which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of State to develop a strategy for supporting free and fair elections in Venezuela, to impose sanctions on individuals who are complicit in gross violations of internationally recognized human rights in Venezuela, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Venezuela Democratic Transition Act</short-title></quote>.</text></section><section id="idb4a39bb978e94095897e191e1041b1ed" section-type="subsequent-section"><enum>2.</enum><header>Findings; sense of Congress</header><subsection commented="no" display-inline="no-display-inline" id="id93f61992299a4e52a81e3c961d554cdc"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text><paragraph commented="no" display-inline="no-display-inline" id="id33509c5db8fb44d08d3db137779b04f6"><enum>(1)</enum><text display-inline="yes-display-inline">the Venezuelan parliamentary election held on December 6, 2020, and the Venezuelan parliamentary election held on May 25, 2025, were fraudulent and widely condemned;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0aee5a1d83c24f51b1cee0bfebb5746c"><enum>(2)</enum><text display-inline="yes-display-inline">the Venezuelan presidential election held on July 28, 2024, violated Venezuelan law and international standards;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9ce048f4704844bfb0e96f6e476b7509"><enum>(3)</enum><text display-inline="yes-display-inline">the Venezuelan regime led by Nicolás Maduro falsely claimed victory in the 2024 presidential election and intensified violent repression against the leaders and supporters of the opposition presidential candidate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd93a5f1066f8456481f17abe8f92df59"><enum>(4)</enum><text display-inline="yes-display-inline">Nicolás Maduro lost the 2024 presidential election and his regime lacks legitimacy to represent the Venezuelan people.</text></paragraph></subsection><subsection id="ide345eac31c3e428eaed71f5ba8d5a0cc"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the United States should—</text><paragraph commented="no" display-inline="no-display-inline" id="idbcb7663d059341589e60fa645feff097"><enum>(1)</enum><text display-inline="yes-display-inline">continue to recognize Edmundo González Urrutia as Venezuela’s legitimate President-elect;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idff8a2325cd5b4d998d2171d8908ffb3d"><enum>(2)</enum><text display-inline="yes-display-inline">support the democratic opposition;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1aa345752008467591d00692890c6e91"><enum>(3)</enum><text display-inline="yes-display-inline">facilitate free and fair presidential elections in 2026 with full opposition participation; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd9ce2b533f534dde94920f1d10de8b19"><enum>(4)</enum><text display-inline="yes-display-inline">ensure that any energy agreements with Venezuela are made only in consultation with the democratic opposition movement.</text></paragraph></subsection></section><section id="id3cb2e49af46a44dc91f6bb16040d4dc0"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id63a528d152474edeaf0773984806d425"><enum>(1)</enum><header>Admission; admitted; alien</header><text>The terms <term>admission</term>, <term>admitted</term>, and <term>alien</term> have the meanings given such terms in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc7f70197c6b04719b9128305fe1bb8b3"><enum>(2)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6162f73d238d427bb19ec714cf93b434"><enum>(A)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id974152adabd04c6abfd5f9bede416c64"><enum>(B)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84e5627f34c446cc9eb46ddbfff07969"><enum>(C)</enum><text display-inline="yes-display-inline">the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs of the Senate</committee-name>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id828ffc5e30fc42f787d0db0c195ab8a9"> <enum>(D)</enum> <text display-inline="yes-display-inline">the <committee-name committee-id="HFA00">Committee on Foreign Affairs of the House of Representatives</committee-name>;</text>
                </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd397eb72e2c349d993e3a910c33689c3">
                    <enum>(E)</enum>
 <text display-inline="yes-display-inline">the <committee-name committee-id="HJU00">Committee on the Judiciary of the House of Representatives</committee-name>; and</text>
                </subparagraph><subparagraph id="id9221991bf54145b491b665f049aade7f" commented="no" display-inline="no-display-inline">
                    <enum>(F)</enum>
