Reauthorization of grant program.</toc-entry></toc></subsection></section><section id="id6e8270e8849340f794b37a8dae4c61d5"><enum>2.</enum><header>Definition of Secretary</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Agriculture.</text></section><title id="idde5a798e3e5945c0b6de51c9309bac9c" style="OLC"><enum>I</enum><header>Improving access to healthy foods</header><section id="id85362c2bc675497abc7cdb01d786b038"><enum>101.</enum><header>Improving micro-grants for food security program</header><text display-inline="no-display-inline">Section 4206 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/7/7518">7 U.S.C. 7518</external-xref>) is amended—</text><paragraph id="id26fb900bd7c34fe9b5916e594f67aa23"><enum>(1)</enum><text>in subsection (b)(1)(A)(iv), by striking subclause (II) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id839a7d6cda304132bf27a18d0f8a5188"><subclause commented="no" display-inline="no-display-inline" id="iddc897624f2ab490d947a6bf76ed1109c"><enum>(II)</enum><text display-inline="yes-display-inline">a public or Tribal elementary or secondary school;</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id321dee08de08426092ece4537edb2d85"><enum>(2)</enum><text>in subsection (c), by striking <quote>competitive distribution of subgrants</quote> and inserting <quote>distribution of subgrants or other financial assistance</quote>;</text></paragraph><paragraph id="id41b1355ecf6744bca0a03544378088af"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc0820defd44b492a8b6c17a9a47540aa"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>subsection (g)</quote> and inserting <quote>subsection (h)</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb1d3b4a484674762933b11721cacd328"><enum>(II)</enum><text display-inline="yes-display-inline">in the second sentence, by striking <quote>an individual who otherwise meets</quote> and inserting <quote>those eligible entities that otherwise meet</quote>; and</text></subclause></clause><clause id="idee9ba3b04e8e40dca10466206a98194e"><enum>(iii)</enum><text>in subparagraph (C), by inserting <quote>or other financial assistance provided</quote> after <quote>subgrant</quote>;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb98b29704f7241579f4fb6f379faa3b0"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="idbc10413cac0b40739e1f448d2a98df37"><enum>(i)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by striking <quote>competitive distribution of subgrants under subsection (c)</quote> and inserting <quote>distribution of subgrants or other financial assistance under this section</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC57AF6B4963442DFBC9B1B3E97B22554"><enum>(F)</enum><text>in paragraph (5), by inserting <quote>or other financial assistance</quote> after <quote>subgrant</quote>;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0cdcc486385b43b58140431f139035a9"><enum>(5)</enum><text display-inline="yes-display-inline">by redesignating subsections (f) and (g) as subsections (g) and (h), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddcdd581c3e7d44a8aaf7da2f01126214"><enum>(6)</enum><text>by inserting after subsection (e) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id31deab26c6c0441fb1a0f8095558b392"><subsection id="idd9d58942040943bdb77fcd5e95ae4e29"><enum>(f)</enum><header>Use of funds by eligible States</header><text>Of the amount received by an agricultural department or agency of an eligible State under subsection (c), some may be used by the agricultural department or agency to provide, or to enter into a contract with a nonprofit entity to provide, an educational or training course or technical assistance designed to increase the quantity and quality of locally grown food for food insecure individuals, families, neighborhoods, and communities.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id13820cfa934d4a1b9efdbb6a2d153fe1"><enum>(7)</enum><text>in subsection (g) (as so redesignated)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id306228bb9285426f9dc2fb2212f31714"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id8550D6C06A0B4031AF3A78F9D1E5E13E"><enum>(i)</enum><text>by inserting <quote>or other financial assistance</quote> after <quote>subgrant</quote> each place it appears; and</text></clause><clause id="id4100ee03449541e8b73e94343fb532a7"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>subgrants by eligible entities</quote> and inserting <quote>subgrant or other financial assistance by the eligible entity</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5dad7f0909f546aaa63f56079e7dad08"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id070fca36db5c4ccca79974ab5f75b289"><paragraph id="id0dd0791539544015ba19a2ab563254eb"><enum>(3)</enum><header>Disposition requirements</header><text>No eligible State or eligible entity shall be required, as a condition of receiving a subgrant or other financial assistance under this section, to monitor or report on, or meet disposition requirements relating to, real property or capital improvements, insurance coverage, or depreciation considerations, as described in sections 200.310, 200.311, 200.330, and 200.436 of title 2, Code of Federal Regulations (or successor regulations), for projects that would build or enhance permanent structures the purpose of which is to improve food security over the long term.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="ide687d83da29942ba97bc47df10e7686d"><enum>102.</enum><header>Grants and loans for food distribution in frontier communities</header><text display-inline="no-display-inline">Subtitle A of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1922">7 U.S.C. 1922 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id113D2F3B7EDD42F88AE5639E24943CA3"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id50363820bfa14696bbeea45b68999dd3"><enum>310J.</enum><header>Grants and loans for food distribution in frontier communities</header><subsection commented="no" display-inline="no-display-inline" id="id377c3820f50c4b84915d76b8642ef2da"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id8bfa2d7d1f8d4d6aaf8c7eb24b282124"><enum>(1)</enum><header display-inline="yes-display-inline">Eligible community</header><text>The term <term>eligible community</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idbb650ccb49c647ad81951c10fe89f57e"><enum>(A)</enum><text display-inline="yes-display-inline">a frontier community that—</text><clause commented="no" display-inline="no-display-inline" id="id4acad78910314fea85751cb9a2ea1199"><enum>(i)</enum><text display-inline="yes-display-inline">is located in a noncontiguous State;</text></clause><clause commented="no" display-inline="no-display-inline" id="id61ad9a1bf8154d798ca5f791a869a202"><enum>(ii)</enum><text display-inline="yes-display-inline">does not have a food bank or food pantry as of the date of submission of an application for a grant or loan under this section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id23c144222a2f4173bfe9d222cd8126fc"><enum>(iii)</enum><text display-inline="yes-display-inline">is determined to be Frontier Level 4 in accordance with the most recent version of the Frontier and Remote Communities Code developed by the Economic Research Service; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id689e56384c69432bb01e0d5bbd787e51"><enum>(B)</enum><text display-inline="yes-display-inline">a rural community that—</text><clause commented="no" display-inline="no-display-inline" id="id26478b9820a947768dc464b0c59cbb5d"><enum>(i)</enum><text display-inline="yes-display-inline">is located in a noncontiguous State;</text></clause><clause commented="no" display-inline="no-display-inline" id="id095b0d649dbe43459ed37b2fa48a9b8e"><enum>(ii)</enum><text display-inline="yes-display-inline">does not have a food bank or food pantry as of the date of submission of an application for a grant or loan under this section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id49b71a7d04694576afb8704b08fb1a01"><enum>(iii)</enum><text display-inline="yes-display-inline">is determined to be Frontier Level 3 in accordance with the most recent version of the Frontier and Remote Communities Code developed by the Economic Research Service.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddba7993bbaa8412b8c7117727c70c794"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0cfe048023a94f3fa5de14406280f5e3"><enum>(A)</enum><text display-inline="yes-display-inline">an Indian Tribe (as defined in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>));</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0473c7df6170445b9d72c8d9a63687bd"><enum>(B)</enum><text>a Tribal organization (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaea5a7b9f8b348e2a2e9a84855adf5ef"><enum>(C)</enum><text>an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of that Code.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3c09beeef9d743f1b3127037152ac217"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text>The Secretary shall establish a program to provide grants and loans to eligible entities to establish food banks or food pantries in eligible communities.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id944fd5ace3a64abba8eba9b12b889fce"><enum>(c)</enum><header>Eligible activities</header><text display-inline="yes-display-inline">An eligible entity that receives a grant or loan under subsection (b) may use the grant or loan for—</text><paragraph id="id2dd538445b094ac296c1668a3dc3d0fb"><enum>(1)</enum><text>the construction or renovation of facilities;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6eea9c8516741a1a445f6becf7012ad"><enum>(2)</enum><text display-inline="yes-display-inline">wages and benefits for employees;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0b11a8d76d564ea5ae4785a6cc6f719e"><enum>(3)</enum><text display-inline="yes-display-inline">equipment to keep food and beverages cold or frozen, as appropriate;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd48c93e2d3ee48839d1adb120200185a"><enum>(4)</enum><text display-inline="yes-display-inline">transportation of foods and beverages from rural hub communities to outlying villages, including by air, barge, or surface transportation; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id731c0bee82d84e52acd6af68af5090f2"><enum>(5)</enum><text display-inline="yes-display-inline">such other activities as the Secretary determines to be appropriate.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idab15de1128864444884006e6b12ce751"><enum>(d)</enum><header>Interest rate</header><paragraph commented="no" display-inline="no-display-inline" id="id8ba17f36361849dd9e835785c861f6a4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to paragraphs (2) and (3), the interest rate of a loan under subsection (b) shall be established by the Secretary, for each quarter of the applicable fiscal year, based on the rate prescribed in Rural Development Instruction 440.1, exhibit B (or a successor instruction), as in effect on the date on which the loan is approved.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc30b780efee34288939a49cbfa0e350e"><enum>(2)</enum><header>Adjustment</header><text display-inline="yes-display-inline">The interest rate established under paragraph (1) shall be adjusted to the nearest <fraction>1/8</fraction> of 1 percent.