<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4802</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260617">June 17, 2026</action-date><action-desc><sponsor name-id="S275">Ms. Cantwell</sponsor> (for herself, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S430">Ms. Blunt Rochester</cosponsor>, <cosponsor name-id="S318">Mr. Wicker</cosponsor>, <cosponsor name-id="S413">Mr. Padilla</cosponsor>, and <cosponsor name-id="S417">Mr. Budd</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the acquisition by the National Oceanic and Atmospheric Administration of aircraft for air, atmosphere, and weather reconnaissance and research missions, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hurricane Hunter Aircraft Recapitalization Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idd0cacf3f5e30496f962f0dd9382c29ec"><enum>2.</enum><header>Acquisition of aircraft for air, atmosphere, and weather reconnaissance and research missions</header><subsection commented="no" display-inline="no-display-inline" id="ide64c23ac628b4061837e4befa099a036"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 11708 of the Don Young Coast Guard Authorization Act of 2022 (division K of <external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; 136 Stat. 4158; 33 U.S.C. note prec. 851) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idc032b6d9e11b4a8ea872ff6d302b8e22"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf87ce832ab9a42a3803bf512fb37a6b6"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text style="OLC" level="subsection">Increased</header-in-text></quote> and all that follows through <quote>The Under</quote> and inserting <quote><header-in-text style="OLC" level="subsection">Hurricane hunter mission.</header-in-text>—The Under</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id54998d9d681b443caa139e0a3783ead0"><enum>(B)</enum><text>by striking <quote>shall acquire</quote> and inserting the following:</text><quoted-block id="id85e084cbc30f4e36a76efae0e67db66b" display-inline="yes-display-inline"><text>shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id7693e8bd3b7c477382da5a821eecf32a"><enum>(1)</enum><text>acquire and maintain</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1966583aeda745afbe61c68bd3d66c33"> <enum>(C)</enum> <text>by striking <quote>requirements</quote> and all that follows through <quote>air reconnaissance and</quote> and inserting <quote>requirements to meet the National Oceanic and Atmospheric Administration air reconnaissance and</quote>; and</text>
 </subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71044c0dc9e64b78baccdf36983d25cc"><enum>(D)</enum><text>by striking <quote>(B) to ensure</quote> and all that follows through <quote>or nongovernmental entities.</quote> in paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide39bdfec92374648920a103a51fc7685"><paragraph commented="no" display-inline="no-display-inline" id="id02fb18987bec47358e68f296c7409075"><enum>(2)</enum><text>carry out airborne reconnaissance and research missions using such aircraft platforms under paragraph (1).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id203cd045711f4bd09b3a05c030f86e43"><enum>(2)</enum><text>by redesignating subsections (b), (c), and (d) as subsections (d), (e), and (h), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfa3feee7bbab4382ac4f94a73ecbea19"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id340383cfdc4548fb8f1ac7b617710fa5"><subsection id="id4e6334459d9741e393835bf2463b5bc9"><enum>(b)</enum><header>Mission requirements</header><text>In carrying out subsection (a), the Under Secretary shall—</text><paragraph id="id081957c5c5854096b89c2d06c783f192"><enum>(1)</enum><text>collect real-time meteorological, oceanographic, and atmospheric observations and ensure such data is made available in near real-time for research and operational purposes, including forecasting, warning, and reconnaissance missions;</text></paragraph><paragraph id="iddd221a71a1a94a4e80e976f38f7624cd"><enum>(2)</enum><text>maintain the capability to safely conduct direct airborne penetration of hurricanes and tropical cyclones; and</text></paragraph><paragraph id="idf2f8955b13014b3fb787c6e842d47dc3"><enum>(3)</enum><text>ensure continuity of airborne hurricane reconnaissance capability during any aircraft recapitalization or transition period, including through the acquisition and maintenance of backup capabilities sufficient to prevent a single point of failure.</text></paragraph></subsection><subsection id="id149389346545412b92f736b88c0e9a82"><enum>(c)</enum><header>Airborne observing technologies</header><text>In carrying out subsection (a), the Under Secretary shall maintain and replace airborne radar and remote sensing capabilities, including Tail Doppler Radar capabilities or successor technologies, necessary to support operational hurricane reconnaissance and forecasting missions.