 <text display-inline="yes-display-inline">the <committee-name committee-id="HBA00">Committee on Financial Services of the House of Representatives</committee-name>.</text>
 </subparagraph></paragraph><paragraph id="id7a452e5afef9486f89377cfd97c419d4" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Gross violations of internationally recognized human rights</header><text>The term <term>gross violations of internationally recognized human rights</term> has the meaning given that term in section 502B(d) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2304">22 U.S.C. 2304(d)</external-xref>).</text></paragraph><paragraph id="id9dceed6dc47f4a22835cb8caf8b4d15c"><enum>(4)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text><subparagraph id="idc86422710eb94d80a56519d511245892"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph><subparagraph id="iddf40c4c3f05040cca79c54d32f52540f"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph><subparagraph id="idfaf2f8fef829464ead448bbe4fe3d4c7" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>any person located in the United States.</text></subparagraph></paragraph><paragraph id="iddc44838fe0584170aa40608746569c51"><enum>(5)</enum><header>Venezuelan person</header><text>The term <term>Venezuelan person</term> means—</text><subparagraph id="idd5844f08b1e54459a9905eab501ee980"><enum>(A)</enum><text>a citizen or national of Venezuela; or</text></subparagraph><subparagraph id="idc7f119b5fe6b4751bddbfa8b21543a0d" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>an entity organized under the laws of Venezuela or otherwise subject to the jurisdiction of the Government of Venezuela.</text></subparagraph></paragraph></section><section id="iddbc4febdec4d4dbb9b7f7cfbe21c22c6"><enum>4.</enum><header>Strategy for supporting free and fair elections in Venezuela</header><text display-inline="no-display-inline">The Secretary of State shall develop and submit to Congress a strategy that—</text><paragraph id="id07a81d6351974fa48a1315eddf7fc8c2"><enum>(1)</enum><text>updates, with input from the appropriate congressional committees, the Democratic Transition Framework for Venezuela, which was originally published by the Department of State on March 31, 2020;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14736dc523364f55bfab85be2362b0a5"><enum>(2)</enum><text display-inline="yes-display-inline">uses all available diplomatic tools—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd2ef18233af64877bda8167b98ebcf22"><enum>(A)</enum><text display-inline="yes-display-inline">to facilitate a new presidential election in Venezuela in 2026 that complies with international standards for a free, fair, and transparent electoral process;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2910da4924974fe5b5fd5cb034d9dc2f"><enum>(B)</enum><text display-inline="yes-display-inline">to end the Maduro-Rodriguez regime’s usurpation of presidential authorities;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id93f530fa79d74c1e9bb9a47305b7360d"><enum>(C)</enum><text display-inline="yes-display-inline">to restore democracy and the rule of law in Venezuela;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc3be4f98f5034ca380f6dbb7c68bc8a0"><enum>(D)</enum><text display-inline="yes-display-inline">to free political prisoners and prisoners of conscience from incarceration in Venezuela; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8c81ad506eba40cb9dea41ea9f8fcc7e"><enum>(E)</enum><text display-inline="yes-display-inline">to facilitate the consistent delivery of humanitarian assistance to the people of Venezuela;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7502701ff80048c7bad0430c803c67bf"><enum>(3)</enum><text display-inline="yes-display-inline">outlines benchmarks towards a democratic transition in Venezuela;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4a277ad69ee14c33925117e45fabe18f"><enum>(4)</enum><text display-inline="yes-display-inline">provides a detailed assessment of Venezuelan government institutions, political prisoners, detention and torture centers, armed groups, and laws used to repress political opposition;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide48f72b76ed2437c8a5439b5fae059da"><enum>(5)</enum><text display-inline="yes-display-inline">outlines the next steps that need to be taken in Venezuela—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2aeacb3dcc1a40318e5be8be7eabdf50"><enum>(A)</enum><text display-inline="yes-display-inline">to coordinate international sanctions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id261a13c023a941b0b9b097fc73bc67de"><enum>(B)</enum><text