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb6ad5af70e35498cb62bc874220ecd14"><enum>(3)</enum><header>Written request</header><subparagraph commented="no" display-inline="no-display-inline" id="id3e4a1624bbea429da66bbab27aa90206"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1), before the closing date of a loan under subsection (b), the eligible entity applying for the loan may submit to the Secretary a written request that the interest rate to be charged for the loan be equal to the lesser of—</text><clause commented="no" display-inline="no-display-inline" id="id6aff96b69df34276997fe6ca455d4ced"><enum>(i)</enum><text display-inline="yes-display-inline">the interest rate in effect on the date of the loan approval; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id9804e0ad364d4afcb2274894a725861a"><enum>(ii)</enum><text display-inline="yes-display-inline">the interest rate in effect on the date of the loan closing.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id910f3a155231437ba4b0b4691bec2379"><enum>(B)</enum><header>Temporary debt instruments</header><text display-inline="yes-display-inline">If a request submitted under subparagraph (A) is approved by the Secretary providing that the applicable interest rate shall be the interest rate in effect on the date of the loan closing, the interest rate charged on a loan involving multiple advances of Federal funds using temporary debt instruments shall be the interest rate in effect on the date on which the first applicable temporary debt instrument is issued.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd81013f2262740f5938b2629421d3043"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $100,000,000.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id16613cdee2e04bc884d4044f30f9c7e2"><enum>103.</enum><header>Acceptance of SNAP benefits through online transactions for certain delivery costs</header><text display-inline="no-display-inline">Section 7(k) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016(k)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2355be8f1f544d96a106826b93555b28"><enum>(1)</enum><text>by striking <quote>on-line</quote> each place it appears and inserting <quote>online</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide37bf9b5020a4f72875efcb0c255f5a7"><enum>(2)</enum><text>in paragraph (1), by striking <quote>paragraph (4)</quote> and inserting <quote>the requirements of this subsection</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74ba112a8bd042ef8119af1fb85e0ada"><enum>(3)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ide248110f7cb64a72bde7dc97e9e1e7ed"><paragraph commented="no" display-inline="no-display-inline" id="id1be2b572ec0a49e284bdf5155b5459b7"><enum>(2)</enum><header>Requirements to accept benefits</header><text>A retail food store seeking to accept benefits from recipients of supplemental nutrition assistance through online transactions shall submit to the Secretary for approval a plan that includes—</text><subparagraph id="id01d5ec24654341f382363a0855574c57"><enum>(A)</enum><text>a method of ensuring that benefits may be used to purchase only eligible items under the supplemental nutrition assistance program;</text></subparagraph><subparagraph id="id1c18868ea53949198a22923417653c74"><enum>(B)</enum><text>a description of the method of educating participant households about the availability and operation of online purchasing;</text></subparagraph><subparagraph id="id8d671f7c8c2e4ecf9e12b9132f1e9b2c"><enum>(C)</enum><text>adequate testing of the online purchasing option prior to implementation;</text></subparagraph><subparagraph id="ida8eee0a2e07b41d19a83b2cadca0d341"><enum>(D)</enum><text>the provision of data, as requested by the Secretary, to analyze the impact of the project on participant access, ease of use, and program integrity;</text></subparagraph><subparagraph id="idc789cefb146d48dbbdac02f4c33693b3"><enum>(E)</enum><text>recipient protections regarding privacy, ease of use, access, and support similar to the protections provided for transactions made in retail food stores;</text></subparagraph><subparagraph id="id1521cff2ccca4a099e40fb3268d06a15"><enum>(F)</enum><text>except as provided in paragraph (4), a method to ensure benefits are not used to pay delivery, ordering, convenience, or other fees or charges;</text></subparagraph><subparagraph id="idbfa9ad9496f04b93859a1f2b72aeca56"><enum>(G)</enum><text>clear notification to participating households at the time a food order is placed of any delivery, ordering, convenience, or other fee or charge associated with the food purchase;</text></subparagraph><subparagraph id="idcfa4d4a0d5364ef98c2c0cdec24c536a"><enum>(H)</enum><text>a method to ensure the security of online transactions by using the most effective technology available that the Secretary considers appropriate and cost-effective and that is comparable to the security of transactions at retail food stores; and</text></subparagraph><subparagraph id="id3af4acf5a0c3490dbfdb39082b2951eb"><enum>(I)</enum><text>any other criteria established by the Secretary.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23e10351f22441b78aca29d196cacded"><enum>(4)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idef5a768f366b4216a17327fe09d5ff15"><paragraph id="id6e51972d660a490cad67fed86edb0573"><enum>(4)</enum><header>Delivery costs</header><text>Benefits may be used for the fees and charges described in paragraph (2)(F) in the case of the purchase of foods that must be delivered to, but not within, a rural hub community or outlying village in a noncontiguous State.</text></paragraph><paragraph id="id84a647e9c0224aba806026607b92d622"><enum>(5)</enum><header>Stakeholder consultation</header><text>The Secretary shall establish a formal process for consultation with State agencies, retail food stores authorized under section 9 (including retail food stores serving rural and frontier communities), electronic benefit transfer processors, consumer advocates, and other relevant stakeholders to incorporate lessons learned from online purchasing operations during the period of 2014 through 2025.</text></paragraph><paragraph id="id88a086fe5eb44d1dba9e57bacf9c5a8f"><enum>(6)</enum><header>Report to Congress</header><text>Not later than 120 days after the effective date of this paragraph, the Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report describing the consultation process under paragraph (5) and recommendations received.</text></paragraph><paragraph id="id6f7f3179be7e4dd599815cb13b2d9a94"><enum>(7)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this paragraph, the Secretary shall promulgate such regulations and issue such guidance as are necessary to carry out this subsection, which shall be informed by the consultation conducted under paragraph (5).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idab00d32df0284e109e732a639ba6bc47"><enum>104.</enum><header>Nonduplication of penalty</header><subsection id="id06de7e43472f41d79c68b052e9f6400e"><enum>(a)</enum><header>In general</header><text>Section 4(a)(2)(B) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2013">7 U.S.C. 2013(a)(2)(B)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="ideef4781ff3e748e5b01d46cb2acbbb31"><clause id="idc40b812aab4f44d49e358cdfb7163d75"><enum>(iv)</enum><header>Nonduplication of penalty</header><text>Notwithstanding subparagraphs (C) through (F) of section 16(c)(1), the Secretary shall not establish a liability amount (as defined in subparagraph (C) of that section) or designate an at-risk amount (as defined in subparagraph (D)(i)(II) of that section) for a State that owes a State share pursuant to this paragraph.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3fd85dd99b854057bd94d0482be43922"><enum>(b)</enum><header>Administrative and judicial review</header><text>Section 16(c)(7) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(c)(7)</external-xref>) is amended—</text><paragraph id="id6784fa82d5c64af382f4315780c61dd9"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>or section 4(a)(2)(B)</quote> after <quote>paragraph (1)</quote>; and</text></paragraph><paragraph id="id11a243f27ad743b490dae13ec9a3b30c"><enum>(2)</enum><text>in subparagraph (B), by inserting <quote>or section 4(a)(2)(B)</quote> after <quote>paragraph (1)(C)</quote>.</text></paragraph></subsection></section><section id="idb8e62ff499c345edac5ca2d47d13525d"><enum>105.</enum><header>Tolerance level for excluding small errors</header><text display-inline="no-display-inline">Section 16(c)(1)(A)(ii)(II) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2025">7 U.S.C. 2025(c)(1)(A)(ii)(II)</external-xref>) is amended—</text><paragraph id="iddad797d015574cf9a75810f44e945b78"><enum>(1)</enum><text>by striking <quote>thereafter, the amount</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id7d1ac226b4af4aa18be36cffa2091565"><text>thereafter—</text><item id="id24025ef47b904a2f8c07b10bde25a969"><enum>(aa)</enum><text>the amount</text></item><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idbd2fa398ac244e3fb3c3cc7b334137c8"><enum>(2)</enum><text>in item (aa) (as so designated), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="idf15e3cd5c95b4ecb958e402b8d9a57d6"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbd2d8bf028a34314a75968fdb86e4b04"><item id="idd311504a6e8b44fcbf210b1175314b3f"><enum>(bb)</enum><text>in the case of households that reside in a region for which cost adjustments in the thrifty food plan are made under section 3(u)(3)(A), 20 percent of the maximum allotment for a 1-person household in that region.</text></item><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id34499e7747ac4e6e98c3d2f9bfd12011"><enum>106.</enum><header>Fee agents serving rural Alaska residents</header><text display-inline="no-display-inline">Section 11(m) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2020">7 U.S.C. 2020(m)</external-xref>) is amended, in the first sentence, by inserting <quote>serving residents living</quote> after <quote>agents</quote>.</text></section><section id="id2bab0d58a0ff4d4b999f4ad7f7cffe3b"><enum>107.</enum><header>Pilot program to purchase locally produced food</header><text display-inline="no-display-inline">Section 203D of the Emergency Food Assistance Act of 1983 (<external-xref legal-doc="usc" parsable-cite="usc/7/7507">7 U.S.C. 7507</external-xref>) is amended—</text><paragraph id="idc074eeda2e4e4659ada557a0ae9702e3"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id54fb3b76a2b54095b9480b5dae67dc76"><enum>(A)</enum><text>by striking <quote>distribution, to store, handle or distribute</quote> and inserting the following: “distribution—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id827955590b0242009044de4218b4cb4c"><paragraph id="id1e46cf07eb3e4fe89e08207080b4d620"><enum>(1)</enum><text>to store, handle, or distribute</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id1e19cdfc64c348969ece8891db3dc14f"><enum>(B)</enum><text>in paragraph (1) (as so designated), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idc684e956951b4039bd99246e8765b914"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7b676499c1a84b3f9c4c29b0904b5724"><paragraph id="id3375c9aef3e7441b8981c7de2488eb92"><enum>(2)</enum><text>to purchase locally produced food in accordance with the pilot program established under subsection (g).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id12ea49f1c9104b5ea55159c2eaa836ad"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb1027113ba1540ca9d4391ed67aa9fa8"><subsection id="id54ea9e644ec84df38033feb4f5b5c747"> <enum>(g)</enum> <header>Pilot program To purchase locally produced food</header> <text>The Secretary shall establish a pilot program under which the Secretary shall permit emergency feeding organizations participating in the program authorized by this Act to use those funds to purchase locally produced food to supplement the commodities provided by the Secretary under this Act.</text>
