enum><text>as a direct result of the activities of the Hub—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcabd976bed934aa4bfa77a5160b0c0e7"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of increased sales by beneficiaries;</text></subparagraph><subparagraph id="id0615f273313842b98bee2405c0ff4a53"><enum>(B)</enum><text>the number of new markets accessed, including the number of new purchasing agreements with schools, food service companies, independent grocery wholesalers, hospital systems, and other entities;</text></subparagraph><subparagraph id="id0ce9e4bd1c02462eb13cdc2300d0b29b"><enum>(C)</enum><text>the number of new on-farm activities initiated, such as value-added production, agritourism, new crops, or new practices of beneficiaries, as applicable;</text></subparagraph><subparagraph id="id029820ab3d5a44c7bfd641ed274903eb"><enum>(D)</enum><text>the number of new customers of beneficiaries; and</text></subparagraph><subparagraph id="id258df734653c4c0e9903ae2927659d00"><enum>(E)</enum><text>the number of new jobs offered by beneficiaries;</text></subparagraph></paragraph><paragraph id="id5c8dd7ed30ff40fbbb84c06aa80d985b"><enum>(2)</enum><text>the barriers to market participation faced by beneficiaries and potential remedies; and</text></paragraph><paragraph id="id29a37b9c9cea4c8a9d9c28c075252227"><enum>(3)</enum><text>such other matters as the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="id5466731fa709475eb53b2cdcaa6b73c1"><enum>(h)</enum><header>Authorization of appropriations</header><text>In addition to any other funds made available to carry out this section, there is authorized to be appropriated to the Secretary to carry out this section $75,000,000 for each of fiscal years 2027 through 2031, to remain available until expended.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
