which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Agriculture and the Secretary of Homeland Security to submit to Congress a report regarding cybersecurity in precision agriculture technologies, and for other purposes.</official-title></form><legis-body><section commented="no" display-inline="no-display-inline" id="id0f72c3ba07e1415ca735e8afd2b6191d" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Precision Agriculture Cybersecurity Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id6b38ea4a504944249258700c4697b1f4"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="ida2f48429bda5419abfff504670a8782c"><enum>(1)</enum><header>Foreign Country of concern</header><text>The term <term>foreign country of concern</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4d91e7fd79da4c8a9cefc4dcfa7093ad"><enum>(A)</enum><text display-inline="yes-display-inline">the People’s Republic of China;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee551e0dee6d4314bfb4c20eaa583e7c"><enum>(B)</enum><text>the Democratic People’s Republic of Korea;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7a4cc2483f294cb786d217fb2187f0e7"><enum>(C)</enum><text>the Russian Federation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82065fbb068645e3afc8b40d26edda02"><enum>(D)</enum><text>the Islamic Republic of Iran.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd2a3494460084508ac834d8219e6c224"><enum>(2)</enum><header>Precision agriculture technology</header><text>The term <term>precision agriculture technology</term> means—</text><subparagraph id="idc19ff9f40cde40f780b2348891cbfb07"><enum>(A)</enum><text>instrumentation and techniques ranging from sophisticated sensors and software systems to manual sampling and data collection tools that measure, record, and manage spatial and temporal data;</text></subparagraph><subparagraph id="id9dcbefd3beca45c3869cf8a4512866a6"><enum>(B)</enum><text>technologies for searching out and assembling information necessary for sound agricultural production decisionmaking;</text></subparagraph><subparagraph id="id34fc60e1560144819f5c8a0f04c4e8e0"><enum>(C)</enum><text>open systems technologies for data networking and processing that produce valued systems for farm management decisionmaking; and</text></subparagraph><subparagraph id="idb247e931833547e68841dbea0bd120a5"><enum>(D)</enum><text>machines that deliver information-based management practices.</text></subparagraph></paragraph></section><section id="id8d548b150fab463ba754627c2aa7f3bd" section-type="subsequent-section"><enum>3.</enum><header>Report on cybersecurity in precision agriculture technology</header><subsection commented="no" display-inline="no-display-inline" id="id5c9d359085814db79e680874a3537524"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture and the Secretary of Homeland Security, acting through the Director of the Cybersecurity and Infrastructure Security Agency, in coordination with the Food and Agriculture Sector Coordinating Council and the Food and Agriculture-Information Sharing and Analysis Center, shall prepare a report containing an assessment of current cyber-threats to precision agriculture technologies.</text></subsection><subsection id="idb349db650aff4aaeb5709c3fa617aee5"><enum>(b)</enum><header>Contents</header><text>The report prepared under subsection (a) shall contain—</text><paragraph id="id67d38f8b89024241a49682ed1293e934"><enum>(1)</enum><text>an evaluation of all cyber-threats to precision agriculture technologies;</text></paragraph><paragraph id="id67ae8e099bb741aa89409622cc942b65"><enum>(2)</enum><text>an assessment of cyber-threats to precision agriculture technologies from foreign countries of concern;</text></paragraph><paragraph id="id42d1d7dc055b4aaa9d21a90cd4664b33"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idb32ff329a0e841df88d0c55ee2f23e82"><enum>(A)</enum><text>an identification of gaps in the United States planning for cybersecurity in precision agriculture technologies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide940ce5043dc48e5a11bd5fec1f4189c" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations to address those gaps;</text></subparagraph></paragraph><paragraph id="id6c79160558b24a2797e313b7b24f0a61"><enum>(4)</enum><text>a review of existing Department of Agriculture and Department of Homeland Security funding opportunities related to enhancing cybersecurity in precision agriculture technologies; and</text></paragraph><paragraph id="ida762afa08d164063a4e033cc047a7e73"><enum>(5)</enum><text>a review of existing staff at the Department of Agriculture and the Department of Homeland Security that contribute to cybersecurity in precision agriculture technologies.