 </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="id403060dff4de47579865b2b6ce29837f" style="OLC"><enum>II</enum><header>Improving support for farmers and food processing</header><section id="id706dc5d1dba64609b42cc9d9567018fb"><enum>201.</enum><header>Forgivable loans for small commercial food processing</header><subsection commented="no" display-inline="no-display-inline" id="id5bd3072af3d24f28a99d086fb36a460d"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of eligible entity</header><text>In this section, the term <term>eligible entity</term> means an individual or entity that is an agricultural producer or owns or operates, or seeks to own or operate, a commercial food processing operation that—</text><paragraph commented="no" display-inline="no-display-inline" id="id76DB724407424E6993D4382EA34DA57F"><enum>(1)</enum><text display-inline="yes-display-inline">holds a commercial license issued by a noncontiguous State; and</text></paragraph><paragraph id="id8d054525bae543198de92c372601ffe9"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc8cba68beb364d298e001d10a3107437"><enum>(A)</enum><text>carries on a farming business (within the meaning of <external-xref legal-doc="usc" parsable-cite="usc/26/263A">section 263A(e)(4)</external-xref> of the Internal Revenue Code of 1986); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="idd5cadb4fd831475e928ed53ce0dd68a1"><enum>(B)</enum><text display-inline="yes-display-inline">conducts a commercial food processing operation that is a small business concern (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc3d2a8557a344f03b29da1078757398e"><enum>(b)</enum><header>Establishment</header><text>The Secretary shall establish a program, to be known as the <quote>Arctic Agriculture Accelerator Loan Program</quote>, to provide—</text><paragraph commented="no" display-inline="no-display-inline" id="id2154f3d38f2748389e6ebe7e1d9079c1"><enum>(1)</enum><text display-inline="yes-display-inline">loans to eligible entities to start or expand a small commercial food processing operation; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id26cfb39712914d79b1dbb4f072940d93"><enum>(2)</enum><text>forgiveness of those loans in accordance with subsection (f).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id03ef5fb4612d45d89013efa46602b40b"><enum>(c)</enum><header>Applications</header><text>To apply for a loan under subsection (b)(1), an eligible entity shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including a description of activities described in subsection (d) that the eligible entity will carry out using the loan.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id098a5430104a4344bd843e103afa7cc7"><enum>(d)</enum><header>Eligible activities</header><text>An eligible entity that receives a loan under subsection (b)(1) may use the loan funds for the purchase and installation of equipment, the construction or renovation of facilities, or any other activity to create or expand the capacity of the eligibility entity to process, store, or distribute locally produced food.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3fb9a041fd224d078ef8b6c44c2846cd"><enum>(e)</enum><header>Loan amounts</header><text>The amount of a loan under subsection (b)(1) shall be—</text><paragraph commented="no" display-inline="no-display-inline" id="idb8d6ba2f14c74c748172c25ae452d846"><enum>(1)</enum><text>$150,000 in the case of an eligible entity that owns or operates, or seeks to own or operate, a small commercial food processing operation for specialty crops or grains; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideef0cead13824aad8e548d447f7562c9"><enum>(2)</enum><text>$250,000 in the case of an eligible entity that owns or operates, or seeks to own or operate, a small commercial food processing operation for meat, poultry, egg, aquaculture, or wild-caught fish products.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id0d819f232a254536808cc5ccbeeb9704"><enum>(f)</enum><header>Loan forgiveness</header><text>The Secretary shall forgive the indebtedness of a borrower of a loan under subsection (b)(1) if the Secretary determines that the borrower has successfully carried out the activities described in the application submitted by the borrower under subsection (c).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idff47c3d2bcf64c6ea7460e6815eb70c0"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated for the cost of loans and forgiveness of loans to carry out this section $10,000,000 for each of fiscal years 2027 through 2031.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id7f21536be0474edd8b88fad9a0e1c013"><enum>202.</enum><header>Improving the geographically disadvantaged farmers and ranchers program</header><text display-inline="no-display-inline">Section 1621(c)(3)(B) of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/8792">7 U.S.C. 8792(c)(3)(B)</external-xref>) is amended by striking <quote>$15,000,000</quote> and inserting <quote>$20,000,000</quote>.</text></section></title><title id="id4eadb48d2db747498ee6d78ca0fb93d1" style="OLC"><enum>III</enum><header>Improving seafood industry</header><section id="id1a6ff63d7c9b4d95ab3570760052f8ca" commented="no"><enum>301.</enum><header>Country of origin labeling for cooked crab</header><text display-inline="no-display-inline">Section 281(1) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1638">7 U.S.C. 1638(1)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id9fa999e773e44d2da2d2916e06a6e9f7"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>The term</quote> and inserting <quote>Except as provided in subparagraph (C), the term</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6ff8d05c7796497a945991a31260ec07"><enum>(B)</enum><text display-inline="yes-display-inline">acquiring, operating, and maintaining a commercial fishing vessel.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1ede3f34f3b94408aa4441a904abc07d"><enum>(3)</enum><header>Farm operating loans</header><text>Section 312 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1942">7 U.S.C. 1942</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id35B414F238A6443F8F67025747A7167A"><subsection commented="no" display-inline="no-display-inline" id="idB5B3B00D995B4D82BC6601F7A97A11D1"><enum>(f)</enum><header>Commercial fishers</header><text>A commercial fisher may use a direct or guaranteed loan under this subtitle for acquiring, operating, and maintaining a commercial fishing vessel.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9023a0559d694ad58cb8caac6bede328"><enum>(b)</enum><header>Farmers' markets and local food promotion program</header><text>Section 210A(d)(6) of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1627c">7 U.S.C. 1627c(d)(6)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB3EEBA93615F44769ABFD2638A6C067B"><subparagraph commented="no" display-inline="no-display-inline" id="idfd247102cb8f409399cc0c7b766ca3ee"><enum>(F)</enum><header>Eligibility of wild-caught fish and shellfish</header><text>For purposes of this paragraph, an agricultural commodity or product described in subsection (a)(12) shall include fish (as defined in paragraph (14)(B) of section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idbadf89c9b9b54583869e03e945119a03"><enum>303.</enum><header>Domestic seafood production</header><subsection commented="no" display-inline="no-display-inline" id="id5d660450e86444888f4ec465e928c20c"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id48e77ce25ce94e35a1ae5dcc73ddb29e"><enum>(1)</enum><header>Mariculture</header><text>The term <term>mariculture</term> means shellfish and aquatic plants grown under controlled conditions.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddf9058e55f414d1f91b94c36c9ffa9f1"> <enum>(2)</enum> <header>Rural community</header> <text>The term <term>rural community</term> means a coastal community located in a rural area (as defined in section 343(a) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991(a)</external-xref>)).</text>
 </paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaebac3cc99d24a1b9c3d684b1afa2251"><enum>(3)</enum><header>Seafood</header><text>The term <term>seafood</term> means wild-caught finfish and shellfish.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id85240fe76dad476cb9e3ee57dfa56683"><enum>(b)</enum><header>Action plan and selection of coastal communities</header><paragraph commented="no" display-inline="no-display-inline" id="idc934cf97536c44169066afed4383cc4f"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary, in consultation with the Secretary of Commerce, shall develop an action plan to facilitate increased domestic processing of United States-caught seafood and mariculture.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1c3bed87ad324e2a98d55e9d32f34d16"><enum>(2)</enum><header>Inclusions</header><text>The action plan developed under paragraph (1) shall include—</text><subparagraph id="ide1d1587198904193a306568e30c684ae"><enum>(A)</enum><text>an identification of coastal communities in which—</text><clause commented="no" display-inline="no-display-inline" id="id0676e9d1d8754f89a48553285b3805e6"><enum>(i)</enum><text display-inline="yes-display-inline">commercial fishing is a significant economic driver; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3c58c72de0c34d768e1278a5567da7cd"><enum>(ii)</enum><text display-inline="yes-display-inline">there exists a need, and voiced community desire, for the creation of new (or rehabilitation of existing) seafood processing infrastructure to allow those communities—</text><subclause commented="no" display-inline="no-display-inline" id="id5a75e2d32232485680afe6a06c6bb37c"><enum>(I)</enum><text display-inline="yes-display-inline">to effectively process the catch of the communities locally; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5c8098d220894f47a9a421583c963416"><enum>(II)</enum><text display-inline="yes-display-inline">to provide for the local and domestic market;</text></subclause></clause></subparagraph><subparagraph id="id667e2fbf8acb4e1bb96ff7f4236cda37"><enum>(B)</enum><text>an identification of coastal communities with existing or developing mariculture operations in which processing infrastructure is not sufficient to meet the needs of the mariculture operations;</text></subparagraph><subparagraph id="id920fd53dc5f44e25a7d208588457bb87"><enum>(C)</enum><text>a consideration of the diversity of coastal communities, including geographic diversity;</text></subparagraph><subparagraph id="idcc18c07ed1404938859d62853d167e4e"><enum>(D)</enum><text>an assessment of the number of coastal communities described in subparagraphs (A) through (C) that qualify as rural communities; and</text></subparagraph><subparagraph id="ide2366806f6f84dfa8d5be55e729bc52a"><enum>(E)</enum><text>an analysis of the current domestic seafood supply chain, including a carbon footprint.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17c053c3bf9547589f8f7ab388a7ee6d"><enum>(3)</enum><header>Selection of eligible communities</header><text>The action plan developed under paragraph (1) shall include a selection of 5 coastal communities across the United States that would be eligible for the grants and cooperative agreements under subsection (c).