<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4838</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260618">June 18, 2026</action-date><action-desc><sponsor name-id="S375">Mr. Daines</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Labor Standards Act of 1938 to exempt certain employees engaged in outdoor recreational outfitting or guiding services from minimum wage and maximum hours requirements.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Outdoor Recreational Outfitting and Guiding Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ida927a84d0c90481292fd9829e3d4ca2f" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Application of the Fair Labor Standards Act of 1938 to certain employees engaged in outdoor recreational outfitting or guiding services</header><text display-inline="no-display-inline">Section 13(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>) is amended by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id009504A46EE447F1947628196F0E0310"><paragraph commented="no" display-inline="no-display-inline" id="ide6667139ac4e40719ee9b9714fef0e92"><enum>(2)</enum><text>any employee primarily engaged in providing outdoor recreational outfitting, including equipment rentals, or guiding services who is employed by an employer primarily engaged in the business of providing such outfitting or guiding services; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