display-inline="yes-display-inline">to close torture centers;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddfbe95d0040741de913914f30b6459cd"><enum>(C)</enum><text display-inline="yes-display-inline">to ensure the Venezuelan military respects the results of free and fair presidential elections;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12b87a96c72e4468acaeb25dc8455ee6"><enum>(D)</enum><text display-inline="yes-display-inline">to establish mechanisms for institutional reform;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcfbc4c5e4a0d4394b418f38fdc004719"><enum>(E)</enum><text display-inline="yes-display-inline">to guarantee the safe return of opposition leaders, including María Corina Machado; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1e926d37fdd749a9be53ddfefcee5402"><enum>(F)</enum><text display-inline="yes-display-inline">to provide pathways for transitional justice and accountability; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3c7821eea6ea4c00a702d73b4b9a602d"><enum>(6)</enum><text display-inline="yes-display-inline">requires transparency and monthly reporting to the appropriate congressional committees with respect to the transition to democracy in Venezuela, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id454f3d788b614ed4b5a96a8a649286d8"><enum>(A)</enum><text display-inline="yes-display-inline">closely monitoring energy-related negotiations; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id127a9e8e9f2344fa9119605e9312bd2f"><enum>(B)</enum><text display-inline="yes-display-inline">tracking progress made toward achieving certain democratic benchmarks.</text></subparagraph></paragraph></section><section id="idc514b1733a6e441b8b6f142a743d62c6"><enum>5.</enum><header>Imposition of sanctions with respect to human rights violations in Venezuela</header><subsection id="idf2fa4c1a587543cd8c5104cfee36ea17"><enum>(a)</enum><header>In general</header><text>The President shall impose the sanctions described in subsection (b) with respect to Venezuelan persons the President determines are complicit in gross violations of internationally recognized human rights in Venezuela.</text></subsection><subsection id="iddea2230089c44caa81fbc4ecf11b6471"><enum>(b)</enum><header>Sanctions described</header><text display-inline="yes-display-inline">The sanctions described in this subsection are the following:</text><paragraph id="idf2bc74594d774a2fa13a36d12e13eaf9"><enum>(1)</enum><header>Blocking of property</header><text>The President shall exercise all of the powers granted by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in all property and interests in property of a person described in subsection (a), if such property and interests in property are in the United States, come within the United States, or are or come within the procession or control of a United States person.</text></paragraph><paragraph id="id2de4197bdf8441ce80f005e4fb26a548"><enum>(2)</enum><header>Aliens inadmissible for visas, admission, or parole</header><text>In the case of an alien described in subsection (a), the alien is—</text><subparagraph id="id4a014077e7dc41878cd26fa3d949b2cf"><enum>(A)</enum><text>inadmissible to the United States;</text></subparagraph><subparagraph id="id777f7a8ed7ce42158e93571d4974cd98"><enum>(B)</enum><text>ineligible for a visa or other documentation to enter the United States; and</text></subparagraph><subparagraph id="idfcdbef046a81444eb4d2b2e7e886e72d"><enum>(C)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="id434e0288f09b4e27bea2dec2ebf78b90" commented="no"><enum>(c)</enum><header>Exceptions</header><paragraph id="id94d3281af8af43fba6fa8395de81665e" commented="no"><enum>(1)</enum><header>Exception relating to importation of goods</header><subparagraph id="ide2419c8a83c64b21ae13500d4f70961b" commented="no"><enum>(A)</enum><header>In general</header><text>A requirement to block and prohibit all transactions in all property and interests in property under this section shall not include the authority or a requirement to impose sanctions on the importation of goods.</text></subparagraph><subparagraph id="id00d411f2a26941ccb4e3fc37ecaff51e" commented="no"><enum>(B)</enum><header>Good</header><text>In this paragraph, the term <term>good</term> means any article, natural or manmade substance, material, supply, or manufactured product, including inspection and test equipment, and excluding technical data.