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id786f4b23e8c94711934e8755d64f8fd1"><enum>(4)</enum><header>Stakeholder engagement</header><text>In developing the action plan under paragraph (1), the Secretary, in consultation with the Secretary of Commerce, shall provide a meaningful stakeholder engagement process that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id12542c0d956e4c3189179eddfc41a227"><enum>(A)</enum><text>prioritizes outreach and engagement through methods that effectively reach residents of rural communities described in subparagraphs (A) through (C) of paragraph (2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0c091eeb7c2847dfa672752ba62905e9"><enum>(B)</enum><text>provides an opportunity for public comment regarding a draft of the action plan, and incorporation of any comments received by the date that is 60 days after the end of the public comment period.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5b60fca554da4584bf898d41820357b3"><enum>(c)</enum><header>Grants and cooperative agreements To support local seafood processing</header><paragraph id="id8ff197b1b7de483faf175ca97895fe31"><enum>(1)</enum><header>In general</header><text>Using funds made available under subsection (f), the Secretary shall, for the period of fiscal years 2027 and 2028, make competitive grants or enter into cooperative agreements—</text><subparagraph id="id8c6a03d273284100b7bdf16a6f6ece0d"><enum>(A)</enum><text>to support pilot projects for new seafood or mariculture processing infrastructure in eligible communities selected under subsection (b)(3);</text></subparagraph><subparagraph id="id73f2dff773934ed58949b57580099f74"><enum>(B)</enum><text>to support pilot projects for the rehabilitation, repair, or retrofitting of existing seafood or mariculture processing infrastructure in those eligible communities;</text></subparagraph><subparagraph id="id2a0c401476804204a0881e141f4b7b36"><enum>(C)</enum><text>to host onsite local training, education, outreach, and technical assistance initiatives for working waterfront populations in those communities; or</text></subparagraph><subparagraph id="id9a53a13f3ed84d6aa3caa6ced92bb39d"><enum>(D)</enum><text>to provide preference for community members from those eligible communities in the startup of pilot seafood or mariculture processing facilities exclusively designed for serving domestic and local markets, which shall include—</text><clause id="ide9ab33a6c0314a65b29816be94840cf6"><enum>(i)</enum><text>entrepreneurship and business training;</text></clause><clause id="id056831906d5c416dbc6140beea6c3646"><enum>(ii)</enum><text>financial and risk management training; and</text></clause><clause id="idc6a736c126344b2487dd60ba03961e3c"><enum>(iii)</enum><text>food safety and recordkeeping.</text></clause></subparagraph></paragraph><paragraph id="id30a7e15256fd4b4196d6cd0e49b0f876"><enum>(2)</enum><header>Eligibility</header><text>To be eligible to receive a grant or enter into a cooperative agreement under paragraph (1), the recipient of the grant or participant in the cooperative agreement shall be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6ffc5118d4ac4cb1985a85dfa6864a3f"><enum>(A)</enum><text display-inline="yes-display-inline">a collaborative State, Tribal, local, or regionally based network or partnership of public or private entities; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id47cc852a66934dbb925875fe1d0d9216"><enum>(B)</enum><text>an individual seafood or mariculture processing company.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19ef619f9ba1403ab773ba706eedcf69"><enum>(3)</enum><header>Priorities</header><text display-inline="yes-display-inline">In making grants or entering into cooperative agreements under paragraph (1), the Secretary shall give priority to—</text><subparagraph id="id1cbf8cbdd28e4492827a95fff863f3b0"><enum>(A)</enum><text>projects that commit—</text><clause id="id14ee364fd38a483087dc356146732926"><enum>(i)</enum><text>to sell a substantial quantity of seafood domestically, as determined by the Secretary;</text></clause><clause id="idda3d658dceae4ea19e68a141a0ffcae0"><enum>(ii)</enum><text>to meaningful local-hire practices, as determined by the Secretary;</text></clause><clause id="id605ddcb8e6974c53a838bb55f878b22d"><enum>(iii)</enum><text>to avoiding additional overburdening of rural communities, such as by minimizing additional vehicular traffic; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idbf8a69672f514b2587b0dadf8fdad5fe"><enum>(iv)</enum><text display-inline="yes-display-inline">to supporting innovative transportation networks to minimize adverse impacts on adjacent communities;</text></clause></subparagraph><subparagraph id="id413495111e094c7f9239ed0c62f55ace"><enum>(B)</enum><text>projects that—</text><clause id="ida60170b1d1ec4d7f9e82e6c315da7420"><enum>(i)</enum><text>colocate with, or supply, community fish markets or community-based seafood distributors, such as local farmers’ markets;</text></clause><clause id="id4c9ca5cf3562443ca3c3342da43ce886"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idad5d3b55c7514b73bf9e16745777dd03"><enum>(I)</enum><text>would retrofit or update existing infrastructure; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd3faafd6f11647cbbb7715720e174b69" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">are zoned for mixed use, such as a processing plant with an adjacent community fish market; or</text></subclause></clause><clause id="id7a48b26a6fb442c1ae0c7e330e0a229a"><enum>(iii)</enum><text>include partnerships with schools or organizations that address food security and hunger; and</text></clause></subparagraph><subparagraph id="idcd6083d80a144f41ae286cb2e8d7a375"><enum>(C)</enum><text>community-based businesses and organizations with expertise in working with rural communities and coastal communities.</text></subparagraph></paragraph><paragraph id="id4058cdebb74449f5a04587f11a16c88a"><enum>(4)</enum><header>Evaluation criteria</header><text>In making grants or entering into cooperative agreements under paragraph (1), the Secretary shall evaluate, with respect to applications for the grants or cooperative agreements—</text><subparagraph id="idf5eb5491319048c3837701161a0122b8"><enum>(A)</enum><text>relevancy;</text></subparagraph><subparagraph id="id73399565862a4ae2a70d864ce2e44cdd"><enum>(B)</enum><text>technical merit;</text></subparagraph><subparagraph id="id26bf842c2ef04e82b2401d45cc8864bf"><enum>(C)</enum><text>achievability, expertise, and track record; and</text></subparagraph><subparagraph id="id44d43baf014c415498a447560b039244"><enum>(D)</enum><text>equity and environmental justice impacts.</text></subparagraph></paragraph><paragraph id="id0180755089484d1ba6ecc9d8dbf654e9"><enum>(5)</enum><header>Requirements</header><text>A grant or cooperative agreement under paragraph (1) shall be for an amount and term determined appropriate by the Secretary.</text></paragraph><paragraph id="id81d8e3b0f62e4aedaa3ecec4db0715b3"><enum>(6)</enum><header>Interagency funding</header><text>Any Federal agency may participate in any grant or cooperative agreement under paragraph (1) by contributing funds, if the contributing agency determines that the objectives of the grant or cooperative agreement will advance the authorized programs of the contributing agency.</text></paragraph><paragraph id="id688a25093f784da7b6e9b854eaa91d90"><enum>(7)</enum><header>Limitation on indirect costs</header><text>A recipient of a grant or a party to a cooperative agreement under paragraph (1) may not use more than 10 percent of the funds received for the indirect costs of carrying out the grant or cooperative agreement.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5194b32352c74fcbac49ef60d3f6a7d4"><enum>(d)</enum><header>Evaluation of action plan, grants, and cooperative agreements</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary, in consultation with the Secretary of Commerce, shall submit to Congress a report evaluating the effectiveness of the action plan developed under subsection (b) and the grants and cooperative agreements made or entered into under subsection (c), including—</text><paragraph commented="no" display-inline="no-display-inline" id="id7bd932cc46824d35b33edd3c28575bd9"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of social and economic benefits resulting from projects carried out using those grants and cooperative agreements; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8d129513eccd499d8845b1407c0b6d27"><enum>(2)</enum><text>recommendations—</text><subparagraph commented="no" display-inline="no-display-inline" id="id57478e0ef1f346fead432547e60f189e"><enum>(A)</enum><text display-inline="yes-display-inline">to improve the effectiveness of the action plan and the grants and cooperative agreements; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id31412634f7d94280b272012fd35c8ce1"><enum>(B)</enum><text display-inline="yes-display-inline">to expand projects carried out using the grants and cooperative agreements to additional coastal communities.</text></subparagraph></paragraph></subsection><subsection id="iddf5498e7292648408c902d2326ca9491"><enum>(e)</enum><header>Exclusive Economic Zone prohibitions</header><paragraph commented="no" display-inline="no-display-inline" id="id3b645d373b5e44d08b3e24caf9dd9fea"><enum>(1)</enum><header display-inline="yes-display-inline">Prohibition on authorizing finfish aquaculture</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no Federal agency shall permit, authorize, or otherwise regulate commercial finfish aquaculture operations in the Exclusive Economic Zone of the United States (as established by Proclamation Numbered 5030, dated March 10, 1983), except in accordance with a law authorizing such an action that is enacted after the date of enactment of this Act.</text></paragraph><paragraph id="id2e578974933c412582c370eefbcfdaac"><enum>(2)</enum><header>Prohibition on funds to promote finfish aquaculture</header><text display-inline="yes-display-inline">No Federal funds available to the National Oceanic and Atmospheric Administration shall be used to award grants to facilitate or otherwise regulate finfish aquaculture in Federal waters.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9a3109830fee4ae6a91f963a151b9339"><enum>(f)</enum><header>Funding</header><paragraph id="id0fb375b959f6408985cc13224d76d8b4"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $15,000,000 for each of fiscal years 2027 and 2028.</text></paragraph><paragraph id="idc9efac10d7b247258f6c4d14e8b01346"><enum>(2)</enum><header>Reservation of funds</header><text>Of the amounts made available under paragraph (1)—</text><subparagraph id="id949df682332d42b287862c375af8fc70"><enum>(A)</enum><text>$200,000 shall be used to carry out subsection (b) during fiscal year 2027, to be divided equally between the Secretary and the Secretary of Commerce;</text></subparagraph><subparagraph id="idca50fe4deea4484b9daf785b148608ea"><enum>(B)</enum><text>$200,000 shall be used to carry out subsection (d) during fiscal year 2028; and</text></subparagraph><subparagraph id="idc7fd8ff102ab4109aebd2515b040572d"><enum>(C)</enum><text>the remaining amounts shall be used, subject to paragraphs (3) and (4)—</text><clause commented="no" display-inline="no-display-inline" id="idd4313dd2bdfa42e09a755c0ac546fc44"><enum>(i)</enum><text display-inline="yes-display-inline">to carry out subsection (c); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id6ba6482d61054c0bb4277e9ff45ed02a"><enum>(ii)</enum><text display-inline="yes-display-inline">for expenses relating to the administration of this section.