which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To clarify provisions of the United States-Mexico-Canada Agreement Implementation Act and the Foreign Trade Zones Act with respect to the appropriate tariff treatment of merchandise in a United States foreign-trade zone, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H81B1F8B714C24FC69A61FEA0FE0F66AC"><section section-type="section-one" id="H312995A5719C4069B91E4D60B2101FE8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign-Trade Zone Export Enhancement Act of 2026</short-title></quote>.</text></section><section id="H1823A6630AE84DB38540084D5B28842E"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to ensure that foreign-trade zones in the United States continue—</text><paragraph id="HAB475CF45B97434E901803073F99034B"><enum>(1)</enum><text>to operate in support of United States competitiveness in manufacturing and distribution; and</text></paragraph><paragraph id="HF3E46B5A20E84610BAD7D934F7B97B3E"><enum>(2)</enum><text>to create and preserve jobs in the United States.</text></paragraph></section><section id="HE99C26BD352D4330AE4B3366447CCEB3"><enum>3.</enum><header>Rules related to duties imposed on foreign-trade zone merchandise</header><subsection id="H15B17899BA654ACDB23AFBD67BEDE818"><enum>(a)</enum><header>Amendments to Foreign Trade Zones Act</header><text>Section 3 of the Act of June 18, 1934 (commonly known as the <quote>Foreign Trade Zones Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/19/81c">19 U.S.C. 81c</external-xref>), is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H67EF747E526F4707AEB2EB5284EACF60"><subsection id="H84D05E7EB23E495BA8849A23CA24CF3E"><enum>(f)</enum><header>Export from a foreign-Trade zone of certain merchandise manufactured or changed in condition</header><text>Notwithstanding the seventh proviso of subsection (a)—</text><paragraph id="HD705915226534FB5AF5A36167C678BBF"><enum>(1)</enum><text>each article subject to the procedures described in such proviso and classifiable under the heading 9801.00.95 of the Harmonized Tariff Schedule of the United States shall enter free of duty in accordance with such heading; and</text></paragraph><paragraph id="H4B237DE5ACD4415FB4511AA4AF50D1A4"><enum>(2)</enum><text>any article consisting of components subject to such procedures and classifiable under such heading shall enter free of duty with respect to such components.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H374C883B4D924120A4677816C6F026BB"><enum>(b)</enum><header>Duty-Free treatment for certain articles</header><text>Subchapter I of chapter 98 of the Harmonized Tariff Schedule of the United States is amended by inserting in numerical sequence the following new subheading:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1C2ABDFC8337486BB99453B8F8FED21C"><table table-type="exception-quote" table-template-name="Duty Suspension, 8-Column" align-to-level="section" frame="none" colsep="1" rowsep="0" blank-lines-before="1" line-rules="hor-ver" rule-weights="0.0.0.0.4.17"><tgroup block-style="1" cols="8" grid-typeface="1.1" rowsep="0" thead-tbody-ldg-size="0.7.9"><colspec coldef="txt-no-ldr-no-spread" colname="column1" min-data-value="8" colwidth="8pts"/><colspec coldef="txt-no-ldr-no-spread" colname="column2" min-data-value="35" colwidth="62pts"/><colspec coldef="txt" colname="column3" min-data-value="60" colwidth="101pts"/><colspec coldef="txt-no-ldr-no-spread" colname="column4" min-data-value="25" colwidth="37pts"/><colspec coldef="txt-no-ldr-no-spread" colname="column5" min-data-value="38" colwidth="24pts"/><colspec coldef="txt-no-ldr-no-spread" colname="column6" colsep="1" min-data-value="38" colwidth="17pts"/><colspec coldef="txt-no-spread" colname="column7" min-data-value="38" colwidth="16pts"/><colspec align="justify" coldef="fig" colname="column8" min-data-value="3" colwidth="12pts"/><tbody><row><entry align="left" leader-modify="clr-ldr" rowsep="0" stub-definition="txt-clr" stub-hierarchy="1" colname="column1"/><entry align="left" leader-modify="clr-ldr" rowsep="0" valign="top" colname="column2">9801.00.95</entry><entry align="left" leader-modify="force-ldr-bottom" rowsep="0" valign="bottom" colname="column3">Merchandise that is subject to duty deferral restrictions of the free trade agreement between the United States, Mexico, and Canada (<external-xref legal-doc="usc" parsable-cite="usc/19/4501">19 U.S.C. 4501</external-xref>, et seq.; commonly known as the <quote>USMCA</quote>) (or any successor agreement) that is admitted into a United States foreign-trade zone, manufactured, or changed in condition therein, and subsequently withdrawn for direct exportation to the territory of a Party to that agreement</entry><entry align="left" leader-modify="clr-ldr" rowsep="0" valign="bottom" colname="column4">Free</entry><entry align="left" leader-modify="clr-ldr" rowsep="0" valign="bottom" colname="column5"/><entry align="left" leader-modify="clr-ldr" rowsep="0" valign="bottom" colname="column6"/><entry leader-modify="clr-ldr" rowsep="0" colname="column7"/><entry align="right" leader-modify="clr-ldr" rowsep="0" valign="bottom" colname="column8"/></row></tbody></tgroup></table><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H839967172A564320B51A78885692F71C"><enum>4.</enum><header>Implementation and enforcement</header><text display-inline="no-display-inline">Not later than 90 days after the date of the enactment of this Act, the Commissioner of U.S. Customs and Border Protection shall issue such regulations as are necessary to implement section 3.</text></section></legis-body></bill>
