which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food and Nutrition Act of 2008 to allow for blended workforces to carry out the supplemental nutrition assistance program under certain conditions, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD6D53B3B1B584FCE8B012B95A02C9F96"><section section-type="section-one" id="H1E014147B4654F3593CD0BBBFC994311"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SNAP Staffing Flexibility Act of 2026</short-title></quote>.</text></section><section id="HA331562FA3A04016B4443DFD7AD24C25"><enum>2.</enum><header>SNAP staffing flexibility</header><text display-inline="no-display-inline">Section 11 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H61824E0CBB8348AA8672B2A4FEB1FF12"><subsection id="H2E13E945308E4C09B3F3CD9F3F627D40"><enum>(y)</enum><header>Staffing flexibility</header><paragraph id="HC12C05CEECFC437FB05500AF8443CD2A"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (e)(6)(B), a State agency may, subject to paragraph (2), hire 1 or more contractors, by contract, to undertake the certification described in subsection (e)(6)(A) or carry out any other function of the State agency under the supplemental nutrition assistance program, subject to paragraph (3).</text></paragraph><paragraph id="idf246f0246efe4dc8a15d87acff64be57"><enum>(2)</enum><header>Circumstances for hiring</header><subparagraph commented="no" display-inline="no-display-inline" id="idcbab79088b454c3bae1656ccfb58531a"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A State agency may hire 1 or more contractors under paragraph (1) if the State agency—</text><clause commented="no" display-inline="no-display-inline" id="idf6b27e46243f4bf7affeb0e32680a46b"><enum>(i)</enum><text display-inline="yes-display-inline">experiences an increase in applications to the supplemental nutrition assistance program; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id73d351c24ee04490ba1bad373f6a4b56"><enum>(ii)</enum><text display-inline="yes-display-inline">cannot timely process applications to the supplemental nutrition assistance program, including due to—</text><subclause id="idf76ac6329fd641a495f16587ef163218"><enum>(I)</enum><text>a pandemic or other health emergency;</text></subclause><subclause id="id04c8244d5782492b881c3525633f00bb"><enum>(II)</enum><text>a seasonal workforce cycle;</text></subclause><subclause id="idda08108db49d46df9f64534bc18df6f0"><enum>(III)</enum><text>a temporary staffing shortage; and</text></subclause><subclause id="id2f947e6bd3b04f778700d6b591607d9a"><enum>(IV)</enum><text>weather or other natural disaster.</text></subclause></clause></subparagraph><subparagraph id="id54d1d130dc1145fd97f6a7aa4d28da9f"><enum>(B)</enum><header>Temporary staffing shortage</header><text>In the case of a State agency hiring 1 or more contractors under paragraph (1) due to a temporary staffing shortage under subparagraph (A)(ii)(III), the authority of a State agency to conduct that hiring—</text><clause id="id28b6520d84344eb08c97bf53ce6f3a40"><enum>(i)</enum><text>shall expire when the backlog of applications to the supplemental nutrition assistance program has been eliminated; and</text></clause><clause id="id4ebeb65a1c0b4ef4aa0e34ddabbb7d9d"><enum>(ii)</enum><text>shall not impact any collective bargaining agreement or memorandum of understanding in effect between the State and employees of the State or a local government of the State.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88a34ee7b7ed4d878e177f318d4facc8"><enum>(3)</enum><header>Requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="id9c7395e9558e4e1ca174d4164a1cc53f"><enum>(A)</enum><header display-inline="yes-display-inline">No incentives for delay or denial</header><text>A contract entered into by a State agency under paragraph (1) shall not provide incentives for the State agency or contractor to delay eligibility determinations or deny eligibility for individuals otherwise eligible for benefits under the supplemental nutrition assistance program.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc0ddc26307bb416aa2257808e567de17"><enum>(B)</enum><header>No financial interest</header><text>A State agency may not hire a contractor under paragraph (1) if the contractor has a direct or indirect financial interest in any approved retail store or wholesale food concern in the State.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2fdd8a7488d14efe959fde2c01e19f57"><enum>(4)</enum><header>Administration</header><text>A State agency that hires 1 or more contractors under paragraph (1) shall ensure that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2a994e3aa44b4e998ddc02e9b38ba2ba"><enum>(A)</enum><text display-inline="yes-display-inline">the contracts are for a reasonable cost and in accordance with the standard contracting rules of the State agency;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25e2a02b7d614ac2ab33061823e4b4e2"><enum>(B)</enum><text display-inline="yes-display-inline">hiring is consistent with the principles described in section 900.603 of title 5, Code of Federal Regulations (or a successor regulation); and</text></subparagraph><subparagraph id="id5bc4c6fc335d479994627a7cd3b91eaf"><enum>(C)</enum><text>the contractors—</text><clause commented="no" display-inline="no-display-inline" id="idcbb12e41972a4760ae507ca4a21a5be3"><enum>(i)</enum><text display-inline="yes-display-inline">are part of a blended government workforce; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf2ee9f026d674c33ba18db0ebd11e594"><enum>(ii)</enum><text display-inline="yes-display-inline">do not supplant existing merit-based personnel in the State.</text></clause></subparagraph></paragraph><paragraph id="HEB90F43A60354867AF7C28C6FA19AC9C"><enum>(5)</enum><header>State agency notification</header><subparagraph commented="no" display-inline="no-display-inline" id="idc07dcd3bba7c4d59b04135e4c9069ea5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>A State agency that hires 1 or more contractors under paragraph (1) shall notify the Secretary of such hiring, including providing information or data indicating the applicable circumstance under paragraph (2) for carrying out that hiring.</text></subparagraph><subparagraph id="id6b7129ffbe5c4994b1e86a6d479f60a9"><enum>(B)</enum><header>Publication</header><text>Not later than 10 days after the date of receipt of a notification under subparagraph (A), the Secretary shall make publicly available on the website of the Department of Agriculture the notification and the accompanying information or data.</text></subparagraph></paragraph><paragraph id="H64244151D91E4090A633170224D0A171"><enum>(6)</enum><header>Annual report</header><text>The Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives an annual report that describes—</text><subparagraph id="HC806E34A7EA44362BCE2496ABD0E180D"><enum>(A)</enum><text>the measures taken by State agencies to address increases in applications to the supplemental nutrition assistance program;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8e91b3fcf9e3437081aecf0c28441006"><enum>(B)</enum><text display-inline="yes-display-inline">reasons for the inability of State agencies to timely process those applications, as applicable;</text></subparagraph><subparagraph id="H4B4196CDC15C42FB99C3F0B2A813AA4A"><enum>(C)</enum><text>the information or data submitted with each notification under paragraph (5)(A); and</text></subparagraph><subparagraph id="idd3d6538bec7d4afe858b5ab5757bc346" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">any recommended changes to the authority of the Secretary to assist State and local agencies in preparing for any future increase in applications to the supplemental nutrition assistance program or inability to timely process those applications.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
