<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4787</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260615">June 15, 2026</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S317">Mr. Barrasso</cosponsor>, <cosponsor name-id="S410">Ms. Lummis</cosponsor>, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, and <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To expedite resolution of certain administrative proceedings at the Department of the Interior, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Free to Exit Administrative Tribunals Act</short-title></quote> or the <quote><short-title>FEAT Act</short-title></quote>.</text></section><section id="id2b1e64d1309d4fafa4e40723a20d3519"><enum>2.</enum><header>Removal of administrative proceedings</header><subsection commented="no" display-inline="no-display-inline" id="idccd24ec07ed441aba1c7ae851cd4d9ba"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="idd499713f6df246e4a47fcb263034f3fe"><enum>(1)</enum><header>Covered action</header><text>The term <term>covered action</term> means an agency proceeding that is adjudicated in the Departmental Cases Hearings Division or the Interior Board of Land Appeals of the Office of Hearings and Appeals of the Department of the Interior.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id875d0b3bb93943a7805caa64870dd4e4"><enum>(2)</enum><header>Covered party</header><text>The term <term>covered party</term> means a party to a covered action that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfd98e59e201d42c7aa8e2c10a487ab4a"><enum>(A)</enum><text display-inline="yes-display-inline">initiated the covered action seeking Department approval to engage in conduct for which Department approval is required; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf58c31e1499842818e7d3eda7e3718b0"><enum>(B)</enum><text>seeks relief from any sanction or civil penalty imposed on that party by the Department.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id829d5c4a737746c7be9417c9c2751668"><enum>(3)</enum><header>Department</header><text>The term <term>Department</term> means the Department of the Interior.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2777c8e7980d4a6b93ebc0ba4669b27f"><enum>(b)</enum><header>Right of removal</header><text>In accordance with section 1446 of title 28, United States Code, a covered party may remove to a district court of the United States of competent jurisdiction a covered action not later than 60 days after that covered action is initiated with the Department.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="ida856fdb073134177aef53b3816838bbe"><enum>(c)</enum><header>Review</header><text>A covered action removed to a district court of the United States under subsection (b) shall be reviewed de novo.</text></subsection></section></legis-body></bill>
