which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To repeal certain impediments to the administration of the firearms laws.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7D7BB826CAE54E4195B40D7ACCA8F3BD"><section section-type="section-one" id="H2FE186F1C314472AB877CD6E0918CEE5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gun Records Restoration and Preservation Act</short-title></quote>.</text></section><section id="H3C18245D3FE84C49A8C517F3817A0CB0"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text><paragraph id="HEB4AACE9F5B846A1BC342503E1974E46"><enum>(1)</enum><text>The Tiahrt Amendments prevent the collection of valuable information, and the establishment of effective policies to prevent illegal guns from being used in crimes.</text></paragraph><paragraph id="HC0988A11712745999FC93F7E8B3203B3"><enum>(2)</enum><text>The Tiahrt Amendments impede enforcement of the gun laws by requiring most background check records to be destroyed within 24 hours, and by barring the Federal Government from requiring annual inventory audits by owners of gun shops.</text></paragraph><paragraph id="H4ACEE2A9F778474A885715B7167BB3EA"><enum>(3)</enum><text>A 2012 study by researchers at Johns Hopkins Bloomberg School of Public Health found that the Tiahrt Amendments dramatically increase gun trafficking to the criminal market.</text></paragraph><paragraph id="HFF046A834FA24AF0888E681B83AA4883"><enum>(4)</enum><text>A 2016 study from the University of Pittsburgh Graduate School of Public Health found that in 2008, 79 percent of all guns recovered by police from crime scenes belonged to someone other than the perpetrator and 30 percent had been stolen.</text></paragraph><paragraph id="H757AEB0456834237BBA93B5C8F952DA7"><enum>(5)</enum><text>A 2020 analysis from the RAND corporation concluded that the Tiahrt Amendments limit researchers’ access to data that provide important insights, such as—</text><subparagraph commented="no" display-inline="no-display-inline" id="H29D334645E7149458838C823511EF942"><enum>(A)</enum><text display-inline="yes-display-inline">how guns flow from States with less restrictive gun laws to States with more restrictive gun laws;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE6F91A49417C47AE8C735776B7DB0DDE"><enum>(B)</enum><text display-inline="yes-display-inline">how prohibited purchasers obtain their firearms;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9636360F29504367807721ABABCD75B3"><enum>(C)</enum><text display-inline="yes-display-inline">the characteristics of straw purchases; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H39D78959D1554AAA9F9BEAA09AE560CB"><enum>(D)</enum><text display-inline="yes-display-inline">whether more restrictive gun laws create a shortage of firearms for prohibited purchases.</text></subparagraph></paragraph><paragraph id="H1AF9630F35E04D93A2684CBBA0E903A9"><enum>(6)</enum><text>Every year, more than 141,000 people are shot in the United States.</text></paragraph><paragraph id="H7ADE707265124F81A2611B819E5081B3"><enum>(7)</enum><text>2021 was one of the deadliest years on record for the United States, with an estimated 21,000 people killed in firearm homicides or non-suicide related shootings, which is an 8 percent increase over 2020.</text></paragraph><paragraph id="H819369EFF8964382A794E90B6461D2CF"><enum>(8)</enum><text>In 2024, 57 percent of firearm homicide victims were Black and 18 percent of firearm homicide victims were Hispanic.</text></paragraph><paragraph id="H0AFFDBF942D3445081CBC51C81AA4B1E"><enum>(9)</enum><text>In 2023, the National Tracing Center at the Bureau of Alcohol, Tobacco, Firearms and Explosives processed 500,000 trace requests on firearms from Federal, State, and local law enforcement agencies.</text></paragraph><paragraph id="HA873FA5516104CF181760D19A4D973FF"><enum>(10)</enum><text>Having effective policies to prevent illegal gun trafficking makes our families and communities safer.</text></paragraph><paragraph id="HCEE6968D1D2E405FB4FEBCA0BE29EBCE"><enum>(11)</enum><text>Repealing the Tiahrt Amendments would support law enforcement efforts and give the public vital information needed to craft the most effective policies against illegal guns.</text></paragraph></section><section id="H165CD7EBB3DD4ED8A517C72E14662B25"><enum>3.