</text></clause></subparagraph></paragraph><paragraph id="iddc7922701d67424d8822475650a12ab7"><enum>(3)</enum><header>Allocation of funds</header><text>A majority of the amount made available to carry out subsection (c) for any fiscal year shall be used to support coastal communities that are rural communities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idac33e225c036421c9af6b60b6dd9c238"><enum>(4)</enum><header>Administrative expenses</header><text>Not more than 5 percent of the amounts made available to carry out this section for a fiscal year may be used for expenses relating to the administration of this section.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id865cfba8236d4662bc2f32278b925122"><enum>304.</enum><header display-inline="yes-display-inline">Grant program to promote the reuse, recycling, and sustainable use of marine products from seafood industry</header><subsection commented="no" display-inline="no-display-inline" id="ideac8cab716854ee1be3b7f01dfb5a3db"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text>The purpose of this section is to support projects that promote the reuse, recycling, and sustainable use of marine products from the seafood industry.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id963354f7b4d840ca8676defca024ffe7"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id95698329d81d433f87b863deb3fdb3c8"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcf4277c38c31429da6640e594652aa45"><enum>(A)</enum><text display-inline="yes-display-inline">an academic institution;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1ea6e48748f74a7785ec693590ca52ef"><enum>(B)</enum><text display-inline="yes-display-inline">a nonprofit organization; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idaabe8787920c41229456727ecd17ed89"><enum>(C)</enum><text display-inline="yes-display-inline">a for-profit company.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd76c04b1c0244b2a4a408fec95603cf"><enum>(2)</enum><header display-inline="yes-display-inline">Marine product</header><text>The term <term>marine product</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ide6ef79c1073e4ea885aed6528cd18a83"><enum>(A)</enum><text display-inline="yes-display-inline">chitin derived from marine animals, including crustaceans, mollusks, and the scales, shells, or waste of any marine animal;</text></subparagraph><subparagraph id="id7c318b009cbf4955a3ca7040c1999b3e"><enum>(B)</enum><text>seaweed;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3ed7dee0cc674e8696f9d0d8d500f9ee"><enum>(C)</enum><text>marine waste from seafood; and</text></subparagraph><subparagraph commented="no" id="ide52ef31afaf049b0b61d213b52d2352d"><enum>(D)</enum><text>any other product or byproduct of the seafood industry that, in the determination of the Secretary—</text><clause commented="no" id="id5245d7e42d7a4c508984221a720f0da9"><enum>(i)</enum><text>would ultimately end in a landfill or other waste disposal facility if not reused, recycled, or put to use in a manner consistent with the purpose of this section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf5fcb97057f44ae48d70c8834efe1f84"><enum>(ii)</enum><text>demonstrates promise for reuse, recycling, or sustainable use.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id116193d4bc134a8d8ae1406329bfeefd"><enum>(3)</enum><header>Reuse, recycling, or sustainable use</header><text>The term <term>reuse, recycling, or sustainable use</term>, with respect to a marine product, includes use of the marine product—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5e97c2565b87497386acc10badf5ca92"><enum>(A)</enum><text display-inline="yes-display-inline">as a fertilizer;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb26048da38df4513b72b32065d105bce"><enum>(B)</enum><text>as a biostimulant;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idefff5becc27840979e70f510547ec647"><enum>(C)</enum><text>as a component in a plastic alternative;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38f30152d2664a4f8ba536ddbd16d69b"><enum>(D)</enum><text>in soil amendment and remediation;</text></subparagraph><subparagraph id="idfa2af8a03abe4cc1a788345c5c9063c6"><enum>(E)</enum><text>in wastewater treatment; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb394e26db92445328047ebe61de0e25f"><enum>(F)</enum><text>for collagen extraction.</text></subparagraph></paragraph></subsection><subsection id="id4d2a639268334b5ab76b3a658b36ca26"><enum>(c)</enum><header>Grant program</header><paragraph commented="no" display-inline="no-display-inline" id="ide1e17097efc34e579a734a04d5297a66"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a program under which the Secretary shall provide grants to eligible entities for projects that involve the reuse, recycling, or sustainable use of 1 or more marine products from the seafood industry.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideb84459a8541461dbd3241928fa118bc"><enum>(2)</enum><header>Set-aside</header><text>The Secretary shall set aside 50 percent of the amounts appropriated to carry out the program established under paragraph (1) to make grants to eligible entities that are domiciled, or have an operating location, in a State that, as determined by the Secretary, is among the States with the greatest length of coastline.</text></paragraph></subsection><subsection id="id66f99889208f479fadf3258517abd943"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section.</text></subsection></section><section id="id11173879951e4a8a82958dfce3301e7a"><enum>305.</enum><header>Wild USA seafood label</header><text display-inline="no-display-inline">Title II of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1bd1c9a2d8a9433a877e398a4236c8d7"><subtitle id="id65329d45e56c47adb19febcc5298ef34"><enum>H</enum><header>Wild USA seafood label</header><section id="idfda3cff268cf4896909ea698ff41946d"><enum>298A.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="id0993e21d1e4f415e8da6adc5d65336d1"><enum>(1)</enum><header>Fish</header><text>The term <term>fish</term> means finfish, mollusks, crustaceans, and all other forms of aquatic animal and plant life other than aquatic mammals and birds.</text></paragraph><paragraph id="idffb5688c50344d4e971c4257aaaab447"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></section><section id="id6c880c204d0a42b2a2bb8c6ed6aa8dd5"><enum>298B.</enum><header>Wild USA seafood label</header><subsection id="idefa05d0538aa489a9407e1173a3017e4"><enum>(a)</enum><header>In general</header><text>A retailer of fish or person engaged in the business of supplying fish to a retailer may label the fish as <quote>wild USA seafood</quote>, <quote>wild American seafood</quote>, or any equivalent designation only if—</text><paragraph id="iddcd1a8bab6304bdf9a24332cd8668f2a"><enum>(1)</enum><text>the fish is—</text><subparagraph id="id8b9e51c715434a8a94ba95659eb32658"><enum>(A)</enum><text>naturally born in the wild; or</text></subparagraph><subparagraph id="idff0d340d2f5b4688bf85ecaa2ada74da"><enum>(B)</enum><text>a hatchery-originated fish released in the wild;</text></subparagraph></paragraph><paragraph id="idbc94e81ac55c496fa513eb7254fbf72b"><enum>(2)</enum><text>the fish is caught, taken, or harvested from—</text><subparagraph id="id55370293a1324c0b8cbef6d9779a44cd"><enum>(A)</enum><text>waters within the exclusive economic zone (as defined in section 107 of title 46, United States Code); or</text></subparagraph><subparagraph id="id487d17ab7eb3460b9dabf0beabf54b72"><enum>(B)</enum><text>navigable waters (as defined in section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>)); and</text></subparagraph></paragraph><paragraph id="id70ca1e061dc94848b3982067668d27b5"> <enum>(3)</enum> <text>if the fish is caught, taken, or harvested by a vessel, that vessel is a vessel of the United States (as defined in section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>)).</text>
 </paragraph></subsection><subsection id="ide82b30548f974e2080472bd76d45ea2c"><enum>(b)</enum><header>Method of notification</header><paragraph id="ida3de4e5617834944b59f4f5607cb0cb5"><enum>(1)</enum><header>In general</header><text>The information described in subsection (a) may be provided to consumers by means of a label, stamp, mark, placard, or other clear and visible sign on the fish, or on the package, display, holding unit, or bin containing the fish, at the final point of sale to consumers.</text></paragraph><paragraph id="id30a36ad6a84f41bc9aa08d05b690a81a"><enum>(2)</enum><header>Labeled commodities</header><text>If fish is already individually labeled for retail sale with the label described in subsection (a), the retailer shall not be required to provide any additional information to comply with this section.</text></paragraph></subsection></section><section id="idbae5406fe127482197dcdba90a3fc22e"><enum>298C.</enum><header>Enforcement</header><subsection id="id1fdeb9c7b742463ca71d76bc69bc6fca"><enum>(a)</enum><header>Warnings</header><text>If the Secretary determines that a retailer of fish or person engaged in the business of supplying fish to a retailer is in violation of section 298B, the Secretary shall—</text><paragraph id="id4efc3dc6ead4477397c43e1a54cefe82"><enum>(1)</enum><text>notify the retailer or person of the determination of the Secretary; and</text></paragraph><paragraph id="id71a8d49f35b54116a8ba5ae19626ccc6"><enum>(2)</enum><text>provide the retailer or person a 30-day period, beginning on the date on which the retailer or person receives the notice under paragraph (1) from the Secretary, during which the retailer or person may take necessary steps to comply with section 298B.</text></paragraph></subsection><subsection id="id3cc7fa401bfa43f08f57da3df6dd6bcf"><enum>(b)</enum><header>Fines</header><paragraph id="id6588f28fff0346cd9455c30953310140"><enum>(1)</enum><header>In general</header><text>The Secretary may fine a retailer or person under paragraph (2) if, on completion of the 30-day period described in subsection (a)(2), the Secretary determines that the retailer or person—</text><subparagraph id="ida1b5d1dec0e54654bb1910d457dc2ff7"><enum>(A)</enum><text>has not made a good faith effort to comply with section 298B; and</text></subparagraph><subparagraph id="id5ff43224061a4b93879feb7c747b8699"><enum>(B)</enum><text>continues to willfully violate section 298B with respect to the violation regarding which the retailer or person received a notification under subsection (a)(1).</text></subparagraph></paragraph><paragraph id="id35c3ce70e73d47d1908c3a48d33d6fbd"><enum>(2)</enum><header>Notice and hearing; amount</header><text>After providing notice and an opportunity for a hearing before the Secretary with respect to the violation described in paragraph (1), the Secretary may fine the retailer or person in an amount equal to not more than $10,000 for each violation.</text></paragraph></subsection></section><section id="id9b39f2d32fdb4dd3b8b79752831171be"><enum>298D.</enum><header>Regulations</header><text display-inline="no-display-inline">The Secretary may promulgate such regulations as are necessary to implement this subtitle.</text></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id35e75c4e7ffe4470afa912b48ee16388"><enum>306.</enum><header>Market name for genetically engineered fish</header><subsection id="id6575ecc8658b421b9e6f061ce5f0fc2d"><enum>(a)</enum><header>In general</header><text>Notwithstanding subtitle E of title II of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639">7 U.S.C. 1639 et seq.