<distribution-code display="yes">II</distribution-code><congress>119th CONGRESS</congress><session>2d Session</session><legis-num>S. 4771</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20260611">June 11, 2026</action-date><action-desc><sponsor name-id="S404">Mr. Scott of Florida</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to require the Secretary of Homeland Security to collect a fee for credible fear interviews, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Asylum Integrity Act</short-title></quote>.</text></section><section id="id900c4748e81c472ba8b9a60b35b3b9aa"><enum>2.</enum><header>Credible fear processing fee</header><subsection id="idafb9221b41f04e628ac7d3bee686328b"><enum>(a)</enum><header>Findings</header><text>Congress makes the following findings:</text><paragraph id="id2ea24f286f2d49f79ae0ea9346ca1203"><enum>(1)</enum><text>The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) expressly authorizes the Secretary of Homeland Security to prescribe and collect fees for the processing of immigration applications, benefits, and claims, including through the Immigration Examinations Fee Account established under section 286(m) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(m)</external-xref>).</text></paragraph><paragraph id="id90c8d650e5de47f683233fa0ca5887de"><enum>(2)</enum><text>The credible fear interview required under section 235(b)(1) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)</external-xref>) is a statutorily mandated component of the expedited removal process and serves as the threshold step for individuals seeking to pursue asylum or other protection claims.</text></paragraph><paragraph id="id66db058d0065446cac181e661b556848"><enum>(3)</enum><text>Credible fear screenings impose substantial administrative, personnel, and operational costs on U.S. Citizenship and Immigration Services and the Department of Homeland Security, including costs relating to officer time, interpreter services, detention support, and downstream processing of positive determinations.</text></paragraph><paragraph id="id355d02cdcf7a455a8086f9f71a67170c"><enum>(4)</enum><text>A reasonable user fee for credible fear processing—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0a3d7dee39494f5794b3c51419fb341a"><enum>(A)</enum><text display-inline="yes-display-inline">is consistent with longstanding congressional policy of recovering costs associated with immigration claims processing;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id729e06e56b114316905bb287bad9e997"><enum>(B)</enum><text display-inline="yes-display-inline">promotes fiscal responsibility;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd8873940595c49db9f6bdec508c0cb80"><enum>(C)</enum><text display-inline="yes-display-inline">deters the filing of frivolous or meritless claims; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id00fcdd9221ea4d6a882198367e9214b4"><enum>(D)</enum><text display-inline="yes-display-inline">generates revenue that can be used to support border security and immigration enforcement activities.</text></subparagraph></paragraph><paragraph id="id39e2132440764e2ab7ddea65a37d4463"><enum>(5)</enum><text>The imposition of such a fee is a budgetary measure that will increase Federal revenues.</text></paragraph></subsection><subsection id="id5f30409ca2a14d368cb2d2fb39be07f3"><enum>(b)</enum><header>Credible fear processing fee</header><text>Section 235(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8144838ca2cd4b49bed15f6ada9c6909"><subparagraph id="iddbe21a54281442799185981a3cb80738"><enum>(H)</enum><header>Fee for credible fear processing</header><clause id="idcefbd1db3e574d039454869e4946a7a7"><enum>(i)</enum><header>In general</header><text>The Secretary of Homeland Security shall assess and collect a fee of not less than $100 for each credible fear interview conducted under this paragraph. Such fee shall be collected before such interview is conducted.</text></clause><clause id="id8616fd70818c4f2382a62b190526d39e"><enum>(ii)</enum><header>Adjustment for inflation</header><text>The amount of the fee under clause (i) shall be adjusted annually, beginning in fiscal year 2027, for inflation using the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics, in the same manner as civil monetary penalties are adjusted under the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 1990 (<external-xref legal-doc="public-law" parsable-cite="pl/101/410">Public Law 101–410</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/28/2461">28 U.S.C. 2461</external-xref> note).</text></clause><clause id="ide59d966a88fd4b288ffdbd16b2ca9b42"><enum>(iii)</enum><header>Deposit of fees</header><text>Notwithstanding any other provision of law, 50 percent of the fees collected under this subparagraph shall be deposited into the Immigration Examinations Fee Account established under section 286(m) and shall be available to U.S. Citizenship and Immigration Services, without further appropriation, for processing and operations. The remaining 50 percent of such fees collected shall be deposited into the general fund of the Treasury.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
