<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4803</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260617">June 17, 2026</action-date><action-desc><sponsor name-id="S322">Mr. Merkley</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Truth in Lending Act to include a home equity investment loan in the definition of a residential mortgage loan for the purposes of that Act, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Home Equity Lending Integrity Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id7d693a2973fb495abc677f9928c83f31"><enum>2.</enum><header>Home equity investment loans</header><subsection commented="no" display-inline="no-display-inline" id="id9add19633b0041c695d7350d215248e9"><enum>(a)</enum><header>In general</header><text>Section 103 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id6f1b47c9afc64d7abfac1012b0ea70a7"><enum>(1)</enum><text>in subsection (dd)(5), by inserting <quote>, including a home equity investment loan,</quote> after <quote>means any consumer credit transaction</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id322c5689daff40e183f27bfc40e61b39"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="id1801033EC3F2436EA04402D5653CDEA5" style="OLC" act-name=""><subsection id="idD8BFB05FEF784C689F12C089EDE68DC8"><enum>(ff)</enum><header>Home equity investment loan</header><text>The term <term>home equity investment loan</term> means a transaction that is secured by a mortgage, deed of trust, or other equivalent consensual security interest on a dwelling or on residential real property, including any option, future, or other derivative between a person and a consumer where the consumer receives money (or any other item of value) in exchange for— </text><paragraph commented="no" display-inline="no-display-inline" id="id64d121a1230647e192b1e78ebe634e61"><enum>(1)</enum><text display-inline="yes-display-inline">an interest (or future interest) in a dwelling or residential real property; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd288359bc0004a2593510ccf6842813d"><enum>(2)</enum><text display-inline="yes-display-inline">a contingent or certain obligation to pay an amount based, in whole or in part, on the value of the dwelling or residential real property.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idad4a0ba0565543f8b588c0c5cce0fe72"><enum>(b)</enum><header>Regulations</header><text>The Bureau of Consumer Financial Protection shall prescribe regulations that apply section 130 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1640">15 U.S.C. 1640</external-xref>) with respect to violations under that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et seq.</external-xref>) with respect to home equity investment loans (as defined in subsection (ff) of section 103 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602</external-xref>), as added by subsection (a) of this section).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idb539d32ad9c246e8bdaac37a9dfb4265"><enum>(c)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the amendment made by subsection (a)(1) reflects the state of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et seq.</external-xref>), as in effect on the day before the date of enactment of this Act, and does not make any substantive change to how that Act is administered.</text></subsection></section></legis-body></bill>
