<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4772</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260611">June 11, 2026</action-date><action-desc><sponsor name-id="S322">Mr. Merkley</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit States and local governments from prohibiting or limiting the connection, reconnection, modification, installation, transportation, distribution, or expansion of a renewable energy service based on the type or source of energy to be delivered, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H954BD6E0D0C34FE8AD1B00B3692DEC87"><section section-type="section-one" id="H2EFD272D677D440C93AE408C913ED92C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Renewable Energy Choice Act</short-title></quote>.</text></section><section id="HD6FE7A450F014CEA8A40FBBC1B1F499C"><enum>2.</enum><header>Definition of renewable energy</header><text display-inline="no-display-inline">In this Act, the term <term>renewable energy</term> includes—</text><paragraph id="H2D379584D25442939DB0B0841D1E859A"><enum>(1)</enum><text display-inline="yes-display-inline">wind;</text></paragraph><paragraph id="H551423EA84364E18AD8D605C8A11AEB0"><enum>(2)</enum><text>solar;</text></paragraph><paragraph id="HD3244B90E7BE4AAAB207A47246652256"><enum>(3)</enum><text>energy storage; and</text></paragraph><paragraph id="H9B43B3FEEBFE43EFB482C6546A08594D"><enum>(4)</enum><text>geothermal.</text></paragraph></section><section id="HC626CE4CA0B74864B11E8DADD4DE10BD"><enum>3.</enum><header>Limitation on regulation of renewable energy choice</header><text display-inline="no-display-inline">A State or local government, including any instrumentality or regulatory agency of a State or local government, may not adopt, implement, or enforce a law, regulation, ordinance, building code, standard, or policy that prohibits or limits, or has the effect of directly or indirectly prohibiting or limiting, the connection, reconnection, modification, installation, transportation, distribution, or expansion of, or access to, an energy service based on the type or source of renewable energy sold in interstate commerce to be delivered to an end-user of that energy service, including by—</text><paragraph commented="no" display-inline="no-display-inline" id="id997f50e663ca49e091a794df060f34d9"><enum>(1)</enum><text>permanently banning renewable energy projects;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8032a0b070dc45a4957b324d010d530d"><enum>(2)</enum><text display-inline="yes-display-inline">executing a moratorium on renewable energy projects for a period greater than 6 months, including any extensions;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb9708d51cc694ce19a498b11f696a526"><enum>(3)</enum><text display-inline="yes-display-inline">limiting project height to less than 525 feet;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2d8114b1e6540f2b4569114ef51b766"><enum>(4)</enum><text>creating a setback requirement greater than 1,000 feet;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ebf89a29e2b4fdb903d7aeebfb38e99"><enum>(5)</enum><text>setting a sound limit below 50 decibels;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd570b18877b4a3ba5668d5864026ef9"><enum>(6)</enum><text>refusing to enter into a road use agreement; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5db77998145d49ee87a1b1d77623728a"><enum>(7)</enum><text>charging a permitting fee the cost of which deviates from the average fee imposed on other energy projects of similar capacity.</text></paragraph></section></legis-body></bill>