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1c9d2738c6e840b49d21366442bc4966"><enum>(c)</enum><header>Publication; submission</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Agriculture and the Secretary of Homeland Security, acting through the Director of the Cybersecurity and Infrastructure Security Agency, shall make publicly available the report prepared under subsection (a) and submit such report to—</text><paragraph commented="no" display-inline="no-display-inline" id="idf981a10bb2624812ad7d03a6ccbd7888"><enum>(1)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id52409b54b91a490da7feafe70fd9d6e1"><enum>(2)</enum><text>the Committee on Agriculture of the House of Representatives;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbf7560bbe621481fa79d4ab558b9df3f"><enum>(3)</enum><text>the Committee on Foreign Relations of the Senate;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id146f65caef2640da9abafec74ba8fd74"><enum>(4)</enum><text>the Committee on Foreign Affairs of the House of Representatives;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd64a2278ccf5424a959d1eaa4756b16e"><enum>(5)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id789390884d7d4457b5f0fd9bacb71a55"><enum>(6)</enum><text>the Committee on Homeland Security of the House of Representatives.</text></paragraph></subsection><subsection id="idd82b7a3b8dbe4da3bf678cfc01bc4e63"><enum>(d)</enum><header>Form</header><paragraph commented="no" display-inline="no-display-inline" id="id233006cb915b4c4384158afb7676a244"><enum>(1)</enum><header>Publicly available report</header><text display-inline="yes-display-inline">The report made publicly available in accordance with subsection (c) shall not contain any classified information.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida1675c40a0a94f0290a07ca7cceecb85"><enum>(2)</enum><header>Congressional report</header><text display-inline="yes-display-inline">The report submitted to the congressional committees in accordance with subsection (c) may include a classified annex, if warranted.</text></paragraph></subsection></section><section id="id339857d76a804a53a59eba6e679a222c"><enum>4.</enum><header>GAO report on coordination and collaboration on cybersecurity in precision agriculture technologies across the Federal Government</header><subsection id="id640750a40a634643a253b2b16e5c70d8"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study on the coordination and collaboration on cybersecurity in precision agriculture technologies across the Federal Government.</text></subsection><subsection id="idcbf7901195534827b48dc706c87150f5"><enum>(b)</enum><header>Contents</header><text>The study conducted under subsection (a) shall—</text><paragraph id="id51a668b030fc411eb1753fb64aac1e01"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idb038162536c141f6908689c9a5ea9d00"><enum>(A)</enum><text>assess current coordination and collaboration across the Federal Government on cybersecurity in precision agriculture technologies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61013d88d10d41da92dfd5dc44dd4d65" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">develop recommendations to enhance such collaboration and coordination; and</text></subparagraph></paragraph><paragraph id="id51b17c1225f44c349dae20d35ead84bc"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id2756cdd2a6bd4a42a9a44a75c4525ce9"><enum>(A)</enum><text>evaluate the work of the Food and Agriculture Sector Government Coordinating Council (referred to in this paragraph as the <term>GCC</term>) and the Food and Agriculture Sector Coordinating Council (referred to in this paragraph as the <term>SCC</term>) on addressing cybersecurity in precision agriculture technologies; and</text></subparagraph><subparagraph id="id8ec6acae5a9c4fdca772d2140921a44e" indent="up1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">identify opportunities to strengthen coordination between the GCC and the SCC.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide58a46e0f48d431fb0822c17a30711cb"><enum>(c)</enum><header>Publication; submission</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall make publicly available a report containing the findings of the study conducted under subsection (a) and submit such report to—</text><paragraph commented="no" display-inline="no-display-inline" id="id24d0494085a24aa080471ffdd8086025"><enum>(1)</enum><text>the Committee on Agriculture, Nutrition, and Forestry of the Senate;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida38903f34282467ebe2984ce6963f2cb"><enum>(2)</enum><text>the Committee on Agriculture of the House of Representatives;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1f432e082a734ad2ade0817e0681f545"><enum>(3)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b6c7e55b5724b99811f7be9785fc24e"><enum>(4)</enum><text>the Committee on Homeland Security of the House of Representatives.</text></paragraph></subsection><subsection id="id25478f8b2ce349ba97bfbf6c025e40d0"><enum>(d)</enum><header>Form</header><paragraph commented="no" display-inline="no-display-inline" id="id75e4c2f3f1b84186be0af4a83da5a5f3"><enum>(1)</enum><header>Publicly available report</header><text display-inline="yes-display-inline">The report made publicly available in accordance with subsection (c) shall not contain any classified information.</text></paragraph><paragraph id="idbbc8e7e750b8493d861689eee4e1ca29" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Congressional report</header><text display-inline="yes-display-inline">The report submitted to the congressional committees in accordance with subsection (c) may include a classified annex, if warranted.</text></paragraph></subsection></section></legis-body></bill>