</enum><header>Repeal of certain limitations on the use of database information of the Bureau of Alcohol, Tobacco, Firearms and Explosives</header><subsection id="H9432111D14A8410D9A6344A6312CE421"><enum>(a)</enum><header>Fiscal year <enum-in-header>2012</enum-in-header></header><text>The matter under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Salaries and Expenses</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Bureau of Alcohol, Tobacco, Firearms and Explosives</header-in-text></quote> in title II of division B of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>; 125 Stat. 609) is amended by striking the sixth proviso.</text></subsection><subsection display-inline="no-display-inline" id="H529F28A1B50E4DB38B05215D20C6101F"><enum>(b)</enum><header>Fiscal year <enum-in-header>2010</enum-in-header></header><text display-inline="yes-display-inline">The sixth proviso under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Salaries and Expenses</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Bureau of Alcohol, Tobacco, Firearms and Explosives</header-in-text></quote> in title II of division B of the Consolidated Appropriations Act, 2010 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/117">Public Law 111–117</external-xref>; 123 Stat. 3128) is amended by striking <quote>beginning in fiscal year 2010 and thereafter</quote> and inserting <quote>in fiscal year 2010</quote>.</text></subsection><subsection display-inline="no-display-inline" id="H1BBAE6AED5724A298EE29A713825E385"><enum>(c)</enum><header>Fiscal year 2009</header><text display-inline="yes-display-inline">The sixth proviso under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Salaries and Expenses</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Bureau of Alcohol, Tobacco, Firearms and Explosives</header-in-text></quote> in title II of division B of the Omnibus Appropriations Act, 2009 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/7">Public Law 108–7</external-xref>; 117 Stat. 473) is repealed.</text></section><section id="HFC70FE8D194548C6810A52C1F9C38632"><enum>5.</enum><header>Repeal of limitations on imposition of requirement that firearms dealers conduct physical check of firearms inventory</header><text display-inline="no-display-inline">The fifth proviso under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Salaries and Expenses</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Bureau of Alcohol, Tobacco, Firearms and Explosives</header-in-text></quote> in title II of division B of the Consolidated and Further Continuing Appropriations Act, 2013 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/113/6">Public Law 113–6</external-xref>; 127 Stat. 248) is amended by striking <quote>and any fiscal year thereafter</quote>.</text></section><section id="HDBFD730D70D4419FA4C492383ECC9DAA"><enum>6.</enum><header>Elimination of prohibition on consolidation or centralization in the Department of Justice of firearms acquisition and disposition records maintained by Federal firearms licensees</header><text display-inline="no-display-inline">The matter under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Salaries and Expenses</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Bureau of Alcohol, Tobacco, Firearms and Explosives</header-in-text></quote> in title II of division B of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/18/923">18 U.S.C. 923</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>; 125 Stat. 609) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HEE82C94CADB0490C9A6D377239336BA9"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the first proviso; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8C91176240CF4EC787F2330404FB3C1D"> <enum>(2)</enum> <text>in the second proviso, by striking <quote><italic>further</italic></quote>.</text>
 </paragraph></section><section id="HFBECD6405B5D4492845D3E0EA02AF45A"><enum>7.</enum><header>Repeal of requirement to destroy instant criminal background check records within 24 hours</header><text display-inline="no-display-inline">Section 511 of the Consolidated and Further Continuing Appropriations Act, 2012 (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/112/55">Public Law 112–55</external-xref>; 125 Stat. 632) is amended—</text><paragraph id="H28D6F1A870D1466D8BD1F5B3DD7C2F23"><enum>(1)</enum><text>by striking <quote>—</quote> and all that follows through <quote>(1)</quote>; and</text></paragraph><paragraph id="H609EA8D61D0345D29800D68881EB4636"><enum>(2)</enum><text>by striking the semicolon and all that follows and inserting a period.</text></paragraph></section></legis-body></bill>
