which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To double the civil penalties for aliens who enter or attempt to enter the United States without authorization, aliens subject to a final order of removal who fail or refuse to depart from the United States, and employers that knowingly hire aliens who are not authorized to work in the United States.</official-title></form><legis-body><section id="id9b548922b036456689529610097d7a67" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Illegal Immigration Cost Recovery Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="idf96e3fd86949469bb5ac1617219c3349"><enum>2.</enum><header display-inline="yes-display-inline">Increased civil penalties for employers that hire unauthorized aliens</header><subsection commented="no" display-inline="no-display-inline" id="id38e8147aedef403f850a07aaaa732127"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 274A(e)(4)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(e)(4)(A)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id88468fee28f441648506250ed9a0102f"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding clause (i), by inserting <quote>, subject to paragraph (10),</quote> after <quote>such violations and</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc0da3194c7a84912969d08b1cf7b7713"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>$250 and not more than $2,000</quote> and inserting <quote>$1,432 and not more than $11,448</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc955c0e0411847d5aa5b5762a147ee56"><enum>(3)</enum><text>in clause (ii), by striking <quote>$2,000 and not more than $5,000</quote> and inserting <quote>$11,448 and not more than $28,616</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id175b2ce0de8d43efae81fc29418a3903"><enum>(4)</enum><text>in clause (iii), by striking <quote>$3,000 and not more than $10,000</quote> and inserting <quote>$17,172 and not more than $57,238</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf546b39c18124a5baaf7a30fecefd94b"><enum>(b)</enum><header>Annual inflation adjustment</header><text>Section 274A(e) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id6918716614d34fe9871bdf125c9ad291" display-inline="no-display-inline" style="OLC"><paragraph id="idfd71b8f41843445db28cd063ffd5f565"><enum>(10)</enum><header>Annual inflation adjustment</header><subparagraph id="idde0ad9fc979b47d5a7f161202752b14f"><enum>(A)</enum><header>In general</header><text>Beginning on October 1, 2027, the penalty amounts established under paragraph (4)(A) shall be adjusted annually to account for inflation by using the Consumer Price Index for All Urban Consumers (CPI–U) published by the Bureau of Labor Statistics, in the same manner as civil monetary penalties are adjusted under the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/28/2461">28 U.S.C. 2461</external-xref> note).</text></subparagraph><subparagraph id="idf2f061ce734d42519ec15ded4f6c89ea" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Publication</header><text>The Secretary of Homeland Security shall publish the inflation-adjusted amounts referred to in subparagraph (A) in the Federal Register not later than December 15 of each year, and such adjusted amounts shall apply to penalties assessed on or after January 1 of the following year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id1f48c8f2dfca4310ad724da4a47c3de4" section-type="subsequent-section"><enum>3.</enum><header>Increased civil penalty for failure to depart</header><text display-inline="no-display-inline">Section 274D(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324d">8 U.S.C. 1324d(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idda95fef084aa4c30a54dd3068f00bcf9"><enum>(1)</enum><text>by amending the section header to read as follows: <quote><header-in-text style="OLC" level="section">Civil penalties for failure to depart</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5b041ba4183e4de09d4e1fbd369a9bc5"><enum>(2)</enum><text>in paragraph (1), by redesignating subparagraphs (A), (B), and (C) as clause (i), (ii), and (iii), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id949d9c28b5a14eadb48e478e906b1cbb"><enum>(3)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c6db1251ec34040a5fcb946b7c8d5bb"><enum>(4)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text style="OLC" level="subsection">(a) In general</header-in-text>.—Any alien</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id16eb5a78010048d69502b46d7fa50e95"><subsection commented="no" display-inline="no-display-inline" id="id94c46c8082da4cb6a837a102c2b1ba43"><enum>(a)</enum><header>In general</header><paragraph commented="no" display-inline="no-display-inline" id="id121adfaf93104946af992ddb5fb336d4"><enum>(1)</enum><header>Conditions</header><text display-inline="yes-display-inline">Subject to paragraph (2), any alien</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id318ca90c32f04af7b13340a221aeb4ff"><enum>(5)</enum><text display-inline="yes-display-inline">in the undesignated matter following subparagraph (B), as redesignated, by striking <quote>$500</quote> and inserting <quote>$1,996</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba3d7773caf04bbbb98d392b9ca03256"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block id="id51b687d329e8471b9713dd7be79b44d0" display-inline="no-display-inline" style="OLC"><paragraph id="idf962b1837a19430d91f711a89c33a29c"><enum>(2)</enum><header>Annual inflation adjustment</header><subparagraph id="idbe89e8a5e106452b93176e75a822bb4b"><enum>(A)</enum><header>In general</header><text>Beginning on October 1, 2027, the penalty amounts established under paragraph (1) shall be adjusted annually to account for inflation by using the Consumer Price Index for All Urban Consumers (CPI–U) published by the Bureau of Labor Statistics, in the same manner as civil monetary penalties are adjusted under the Federal Civil Penalties Inflation Adjustment Act Improvements Act of 2015 (<external-xref legal-doc="usc" parsable-cite="usc/28/2461">28 U.S.C. 2461</external-xref> note).</text></subparagraph><subparagraph id="id52355b776c4f4016bd2885879afed1fe" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Publication</header><text>The Secretary of Homeland Security shall publish the inflation-adjusted amounts referred to in subparagraph (A) in the Federal Register not later than December 15 of each year, and such adjusted amounts shall apply to penalties assessed on or after January 1 of the following year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="S1"><enum>4.</enum><header>Increased civil penalty for improper entry</header><text display-inline="no-display-inline">Section 275(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325(b)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2d55086a1de14259ab7158a66a351b77"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and by moving such subparagraphs 2 ems to the right;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8e2430fe451442e089df944b3f8f5826"><enum>(2)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), as redesignated, by striking <quote>Any alien</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id59c37e37ee3048ca97ca9e3ae25ab1dc"><paragraph commented="no" display-inline="no-display-inline" id="idada7aa61698d43cabd72f13d4faaec04"><enum>(1)</enum><header>Civil penalty</header><text>Subject to paragraphs (2) and (3), any alien</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb8c7993f3c044efaada9aa7d689b6b05"><enum>(3)</enum><text>in paragraph (1)(A), as redesignated, by striking <quote>$50 and not more than $250</quote> and inserting <quote>$200 and not more than $1,000</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddfb132cce2a3439ba79fbea3aec2a0d3"><enum>(4)</enum><text>in the undesignated matter following subparagraph (B), as redesignated, by striking <quote>Civil penalties</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id796693bdb3ab4004a2656c7dfb3e3940"><paragraph commented="no" display-inline="no-display-inline" id="id10cc0ad9f66e4b2791f0df6c9ef44644"><enum>(2)</enum><header>Clarification</header><text>Civil penalties</text></paragraph><after-quoted-block>;