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide9aae869e0284ae080fc9334732aac27"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (d) (as so redesignated)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5914519cbcb84af5adbb4a3707147640"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by striking <quote>up to 6</quote> and inserting <quote>not fewer than 6, but not more than 9, manned</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idde1ef1171992459bbd28897714768e77"><enum>(B)</enum><text>in paragraph (2), by striking <quote>subparagraph (A)</quote> and inserting <quote>paragraph (1)</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00b7683fa093434bb50bc32f5e086c30"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (e) (as so redesignated), by striking <quote>agency air reconnaissance and research mission requirements</quote> and inserting <quote>the mission requirements described in subsection (b)</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id522b9e4a35bc4d3bb14ae7827aa1325f"><enum>(6)</enum><text display-inline="yes-display-inline">by inserting after subsection (e), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideb56286e551c47a19b6c186800aff81f"><subsection id="idef2a01328525463d9c7a744b521ec1bf"><enum>(f)</enum><header>Multiyear contracts</header><paragraph id="id8b24b4a2a7b44d4a82b27bd2b2e3abb6"><enum>(1)</enum><header>In general</header><text>The Under Secretary may enter into multiyear contracts in accordance with section 3903 of title 41, United States Code, for purposes of carrying out this section and shall ensure compliance with all contract clauses provided in such section of title 41, United States Code.</text></paragraph><paragraph id="id8dd31e7d0be74e2e817ee099fa2f6268"><enum>(2)</enum><header>Exception for contract duration limitation</header><text>The limitation on the duration of such contracts provided under subsection (a) of such section of title 41, United States Code, shall not apply to contracts for the acquisition of aircraft in accordance with this section or the maintenance of such aircraft, including any associated services or support, provided that such contracts comply with applicable law and include appropriate safeguards for any unfunded contingent liability in the event of cancellation.</text></paragraph></subsection><subsection id="id78d8e991eced4b81bc4aab3341cca57b"><enum>(g)</enum><header>NOAA Corps Aviation Capability</header><text>The Under Secretary shall maintain qualified National Oceanic and Atmospheric Administration Commissioned Officer Corps aviators to conduct the airborne reconnaissance and research missions authorized under subsection (a)(2).</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida40d1a059326409ca8594e5fc7622fa5"><enum>(7)</enum><text>in subsection (h), as so redesignated—</text><subparagraph commented="no" display-inline="no-display-inline" id="id459b348725904f809a6cab510871608e"><enum>(A)</enum><text>by striking <quote>For</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2d68f4227a7649bbb54ad4a6413a6f86"><paragraph commented="no" display-inline="no-display-inline" id="id71567e3024ef4065b3d2bee24a51e0a8"><enum>(1)</enum><header>Acquisition of aircraft</header><text>For</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaa4524519b6b47d9a971e1ce98241351"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>year 2023</quote> and inserting <quote>years 2027 through 2031</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id98b5c8dee7464e558b26d07bb89c492e"><enum>(C)</enum><text>by striking <quote>$800,000,000</quote> and inserting <quote>$2,500,000,000</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id513c87520b88493fa4c836e8999f5170"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5ecf47221d384ff9b6bfca12e8869f53"><paragraph commented="no" display-inline="no-display-inline" id="id7d54782e79c4448fa233110a3232b824"><enum>(2)</enum><header>OMAO aviation operations and aircraft services</header><text>For each of fiscal years 2027 through 2031, there is authorized to be appropriated to the Under Secretary $45,000,000 for aviation operations and aircraft services by the Office of Marine and Aviation Operations.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2770163d75194853b9f114606cb9102a"><enum>(b)</enum><header>Transfer</header><paragraph commented="no" display-inline="no-display-inline" id="id0e9692f4d37b4c0b9ea3513afe31de68"><enum>(1)</enum><header>Weather Research and Forecasting Innovation Act of 2017</header><text>The Weather Research and Forecasting Innovation Act of 2017 is amended by repealing section 413 (<external-xref legal-doc="usc" parsable-cite="usc/15/8549">15 U.S.C. 8549</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6b17681764164cd0ba493b1374139d32"><enum>(2)</enum><header>Don Young Coast Guard Authorization Act of 2022</header><text display-inline="yes-display-inline">The Don Young Coast Guard Authorization Act of 2022 is further amended by transferring section 11708 of such Act, as amended by subsection (a), to the Weather Research and Forecasting Innovation Act of 2017 (<external-xref legal-doc="usc" parsable-cite="usc/15/8501">15 U.S.C. 8501 et seq.</external-xref>) to appear as section 413 of such Act and redesignating such section, as so transferred, as section 413.</text></paragraph></subsection><subsection id="id80d6adc4f8bd4ab18ca95b6fc8d0122e"><enum>(c)</enum><header>Clerical amendments</header><text>The table of contents in section 1(b) of the Weather Research and Forecasting Innovation Act of 2017 is amended by striking the item related to section 413 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf6fa0ca4ac1d4d2caf07060a31817328"><toc><toc-entry level="section" bold="off">Sec. 413.