</text></subparagraph></paragraph><paragraph id="id274a6d3e87b4482a89da6edf933eaddd" commented="no"><enum>(2)</enum><header>Exception to comply with united nations headquarters agreement and law enforcement activities</header><text>Sanctions under subsection (b)(2) shall not apply with respect to the admission of an alien to the United States if admitting or paroling the alien into the United States is necessary—</text><subparagraph id="id09da7f793c2448fea302a9bbc3d0abb2" commented="no"><enum>(A)</enum><text>to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States, or other applicable international obligations of the United States; or</text></subparagraph><subparagraph id="id96e31f04d7ec4dc3a765c80d6204d4ad" commented="no"><enum>(B)</enum><text>to carry out or assist authorized law enforcement activity in the United States.</text></subparagraph></paragraph><paragraph id="id092d1f5023ce4107a10a71ec3b82308f" commented="no"><enum>(3)</enum><header>Exception to comply with intelligence activities</header><text>Sanctions under this section shall not apply to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or any authorized intelligence activities of the United States.</text></paragraph></subsection><subsection id="id357c9a7a4b20449384cd08c5dff774a6"><enum>(d)</enum><header>Waivers</header><paragraph id="idb8dd100ebf014fa7bbe90a8cc3f2c3d3" commented="no"><enum>(1)</enum><header>National security waiver</header><text>The President may waive the application of sanctions under this section if the President—</text><subparagraph id="id2679e6790f674079b0526770c9a62d4f" commented="no"><enum>(A)</enum><text>determines such a waiver is in the national security interests of the United States; and</text></subparagraph><subparagraph id="idd48d128e85674634837eb0f4708df847" commented="no"><enum>(B)</enum><text>submits to the appropriate congressional committees a report on the waiver and the reasons for the waiver.</text></subparagraph></paragraph><paragraph id="id6a2705f34cd244409c8c25c361d46c31" commented="no"><enum>(2)</enum><header>Humanitarian waiver</header><subparagraph id="idd844cea02e1c45abb2e2a7e107284c8d" commented="no"><enum>(A)</enum><header>In general</header><text>Sanctions under this section shall not apply to—</text><clause id="id0bd4885e63e94ac59c3ca15f16857b00" commented="no"><enum>(i)</enum><text>the conduct or facilitation of a transaction for the provision of agricultural commodities, food, medicine, medical devices, humanitarian assistance, or for humanitarian purposes; or</text></clause><clause id="idceb656f3194c4ff39aedcc2a82343a1b" commented="no"><enum>(ii)</enum><text>transactions that are necessary for or related to the activities described in clause (i).</text></clause></subparagraph><subparagraph id="id5cdce8f93fe045b4bdcb6dcbfb24153e" commented="no"><enum>(B)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="id49f9b4cc13e0482e91e6fa611bb1564a" commented="no"><enum>(i)</enum><header>Agricultural commodity</header><text>The term <term>agricultural commodity</term> has the meaning given that term in section 102 of the Agricultural Trade Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/5602">7 U.S.C. 5602</external-xref>).</text></clause><clause id="id3c96ef70bbe944268c020c3ed70ea4d8" commented="no"><enum>(ii)</enum><header>Medical device</header><text>The term <term>medical device</term> has the meaning given the term <term>device</term> in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text></clause><clause id="id7183b56c95ec421ca984d993f6bc01c7" commented="no"><enum>(iii)</enum><header>Medicine</header><text>The term <term>medicine</term> has the meaning given the term <term>drug</term> in section 201 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="id85663e82df4b4e04bcaa253414401024"><enum>(3)</enum><header>Democratic transition</header><text display-inline="yes-display-inline">The President may waive the application of sanctions under this section upon receiving certifications from the Secretary of State and the Secretary of the Treasury that a democratic transition has occurred in Venezuela.</text></paragraph></subsection><subsection id="id10ae094dc28048e186c57d7875c67d14"><enum>(e)</enum><header>Implementation; penalties</header><paragraph id="idcb02aee2453d44c4b5caa28cf5c6e6ec"><enum>(1)</enum><header>Implementation</header><text>The President may exercise all authorities provided under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to carry out this section.</text></paragraph><paragraph id="id78e2dc8794aa45958fad322ebb7b06e0"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of this section or any regulation, license, or order issued to carry out this section shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></paragraph></subsection></section></legis-body></bill>