</external-xref>), or any other provision of law, for purposes of applying the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>), the acceptable market name of any fish product that is genetically engineered shall include the words <quote>Genetically Engineered</quote> or <quote>GE</quote> prior to the existing acceptable market name.</text></subsection><subsection id="id18ddeab46d8f417c87b53d3a2ff5a2e6"><enum>(b)</enum><header>Genetically engineered described</header><text>For purposes of this section, a fish product shall be considered to be genetically engineered if the fish product has been modified by recombinant DNA (rDNA) techniques, including the entire lineage of fish that contain the rDNA modification.</text></subsection></section><section id="idd2e20597fee44a24a0a098ccfa2aedbd"><enum>307.</enum><header>Market name for cultivated fish</header><subsection id="id76c44827fa434e3ea5ce9326fbe3ab23"><enum>(a)</enum><header>In general</header><text>Notwithstanding subtitle E of title II of the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1639">7 U.S.C. 1639 et seq.</external-xref>) or any other provision of law, for purposes of applying the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>), the acceptable market name of any fish product that is laboratory-grown shall include the word <quote>Cultivated</quote> prior to the existing acceptable market name.</text></subsection><subsection id="id27811675c59547deba786ffb0f9eec72"><enum>(b)</enum><header>Cultivated described</header><text>For purposes of this section, a fish product shall be considered to be cultivated if the fish product is derived from the harvested cells of fish and grown in a laboratory setting.</text></subsection></section></title><title id="id58c2a0f728fc42648440d90ada01c0b6" style="OLC"><enum>IV</enum><header>Improving agricultural research</header><section id="id5b39a2b9eb914fe4a77424046185d3ee"><enum>401.</enum><header>Funding for agricultural research in States without Agricultural Research Service facilities</header><text display-inline="no-display-inline">Subtitle B of title VI of the Agricultural Research, Extension, and Education Reform Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/7/7651">7 U.S.C. 7651 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id491AD198497B476FB2A0FE750345FA88"><section id="id6b181251c17d46358e951ed15b8ee512"><enum>621.</enum><header>Funding for agricultural research in States without Agricultural Research Service facilities</header><text display-inline="no-display-inline">There is authorized to be appropriated $5,000,000 for fiscal year 2027 and each fiscal year thereafter, to remain available until expended, for agricultural research at 1862 Institutions and State agriculture agencies in States that do not have an Agricultural Research Service facility, to address the research priorities of those States.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3243b4433f0040878d0868eb20a6a620"><enum>402.</enum><header display-inline="yes-display-inline">Seaweed methane reduction research grants</header><text display-inline="no-display-inline">Subtitle H of title XVI of the Food, Agriculture, Conservation, and Trade Act of 1990 is amended by inserting after section 1673 (<external-xref legal-doc="usc" parsable-cite="usc/7/5926">7 U.S.C. 5926</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7CEF898678FB4DEABB3DB0C3F0485C8B"><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idbbe59a4961264061a4863b717fc9e0fc"><enum>1674.</enum><header>Seaweed methane reduction research grants</header><subsection commented="no" display-inline="no-display-inline" id="id67a203f2aab147048b8320e8dd5c2faa"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id04f8b4fab6374394a804e786fb75aa32"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an institution of higher education (as defined in section 101 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb89fc498ea84e71a17e02a03700ca75"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="ide4e8db7b10dd44d88081eaf911d0d71e"><enum>(b)</enum><header>Grants</header><text>The Secretary shall provide grants to eligible entities for the research and development of the suitability of cold-water seaweed species for reduction of enteric methane through livestock feed additives.</text></subsection><subsection id="idda61634f07c441e6bfd3a9f757bd95b7"><enum>(c)</enum><header>Research priorities</header><text>The Secretary shall give priority in providing grants under subsection (b) for the following types of research:</text><paragraph id="idd58715a5c74c4de8aeb67b60ad6d1318"><enum>(1)</enum><text>Research conducted on which varieties of seaweed inhibit methane production.</text></paragraph><paragraph id="id275645534ddd4957a2dbd79274b31a74"><enum>(2)</enum><text>Research conducted on which varieties of seaweed that inhibit methane production can grow in cold-water climates.</text></paragraph><paragraph id="id4545d9cad4ac4b799ac156b4708d5424"><enum>(3)</enum><text>Research conducted on whether bromoform from seaweed causes any effects on the ozone.</text></paragraph><paragraph id="id98bb8e4de6e74766922fd29641412916"><enum>(4)</enum><text>Research conducted on what level of shelf-life seaweed could have if produced on a large scale.</text></paragraph><paragraph id="idbb7096b379194774a618d1bc62b5cc84"><enum>(5)</enum><text>Research conducted on whether, and to what extent, large-scale production of seaweed has environmental effects.</text></paragraph><paragraph id="id3ab36e658ebf4972b11a61c3999ce34a"><enum>(6)</enum><text>Research conducted on how seaweed affects livestock biology if used as livestock feed.</text></paragraph><paragraph id="id500baa2caaa74d029b04b7dbe88c777e"><enum>(7)</enum><text>Research conducted on whether seaweed affects human health if used as livestock feed.</text></paragraph><paragraph id="ida4943c88cf8348f09b46c71bc3200937"><enum>(8)</enum><text>Research conducted on how knowledge of the ability of seaweed to inhibit methane production would affect the market value of seaweed products, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida4414a70477c4510811472fa582b091b"><enum>(A)</enum><text display-inline="yes-display-inline">the largest entities or sectors that would potentially purchase seaweed products;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ec9e8128dd24ce2bcac3d0ad03525b8"><enum>(B)</enum><text display-inline="yes-display-inline">potential market prices for livestock feed containing seaweed additives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44bfa00f7f714a75b76cf2ebe4dfd612"><enum>(C)</enum><text display-inline="yes-display-inline">the potential role of greenhouse gas emission credits in supporting the reduction of enteric methane using seaweed.</text></subparagraph></paragraph></subsection><subsection id="idb6346ad17df94316a1f57b2c2bd5aa8b"><enum>(d)</enum><header>Requirements</header><text>In providing grants under subsection (b), the Secretary shall—</text><paragraph id="idd5e9527a73b747dba68cb9201ac05458"><enum>(1)</enum><text>select recipients on the basis of the quality of the proposed research project; and</text></paragraph><paragraph id="idac2b5dccdb614156b17cd77aeb9e0030"><enum>(2)</enum><text>award not less than 50 percent of funding to eligible entities in States that, as determined by the Secretary, are among the States with the greatest length of coastline.</text></paragraph></subsection><subsection id="id32705d4ab279434cb93e3b96c1bd8bad"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated such sums as are necessary to carry out this section for each of fiscal years 2027 through 2031.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idc17afa2eac774146a9b40acd8c464022"><enum>403.</enum><header>Urban, indoor, and other emerging agricultural production research, education, and extension initiative</header><text display-inline="no-display-inline">Section 1672E of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5925g">7 U.S.C. 5925g</external-xref>) is amended—</text><paragraph id="id3150a07dfac74680a9c833f1bc21bc06"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0381d16e4a524098873ca2cfe77d1c4e"><enum>(A)</enum><text>in paragraph (5), by striking farming</header><subsection commented="no" display-inline="no-display-inline" id="id23b40ac0e15d43ae911ee05ca1c65325"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id340fba30cd7b47e79ee9fd3780c59e9b"><enum>(1)</enum><header>Coastal seaweed farming</header><text>The term <term>coastal seaweed farming</term> means the onshore or nearshore propagation and harvesting of seaweed and products derived from seaweed that—</text><subparagraph id="id1c8459eeeda04fdd9809b952771eeb04"><enum>(A)</enum><text>does not use any—</text><clause id="ide141101f4b824e93a9fc84e50fc4d9ca"><enum>(i)</enum><text>synthetic pesticide (as defined in section 2 of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref>)); or</text></clause><clause id="idbf1ade2e50cc49e484f9aa42e9846435"><enum>(ii)</enum><text>plastic, unless a suitable replacement does not exist; and</text></clause></subparagraph><subparagraph id="ideb395dafe7594795a5b3abcbccf247f6"><enum>(B)</enum><text>does not produce finfish for commercial purposes.</text></subparagraph></paragraph><paragraph id="id7d82c3f0afa44bbfbd6117a9f92843a5"><enum>(2)</enum><header>Seaweed</header><text>The term <term>seaweed</term> means any macroscopic, multicellular marine algae species.</text></paragraph><paragraph id="id0162236b52c64fe395f8d315d895a84e"><enum>(3)</enum><header>Secretaries</header><text>The term <term>Secretaries</term> means—</text><subparagraph id="idbd8bd21e2ca744fe95adcdd45aec11e8"><enum>(A)</enum><text>the Secretary; and</text></subparagraph><subparagraph id="idce88bfe60e3b4b5da7e3d83b341c6774"><enum>(B)</enum><text>the Secretary of Commerce, acting through the Under Secretary of Commerce for Oceans and Atmosphere.</text></subparagraph></paragraph></subsection><subsection id="id9b18ad7a95fd4b6ba034db2138b813a9"><enum>(b)</enum><header>Reports</header><paragraph id="idd299db9a8aff4db297cd7347665dd42e"><enum>(1)</enum><header>Preliminary report</header><subparagraph id="ide7a0f3ff5c214be1ba16234a2362e7e4"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretaries shall jointly submit to Congress, and publish on the websites of the Department of Agriculture and the National Oceanic and Atmospheric Administration, a preliminary report analyzing the following:</text><clause id="id444fab6e295940a19362a8b033c22aff"><enum>(i)</enum><text>The effects of coastal seaweed farming on—</text><subclause commented="no" display-inline="no-display-inline" id="id4c368f3798bf46eca20650266045c1ac"><enum>(I)</enum><text display-inline="yes-display-inline">surrounding communities;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbfa0baa14b814f43bf12e62bc73c8590"><enum>(II)</enum><text display-inline="yes-display-inline">the ecosystem; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id33a8816b6e954598bfaecf1b48e9a9c3"><enum>(III)</enum><text display-inline="yes-display-inline">marine and coastal wildlife.</text></subclause></clause><clause id="id42208b15753b48a28c35dbeba8f0e013"><enum>(ii)</enum><text>Best practices for cultivating and sourcing local seeds to propagate for coastal seaweed farming, including practices based on traditional ecological knowledge.</text></clause><clause id="idc7ced75386a8498c98718f71fb1bb9b9"><enum>(iii)</enum><text>Best practices, including practices based on traditional ecological knowledge, to prevent the escape or spread during coastal seaweed farming of any organism that would—</text><subclause commented="no" display-inline="no-display-inline" id="id87f50ee4b34044d8b5d26e21d0c05913"><enum>(I)</enum><text display-inline="yes-display-inline">alter the natural ecosystem; or</text></subclause><subclause risk.</text></subclause></clause><clause id="ida69bc0897c484491872f74c867d11e86"><enum>(iv)</enum><text>Best practices, including practices based on traditional ecological knowledge, relating to species selection, harvesting cycles, spatial planning and siting, engineering and design, and environmental aspects of coastal seaweed farming that—</text><subclause id="idbc10884c75f34b9083f06e29d572bac1"><enum>(I)</enum><text>maximize benefits, and avoid adverse effects, on the marine ecosystem and marine and coastal wildlife;</text></subclause><subclause id="ida9869614b6484b2ebf1f6c7aad8957e7"><enum>(II)</enum><text>lead to optimal yields;</text></subclause><subclause id="id14107339ac9a4f3a84fb0c7fe4821d5f"><enum>(III)</enum><text>account for the impact climate change may have on natural habitats and coastal seaweed farming operations;</text></subclause><subclause id="ide2487ede6eb046e1b107b9e10da43e03"><enum>(IV)</enum><text>minimize entanglements and other harmful interactions between marine life and nearshore seaweed farming infrastructure and gear;</text></subclause><subclause id="idd943912e3521493ab699eb91ff9fe40e"><enum>(V)</enum><text>account for changes in migration patterns of marine mammals and highly migratory species (as defined in section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>)); and</text></subclause><subclause id="id9e6a00c11ac64045a1e69187d9a1ff26"><enum>(VI)</enum><text>account for, and avoid interference with, competing uses, including vessel traffic and commercial and recreational fishing.</text></subclause></clause><clause id="id4eda883b8a1e4d8c8c189ddaea8b6670"><enum>(v)</enum><text>The potential for growing seaweed for long-term carbon sequestration and best practices for measurement, reporting, and verification approaches for that growing, specific to the sequestration reservoir.</text></clause><clause id="id3d12f6eac0c6424fa1840d537369f5c1"><enum>(vi)</enum><text>The effects of cocultivation of bivalves with seaweed on the ecosystem, ocean acidification, and hypoxia levels.</text></clause><clause id="id4a2a689ba0a44e2395eaf8d62e992aca"><enum>(vii)</enum><text>The effects of coastal seaweed farming on water quality.</text></clause><clause id="id9119d912a8194e06a1a7061c776d27b6"><enum>(viii)</enum><text>Best practices for limiting the use of plastic in coastal seaweed farming gear.</text></clause><clause id="id8204f36137c840a5a40f0837da77ffab"><enum>(ix)</enum><text>The history and use of Indigenous and traditional seaweed farming practices.</text></clause><clause id="id1c0a7750d5fd4d60bb697dc5040ec436"><enum>(x)</enum><text>Best practices for sustainable harvest and post-harvest processing of coastal seaweed farming products, including—</text><subclause commented="no" display-inline="no-display-inline" id="idfe95a92302b646ccaada176b9ca78296"><enum>(I)</enum><text display-inline="yes-display-inline">methods of reducing energy costs; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0a4aeb8774604021a15761480bd90655"><enum>(II)</enum><text display-inline="yes-display-inline">methods based on traditional ecological knowledge.</text></subclause></clause><clause id="id1744c3a942274aee867c69c78846fded"><enum>(xi)</enum><text>Scalable commercial applications for value-added seaweed or products derived from seaweed, including as feedstock for animals and other agricultural, commercial, and industrial applications.</text></clause><clause id="idefc3d8fbe3ea43c3bc0ef8dbacb541f3"><enum>(xii)</enum><text>Processes for processing, storage, and transportation of seaweed that—</text><subclause commented="no" display-inline="no-display-inline" id="idd2b57be3f9c1404181396d245b7b6740"><enum>(I)</enum><text display-inline="yes-display-inline">are cost-effective and efficient; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id46e514ce9b7344fa8469c16339b48259"><enum>(II)</enum><text display-inline="yes-display-inline">reduce carbon emissions from transportation.</text></subclause></clause><clause id="id403bf746115a461b95a00958013f29ae"><enum>(xiii)</enum><text>Existing and potential markets and market capacity for major cultivated seaweed species.</text></clause><clause id="id6e082c2c89644d2486d88ace501c014c"><enum>(xiv)</enum><text>Baseline economic analyses and business planning models for major cultivated seaweed species.</text></clause><clause id="id1ce699e07b6b49d1aaa6857745e46d00"><enum>(xv)</enum><text>The effects of water quality on the quality of cultivated seaweed for human consumption, including the absorption of toxic heavy metals and persistent organic pollutants.</text></clause><clause id="id5d4242af95484ed4899260f8405427a6"><enum>(xvi)</enum><text>Best practices for onshore seaweed farming issues that reduce energy requirements to pump water, include management of effluent and spatial planning, and address conflicting uses of the onshore coastal zone.</text></clause><clause id="idc5f1b2a7bd864321aa66dacddda1f2e1"><enum>(xvii)</enum><text>Best practices in efficient and effective Federal and State regulatory systems for coastal seaweed farming.</text></clause></subparagraph><subparagraph id="iddbb80e6010324833a88f6609877094b9"><enum>(B)</enum><header>Consultation and engagement</header><text>In preparing the report under subparagraph (A), the Secretaries shall consult or engage, as appropriate, with the following:</text><clause id="id849cf3d6d9f148f3aa9017daa10b19f5"><enum>(i)</enum><text>The Interagency Working Group on Indigenous Traditional Ecological Knowledge, with respect to—</text><subclause id="id0970990e32d248e9a162cf46d44fe109"><enum>(I)</enum><text>the cultivation of kelp, seaweed, and shellfish;</text></subclause><subclause id="id5366202712994c95866f4b18c4bac698"><enum>(II)</enum><text>the use of Tribal waters for coastal seaweed farming;</text></subclause><subclause id="idbdbfa9075d544bce8ad903dca6765374"><enum>(III)</enum><text>the impact and benefits of coastal seaweed farming on Tribal waters; and</text></subclause><subclause id="idf232f204d7754d21a7c8461557f44566"><enum>(IV)</enum><text>best practices for engaging with Indian Tribes (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)) with respect to matters relating to coastal seaweed farming.</text></subclause></clause><clause id="idc663ed14fbdd4cd0b1a972120bc7e5f9"><enum>(ii)</enum><text>Indian Tribes (as so defined).</text></clause><clause id="idb94d65d6b67940f8bb2f657480eb7512"><enum>(iii)</enum><text>The Office of Hawaiian Affairs (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>)).</text></clause><clause id="id217f1e386b904474b8afe290653d3d8a"><enum>(iv)</enum><text>The Interagency Working Group on Research for Farming of Seaweeds and Seagrasses.</text></clause><clause id="idb60f6664e46a4627b292176eb22ac9e9"><enum>(v)</enum><text>The Interagency Working Group on Ocean Acidification.</text></clause><clause id="id47bac4bbb98642e2a52edeea5377d974"><enum>(vi)</enum><text>The Joint Subcommittee on Aquaculture of the National Science and Technology Council.</text></clause><clause id="idcce78cfba51548a99bfb2053fe540f89"><enum>(vii)</enum><text>Such other agencies as the Secretaries determine to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="id42eb50b4fc0a49ccbbcba0af66f2b077"><enum>(2)</enum><header>Update</header><text>Not later than 2 years after the date on which the report under paragraph (1) is submitted, the Secretaries shall submit to Congress an updated report based on pertinent information derived from Federal research programs and other sources of information.</text></paragraph></subsection><subsection id="id03cb4bd8bc294b358c358de2068a9ada"><enum>(c)</enum><header>Regulations</header><text>Not later than 1 year after the date on which the preliminary report under subsection (b)(1) is published, the Secretaries, in consultation with the Chief of Engineers, shall promulgate and implement such regulations as the Secretaries determine to be appropriate—</text><paragraph id="id3c0fdd5cf80d4836bf2a7bfaa01d22d1"><enum>(1)</enum><text>to ensure that design, development, siting, species selection, operation, and production systems of coastal seaweed farming maximize potential benefits to, and avoid potential adverse effects on, the marine ecosystem, wildlife, and fisheries and surrounding communities;</text></paragraph><paragraph id="id54c195421d304358996210db63bb9d58"><enum>(2)</enum><text>to establish evaluation metrics to measure the impact and benefits of coastal seaweed farming on—</text><subparagraph id="id40f5abca5e674b58b56d64978632536c"><enum>(A)</enum><text>the marine ecosystem, including marine wildlife, biodiversity, productivity, water quality, and stored carbon; and</text></subparagraph><subparagraph id="id1053d8fbbcef495a9b1755cc0e203829"><enum>(B)</enum><text>surrounding communities, including relating to the equitable distribution of costs and benefits (including economic and environmental costs and benefits) within those communities; and</text></subparagraph></paragraph><paragraph id="id1abbe35077904bb697c9554ef11e0d57"><enum>(3)</enum><text>to require monitoring and reporting relating to—</text><subparagraph id="ida23cb5bb256e4e2185e8b7dc7ab517ad"><enum>(A)</enum><text>any adverse effects on the marine ecosystem and wildlife, including entanglements of marine life; and</text></subparagraph><subparagraph id="idb3b6e452b6c54c52a7d8e70b2c3f31c4"><enum>(B)</enum><text>any effects on commercial and recreational fishing.</text></subparagraph></paragraph></subsection><subsection id="id6535f33d321b478aa2a112e222d373aa"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretaries, to be allocated between the Secretaries as the Secretaries determine to be appropriate—</text><paragraph commented="no" display-inline="no-display-inline" id="id1414a4b38f474214a3b62e2eed555fc0"><enum>(1)</enum><text display-inline="yes-display-inline">$3,000,000 for each of fiscal years 2027 and 2028 to complete the preliminary report under subsection (b)(1);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc19020c61e69446aafe6d560ea514bea"><enum>(2)</enum><text>$3,000,000 for fiscal year 2029, of which—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc1d5bd4b316847558671ce5a7d265124"><enum>(A)</enum><text>$1,000,000 shall be used for the updated report under subsection (b)(2); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc5dce29d8c7d4a669239a946b965ff55"><enum>(B)</enum><text display-inline="yes-display-inline">$2,000,000 shall be used to promulgate and implement regulations pursuant to subsection (c); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida5259f159420412bb8a5b4289e124b0a"><enum>(3)</enum><text display-inline="yes-display-inline">$1,000,000 for fiscal year 2030 to complete the updated report under subsection (b)(2).</text></paragraph></subsection></section></title><title for decorative use.</text></paragraph><paragraph id="H91453AFCF7854859912495D5C3995E3C"><enum>(4)</enum><header>Cut green</header><text>The term <term>cut green</term> means a green, foliage, or branch removed from a living plant for decorative use.</text></paragraph><paragraph id="idF7768BE5B38747B199E49D541B5E9F70"><enum>(5)</enum><header>Qualifying area</header><text>The term <term>qualifying area</term> means—</text><subparagraph id="idC43CF39F6B4244668EE3C39874E20792"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="id9893DA3E344D425C853E557AF088928A"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="id3AE2934712854FCCA95757E061BE7C62"><enum>(C)</enum><text>a territory or possession of the United States; and</text></subparagraph><subparagraph id="id88D3E653619D4C0DBD4FD04798FAB822"><enum>(D)</enum><text>an area subject to the jurisdiction of a federally recognized Indian Tribe.</text></subparagraph></paragraph></subsection><subsection id="idAB9003C5AD42471DA40C3085BEA2B31B"><enum>(c)</enum><header>Requirement</header><paragraph id="idED4B04847BE141B1896EF6C92A909F2E"><enum>(1)</enum><header>In general</header><text>Funds appropriated or otherwise available to a covered agency may only be used for the procurement of a cut flower or cut green if the cut flower or cut green is grown in a qualifying area.</text></paragraph><paragraph id="HEC026A08F3BC4915889E7B70A6E378AA"><enum>(2)</enum><header>Applicability</header><text>This subsection shall apply to a procurement made or contracted for—</text><subparagraph id="id7626610701794C6DAB33B4CBC76618B9"><enum>(A)</enum><text>in the United States; and</text></subparagraph><subparagraph id="id2B84EE3A35B44A7E814F9FDA1D71CFE6"><enum>(B)</enum><text>on or after the date that is 1 year after the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="id45A722852ADA4D3AB4C4C27EE6C7836F"><enum>(d)</enum><header>Gifts for display</header><paragraph id="idD8E9F4793633415CB3471C3B4A5D7413"><enum>(1)</enum><header>In general</header><text>A covered agency may only accept a gift of a cut flower or cut green that is not grown in a qualifying area from a covered entity for the purpose of displaying the cut flower or cut green if—</text><subparagraph id="id4BDB3C4459D241D295D80C0E90BA318E"><enum>(A)</enum><text>the origin of the cut flower or cut green is clearly displayed at the time of delivery; and</text></subparagraph><subparagraph id="idCBD4234E872A4CA8B004CD87BC483E8B"><enum>(B)</enum><text>at the time of delivery, the covered agency procures an additional cut flower or cut green that is grown in a qualifying area to display during the period of display of the gift.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAC762CE17AFF4FD39F9285989DC68760"><enum>(2)</enum><header>Requirement</header><text>A covered agency that accepts a gift of a cut flower or cut green from a covered entity under paragraph (1) shall clearly display the origin of the cut flower or cut green during the period of display of the cut flower or cut green.</text></paragraph></subsection></section></title><title id="id0691052273624945bfd469477f84658c" style="OLC"><enum>VII</enum><header>Improving Tribal self-determination</header><section id="id75c5f75c88c2490cacb7889f31a923d3"><enum>701.</enum><header>Agricultural self-determination and self-governance</header><subsection commented="no" display-inline="no-display-inline" id="idb39d97332c0e449d9699c21ae8460810"><enum>(a)</enum><header display-inline="yes-display-inline">Self-Determination for Department of Agriculture activities and programs</header><text>Title I of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5321">25 U.S.C. 5321 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id11f9889007bb4ea6bab53a03ff04b859"><section id="id96eac755f7894d5789aa0ab3f42654ce"><enum>112.</enum><header>Self-determination for Department of Agriculture activities and programs</header><subsection id="idb0d471461df64921aae7d2534b409519"><enum>(a)</enum><header>Agriculture self-Determination authorized</header><text>The Secretary of Agriculture shall enter into self-determination contracts, in accordance with subsection (c), with Tribal organizations, on the request of any Indian Tribe, by Tribal resolution—</text><paragraph commented="no" display-inline="no-display-inline" id="id749ff493691440b9a07405216e3ced13"><enum>(1)</enum><text display-inline="yes-display-inline">to plan, conduct, and administer any function, service, or activity provided by the Forest Service or the Natural Resources Conservation Service for the Indian Tribe; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf567ef0ed69a4b819117da64f4b67efd"><enum>(2)</enum><text>subject to subsection (b), to carry out the authority of the Food Safety and Inspection Service under the Federal Meat Inspection Act (<external-xref legal-doc="usc" parsable-cite="usc/21/601">21 U.S.C. 601 et seq.</external-xref>) and the Agricultural Marketing Act of 1946 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621 et seq.</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2f5011525cef455a858364e11af09486"><enum>(b)</enum><header>Food Safety and Inspection Service contracts</header><paragraph commented="no" display-inline="no-display-inline" id="idde572746d495455a842d2b4e1f19027b"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Before requesting to enter into a self-determination contract described in subsection (a)(2), a Tribal organization shall adopt, by Tribal resolution, a food and agriculture code approved by the Secretary of Agriculture, after which the Secretary of Agriculture shall exercise the authority of the Secretary of Agriculture under <external-xref legal-doc="public-law" parsable-cite="pl/87/718">Public Law 87–718</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/7/1633">7 U.S.C. 1633</external-xref>) with respect to the Indian Tribe governed by that Tribal organization.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id226fb794db0c4780b77b693d4ef2e3f1"><enum>(2)</enum><header>Rural water, waste disposal, and community facilities loans and grants</header><text>An Indian Tribe operating under a contract described in subsection (a)(2) shall be eligible for grant and loan programs under paragraphs (19) and (24) of section 306(a) of the Consolidated Farm and Rural Development id="id5ab0c33c978442eb8c3bb430ea17e584"><enum>(c)</enum><header>Self-Determination contract</header><text>A self-determination contract entered into under subsection (a) shall have the same terms and conditions, and be subject to the same procedures, regulations, and requirements, as a self-determination contract entered into under section 102, except that the Secretary of Agriculture and the Department of Agriculture shall be the appropriate Secretary and agency for purposes of a self-determination contract entered into under subsection (a).</text></subsection><subsection id="id8921a5b4655141229aed5b674fb9931a"><enum>(d)</enum><header>Technical assistance</header><paragraph commented="no" display-inline="no-display-inline" id="id9a724ae4253242368f5f58a745fd1d37"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Office of Self-Governance of the Bureau of Indian Affairs shall provide technical assistance with respect to self-determination contracts under subsection (a)—</text><subparagraph id="id1BB62A238B2A44D5A490F29800A5EDF4"><enum>(A)</enum><text>to the Secretary of Agriculture; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA1CCD17644074840B14DA8DC8CDBE382"><enum>(B)</enum><text>to Indian Tribes and Tribal organizations that request that assistance.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea8c26f479754afb9d4beb893a076d71"><enum>(2)</enum><header>Department of Agriculture</header><text display-inline="yes-display-inline">After an Office of Self-Governance is established in the Department of Agriculture, the Office of Self Governance of the Bureau of Indian Affairs may continue to provide technical assistance under paragraph (1), subject to the condition that self-determination contracts under subsection (a) shall be primarily negotiated and executed by the Office of Self-Governance of the Department of Agriculture.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idfcd7b85121b14a34b1503946889081ea"><enum>(b)</enum><header>Department of Agriculture Office of Self-Governance</header><paragraph commented="no" display-inline="no-display-inline" id="idd0520805ed9c455cb3bebd4c86b0e784"><enum>(1)</enum><header>Study</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall conduct a study to determine the feasibility of a Tribal self-governance demonstration project for appropriate programs, services, functions, and activities of the Department of Agriculture.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28a64f26afb5442ea1187273f5549bf9"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary shall submit to Congress a report detailing—</text><subparagraph commented="no" display-inline="no-display-inline" id="id607638f6f6594563b45dfcf98afa0b81"><enum>(A)</enum><text display-inline="yes-display-inline">the results of the study conducted under paragraph (1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd5b7803d9694458ea664e7484ea36e81"><enum>(B)</enum><text display-inline="yes-display-inline">a plan to establish an Office of Self-Governance in the Department of Agriculture to carry out—</text><clause commented="no" display-inline="no-display-inline" id="id1fa5dc78f0744323886d4413c0e1ae01"><enum>(i)</enum><text display-inline="yes-display-inline">the results of that study; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8cd28baf223d4b988ff871a7a2526707"><enum>(ii)</enum><text display-inline="yes-display-inline">the amendment made by subsection (a).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2e42d2c894ec4bbe818b513b57c0da35"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Secretary shall develop the plan described in paragraph (2)(B) in consultation with Indian Tribes, the Office of Tribal Relations of the Department of Agriculture, and the Tribal Advisory Committee established under section 309(b) of the Federal Crop Insurance Reform and Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6921">7 U.S.C. 6921(b)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7e8d1f03d98d40a7b373d9af67fa3914"><enum>(4)</enum><header>Implementation</header><text display-inline="yes-display-inline">Not later than 18 months after the date on which the Secretary submits the report under paragraph (2), the Secretary shall implement the plan described in the report.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id65dad64494254cb49867742144464b33"><enum>702.</enum><header display-inline="yes-display-inline">Buy Indian Act modifications</header> <text display-inline="no-display-inline">Section 23 of the Act of Act of June 25, 1910 (36 Stat. 861, chapter 431; <external-xref legal-doc="usc" parsable-cite="usc/25/47">25 U.S.C. 47</external-xref>) (commonly known as the <quote>Buy Indian Act</quote>), is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ida8c1eba6840d49a9ba6a2146cf8a86c4"><enum>(1)</enum><text>in subsection (a)(3)—</text><subparagraph id="id64206dffef9b4ed2b296601b0d0652d8"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c50013cc56b4fb6a31c3efdf8270bca"><enum>(B)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>; Native villages and rural villages</header><text display-inline="no-display-inline">Section 306D(c) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926d">7 U.S.C. 1926d(c)</external-xref>) is amended by inserting <quote>and the Alaska Native Tribal Health Consortium</quote> after <quote>State of Alaska</quote>.</text></section><section id="idd93abdb8720944b89f5de19166935cd9"><enum>704.</enum><header>Reauthorization of grant program</header><text display-inline="no-display-inline">Section 1419B(a) of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3156">7 U.S.C. 3156(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id56de884545a64f9facb1e0be2903de00"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>, for up to 5 years,</quote> after <quote>competitive grants</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d5b2131ebc341edba00351403351f43"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline"
